SUBJECT: Standard Drai Langaage for the Dedication on S P~' C~ 6 3
1) Drainage easements, as platted and shown hereon, which are for the purpose of installing,
operating and maintaining drainage swales and drainage facilities Lo dispose of runoff, are hereby
granted. The County of Spokaae is hereby granted the right of ingress and egress to all drainage
easements adjacent to the public right of way. The property owner shall maintain the drainage
swale with a permanent live cover of lawn turf, with optional shrubbery and/or trees, which do
not obstruct the flow and percolation of storm drainage water in the drainage swale as indicated
by the approved plans.
2) The owners of Lots & , of Block , and Lots
, , & , of Block , shall be held respoasible for
keeping open and maintaining the path of the natural or man-made drainage fldw over a.nd across
the property.
3) The property owner or his representative shall inform each succeeding purchaser of all drainage
e.asements on the property and his responsibility for maintaining drainage facilities within said
easecnents.
4) Spokane County does not accept the responsibility of maintaining the drainage course on private
lots within drainage easements or floodplain areas, nor the responsibility for any drainage,
whatsoever, including but not limited to inverse condemnation Lo any properties due to deficient
construction and/or maintenance of drainage courses in draina$e easements on private property.
~ The lowest building opening, including basement opening, for any building on Lots A ,
C., , and ,p HMlm- shall be high eaough to allow a minimucn slope of 2%
away from the building. All drainage shall be routed away from the building to natural drainages
or nther lawful drainage features.
6) Development within this subdivision shall conform to the requirements of the National Flood
Insuraace Program and Chapter 3.20 of the Spokane County Code. The lowest floor, including
basement floor, for any structure shall be constructed accordiog to the requirements of the
Spokane County Flood Zone regulations in effect at the time a building permit is issued.
Purchasers of property in this subdivision are warned of possible flooding or ponding and tLe
potential requirement to purchase Flood Insurance. This warning shall be carried in each and
every deed drawn to transfer owaership of any and all property within t6is plat in the Area of
Special Flood Hazard.
7) A.n approved lot grading plan exists for Lots and

Block , and Lots & , Btock .
Grading must conform to said plan on file in the County Engineer's Office.
8) Spokane Couaty shall not be responsible to maintain ingress or egress across the tlood plain area.
9) The owner(s) or successor(s) in interest agree to join in any County approved Stormwater
Management Program and to pay such rates and charges as may be fixed through public hearings
for service or benefit obtained by the planniag, design, constructing, maintaining, or operation
of stormwater control facilities.
10) A statement must appear in the dedic,atory language of the plat that individual driveway access
permits be required prior to issuance of a building permit for driveway approaches to the County
road system. This approach shall be constructed in accordance with the approved plan on file
in the County Engineer's office.

SHORT PLAT NO. SP-663-90 ) CONCLUSIONS AND
DECISION
THIS MATTER, an applicadon for subdivision of land, from Paui Wbite and Karl Guenzel
has been re;ceived and decided upon, pursuant to Spokauae County Subdivision regvlations, on
the 8 day of November, 1990.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below bas further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide 3 acnes intn 41ots for the development of single family
residenees.
3. The proposal is located south of and adjacent to Broadway Avenue and approximately
210 feet east of Conklin Road in the SE 1/4 of Section 13, Township 25 North, Range
44 EWM, Spokane County, Washington.
4. The current zoning of the property is AgriculturW (A). The proposed lot sizes, frontage
and intended uses are allowed within this zone.
5. Thc Spokane County Comprehensive Plan designates this area as Urban. The
development and use.s proposed are generally in accord with this category.
6. The required public notice was provided for this proposal and agencies having a potendal
interest in the project were notified aad rocommendations solicited.
7. No property owners in the arseea commented on the groposal. -
8. The Spokane County Arterial Road Plan identifies Broadway Avenue as a Principal
Arterial. The exisring right of way of 40 feet is iaadequate to implement the Arterial Road
Plan. Therefore, in addition to the required dedication of 10 feet, a strip of property ZO
feet in width along Bruadway Avenue shall be set aside in reserve as a Future Acquisition
Area.
9. Recognizing the recommended conditions and Spokane County development standsrds,
the proposed subdivision makes appropriau provisions for the public health, safety and
general welfare and that the public use and interest will be served by platti.ng the
subdivision.
10. The project is exempt from environmental review under the State Environmental Policy .
Act pursuant to WAC 197-11-800 (b) (a). ;
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-663-90 is hereby APPROVED nndl December 1,1993, subject to cond.itions noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in wriang, consisoent with adopted appeal procedures.
These Conditions of Approval apply to appiicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. The preliminary plat of record approval is for the property legally described in the
application for this proposal.

