SHORT PLAT NO. SP-659-90 ) CONCLUSIONS AND
DECISION
THLS MATTER, an application fvr subdivision of land, from William W. Main Corporation
has ~eived and decided upon, pursuant to Spokane County Subdivision regulaaons, on
the y of October,1990.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by tbe Spokane County Director of Planning.
2. The proposal is to divide approximately 1.61 a,cr+es into 21ots for the 2 exisang office
build.ings. '
3. The prnposal is located sout6 of and adjaceent to Nora Avenue, approximately 1,300 feet
east of Pines Road and I 90 Int=hange in the SW 1/4 of Section 10, Township 25
North, Range 44 E;WM, Spokane County, Washington.
4. The curnent zoning of tlie property is Residendal Office. The proposed lot sizes, frontage
and intended uses are allowed within this zone.
5. The Spokane County Compnehensive Plan desigaates this area as Urban. The
development and uses pmoposed are generally in accord with this category.
6. The required public notice was provided for this proposal and agencies having a potential
interest in the pruject were no 'ufied and aecommendations solicited.
7. No property owners in the area commented on the proposal.
8. Recognizing the recommended cond.idons and Spokane County development standards,
the propased subdivisioa makes appropriate pmvisions for the public health, safety and
geneml welfare and that the public use and inoerest will be served by platting the
subdivision.
9. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Basod upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-659-90 is hereby APPROVED until November 1,1993, subject to conditions noted
below. Most of the candidans of approdal shall be accompbshed by the applicant and/or
sponsor prior to finalizadon of the short snbdivision. This decision is final unless
appealed in writing, consist+ent with adopteti aPPeal Procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any succes9ors•in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. The preliminary plat of record approval is for the property legally described in the
application for this proposal.
2. The final plat shall be designed substantially in confornlance with the preliminary plat
of record. No increase of density ar number of lots shall occur without a change of
condition application subnuttal and approvaa.
3. The Planning Director/designee shall review any pr+oposed final plat to ensure
compliance with these Findings and Conditions of Appmval.

4. The preliminary plat is given conditional approval for three (3) years, specifically to
November 1,1993. The applicant may request aa extension of time by submitting a
written request approximately forty-five (45) days prior to the above expiradon date.
S. Apprapriate road name(s) shall be indicated.
6. Appropriata udlity eaaoaicata shall be indicated on copies of the proposed final plat.
Written appraval of utility easements by appmpriate utility companies shall be received
with the subauttal of the final p1aL
7. 1'hm (3) cument ceatificates of tide shall be furnished to the Planning Deparnnent prior
to filing the final plat.
8. The fiaal plat map shall indicate by a ciear, dashed line the requirod yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
stacement:
"Side yard and rear yard setbacks shall be determined at the timme building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied frorn if proper zoning appmovals are obtained."
9. No water plan is required, and a simple tap is needed at the tiaie of building permit
release.
10. A survey is required priar w the filing of a final plat
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The condidonal approval of the plat is given by the County Enpineer subject to
dedicadon of right-of-way and approdal of the road system as uidicated in the
preliminary plat of record.
2. Existing county roads pmoviding direct access to the plat shall be paved and✓or curbed to
Spokane County standards.
3. Ile word "applicant" shall include the owner ar owners of the property, his heirs,
assigns and successors.
4. To construct the road improvements stated herein, the applicant may, with the approval
of the County Engi.neer, joia in and be a willing participant in any peddon or resoludon
wbich purpose is the formatioa of a Road IWrovement District (RID) for said
iznpravements, puisuant tro RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane Counry, the
improvements roquinod (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigaed owner(s), their heirs, grantees
and assigns. This provision is applicable to Nora Avenue.
5. As an alternative method of constructing the road improveuents stated herein, the
applicant rnay, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the requirod road improvements. At such tune as an RID is
created or any Road Improvement Project is sancdoned by Spokane Counry, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavecnent) will be at the sole expense of the undersigaed owner(s), their heirs, grantees
and assigns. This provision is applicable to Nora Avenue.
6. 'Ihe following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in incerest agree to authorize the County to place
their name(s) on a petition for the fornaation of a Road Improvement District
(RID) by the perition method pursuant to Chapter 36.88 RCW, which petidon
includes the awner(s)' property, and further not to object, by the signing of a
ballot, to the formation of an RID by the resolution method pursuant to Chapter
36.88 RCW, which resolution includes the owner(s)' property. If an RID is
formed by either the petition or resolution method as pmvided for in Chapter
36.88 RCW, the owner(s) or successar(s) further agree:

(a) that the ianprovemont(s) or construction oontemplated within the proposed
RID is feasible;
(b) that the benefits to be derived from the formation of the RID by the property
included therein, tiogether with the aaQOUnt of any County participation,
exceed the cost and expense of formation of the RID; aad
(c) thac the property within the progosed RID is sufficiently developed.
Provided further that the owner(s) or successar(s) shall retain the right, as
autharized under RCW 36.88.090, to object to any assessment(s) on the
property as a result of the improvements called far in conjuactioa with the
formation of aa RID by either petidoa or resolution aethod under Chapter
36.88 RCW, and to apgeal to the Superior Court the decision of the Board
of Couaty Commissioners afffrming the final assessment roll.
It is further agead that at such tim as an RID is cneated or any Road
Improvement Piroject is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the sole
expense of the undersigned owner(s), their hears, grantees and assigns
withont parrticipation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years
from the date of execution below. However, the owner(s) or successor(s)
agree that if said RID waiver expires wit6out construcdon of the required
icnproveanents, the owner(s) or successor(s) agree to construct the required
impr~vements at their own expense, pay to Spokane County the then
esoimated vost of the required improveffients to enable the County to
camplete the same, or finnish a bond or other secure method suitable to the
Counry (which may include the execution of another RID waiver agreement)
providing for or securing tn the County the actual construction of the
ianprovements.
All of the requirements of this agreement shall run with the land and shall be
binding upon the owner(s), their successor(s) or assign(s)." This provision
is applicable to Nora Avenue.
7. The County Engiaeer has designated Typical Roadway Section Number T+vo, Local
Aacess stanndai+d for the impro~vement of Nora Avenne, which is adjacent to the
proposed development This will rcquire the addition of approximately 4- 6 feet of
asphalt along the frontage of die development, The coastruction of curbing and
sidewalk is also requireci.
8. T1ie proposed private roa,d(s) as shown on the preliminary plat serving 21ots with no
extension possible is approved by the County Engineer.
9. Privatre road(s) shall be impruved to Spokane County standard for a private road
Urban/Suburban standand serving 21ots, and are subject to approval under Secdon
10.207 of the Spokane County Fire Code. .
10. A statement shall be placed in the plat dedication that the Ti,act "X" private raad(s)
contained within this pla (isJare) for the sole nse of parcels within the plat untill such
time as die roadway i.s improved and established as a public road.
11. All vested owaers shall sign and recard private road documents as prescribed by the
Spokane County Engineer. T6ese documents shall be reviewed and approved by tbe
Spokane County Eagiaeer prior tio recording with the Spokane County Auditor.
Recording numbers shall be refesenced in the dedicatory language of the plaL
12. The following statement shall be placed in the plat dedicarion:
"WARNING: Spokane County has no respoasibility to build, iaapmve, maintain or
otherwise service the private roads contaiaed within or provide service to the property
described in this plaL By accepting this plat or subsequeady by allowing a building
pemut to be issued oo property on a private road, Spokane County assumes no
obligation for said private road, aad the owners hereby aclsnowledge that the County
has no obligation of any kind or nature whatsoever to establish, examine, survey,
construct, alter, repair, unprove, maintain or provide drainage or snaw removal on a
private road. This requirement is and shall run with the land and shall be binding upon

the owner(s), their heirs, successors or assigns, including the obligation to participate
in the maintenance of the private road as provided herein."
13. The proposed subdivision shall be improved to the standards set forth in Sgokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolutioa establishes regulations for roads, approaches, drainage and fees in new
consuuction.
14, The County Engineer has examined ttus development proposal and has determined that
the impact of this proposal upon the existing couaty road system wairants the
dedicadon of additional right-of-way and the roadway improvements herrecin specif ed.
15. This proposed subdivision or development propasal is 1ocated within a draiaage basin
whicb has been identified by the Spokane County Engineds office as having
stormwater nunoff problems. Since this proposed subdivision ar develop ment proposal
or is a contnbutor t4 storznwater flows, property owners should
is affected by
participate in the planning and implementation of a future basinwide stQrnnwater
management system. The follawing statement shall be placed i.n the plat dedication:

CQUNTY HEALTB DLSTRICT CONI3TTIONS
1. The final plat shall be designed as indicated on tbe pre 'luninary plat of record and/or any
attached sheets as noted.
2. Sewage disposal method shall be as authorized by the Directar of Utilities, Spokane
County.
3. Water service shall be coondinatod dmugh the Dinector of Utilities, Spokane County.
4. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Deparvment of Health.
5. Prior to filing the final plai, the spoasar shall present evidence that the plat lies within
the recurded service area of the water system proposed oD serve the plak
b. A public sewcr system will be made available for the plat, and individual service will be
pravided to each uact prior to sale. Use of individual on-site sewage disposal systems
shall aot be authoritied. •
7. A statejnent shall be placed in the dedication to the eiffect that: "A public sewer system
will be made available for the p1at, aad individual service will be prnvided to each tract
prior to sale. Use of individual on-site sewage disposal systems shall not be
authorized."
8. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
9. The plat dedication will vontain a statement to the effect that: "The public water system,
as approded by county and state health authorities, the local fire district and purveyor,
will be installed within this plat, and the subdividear will provide far individual domesdc
water serviee as well as fine protection t+o each tract privr to sale of each tract"

