SP-646-90 ) CONCLUSIONS AND DECISION THIS MATTER, an application for subdivision of land, frorri Ronald Nichols has becn received and decided upon, pursuant to Spokane County Subdivision regulations, on the day of September, 1990. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. 2. The proposal is to divide approximately 3/4 of an acre into 21ots for the development of single family resideoces. 3. The proposal is located soutb of and adjacent to Broadway Avenue approximately 450 feet west of Evergneen Road, in the SE1/4 of Section 15, Township 25 North, Range 44 EWM, Spokane County, Washington.. 4. The cuirent zoning of the pr+operty is Agricultural. The proposed lot sizes, frontage and intended uses are aUowed within this zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses proposed are generally in accord with this category. 6. The requued public notice was pr+ovided for this proposal and agencies having a potendal interest in the project were notified and r+ecommendadons solicited. No property owners in the area coaunented on the proposed short plaL 8. The Spokane County Arterial Road Plan identifies Broadway Avenue as a Principal ArUerial. The existing right of way width of SS feet is inadequate to implement the Plan. Therefore, in addition m the required right of way dedication, a strip of property 16 feet in width along the Broadway Avenue frontage should be set aside in reserve. This prvperty may be acquired by Spokane County at the rime when arterial improvements are made to Broadway. 9. Recognizing the recommended condidons and Spolcane County development standards, the proposed subdivision makes appropriate provisions for the public health, safety and geneml welfare and that the public use and intmst will be served by platting the subdivision. 10. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-500 (6) (a). DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-646-90 is hereby APPROVED until October 1, 1993, subject to condiaons noted below. The preliminary plat of recard approval is for the property legally described in the applicadon far this proposal. y SP DECISION SP-646..90 2 2. The final plat shall be designed substantially in oonfomnance with the preliminary plat of recani as legally described and advertised. No incnease of density or lot number shall ovcur without a new applicadan submittal and agproval. 3. The Spokane County Planning I?irector/designee shall review any pmposed final plat to ensure compliance with these Findings and Conditions of Approval. 4. The preliminary plat is given conditional approval for three (3) years, specifically to October 1,1993. The applicant tnay request an extension of time by submitting a written request approximately forty-five (45) days prior to the above expiration date. 5. Appropriate road name(s) shall be indicated. 6. Appropriate utility easements shall be indicated on copies of the proposed final plat. Wntten appraval of utility easements by appropriate utility companies must be received with the submittal of the final plat. 7. I7uee (3) current certificates of title shall be furnished the County Planning Deparnnent prior to filing the final plaL 8. The final plat map shall indicate by a clear dashed line the required yard setbacks from all private, "Tract X" or public raads. The dedication shall contain the following statement thar. The purveyar shall also certify that appropriate contractual anangements and schedule of improvements have been made with the plat sponsor for construcdon of the water system in accondance with the approved WATER PLAN. The rime schedule shall provide for completion of the water system and inspection by the appropriate health authorides prior to applicadon for building pemvts within the final plat. The arrangements or agreements shall include a provision holding Spokane Counry and che purveyor hannless from claims by any lot purchaser refused a building pemvt due to the failure of the subdivision sponsor to satisfactorily complete the approved water system. 12. The final plat dedication shall contain the following statemenG "The public water system, pursuant the WATER PLAN approved by County and State Health authorities, the local fue protection district, County Building & Safety Department, and water purveyor, shall be installed within this subdivision, and the subdivider/sponsor shall provide for individual domestic water service as well as fire protection co each loc prior to sale of each lot and prior to issuance of a building permit for eacb loL " 13. No building permit will be issued for any lot within the final plat undl certified by a Washington Staterlicensed engineer that "the water system has been inscalled pursuant to the appmved WATER PLAN for the final plat," signed and stamped by said engineer. The certification may be in the fozm of a letter, but is preferned to be cerafied on a copy of the WATER PLAN as a schematic map showing the "as-built" water system. 14. The Water P1an and the above four (4) oonditions of approval regarding the WATER PLAN may be waived by the Planning Director/designee upon receipt of letters from the appropriate water purveyor and fire protecdon district stating that simple connections to an existing, approved water system, will provide adequate domesdc and fire protecaon water to ensure the public health, safety and general welfare. 15. A survey is required priar to the filing of a final plat r SP DECISION SP-646-90 3 16. Spokane County Planning Deparnnent is required to record with the County Auditar a "Tide Notice," as prepared and signed by the applicant, for a future acquisition area for mad right-of-way and utilides to run with the land, and the future acquisition area reservation shall not be removed without prior approval by the Spokane County Planning Departmeat Notice shall bc reoorded pnor to the issuance of a building pennit and shall provide the following: a. 16 feet of future acqtrisidon area for road right-of-way and utilities, in addidon to the existing right-of-way dedication required by the County Engineer, along Broadway Avenue. b. Biiilding and other setbacks required by the Spokane County Zoning Code shall be measurod 25 from the south edge of the Future Acquisition Area that is reserved for road right-of-way and utilities along Broadway Avenue. c. The following minimum unprovements necessary to support the use within the zone classification as required by the Spokane County Zoning Code stanciards should not be located within the Future Acquisirion Area. 1. Landscaping 2. Surfave dreinage 3. Drainfields 4. Parking 5. Other d. The 16 foot Future Acquisition Area, until acquir+ed by Spokane County, shall be privaoe praperty and may be used as allowed in the zone, except any improvenients (such as landscaping, parldng, surface drainage, drainfields, signs or others) shall be considered "interim" uses. The pr+operty owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements after acquiring sud Futune Acquisition Area. e. This "Tide Nodce" shall be signed by the applicant to serve as official nobce and acknowledgement of said Fuau+e Acquisition Area for road right-of-way and utilities. COUNTY ENGINEER'S DEPARTMENT CONDITIONS 1. The canditional approval of the plat is given by the County Engineer subject to dedicadon of right-of-way and appmval of the road system as indicated in the prelirninary plat of reconl. 