of record. No increase of dcnsity ar number of loa shaU occur without a change of
condition applicadon submittal and approval.
3. Ite Planning Director/designee shall review any proposed 5na1 plat to ensure
compliance with these Findings and Conditions of Approval.
4. Tle prelimin ry plat is given conditional approval for thr~e (3) years, specifically to
December 1,1993. The applicant may request an ext+ension of tim+e by submitting a
written rcquest approximacely forty-frve (45) days prior to the above expiration dace.
5. Appropriate road name(s) shaU be indicated.
6. Appmpriate utility easements shall be ind.icated on copies of the proposed final plat.
Wntten appraval of utility easements by appropriate uality companies shaU be received
with the submittal of the fiaal plai.
7. Three (3) current certificates of tide shaU be furnished to the Planning Deparmaent prior
to filing the final plat.
8. The f nal plat map shaU indicate by a clear, dashed line the required yard setbacks from
a11 private, '"Tract X" or public roads. The dedication shaU contain the following
statemmt:
"Side yard and rear yanl setbacks shaU be determined at the ti~me building permits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on thi.s plat may be varied fnom if proper zoning approvals are obtained,"
9. No water plan is required, and a siniple tap is neeied at the time of building pennit
release.
10. A survey is required prior to the filing of a final plat
11. The Spokanne County Planning Degartment shaU prepare and recor+d with the County
Auditor a Tide Notice specifying a funu+e land aoquisidon area for road right-of-way
and utilities. The reserved future acquisition area T'ide Notive shall be released, in full
or in part, by the Planning DepartmenL The notice should be recorded within the same
tim fiame as an appeal and sball provide the following:
a. At leasc 20 feet of reserved future acquisition anea for road right-of-way and
utilities, in addition to the exisdng andlor newly dedicated right-of-way along
Broadway Avenue. NOrI'E: The County Engineer has required 10 feet of new
dedication.
b. Futm building and other setbatcks required by the Spokane County Zoning Code
shall be measured from the reserved future acquisidon wea.
c. No requi,red landscaping, paricing, '208' areas, drainfield or allowed signs°should
be loeated within the future acquisition anea for road right-of-way and utilities. If
any of the above improvements are made within this area, they shaU be relocated
at the applicanes expense when roadway unprovements are made.
d. The future acquisidon area, until acquired, shall be private propeny and may be
used as allowed in the zone, except that any improvements (such as landscaping,
pariing, surface drainage, drainfield, signs or others) shaU be considered interim
uses.
COUNTY ENGINEER'S DEPARTMENT COIVDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedicarion of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. Drainage plans and design calculations showing the aligament of drainage facilities
shaU be submitted to the County Engineer for approval pnor to construction and/or the
filing of the final plaL Drainage plans to be prepared under the direction of a licensed
Professional Civil Engineer.

