PLANNING DEPARTMENT CONDITIONS
1. The preliminary plat of record approval is for the property legally described in the
applicarion for this proposal.,
2. The final plat shall be designed substantially in oonformance with the preliminary plat
of mcord as legally described and advertised. No increase of density or lot number
shall occur without a new application submittal and approval.
3. The Spokane County Planning Director/designee shall review any proposed final plat to
ensure compliance with these Findings and Conditions of Approval.
4. The preliminary plat is given condidonal approval for three (3) years, specifically to
Occober 1, 1993. The applicant may request an extension of time by svbmitting a
written request approximaoely forty-five (45) days prior to the above expiration date.
5. Appropriate utility easements shall be indicated on copies of the proposed final p1aG
Written approval of utility easements by appmpriate utillity companies must be received
with the submittal of the final plat.
6. Three (3) current certificates of tide shall be fumished the County Planning Department
prior to filing the final plat
7. The following statement shall be glaced in the final plat dedicarion: "No mare than one
(1) dwelling structure shall be placed on any lot, nor shall any lot be fiutiher subdivided
for the puipose of creating additional lots, ownerships or building sites without first
filing and receiving approval of a replat."

9. A plan for water facilities adequate for doniestic service and fire protecdon shall be
approved by the waLer pun►eyor, appropriate fire pmtecdon district, Spokane County
Building & Safety Department and Spokane County Health DistricL The agencies will
cereify on the WATER PLAN, priar to the filing of the final plat or any phase of the
preliminary plat, that the plan is in confonnance with their respective needs and
regulations. The WATER PLAN and certification shall be drafted on a transparency
suitable for reproducdon and be signed by the plat sponsor.
10. The purveyor shall also certify that aPProPriate contractual arrangements and schedule
of unprovements have beea made with the plat sponsor for construcdon of the water
system in accordance with the approved WATER PLAN. The time schedule shall
provide for completion of the water system and inspecdon by the appropriate health
authorities prior to applicadon for building permits within the final plat. The
affangements or agreements shall include a provision holding Spokane County and the
purveyor harnnless fr+om claims by any lot purchaser refused a building perrrut due to
the failure of che subdivision spoasor to satisfactorily compleoe the approved water
system.
11. The fuial plat dedication shall contain the following statement: "'Ihe public water
system, pursuant the WATER PLAN approved by County and State Health authorides,
the local fire protecdon district, County Building & Safety Department, end water
purveyor, shall be installed within this subdivision, and the subdivider/sponsor shall
provide for individual domesac water service as well as fire protecdon to each lot prior
to sale of each lot and prior to issuance of a building peimit for each loL"
12. No building permit will be issued for any lot within the final plat undl certified by a
Washington State-licensed engineer that "the water system has been installed pursuant
to the approved WATER PLAN for the final plat," signed and stamped by said
engineer. The certificadon may be in the form of a letter, but is prefeired to be certified
on a copy of the WATER PLAN as a schematic map showing the "as-built" water
system.
13. The Water Plan and the above four (4) conditions of approval reganding the WATER
PLAN may be waived by the Planning Director/designee upon receipt of letters from
the appropriate water purveyor and fire protecdon district stadng that simple

15. Spokane Counry Planning Department is required to record with the County Auditor a
"Tide Nodce," as prepared and signed by the applicant, for a funm acquisition area for
road right-of-way aad utilities to run with the land, and the future acqwsition area
reservation shall not be removed without prior approval by the Spokane County
Plarming DeparmaenL Notice shall be recorded prior to the issuance of a building
permit and shall provide the following:
a. Sixteen feet of future aoquisition area for road right-of-way and utilities, in addidon
to the existing right-of-way dedication required by the County Engineer, along
University Road, for arterial road purposes. NOTE: This plat may be affected by a
proposed Interstate 90 interchange with University Avenue.
b. Building and other setbacks required by the Spokane County Zoning Code shall be
measured 25 feet firom the wesLern edge of the Fuuum Acquisition Area that is
reserved for road right-of-way and utilides along University Road.
c. The following minimum improvements necessary to support the use within the zrone
classification as required by the Spokane County Zoning Code standards sbould not
be located within the Future Acquisidon Area.

d. The sixteen feet of Future Aoquisition Area, until acquired by Spokane County or
the State of Washington, shall be private property and may be used as allowed in
the zone, except any irnprovements (such as landscaping, parking, surface

The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improveaents aftes
acx~uiring said Fupm Acquisition Anea.
e. This "Tide Notice" shall be signed by the applicant to serve as otficW aotice and
acknowledgement of said Future Acquisidon Area for road right-of-way and
utilides.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The condiaonal approval of the plat is given by the County Engineer subject tio
dedicadon of right-flf-way and approval of the road system as indicated in the
preliminary plat of record.
2. Construction within the proposed public saeets and easemeots shall be perfomned
under the d.irect supervision of a licensed eagineer/surveyor, who shall furnisb the
County Engineer wnth "as-built" plans and a certificate in writing that all improvements
were installed to the lines and grades shown on the approved construction plans and
that all disturbed monuments have been replaced,
3. No construcdon work is to be perfonned within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
4. Individual driveway access per,mits are required prior to issuance of a building pernut
for driveway approaches to the county road system.
5. Dedicadon of fourteen feet of additional right of-way along University Road is
required.
6. Existing county roads providing dimct access to the plat shall be paved and/or curbed to
Spokane County standards.

created or any Raad Improvement Pnaject is sanctioned by Spokane County, the

pavement) wW be at the sole expense of the undersigned awner(s), their heirs, grantees
and assigns.
11. The following statement be placed in the plat dedicatioa:

