SHORT PLAT NO. SP-650-90 ) CbNCLUSIONS AND
' DECISION
THIS MATTER, an applicadon for subdivision of land, from Clarence Gehrke has been
received and decided upon, pursuant to Spokane County Subdivision regulations, on the 2nd
day of October, 1990.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has furthex been properly delegated the responsibility for
rendering che decision by the Spokane County Director of Planniag.
2. The proposal is to divide 1.03 acres into 31ots for the development of residences.
3. The proposal is located at the northwest corner of the intersecdon of 8th Avenue and
Adams Road in Secdon 23, Township 25 North, Range 44 EWM, Spokane County,
Washington.
4. The curnent zaning of the property is Agricultural Suburbau (AS). The propased lot
sizes, frontage and intended uses are allowed within this zone.
5. The Spokane County Comprehensive Plan designates this area as Urban T6e
development and uses proposed are geAerally in avcord with this categary/designadon.
6. The required public notice was provided for this proposal and agencies having a potential
interesc in the project were notified and recommendauons solicited.
7. One person in che area commented on the proposal. The chief concerns exgressed was
the potendal for duplex construction on the grogosal.
8. The Spokane County Arterisl Road Plan identifies 8th Avenue and Adams Road as minor
arterials. Ecisting right of way of 50 feet is inadoquate to implement the Arterial Road
Plan. Therefore, in addidon to a 12 foot right of way dedicarion on 8th Avenue and
Adarns Road a strip of propesty 8 feet in width along 8th Avenue and Adains Road will
be set aside in reserve as a future acquisidon anea
9. Recognizing the recommended conditions and Spokane County development standards,
the proposed subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
10. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-650-90 is hereby APPROVED until November 1, 1993, subject to conditions noted
below. Most of the condidons of approval shall be accomplished by the applicant andlor
sponsor prior to finalization of the short subdivision. This decision is finsl unless
appealed in wridng, consistent with adopted appcal procedures.
These Cnnditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successor9-in•interest to propecty.
PLANNING DEPARTMENT CONDITIONS
1. The preliminary plat of reooni approved is for the property legally described in the
application for this proposaL

2. 1'he final plat shall be designed substantially in conformance vrrith the preiinninary plat
pf record. No incr+ease of density ar number of lots shall accnr without a change of
cvndition application submittal and approval.
3. The Planning Directar/designee shall review any pmposed final plat/binding site plan ta
ensure campliance wYth the.w Findings and Conditians of Approval.
4. The prelinzinary platlbindiag site plan is given canditional approval far three (3) yeers,
specifically co 1~ovembex 1, 1993. The apphcant rnay re.quest an extension vf time by
subcnitriRg a written request approxirnstely fvrty-five (45) days prior to the above
expiration d-ate.
5. Appropriace utility easements shall be indicated on copies of the pmgasei final
p1atJbinding site glan. Written appmval of utility easements by appropriate utiliry
cornpanies shall be receiaed with the submiml of the finaI platlbiriding site plan.
6. Three (3) current certificates af tide shall be furnished to the Planning Department pnor

7. The final plar/binding stite plan rnap shall indieate by a clear, dashed line tbe required
yard setbacks from all priwate, "Tract X" or public roads. The dedication shatl contain
the following statement;
"Side yard and rear yard setbacks shaLi be detemnined at the time building pemnits are
requested unSess these sexbacks are specifically drafted an this fi,natl glatJbinding site
plan. 1'he setbacks indicated on this plat/binding site plan may be varied frona if proper
zaning appmvals are abtained."
8. No waces plan is requuaed., and a simtple tap is needed at the tinne of building permit
relme.
9. A suivey is required prior ta the filing of a final platlbinding site plan.
10. The Spakane County Planning I)epartmeat shali prepare and recorri with the Caunty
Auditor aTide Natice specifyung a future ]and avquisition area €or mad right-of-way
an.d uriliries. The reserved future acquisition area T"itle Natice shall be rcleasead, in full
ar in part, by the Planni.ng DepartznenL 'Ihe notice should be recorded within the same
time frame as an appeal and shau gravide the fallawing:
a. At Ieast 8 feet af reserved future acquisition area for road right-vf-way and
udlities, in additicrn to the existing arid/ar newly dedicated right-of-way along 8th
Avenue and Adams Raad. N'OTE: The County Engineer has required 12 feet of
new dedication,
b. Future bui.lding and ather setbacks required by the Spakane County 7oning Code
shall be measwed from the resmed future acquYSition area.
c. No required landscaping, parking, '208' areas, drainfield or a1lawed signs shauld
be located within the future acquisition area for road right-of•way and utilities. If
any of che above imFrovernents are made within this area, they shalt be relocated
at the applrcanes expense when roadway improvements are made.
d. The futur+c acquisitian area, until aequired, shall be private propaty and may be
used as allawed in the zone, except that any improvements (such as landscaping,
parking, susface drai.nage, drainfeld, signs or others) shall be considered interim
uses.
COUNTY ENGI]'dEER'S I)EPAR'I`NiEN'T CONDITIONS
1, The conditional approval of the plat is given by the County Engineer subject to
dedicauon of right-of-way and approrral of the road system as iadicated in the
preliminary plat of recotcL
2. i'lans, profiles, and cnass-sectiaas as designed to County standards showing Pi`+aPosed
smeet centerline and curb grades shall be submitted to the Caunty Engineer for approval