2. No construction work is to be perfarn~ed within the existing or proposed public right- of-way until a genmit has been issued by the County Engineer. All work is subject to inspecdon and approval by tbe County Engineer. 3. Individual driveway access pennits are required prior to issuance of a building pennit for driveway approaches to the county road system. 4. Dedication of 9 feet of additional right-of-way along Broadway Avenue is required. 5. Dedication of ZS feet of additional right-of-way along Alki Avenue and dedication of applicable right of way to complete the cul de sac on AllQ Avenue. 6. Existing county roads providing direct access to the plat shall be paved and/or curbed to Spokane County standards. 7. All public roads within the plat shall be designed and constructed to Spokane County standards. 8. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. 9. To construct the road impravements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resoludon which purpose is the fomnation of a Road Improvement District (RID) for said improvements, pursuant to RCW 36.88, as amended. At such ti.me as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the . SP DECISION SP-646-90 4 improvements required (curb, sidewaik, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Broadway Avenue and Allci Avenue. 10. As an altemative method of consavcdng the road improvements stated herein, the applicaant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Prvject (CRP) to the extent of the required road improvements. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, dminage control and paving to exisdng pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Brnadway Avenue and Allci Avenue. 11. The fiollowing statenlent be placed in the plat dedication: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petidon for the foimadon of a Road Impravement District (RID) by the petition method pursuant to Ghapter 36.88 RCW, which petition includes the owner(s)' property, and further not to object, by the signing of a ballot, to the formation of an RID by the resolution method pwsuant to Chapte,r 36.88 RCW, which resolution includes the owner(s)' property. If an RID is formed by either the petition or resoludon method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agme. . (a) that the imInrovement(s) or conserucdon contemplated within the proposed RID is feasible; (b) that tha benefits to be derived fc+om the frnmation of the RID by the property included ther+ein, together with the amount of any County participation, exceed the cost and expense of formation of the RID; and (c) that the property within t6e proposed RID is sufficiendy developed. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the pmperty as a result of the uaprovements called for in conjunction with the for,mation of an RID by either petition or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of County Comnissioners affiming the final assessment rnll. It is further agr+eed that at such time as an RID is created or any Road Improvement Project is sancdoned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns without participation by Spokane County. The RID waiver contained in this agrc;ement shall expue after ten (10) years from the date of execudon below. However, the owner(s) or successor(s) agree that if said RID waiver expires without construcdon of the required improvements, the owner(s) or successor(s) agree to construci the required impravements at their own expense, pay to Spokane County the then estimated cost of the required improvements to enable the County to complete the same, or funusb a bond or other secure method suitable to the County (wtuch may include the executioo of another RID waiver agreement) providing for or securing to the County the actual construction of the improvements. All of the requirements of this agreement shall run with the land and shall be binding upon the owner(s), their successor(s) or assign(s). This provision is applicable to Broadway Avenue and Alki Avenue. 12. The County Engineer has designated Typical Roadway Secdon Number Two, Local Access standand for the improvement of Allci Avenue, which is adjacent to the proposed development. Thi.s will require the addition of approximately 30 feet of asphalt along the frontage of the developmenL The construction of curbing is also required. 13. The County Engineer has designated Typical Roadway Secdon Number Two, Principal Arteiial standard for the improveinent of Broadway Avenue, which is adjacent to the proposed development. 14. The pmposed subdivision shall be unproved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80-1592, as amended, which resolution establishes reguladons far raads, approaches, drainage and fees in new construccion. . SP DECISION SP-646-90 5 15. The County Engineer has examined this developrnent proposal and has determined that the impact of this praposal upon the existing county road system wamants the dedication of additional right-of-way and the raadway improvements herein specified. 16. This proposed snbdivision or development proposal is located within a drainage basin which has been identified by the Spokane County Engineer's office as having stormwater runoff psoblems. Since this proposed subdivision or development proposal is affected by or is a contributor oo stormwater flows, property owners should participate in the planning and implementation of a future basinwide stormwater management system. The following statement shall be placed in the plat dedication: "The owner(s) ar successor(s) in interest agree to join in any County-approved stormwater managermnt program and to pay such rates and charges as may be fixed through public hearings for seivice or benefit obtained by the planning, design, constructing, maintaining or apeiation of stannwater control facilities." 17. The County Arterial Road Plan identifies Broadway Avenue as a Principal arterial. The existing right-of-way width of 55 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in add.ition to the required right-of-way dedication, a strip of property 16 feet in aridth along the Broadway Aveaue frontage shall be set aside in reserve. This property may be acquued by Spokane County at the drne when arterial improvements are made to Broadway Avenue. Special Conditions 18. Applicant shall dedicate at the intersection of Alld Avenue and Mamer Street a condnuation of the cul-de-sac design as proposed and conditioned in PE-1225 Belchefs Addition. 19. Applicant shall request that the 1 foot strip along the north line of Alld Avenue be dedicated as a public road from genera►1 county praperty. COUNTY HEALTH DISTRICT CONDTTIONS 1. The final plat shall be designed as ind.icated on the preliminary plat of record and/or any attached sheets as noted. 2. Appmpriate utility easements shall be indicated on copies of the preliminary plat of record for distribution by the Planning Deparanent to the utility companies, Spokane County Engineer and the Spokane County Health DistricG Written approval of the easements by the utility companies must be received prior to the submittal of the final plaL 3.
