BEFORE THE SPOKANE COUNTY PLANNING DEPARTMENT
IN THE MATTER OF ) FINDINGS OF FACT,
SHORT PLAT NO. SP•657-90 ) CONCLUSIONS AND
DECISION
THIS MATfiER, an application for subdivision of laad, from Ron Sloan has been received
and decided upon, pursuant to Spolcane County Subdivision regulations, on the X s* day of
October,1990.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide .64 acres into 21ots to retain the existing single family dwelling
and develop one duplex. ~
3. Tbe proposal is located north of and adjacent to 4th Avenue, west of Felts Road and 1/4
mile east of Faa Road.
4. The current zoning of the property is Agricultural Suburban (AS). The proposed lot
sizes, frontage aad inteaded uses ar+e allowed within this zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
developunent and uses proposed are generally in accomd with this category.
6. The requirad public notice was provided for thiis pioposal and agencies having a potential
interest in the project were notified and recommendadons solicited.
7. No property owners in the area commented on the proposal.
8. The Spokane County Arterial Road Plan identiSfies 4th Avenue as a Collector Aroerial.
The existing right of way of 40 feet is inadequate t,o implement the Arterial Road Plan.
Ttierefore, in addition to die required dedication of 10 feet, a strip of property S feet in
width along 4th Avenue shall be set aside ia rese,rve as a Future Acquisitioa Area.
9. Recognizing the reconnmended conditions and Spokane County development standards,
the proposed subdivisioa makes appropriate provisions for the public health, safety annd
general welfare and that the public use and intmst will be served by platting the
subdivision.
10. The project is exempt firom environmental review under the Stace Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
11. The current z,oning of the property is AgriculturAl Suburban (AS), which will allow a
duplex on a lot of 11,000 square feet ar gteater. On January 1,1991, the effective date
of the new Spokane Counry Zoaing Code, the zoning on this property will change to a
designation of Urban Residential -3.5 (UR -3.5). UR -3.5 will only allow a duplex on a
lot of 20,000 square feet or greater. Failure to finalize and rocord this plat before January
1, 1991 would preclude duplexes on these tracts as these tracts would not have the square
footage as required in 1991.
DECISION
Based upon the above noted Findings of Fact and Conclusians, Short Plat Application
SP-657-90 is her+eby APPROVED until November 1, 1993, subject to conditioas noted
below. Most of the condidons of approval shall be accomplished by the applicant andlor
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors•in•interest to property.