3. No construction work is to be perfornied within the existing or proposed public right-
of-way antil a permit bas been issued by the County Engineer. All work is subject to
inspecdon and approval by the County Enginoer.
4. Individual driveway a,ccess pemnits are required prior to issuance of a building permit
for driveway approaches t+o the couaty road system.
5. Dedication of 10 feet of additional right-of-way along Broadway Avenue is required.
6. Exisring county roads providing dimct acce.ss to the plat shall be paved and/or curbed to
Spokane County standards.
7. Sidewalks are required aloag the arterial oa Broadway Avenue.
8. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
9. To oonstruct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be s willing pazticipant in any peddon or resoludoa
wluch purpose is the fornaadon of a Raad Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as unended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage oontrol and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable tio Broadway Avenue.
10. As an alternadve aethod of constructing the road improvements stated herein,, tbe
applicant may, with the approval of the County Engineer, accomplish the road
unprovements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvements. At such tune as an RID is
created or any Road Improvemeot Project is sancaoned by Spokane Counry, the
improvements required (curb, sidewalk, disinage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(si), thein ceirs, grantees
and assigns. This provision is applicable to Broadway Avenue.
11. The following statement shall be placed in the plat dedication:
'The owner(s) or successar(s) in interest agree to authorize the County tio place
their name(s) on a petition for the formation af a Raad Improvemeat District
(RID) by the petidon method pursuant to Chapter 36.88 RCW, which petition
includes the owner(s)' groperty, s►nd further not to object, by the signing of a
ballot, to the formarion of aa RID by the resoludon method pursuant to Chapter
36.88 RCW, which resoludon includes the owner(s)' property. If an RID is
formed by either the petition or resolution method as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construcdon oontemplated within the proposed
RID is feasible; .
(b) that the benefits to be derived from the formation of the RID by the property
included therein, together with the amount of any County participatioa,
exceed the cost and expense of formadon of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the
property as aresult of the improvements called for in conjunction with the
farmation of an RID by either pedtion or resolution raethod under Chapter
36.88 RCW, and to appeal to the Superior Court the decision of the Board
of County Commissioners aff'uming the final assessment roll.
It is fiuther agreed that at such time as an RID is created or any Road
Improvement Project is sanctioned by Spokane Counry, the improvements

12. 1he County Engineer has designated Typical Roadway Section Number Two, Collector
Arterial standard for the impmvement of Broadway Avenue, which is adjacent to the
proposed development This will require the addition of approximately 10 -12 feet of
asphalt along the frontage of the development. The construction of curbing and
sidewalk is also required.
13. The proposed subdivision shall be improved to the standards set forth in Spokaae
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
construction.
14. The County Engineer has exarnined this dev+alopment proposal and has detemiined that
tha unpact of this proposal upon the existing county road system warrants the
dedicadon of additional right-of-way and the roaciway improvements herein specified.
15. This propcued subdivisioa or development proposal is located witbin a drainage basin
wluch has been identified by the Spokane County Engineds office as having
stormwater runoff problems. Since this proposed subdivision or development proposal
is affected by or is a contributor to stormwater flows, property owners should
participate in the planning and implementation of a future basinwide stormwater
management system. The following statement shall be placed in the plat dedication:
"Me owner(s) or successor(s) in interest agree to join in any Countyapproved
stormwater managennent pr~gram and to pay such rates and charges as may be fixed
through public hearings for sesvice or benefit obtained by the planning, design,
consorucang, maintaining or operation of stormwater control facilities."
16. The County A►rterial Road Plan identifies Broardway Avenue as a Principal Arterial.
The eacisting rigbt-of-way width of 40 feet is not consistent with that specified in the
Plan. In onier t4 irnplement tha A,roerial Road Plan, in addidon tu the required right-of-
way dedication, a strip of property 20 feet in width along the Broadway Avenue
frontage shall be set aside in reserve. This property may be acquired by Spokane °
County at the time when arterial impmoveinents are made to Broadway Avenue. ;
17. There may exist utilides, either underground or overhead, affecting the subject
property, including pmperty to be dedicated or set aside for future aoquisition.
Spokane County assumes no financial obligation for adjusmaents or relocadon
reganding these utilities. Applicant(s) should check with the applicable u''ty purveyor
and the Spokane County Engineer to determine whedier applicant(s) or the utility is
responsible for adjusmaent or relocadon costs and to make airangements for any
aecessary work.
COUNTY HEALTH DISTRICT CONDITIONS
1. 'I1ie final plat shall be designed as indicated on the prelinninary plat of record and/or any
auached sheets as noted.
2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
3. Water service shall be coordinated through the Director of Utilides, Spokane County.

