IN THE MATTER OF ) FINDINGS OF FACT,
SHORT PLAT NO. SP-647-90 ) CONCLUSIONS AND
DECISION
TIiIS MATTER, an application for subdivision of land, from Gerald Pelley has been
r+eceiv and decided upon, pursuant to Spokane County Subd.ivision regulations, on the
~ `'Iday of August, 1990.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decisian by the Spokane County Dir+ector of Planning.
2. The pmposal is to divide 1.1 acres into 2 lots for the development of single family
residences.
3. The proposal is located on the southeast corner of Sprague Avenue and Long Road in
Section 19, Townstup 25 N., Range 45 EWM. 4. The current zoning of the property is Agricultural. The proposed lot sizes, frontage and
intended uses are allowed within this zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. Tbe
development and uses proposed are generally in aocord with this category/designation.
6. The required public nodce was provided for this proposal and agencies having a poteneal
interest in the project were notified and recommendatioas solicited.
7. No one in the area oomunented on the proposal.
8. The Spokane County Arterial Road Plan identifies Sprague Avenue as a Minor Arterial.
Exisdng right of way width of 60 ft is iaadequate to implement the Arterial Road Plan.
Therefore, in addidon to the required right of way dedication, a strip of property 8 ft. in
width along Sprague Avenue be set aside in reserve as a future acquisition area.
9. Recognizing the recommended condidons and Spokane County development standards,
the proposed subdivision makes appropriatre provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
10. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon tbe above noted Findings of Fact and Conclusions, Short Plat Application
SP-647-90 is hereby APPROVED until September 1,1993, subject to conditions noted
below. Most of the cond.itions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the shvrt subdivision. This decision is final unless
appealed in wridng, consistent with adopteci appeal procedures.
These Conditions of Approval apply to appiicant(s), owner(s) of the
property, heirs, assigns or any successors•in-fnterest to property.
PLANNING DEPARTMENT CONDITIONS
1. The preliminary plat of record approval is for the property Iegally described in the
application for this proposal.
2. The final plat shall be designed substantially in conformance with the preliminary plat
of record as legally described and advertised. No increase of density or lot number
shall occur without a new application submittal and approval.

3. The Spokane County Planning Director/desigaee shall review any proposed final plat to
ensure conlpliance with these Findings and Conditions of Approval.
4. The preliminary plat is given condidonal approval for three (3) years, specifically Lo
September l, 1993. T'he applicant may r+equest an extension of time by submitting a
written request approximately forty-five (45) days prior to the above expiradon date.
5. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appmpriate utility companies must be received
with the submittal of die final plat.

7. Ile following statement shall be placed in the final plat dedication: "No more than one
(1) dwelling structure shall be placed on any lot, nor shall any lot be further subdivided
for the purpose of creating addidonal lots, ownerships or building sites without first
filing and m,ceiving approval of a replaL"
8. The final plat map shall indicate by a clear dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement that: "Side yard and rear yard setbacks shall be deteimined at the time
building permits are requested. The setbacks indicated on this plat may be varied from
if proper zoning appmvaLs are obtained.,"
9. A plan for water facilities adequate for domesdc servive and fire protection shall be
approved by the water purveyor, appropriate fire protection distnct, Spokane County
Building & Safety Department aad Spokane County Health District The agencies will
certify oa the WATER P`LAN, prior to the filing of the final plat ar any phase of the
preliminary plat, that the plan is ia confor,mance with their respective need,s and
reguiations. The WATER PLAN and certification shall be drafted on a transparency
suitable for reproducdon and be signed by the plat sponsor.
10. The punveyor shall also cerafy that appropriate contractual arrangements and schedule
of ianprovements have been made with the plat sponsor for construction of the water
system in avc~ardance with the approved WATER PLAN. The tinae schedule shall
pravide for coinpletion of the water systetn and inspection by the appr+opriate health
authorities prior to application for building permits within the fmal plat. Tbe
arrangements or agreements shall include a prnvi~ion holding Spokane County and the
purveyor harmless fram claims by any lot purchaser refused a building permit due to
the failure of the subdivision sponsor to satisfactorily complete the approved water
system.
11. The final plat dedication shall contain the following statement: "Me public water
system, pursuant the WATER PLAN approved by County and State Healtb autharides,
the local fire protecdon district, County Building & Safety Departinent, and water
purveyor, shall be installed within ttus subdivision, and the subdivider/sponsor shall
provide for individual domestic water service as well as fire protecdon to each loi prior
to sale of each lot and prior to issuance of a building permit far each lot"
12. No building pernnit will be issued for any lot within the final plat until oertified by a
Washington State-licensed engineer that "the water system has been installed pursuant
to the appraved WATER PLAN for the final plat," signed and stamped by said
engineer. The certificarion may be in the fonn of a letter, but is prefe,n-ed to be certified
on a copy of tlie WATER PLAN as a schemadc map showing the "as-built" water
systern.
13. The Water Plan and the above four (4) conditions of approval regarding the WATER
PLAN may be waived by the Planning Direetor/designee Upon receipt of letters from
the apprnpriate water purveyor and fire protection district stating that simple
connectioas to an existing, approved water system, will provide adequate domestic and
fire protection water to ensure the public health, safety and geneml welfare.
14. A survey is required prior to the filing of a final plaL
15. Spokane County Planning Departinent is required to record with the County Auditor a
"Tide Notice," as prepared and signed by the applicant, for a future acquisition area for
road right-of-way and utilities to run with the land, and the future acquusition area
reservation shall not be removed without prior approval by the Spokane County
Planning Deparmrient Notice sha11 be recorded prior to the issuance of a building
perrnit and shall provide the following:

a. Eight (8) feet of future acquisition area for road right-of-way and utilities, in
addition to the existiag right-of-way dedication required by the County Engineer,
along Sprague Aveaue.
b. Building and other setbacks required by the Spokane County Zoniag Code shall be
measured 35 fL from the southerly edge of the Future Acquisidon Area that is
reserved for road right-of-way and utilities along Sprague Avenue.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs should
be within the future acquisition area for road rigbt of way aad utilities. If any of the
above improvements are made witlun this area, they shall be relocated at the
applicant's expense when roadway improvements are made.
d. The 8 foot Future Acquisition Area, until acquir+ed by Spokane County, shall be
private property and may be used as allowed in the zone, except any impravements
(such as landscaping, parking, surface drainage, drainfields, signs or others) shall
be considered "interim" uses.
The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway unprovements after
acquiring said Futm Acquisition Area. •
e. This "Tide Notice" shall be signed by the applicant to serve as official nodce and aclnowledgeraent of said Fuum Acquisition Area for road right-0f-way and
utilides.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
deciiicadon of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. Individual driveway access permits are reyuined prior to issuance of a building permit
for driveway approaches to the county road system.
3. Dedication of 2 feet of additional right-of-way along Sprague Avenue and 5 feet
additional right of way along Long Road is required.
4. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.

6. The word "applicant" shall include the owner or owners of the property, his heirs,

7. To construct the road improvements stated herein, the applicant may, with the apprnval
of the County Engineer, join in and be a willing pamicipant in any petition or r+esolution
which purpose is the formation of a Road Ianprovement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such tiwne as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the

created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage oontrol and paving to existing
pavement) will be at the sole exgense of the undersigned owner(s), their heus, graantees

(a) that the improvement(s) or construcdon contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived frnm the forrnavon of the RID by the property
included therein, tiogethe.r with the amount of any County participation, exceed the
cost and expense of foranadon of the RID; and
(c) that the property within the praposed RID is sufficiendy developed.
Provided fiu-ther that the owner(s) or successor(s) shall retain the right, as authorized
nnder RCW 36.88.090, to object to any assessment(s) on the property a.s a result of the
unprovements called for in conjuncdon with the fonnation of an RID by either petition
or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court
the decision of the Board of County Commissioners affuming the final assessment roll.
It is further agreed that at such time as an RID is cmated ar any Road Impiovenent
Prtiject is sa.nctioned by Spokane County, the improvements required (curb, sidewalk,
drainage conmol and paving) will be at the sole expense of tbe undersigned owner(s),
their heirs, grantees and assigns without participation by Spokane County. -
The RID waiver contained in this agmment shall expire afta ten (10) years from the
datre of execution below. However, the owner(s) or successor(s) agree that if said RID
waiver expires without construcdoo of the required 'unprovements, the owner(s) or
successor(s) agree to consauct the required improvements at their own expense, pay to
Spokane County the then estimated cost of the required impmvements to enable the
County to complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement) providing
for or securing to the County the actual construction of the unprovements.
All of the requinements of this agreement shall rua with the land and shall be binding
upon the owner(s), their successor(s) or assign(s). This provision is applicable to
Sprague Avenue and Long Road.

10. The County Engineer has designated Typical Roadway Secdon Number Two
Secondary Arterial standard for the improvement of Sprague Avenue, which is adjacent
to the proposseid development. This will require the addition of approximately 10-12
feet of aspbalt along the frontage of the development The construcaoa of curbing and
sidewalk is also required.
11. The County Engineer has designated Typical Roadway Section Number Two, Local
Access standard for the impmvement of Long Road, which is adjacent to the proposed
development This will require the addidon of approximately 9• 11 feet of asphalt along
the frontage of the development. The construction of curbing is required.
12. The proposed plat shall be improved oo the standands set forth in Spokane County
Boar+d of Comnnissioners Resoludon No. 80-1592, as amended, which resolution
establishes regulations for roads, approaches, drainage and fees in new constructioa.
13. The County Engineer has examined this development proposal and has detenmined that
the impact of this proposat upon the existing county road system warrants the
dedicanon of addidonal right-of-way and the roadway improvements herein specified.
14• The County Arterial Road Plan idendfies Sprague Avenue as a Niinor Arterial. The
existing right-of-way width of 60 feet is not consistent with that specified in the Plan.
In order to implement the Arterial Road Plan, in addidon to the required right-of-way
dedication, a strip of property 8 feet in width aloag Sprague Avenue frontage shall be
set aside in reserve. 'Ihis property may be acquired by Spokaae County at the time
when arterial 'unprovements are made to Sprague Avenue.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminarY plat of record and/or any
attached sheets as noted.
2. Appropriate udlity easements shall be iadicated on copies of the preliminary plat of
necord for distribution by the Planning Deparbment to the utility oompanies, Spokane

also required.

forth fn Spokane County Board of Commissioners Resolution
No. 80-1592, as amended, which establishes requlations for