3. Drainage plans and design calculations showing the alignment of drainage facilities
shall be submitted to the County Engincer for approval prior to construction andJor the
filing of the final plat. Drainage plans to be prepared under the direcdon of a licensed
Professional Civil Engineer. 4. Construcrion within the proposed public sueets and easements shall be perfolmed
under the direct supervision of a licensed engineer/surveyor, who shall furnish the
County Engineer with "as-built" plans and a certificate in writing that all impravements
were installed to the lines and gmdes shown on the approved construction plans and
that all disturbed monuments have been replaced.
5. No construction work is to be perfornned withia the euisting or proposed public right-
of-way until a perniit has been issued by the County Engineer. All work is subject to
inspecdon and approval by the County Engineer.
6. All construCaon within the existing or pmposed public right-of-way is to be completed
prior to filing each final plat, or a bond in the amount estirnated by the County Engineer
to cover the cost of construcdon of improvements, construction certificadon, "as-built"
plans and monumenting the saw centerlines shall be filed with the County Enginar.
7. Individual driveway access permits are requined prior to issuance of a building permit
for driveway approaches to the county road system.
8. Dedicadon of 12 feet of add.itional right-of-way along 8th Aveaue is required.
9. Dedication of 12 feet of additional right-of-way along Adazns Road is required.
10. Exisdng county roads prnviding direct acce,ss to the plat shall be paved and/or curbed to
Spokane County standards.
11. All public roads withi.n the plat shall be designed and constructed w Spokaae County
standards.
12. Sidewalks are required along the arterial(s) on Adams Road and 8th Avenue.
13. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
14. The County Engineer has designated Typical Roadway Secdon Number T~vo,
secondary arterial standand for the impmvement of Adams Road, which is adjacent to
the propased development This will require the addition of approximately 11- 13 feet
of asphalt along the frontage of the developmnt Ihe construction of curbing and
sidewalk is also required.
15. Tbe County Engineer has designated Typical Roadway Section Number Two,
secondary artenal standard for the improvement of 8th Avenue, which is adjacent to the
proposed developmenL This will require the addition of approximately 11- 13 feet of
asphalt along the frontage of the development. The construction of curbing and
sidewalk is also required.
16. The proposed subdivision shall be improvod to the standards set forth in Spokane
County Board of Commissioners Resoludon No. 80-1592, as amended, which
resolution estabVshes regulations for roads, approaches, drainage and fees in new
construcdon.
17. The County Engineer has examined this development proposal and has deterrnined that
the impact of this proposal upoa the existing countyroad system warrants the
dedicadon of additional right-of-way and the roadway unprovements herein specif ed.
18. This proposed subdivision or development proposal is located within a drainage basin
whicb has been idendfied by the Spokane County Engineer's office as having
stormwater runoff problems. Since this proposed subdivision or development proposal
is affected by or is a contributor t,o stormwater flows, property owners should
partieipate in tbe planaing and implementation of a future basinwide stonnwater ~
management system The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to join in any County-approved
stonnwater management program and to pay such rates and charges as may be fixed
through public hearings for serrice or benefit obtained by the planning, design,
constructing, maintaining or operation of stormwater control facilities."

19. The County Arterial Raa,d Plan identifiies Ad.a,ms Road as a Manor arterial. The existing
right-of-way which varics is nrot cansiscent with that specified in the p18n, In order to
unptement the Arterial Road Plan, in addition to the rGquired right-of-way dedication, a
strip of property 8 feet in width along the Adams Road frontarge shall be set aside in
reserwe. This property tnay be acquired by Spakane County at the time when arterial
impravennents are nade to Adams Road.
20 The County Arteri.al Road Ptan identifies 8th Avenue as a Minor artaial. The existing
right-of-way width of 5+0 feet is not consistent with that specified in the Fian. In arder
to implement the Arterial Rvad Plan, in addition ta the reqWred right-of=way dedicatiaa,

Number Two, Secondary Arterial standard for the improvement
of Eiqhth Avenue which is adjacent to the proposed
development. This will zequire the addition of
approximately 11-13 ft. of asphalt along the frontage of the
develapment. The construction of curhing and sidewalk is
also required.

forth in Spokane County Board of Commissioners Resolution
No. 80-1592, as amended, which establishes Zegulations for
roads, approaches, drainage and fees in new construction.