Spokane County to place theit name(s) on a petition for the
formation of a Road Impzovement District (RID) by the
petition method pursuant to Chapter 36.88 RCW, which
petition includes the owner(s) property, and further not to
object, by the signing of a ballot, the formation of a RID
by the tesolution method pursuant to Chapter 36.88 RCW,
vhich resolution includes the ovner(s) pzopezty. If a RID
is formed by either the petition or resolution method, as
provided for in Chapter 36.88 RCW, the ovner(s) or
successor(s) further aqree: (1) that the improvements or
construction contemplated within the proposed RID is
feasible, (2) That the benefits to be derived from the
formation of the RID by the pzoperty included thezein,
together vlth the amount of any County participation,
exceeds the cost and expense of formation of the RID, and
(3) that the property vithin the proposed RID is
sufficiently developed. Provided, further, the ovner(s) or
successor(s) shall retafn the right, as authorized under RCW
36.88.090, to object to any assessment(s) on the property as
a result of the improvements called for in conjunction vith
the formation of a RID by either petition or resolution
method under Chapter 36.88 RCW, and to appeal to the
Superior Court the decision of the Hoard of County
Commissioners affirming the final assessment roll.
It is further aqreed that at such time as an RID fs
created or any Road Improvement Project is sanctioned by
Spokane County, the improvements required (curb, sideWalk,
drainage control and pavinq) will be at the sole expense of
the undersiqned owner, their heirs, gtantees and assigns
vithout participation by Spokane County.
The RID vaiver contained in this agreement shall expire
after ten (10) years from the date of execution below.
Hovever, the oWner(s) or successor(s) aqree that if said RID
Waivet expires without construction oF the required
impzovements, the oWner(s) oz successor(s) agree to
construct the required improvements at their oWn expense;
pay to Spokane County the then estimated cost of the
required improvements to enable the County to complete the

same; or furnish a bond or other secure method suitable to
the County (which may include the executfon of another RID
waiver aqreement), providing for or securinq to the County
the actual construction of the improvements.
All of the requirements oF this aqreement shall run
With the land and shall be binding upon the owner(s), their
successor(s) or assign(s). This provision is applicable
Nora Avenue.
E24 The County Engineer has desfgnated Typical Roadway Section
Number Two, Local Access standard fot the improvement of
Nora Avenue which is adjacent to the proposed development.
This will require the addition of approxirnately 9-6 ft. of
asphalt along the frontage of the development. The
construction of curbing and sidewalk is also required.
E26 The proposed private road(s) as shoWn on the preliminary
plat serving 2 lots with no extension possible is approved
by the County Engineer. '
E27 That private road(s) be improved to Spokane County standard
for a private road Urban/Suburban standard servinq 2 lots.
Sub3ect to approval under section 10.207 of the Spokane
County Fite Code.
E29 A statement shall be placed in the plat dedication that the
private road contained within this plat is for the sole use
of parcels vithin the plat until such time as the roadway is
imptoved and established as a public road.
E30 All vested owners shall sign and record pzivate road
documents as prescribed by the Spokane County Enqineer.
These documents shall be zevieved and approved by the
Spokane County Enqineer prior to recordinq vith the Spokane
County Auditor. Recording numbers shall be referenced in
the dedicatory languaqe of the plat.
E31 That the followinq statement be placed in the plat
dedication:
WARNING: Spokane County has no responsibility to
build, itnptove, maintain or other vise service the ptivate
roads contained within or providing service to the ptopezty
described in this plat. ey acceptinq this plat or
subsequently by allorring a building percnft to be issued on
property on a private road, Spokane County assumes no
obligation far said private road and the owners hereby

acknowledge that the county has no obligation of any kind or
nature whatsoever to establish, examine, survey, construct,
alter, repair, improve, maintain, provide drainage or snow
removal on a private road. This requirement is and shall
run With the land and shall be bindinq upon the owner, their
helrs, successors or assigns including the obligation to
participate in the ma intenance of the pr ivate road as
provided herein.
E32 The proposed plat shall be improved to the standards set
forth in Spokane County Board of Commissioners Resolution
No. 80-1592, as amended, which establishes regulations for
roads, approaches, drainage and fees in new consttuction.
E33 The County Eagineer has examined this development proposal
and has determined that the impact of this proposal upon the
existing County Road System warrants the dedication of
additional Right of Way and the roadway improvements herein
specified.
E34 This plat or development proposal is located within a
drainaqe basin vhich has been identified by the Spokane
County Enqineers Office as havinq stormWatez runoff
problems. Since this plat or development proposal is
affected by or is a contributor to stormwater flows,
property owners should pazticipate in the planninq and
implementation of a future basinwide stormwater manaqement
system. The following statement shall be placed in the plat
dedication: "That the otiner(s) or successoz(s) in interest
aqree to ioin in any County approved Stormwater Manaqement
Program and to pay such rates and charges as may be ffxed
throuqh public hearinqs for service or benefit obtained by
the planning, design, constructinq, maintaining or opetation
of stormvater control facilities."
E35 That the following statement must be placed in the plat
dedication: "The private road as shown hereon is an
easement whf ch provides a means of ingress and egress for
those lots within the plat having frontaqe thereon."