PLANNING DEPARTMENT CONDITIONS
1. Ile preliminary plat of record approval is for the property legally described in the
application for this proposal.
2. The Spokane Counry Planning Departinent shall prepare and revord with the County
Auditor a Title Notice specifyiag a future land aoquisidon area fvr rQad right-of-way
and udlides. The raserved fuaue acquisidon area Tide Notice shall be released, in full
or in part, by the Planning DepartmenL 'Ihe notice should be recorded widiin the same
dme fi,ame as an appeal and shall provide the following.
a. At least 5 feet of reserved future acquisition area for road right-of-way and
udliaes, in addition to the existing and/or newly dedicated right-of-way along 4th
Avenue. N02'E: Zhe County Engineer has required 10 feet of new dedication.
b. Future building and other setbacks roquired by the Spokane County Zoning Code
shall be measured from the reserved future acquisition area. '
c. No required landscaping, parking, '208' aneas, drainfield or allowed signs should
be located within the future acquisidon area for road right-of-way rand utilities. If
any of the above unpravements are made within this area, they shall be relocated
at the applicanes expense when roadway improvements are ma~de.
d. The future aaquisition area,, until acquired, shall be private pmpeaty and may be
used as allowed in the zvne, except that any improvements (such as landscaping,
parking, surface drainage, drainfield, signs or others) shall be considered interim
uses.
3. The final plat shall be designed substantially in oonformance with the preli.minary plat
of record. No increase of density ar number of lots shall occur without a change of
condition applicatian submittal and approval.
4. The Pbnning Direcoor/designee shall review any proposed final plat to ensure
compliance with these Findings and Condidons of Approval.
5. The preliminary plat is given conditional approval for duve (3) years, specifically to
November 1, 1993. The applicant may request an extension of time by submitting a
written requesc approximately forty-five (45) days prior to the above exgiration date.
6. Appropriate road name(s) shall be indicated.
7. Appropriate utility easements shall be indicated on cvpies of the proposed fmal plat.
Written approval of utility easements by appropriate utility campanies shall be receival
with the submittal of the final plat.
8. Three (3) current certificatres of tide shall be furnished to the Planning Department prior
to filing the final plat.
9. Ifie final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedicadon shall contain the following
statement:
"Side yard and rear yard setbacks shall be detenmined at the dme building pemuts are
requested unless these setbacks ane specificaUy drafZed on this final plat. The setbacks
indicated on this plat may be varied finm if proper zoning appmvals are obtained."
10. A plan for water facilides adequete for domestic service and fire pr+otection shall be
approved by the water purveyor, appropriate fire pr+otecdon d.istrict, County Building &
Safety Depmrnrnnent and County Healtb I?istricL Ile agencies will certify on the Rlater
Plan, prior tio the filing of a 5na1 plat, that the plan is in conformance with their
respecdve needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproducdon and be signed by the plat sponsor.
11. The water purveyor shall certify that appropriate caontractual arrangements and schedule
of improvements have been naade with the plat sponsor for construction of the water
system in acconiance with the approved Water Plan. The tim schedule shall provide
for compleeon of the wata system and inspection by the apprapriate health authorides
prior to application for building peimits within the final plaL The anangements or
agreements shall include a provision holding Spokane County and the purveyar

' haimless fmm claims by any lot purchaser refused a building penmit due to the failure
of the subdivision sponsor t,o satisfactorily complete the appioved water system.
' 12. The final plat dedication shall contain the following statement:
"1hc public water system, pursuant to the Water Plan approved by county aad state
health avthorides, the local fire protection district, County Building & Safety
Depardrnent and water purveyor, shall be installed within this subdivision or binding
site plan, and the applicant shall provide for individual domestic water savice as well
as firc protecaon to each lot prior to sale of each lot and prior to issuance of a building
pe.rmit far each loL "
13. No building permit will be issued for any lot within the final plat until oertified by a
VVashington state-licensed engineer that "the water system has been installed pursua.nt
to the approved Water Plan far the final plat," includi.ng a signed license stamp. 1he
certification may be in the fann of a letter, but is prefeaed to be certified on a copy of
the Water Plan as a schematic map showing the "as-built" water system
14. The Water Plan and the above four (4) conditions of appraval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire prowrion district stating that simple connecdons to
an existing, approved water system will provide adequau domesdc and fire protecdon
water to ensure the public health, safety and general welfare.
15. A survey is required prior to the filing of a final plat
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional appraval of the plat is given by the County Engiaeer subject to
dedication of right-of-way and approval of the road system as indicated in the
preliminary plat of reconi.
2. No construction work is to be peifonmed within the existing or proposed public right-
of-way until a pernait has been issued by the County Engineer. All work is subject o0
inspection and approval by the County Engineer.
3. Individual driveway access pemnits are required prior to issuance of a building pamit
for driveway spproaches tio the county road system.
4. Dedication of 10 feet of addidanal right-of-way along 4th Avenue is required.
5. Existing county roads prnviding direct access to the plat shall be paved and/or curbed to
Spokane County standands.
6. All public roads within the plat shall be designed and consaucted w Spokane County
standards.
7. Sidewalks are required along the arterial on 4th Avenue. .
8. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
9. To construct the raad improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any pedtion or resoludon
which purpose is the formation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as annnended. At such time as an RID is