(e) that the property within the proposed RID is sufficieritly developed,

drainage control and paviag) will be at the sole expense of the undersigned ownerr(s),
their heirs, grantees and assigns without garticipatian by Spokane County.
The RID waiver contaiaed in this agmement shall expire after ten (10) years frorn the
,date of execution below. Hawever, the vwner(s) or successor(s) agree that if said RID
waiver expires without canstructian of the required improvements, the awner(s) or
successar(s) agme tv coastruct the required improvenrrents at their own expense, pay to
Spokane Gaunty the then esfimated cost of the requirred imprtfvements to enable the
County to conplete the same, or furnish a bond vr other secure method suimble to the
Cou.nty (which may includ.e the exectttion of another RI]] waiver agreement) praviding
for or securing ta the Couaty the actual construction of the improvements.
All of the requirements of this agreement shall run with the Iand and shall be binding
upon the owner(s), their successor(s) or assign(s).
12. The County Engineer has designated Typical Roadway SSecdon Number One, Principal
Arterial sta.ndard for the unpmvement of University Road, which is adjacent ta the
proposed develapment. This will require the addition of appru3cimately 30 feet of

asphalt along the frontage of the developmenL 'Ihe construcdon of curbing and
sidewalk is also required.
13. The Counry Engineer has designated 'Iypical Roadway Section Number Two, Local
Access standard far the imprevement of Raymond Road, which is adjacent to the
proposed developmenL
14. The proposed subdivision shall be improved to the standards set forth in Spokane
County Board of Commissioncrs Resolution No. 80-1592, as amended, wluch
resoludon establishes reguladons for roads, approaches, drainage and fees in new
construction.
15. This proposed subd.ivision or development proposal is located within a drainage basin
which has been identified by the Spokane County Engineei's office as having
stormwater runoff problems. Since this pmposed subdivision or development proposal
is affected by or is a contributor to suormwater flows, property owners should
parti.cipate in the planning and implementation of a future basinwide stormwater
management system. The following statement shall be placed in the plat de,dication:
"'Ibe owner(s) or successor(s) in interest agree to join in any County-approved
stormwater management program and to pay such rates and charges as may be fixed
through public hearings for service or benefit obtained by the planning, design,
constructing, maincaining or operadon of stormwater control facilities."
16. The County Arterial Road Plan identifies University Road as a Principal arterial. The
existing right-of-way width of 40 feet is not consistent with that specified in the Plan.
In order to implement the Arterial Road Plan, in addidon to the r+equired right-of-way
dedication, a strip of property 16 feet in width along the University Road frontage shall
be set aside in reserve. lhis property may be acquired by Spokane County at the time
when arterial unprovements are made to Uaiversity Road.
17. The applicant should be advised that the County Road Arterial Plan provides for an
interchange at University Road and Interstate 90, this would appear to impact the
proposed short plat Review end approval by the Department of Transportation is
required prior to finalization of this short plat regarding right of way dedicarion and
setbacks of proposed structures.
COUNTY HEALTH DISTRICT CONDITIONS
1. The Snal plat shall be designed as indicated on the preliminary plat of revard and/or any
attached sheets as noted.
2. Appropriate utiliry easements shall be indicatai on copies of the praliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County Engineer and the Spokane County Health District Written approval of the
easements by the utility vompanies must be received prior to the submittal of the final
plat.
3. A combined sutface water and sewage dispasal detailed plan shall be approved by the
County Engineer and the Spokane County Health District prior to the issuance of any
building permit for this projecL
4. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
5. Water service shall be coordinated through the Director of Utilities Spokane County.
6. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Social & Health Services.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serre the plat,
8. Disposal of sewage effluent beneath paved surfaces is currently prohibited.
9. Prior to filing thc final plat, the sponsor shall demonstrate to the sadsfaction of the
Spokane County Health District that suitable sites for on-site sewage disposal systems
ane available on Tract A.

10. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that the existing on-site sewage disgosal system
serving the residence located on Tract B is wholly located within the boundaries of the
tract.

11. Subject to specific application approval and issuance of peraaits by the health officer,
the use of an ind.ividual on-site sewage disposal system may be authorized.
12. The dedicacory language of the plat will state that: "Subject to specific application
approval and issuance of pennits by the Health Off'icer, the use of an individual on-site
sewage disposal system may be authorized."
13. The ded.icatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
14. The plat dedication will contain a statement to the effect that: "The public water system,
as approved by County and state health authorities and the local fire disaict and
purveyor, will be installed within this p1at, end the subdivider will provide for
individual domesdc water service, as well as fire protection, to each lot/tract prior to
sale of each lot/tract."
COUNTY UTILTTIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized This authorization is conditioned
on compliance with all rules and reguladons of tfie Spokane County Health District and
is further conditioned and sub1ect to specific application approval and issuance of
permits by the Health District
2. The dedication shall state: 'The owner(s) or suvicessor(s) in interest agree to autharize
the County to place their name(s) on a pedtion for the formation of ULID by petition
method pursuant to RCW 36.94, wbich the petidon includes the owner(s)' property;
and further not to object by the signing of a protest petition against the formation of a
ULID by resolution method pursuant to RCW Chapter 36.94 which includes the
owner(s)' property. PROVIDED this condition shall not prohibit the owner(s) or
successor(s) from objecting to any assessment(s) on the praperty as a result of
improvements called for in conjunction with the formation of a ULID by either pedtion
or resoludon method under RCW Chapter 36.94."
3. Any water service far this project shall be provided in accordance with the Coord.inated
Water System Plan for Spokane County, as ameaded.
4. Tfie dedicadon shall state: "Each new dwelling unit shall be double-plumbed for
connecdon to future areawide collecdon systems."