on compliance with all rules and regulations of the Spokane County Health I?istrict and

permits by the Health District

'The owner(s) or successor(s) in interest agree to anthorize the County to place their
name(s) on a petition for the formation of ULID by petition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest petition against the formaaon of a ULID by resolution method
pursuanc to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the proparty as a result of improvements called for in conjunction
with the fornLation of a ULID by either petidon or resolution method under RCW
Chapter 36.94."
3. Any water service for this project shall be provided in accordance with tbe Coordinated
Water System Plan for Spokane County, as amended. •
P-4 The detiication shall state: "Each new dwelling unit shall be double-plumbed for
connection to future areawide collecdon systems."
BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. Requirements of Fire District No. 1 need to be sadsfied during the building permit
process.
2. The required fum flow for any building ar subdivision is determined by building size,
type of construction and pmoximity of exposures. Based on infomAation presented to
this office regarding this subdivision, the nunimum fire flow established by code of
500 gallons per minute for 30 minutes is being required.

The following "Conditions of Approval" for the above referenced
subdivision are submitted to the Spokane County Planning
Department for inclusion in the "Findings and Order" should the
short plat be approved.
E 1 That conditional approval of the plat by the County Engineer
is given subject to dedicatiort of Right-of-Way and approval
of the road system as indicated in the preliminary plat of
record.
E 3 That drainage plans and design calculations showing the
alignment of drainage facilities be submitted to the County
Engineer for approval prior to construction and/or the
filing of the final plat. Orainage plans to be pzepared
under the direction of a licensed Professional Civil
Engineer.
E 6 No construction work is to be performed Within the existinq
or proposed Public Right-of-Way until a permit has been
issued by the County Engineer. All work is subject to
inspection and approval by the County Enqineer.
E12 The applicant should be advised that individual driveway
access permits are required prior to issuance of a buildinq
permit for driveway approaches to the County road system.
E13 Dedication of 10 ft. of additional Riqht-of-Way along
eroadwav Avenue.

RCW 36.88, as amended. At such time as an RID is created or
any Road Improvement Pzoject is sanctioned by Spokane

expense of the undersigned owner, their heirs, qrantees and

E21 As an alternative method of constructing the road
improvement statec3 herein, the applicant may, with the
approval of the County Enqfneer, accomplish the road
improvements stated he=ein by joining and participating in a
County Road Project (CRP) to the extent of the required road
improvement. At such time as an RID is created or any Road
Improvement Project is sanctioned by Spokane County, the
improvements requized (curb, sidewalk, drainage control and
paving to existinq pavement) vill be at the sole expense of
the undersiqned owner, their heirs, grantees and assiqns.
This provision is applicable to BroadWay Avenue.
E22 That the following statement shall appeaZ Within the
dedicatozy language of the final plat:
The owner(s) or successor(s) in interest agree to authorize
Spokane County to place their name(s) on a petition for the
formation of a Road Improvement District (RID) by the
petition method pursuant to Chapter 36.88 RCW, which
petition fncludes the owner(s) property, and further not to
object, by the siqninq of a ballot, the formation of a RID
by the resolution method pursuant to Chapter 36.86 RCW,
Which resolution includes the owner(s) property. If a RID
is formed by either the petition or resolution method, as
provided for in Chapter 36.88 RCW, the owner(s) or
successor(s) further agree: (1) that the improvements or
construction contemplated Within the proposed RID is
feasible, (2) That the benefits to be derived from the

together With the amount of any County partfcipation,
exceeds the cost and expense of formation of the RID, and
(3) that the property within the proposed RID is
sufficiently developed. Provided, further, the owner(s) or
successor(s) shall retain the riqht, as authorized under RCw
36.88.090, to object to any assessment(s) on the ptoperty as
a result of the imp=ovements called for in conjunction with
the formation of a RID by either petition or resolution
method undez Chaptez 36.88 RCW, and to appeal to the
Superior Court the decision of the Board of County
Commissioners afffrming the final assessment roll.
It is further agreed that at such time as an RID is
created or any Road Improvement Project is sanctioned by
Spokane County, the improvements required (curb, sidewalk,
drafnage control and paving) will be at the sole expense of
the undersigned owner, their heirs, qrantees and assigns
without participation by Spokane County.
