SHORT PLAT NO. SP-662-90 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for subdivision of land, from Paul White has been received
and decided upon, pursuant to Spokane County Subdivision regulations, on the 8 day of
Novenber, 1190.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide 5 acres into 2 flots for the development of single family
residences.
3. The proposal is located south of and adjacent to Broadway Avenue, 650 feet east of
Conklin Road a,nd west of Flora Road in the SE 1/4 of Secdon 13, Township 25 North,
Range 44 EWM, Spokane County, Washington.
4. The current zoning of the property is Agricultural (A). The proposed lot sizes, frontage
and intended uses are allowed within this zone.
5. The Spokane County Comprchensive Plan designates this area as Urbann. The
development and uses pmoposed are generally in accord with this category.
b. The required public notice was provided far this pmposal and agencies having a potential
interest in the project were no dfied and recommendaaons solicited.
7. No pmperty owners in the area commented on the proposal. '
8. The Spokane County Arterial Road Plan identifies Broadway AveQUe as a Principal
ArteriaL The eacisting right of way of 40 feet is inadequate to implement the Arterial Road
Plan. Tberefore, in addidon Lo the required dedication of 10 feet, a sarip of property 20
feet in width along Broadway Avenue shall be set aside in reserve as a Future Acquisition
Ar+ea.
9. Recognizing the reoommended conditioas and Spokane County development standards
the proposed subdivision makes appropriate provisions for the public health, safety snd
general welfare and that the public use aad intie.rest will be served by platting the
subdivision.
10. The project is exempt from environmental review under the State Envirocimental Policy Act pursuant to WAC 197-11-800 (6) (a). ~
DECISION
Based upon the above noted F'uidings of Fact and Conclusions, Short Plat Application
SP-662-90 is hereby APPROVED until December 1, 1993, subject to conditions noted
below. 1Vlost of the conditions of approval shall be accomplished by the applicant andlor '
sponsor prior to finalization of the short subdivision. This decision is final unless
appesled in wridng, consisteat with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.

PLANIYING DEPARTMENT CONDITIONS •
1. The preliminary plat of rocord approval is for the prnperty legally described in the
applicaxioa for this pmposal.

2. 1'he final plat shaU be designed substantially in confonnance with the preliminary plat
of record. No increase of density ar number of lots shaU occur withont a change of
condidon application submiaal and appr+uvaL
3. Ihe Planning Directar/designee shail review any proposed final plat to ensure
compliance with these Findings and Condidons of Approval.
4. The pre 'L,minary plat is given conditional approval for throe (3) years, specifically to
December 1,1993. 1he applicant may request an extension of time by submitting a
written reqnest approximately forty-five (45) days prior w the above expiration date.
5. Appropriate road name(s) shall be indicated.
b. Appropriate udliry easements shaU be indicated on copies of the proposed final plat.
Written approval of utility easements by apprapriate utility companies shall be receival
with the subminml of the final plat.
7. 'I'tuee (3) current cerdficatres of tide shaU be fumished to the Planning Department prior
to filing the final plat.
8. The final plat map shaU indicate by a clear, dashed line the required yatd setbacks from
all privaLe, "Tract X" or public roads. The dedicadoa shaU contai.n the following
statement:
"Side yard and rea yard setbacks shaU be determined at the time building permits are
requested unless these setbacks are specifically drafted on dris final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
9. No water plan is required, and a simple tap is aeeded at the dme of building perinit
release.
10. A survey is required prior to the filing of a final plat.
11. The Spokane County Planning Department shall prepare and record with the County
Auditor a Tide Notice specifying a future land aoquisidon area for road right-of-way
and utilides. The reseived fupm acquisitioa area Tide Notice shaU be released, in full
or in pat, by the PIanning Deparanent. The notice should be re,corded within the same
time frame as an appeal and shaU provide the following:
a. At least 20 feet of resemred future acquisition area for road right-of-way and
udlities, in addition to the existing and/or newly dedicated right-of-way along
Broa~dway Avenue. NOrTE: The County Engineer has required 10 feet of new
dedication.
b. Future building and other setbacks required by the Spokane County Zoning Code
shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs §hould
be located within the future acquisidon area for road right-of-way and utilides. If
any of the above improvements are maide within this area, they shaU be relocated
at the applicant's expense when roadway improvements are made.
d. The future acquisidon area, until acquired, shall be private property and may be
used as allowed in the zone, except that any impruveaaents (such as landscaping,
parlang, surface drainage, drainf el(L signs or others) shall be considered interim
uses.
COUN1'Y ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedicadon of right-of-way and apprQVal of the road system as indicated in the
preliminary plat of record.
2. No construcdon work is to be performed within the exisdng or proposed public right-
of-way until a permit hss been issued by the County Engineer. All work is subject to
inspecdon and approval by the County Engineer.