their name(s) on a petition for the formation of a Road Improvement District
(RID) by the petidon method pursuant to Chapter 36.88 RCW, which pedtion
includes the owner(s)' pmperty, and fiuther not to object, by the signing of a
ballot, to the fornnation of an RID by the resolution method pursuant to Chapter
36.88 RCW, which resolution includes the owner(s)' property. If an RID is
fonned by either the petition or resolution tnethod as provided for ia Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) ar oonstruction vontemplated within the proposed
RID is feasible;
(b) that the benefits to be derived from the fomnation of the RID by the property
included theiein, together with the amount of any County participation,
exceed the cost and expense of formation of the RID; and
(c) that the property within the proposed RID is suffciently developad.
Provided further that the owner(s) or successor(s) shall retain the rig6t, as
authorized under RCW 36.88.090, to object to aay assessment(s) on the

'Ihe RID waiver coatained in this agreement shall expire after ten (10) years

agree that if said RID waive,r expires withont construcdon of the required
improvements, the owner(s) or suGCessor(s) agree to consavct the required
improvements at their owa expense, pay to Spokane County the then
esdmated oost of the required unp~novements to enable the County to
complete the saa~e, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement)
providing for or securing Lo the County the actual consavction of the
improvements.
All of the requirements of this agreement shaU run with the land aad shall be

12. The County Engineer has designated Typ ical Roadway Section Number Two, Collector
Arterial standard for the improvement of 4th Avenue, which is adjacent to the proposed
developmenL This will requine the addidon of approxicnately 10 feet of asphalt along
the frontage of the development The construction of curbing and sidewalk is also
required.
13. The proposed subdivision shaU be improved to the standards set forth in Spokaae
County Board of Commissioners Resolution No. 84-1592, as amended, which
r'esolution establishes reguladons for roads, approaches, drainage and fees in new
constivccion.
14. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
dedication of additional right-of-way and the roadway improvements herein specified.
15. This proposed subdivision or development proposal is located within a drainage basin
which has been identified by the Spokane County Engin@er's office as having
stormwater runoff problems. Since this pmposed subdivision or development proposal
is affected by or is a contributor tn storrmwater flows, property owners should
participate in the planning aad implementadon of a future basinwide stormwater
management system. The following statement shaU be plaoed in the plat dedicadon:

16. The County Arterial Road Plan identifies 4th Avenue as a Collector arterial. The
existing right-of-way width of 40 feet is not consistent with that speCified in the Plan.
In onder to implement the Arterial Road Plan, in addition to the required right-of-way
dedication, a strip of property 5 feet in width along the 4th Avenue frontage shall be set
aside in reserve. This property may be acquired by Spokane County at the time when
arterial irnpmvements are made to 4th Avenue.
17. There may exist utilities, either underground or overhead, affectii.ng the subject
property, including property to be dedica~ed or set aside far future aoquisitioa.
Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilities. Applic.aunt(s) should check with the applicable utility purveyor
and the Spokane Couaty Engineer to det~ermine whether applicant(s) ar the uriiity is
responsible for a,djustment or relocation costs and to make arrangements for any
necessary work. •
COUNTY HEALTH DISTRICT CONDITIONS
1. Ile final plat shall be designed as indicated oa the preliminary plat of record andlor any
attached sheets as not,ed.
2. A oombined surface water and sewage disposal detailed plan shall be approved by the
Spokane County Engineer aad the Spokane County Health District prior m the issuance
of any on-site sewage disposal pennit or building pemmit for this projecL
3. Sewage disposal method shall be as authorized by the Director of Urilities, Spokane
Counry.
4. Water service shall be coordinated through the Director of Utilities, Spokane County.
5. Water service shall be by an exisdng public water supply when approved by the
Regional Engineer (SpQkaae), State Department of Health.
6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water systJem proposed co serve die plat
7. Disposal of sewage effluent beneath paved surfaces is currendy prohibited.
8. Prior to filing the final plat, the sponsor shall demonstrate to the satisfacdon of the