3. Individual driveway access pennits are required prior to issuance of a building penmit
for driveway approaches w the county road system.
4. Dedication of 10 feet of additional right-of-way along Broadway Avenue is roquined.
5. Existing county roads provid.ing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
6. Sidewalks are required along the arterial on Broadway Avenue.
7. The word "applicant" shall include the owner or owaers of the pnoperty, tus heirs,
assigns and successors. 8. To construct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in aad be a willing participant in any petition or resolntioa
which purpose is the fornation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Impmvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, dzainage vontrol and paving tQ existing
pavement) will be at the sole expense of the undersigned owaer(s), their heus, grantees
and assigns. This provision is applicable to Broadway Avenue.
9. As an alternadve nlethod of ooasavcting the road improvements stated herein, the
applicant may, with the approval of the County Enginneer, accomplish the road
improvements staoed heaein by joining and participating in a County Road Project
(CRP) to the extent of the required road impruvements. At such time as an RID is
created or aoy Road Improvement Project is sanctioned by Spokane County, the
improvenents required (curb, sidewalk, drai.nage oontrol and paving to existing
pavement) will be at the sole expense of the uadersigned owner(s), their heus, grantees
and assigns. This provision is applicable oo Broadway Avenue.
10. The following statement shall be placed in the plat dedication:

their nazne(s) oa a petition for the formation of a Road Improvement Distnct
(RID) by the petition method pursuant to Chapter 36.88 RCW, wtuch petition
includes the owner(s)' property, and further not to object, by the signing of a
ballot, to the fornaation of an RID by the resolution cnethod pursuant to Chapter
36.88 RCW, whicb resolution includes the owner(s)' property . If an RID is
formed by either the petidon or resoludon method as provi'ded for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) ar construction oontemplated within the pTOposed
RID is feasible;
(b) that the beneSts t,o be derived from the formation of the RID by the property
included thesein, together with the amount of any County participadon. '

It is further agreed that at such time as an RID is created or any Road
Improvement Project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the sole
expense of the undersigned owner(s), their heirs, grantees and assigns
without participation by Spokane County.
The R.ID waiver contained in this agreement shall expire after ten (10) years
from the date of execution below. However, the owner(s) or successar(s)
agree that if said RID waiver expires without construcdon of the required
improvements, the owner(s) or successor(s) agree to construct the requir+e~d
improvements at their own expense, pay to Spokane County the then
estimated cost of the required improvements to enable the County to

complete the same, or furnish a bond ar other secure method suitable to the
County (which may iaclude the execution of another RID waiver sgreement)
providing for or securing to the Couaty the actual construction of the
improvements.
All of the requirements of thi.s agreement shaU nun with the land and shaU be
binding upon the owner(s), their successor(s) or assign(s)." This pmvision
is applicable to Broadway Avenue.
11. The County Engineer has desigaated Typical Roadway Section Numbez Two, Collector
Arteriai standard for the improvement of Broaidway Avenue, which is adjacent to the
proposed development This will require the addition of approximately 10 -12 feet of
asphalt along the frontage of the developmenL The construction of curbing and
sidewalk is aiso required.
12. The proposed subdivision shall be improved to the scandards set forth in Spokane
Counry Board of Commissioners Resoludon No. 80-1592, as acnended, which
resolution establishes reguladons for rQads, approaches, draiAage and fees in aew
construction.
13. The County Engineer has exannined this development proposal and has deterncrined that
the impact of this proposal upon the exisdng county road system wairants the
dedicadon of add,itional right-of-way and the roadway improvements herein specified.
14. Thi,s proposed subdivision or development proposal is located within a drainage basin
which bas been ideati.fied by the Spokane County Engineer's off'ice as having
stormwater runoff problems. Since this proposed subdivision or development proposal
is affected by or is a contributor to stormwater flows, property owners shoald
participate in the planning and implementation of a future ba.sinwide stormwater
nnanagenient systrem. The following statement shaU be placed in the plat dedication:
"The owaer(s) or successor(s) in interest agree to join in any County-approved
sconnwater management prograrm and to pay such rates and charges as rnay be fixed
through public hearings for service or benefit obtained by the planning, design,
constructing, maincaining ar operation of stomnwater ccontrol facilides."
15. The County A►rt,erial Road Plan iden tifies Broadway Avenue as a Principal Arterial.
The existing right-of-way width of 40 feet is not consisteat with that specified ia the
Plan. In oider to implenent the Arterial Road Plan, in addition to the required right-of-
way dedication, a strip of property ZO feet in width along the Broadway Avenue
frontage shaU be set asside in iese,rve. This property may be acquired by Spokane
County at the time when arterial impmvements are aaade to Broadwsy Avenue.
16. Tlere may exist utilities, either unckrground or overhead, affecting the subject
pnoperry, including property tQ be dedic,ated or set aside for future acquisition.
Spokane County assuaQes no financial obligation for adjustments ar relocxition
regarding these udlities. Applicant(s) should check with the applicable utility puiveyor aad the Spokane County Engineer to deterinine whether applicant(s) or the utility-is
responsible far adjustment or relocation costs and to make arrangements for any
necessary work.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shaU be designed as indncated on the greliminary plat of record and/or any
aaached sheets as noted.
2. Sewage disposal method shaU be as authorized by the Director of Utilities, Spokane
Counry.
3. Water service shaU be coordinated through the Diroccor of Utilides, Spokane County.
4. Water service shall be by an exisdng public water supply when appTaved by the
Regional Engineer (Spokane), State Department of Health.
5. Prior to filing the final plat, the sponsor shall present evidenee that the plat lies withiu
the recorried seivice area of the water system proposed to serve the plaL

6. Prior to filing the final plat, the sponsor shall demanstrate eo the sadsfa;ction of die
Spokane County Health I?istrict that a suitable sitie for an on-site sewage disposal
system is available on uact B.
7. Prior to filing the final plat, the sponsor shall demonstrate to the sadsfaction of the
Spokane County Health District that the existing on-site sewage disposal system
serving the residence located on tract A is wholly located within the boundaries of the
tract.
8. Subject to specific application appmval and issuance of permits by the 6ealth officer,
the use of individual on-site sewage disposal systems may be authorized.
9. The dedicatory language of the plat will scate: "Subject to specific application approval
and issuance of per,mits by the Health Officer, the use of on-site sewage syst,ems may
be authorized."
10. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited." ,
11. The plat dedication will contain a stat,ement to.the effect that: 'The public watier system,
as approved by county and state health authonues, the local fire distnct and purveyor,
wi11 be installed within Lhis plat, and the subdivider will provide far individual doniestic
water service as well as fine procecdon to each tract prior to sale of each tract"
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to tbe Board of County Commi.ssioners Resolution No. 80-0418, tbe use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
on compliaace with all ruies and regulations af the Spokane County Health District and
is further condidoned and subject to specific appiication approval and issuance of
permits by the Health District
2. The dedication shall state:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a pedtion for the formation of ULID by petition method pursuant to RCW
36.94, which petitioa includes the owner(s)' praperty; and further not to object by the
signing of a protest petition sgainst the formation of a ULID b7 resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s) property. PROVIDED,
rhis condition shall not prohibit the owner(s) or suocessor(s) from objecting to any
assessment(s) on the property as a result of imgrovements called for in conjuncdon
with the formadon of a ULID by either pedtion ar resolution method under RCW
Chapter 36.94."
3. Any wacer service far this project shall be provided in aocordance with the Coordinated
Water System Plan for Spokane County, as amended. ;
BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. Requirements of Fire District No. 1 need to be satisfied during the building permit
pracess.

drainaqe basin which has been identified by the Spokane
County Enqineers Office as having stormwater runoff
groblems. Since this plat or development proposal is
affected by or is a contributor to stormwater flows,
property owners should participate in the planning and
implementation of a future basinwide stormwater management
system. The folloving statement shall be placed in the plat
dedication: "That the oWner(s) or successor(s) in interest
aqree to join in any County approved StormWater Management
Program and to pay such rates and charges as may be fixed
through public hearings for service or benefit obtained by
the planning, desiqn, constructinq, maintaininq or operation
of stormwater control facilities."
E61 The County Arterial Road Plan fdentifies Broadwax Avenue as
a Principal arterial. The existing riqht-of-way width of 40
feet is not consistent With that specified in the Plan. In
order to implement the Arterial Road Plan, in addition to
the required riqht-of-way dedication, a strip of property 20
feet in width alonq the BroadWay Avenue frontage shall be
set aside in reserve. This property may be acquired by
Spokane County at the time artetial improvements are made to
Broadway Avenue.
E90 The applicant should be advised that there may exist
utilities either underqround or overhead affectinq the
applicants property, including property to be dedicated or
set aside for future acquisition. Spokane County will
assume no financial obligation foz adjustments or relocation
reqardinq these utilities. The applicant should check With
the applicable utilities and Spokane County Engineer to
determine rrhether the applicant or utility is tesponsible
foz adjustment or relocation costs and to make arrangements
for any necessary Work.
