JAY TRIPP AN APPROVED ) CONCLUSIONS AND PRELIMINARY SHURT PLAT ) DECISI4N THIS MATTER, a request for an extension of rime from E. Jay Tripp has been received and decided upon, pursuant to Spokane County Subdivision regulation (Chapter III, Section G) and RCW 58.17.140. FINDINGS OF FACT 1. The individual signing below has been groperly delegated the responsibiiity for rendering this decision by the Spokane County Director of Planning. . 2. The subject preliminary plat was approved by the Planning Department on September 17, 1984. 3. The property is genera.lly located at the northwest corner of Sixth Avenue aad Bowdish Road intersection in the SE 114 of the NW 1/4 of Section 21, Township 25 North, Range 44 F;WM, Spokane County, Washington. 4. The site contains an existi.ng single family residence and accessory structures. The original prelinunary plat indicated one accessory structure straddles a proposed lot line. 5. The proposed short plat had expired on October 1,1987. The property owner assumed all conditions of final platting had been completed and that the three residential lots, in fact, did exast. Reacdvating this expired preliminary plat would grant the property owner non- conforming statns for each lot as to lot size which is similar to the lots sizes in the surrounding area. e 6. Spokane County has established specific criteria for considering the extension of time for the expuation of preliminary subdivislans, specificaUy for regular subdivisions, and deparnnent policy for short subdivisions. These criteria are found in Chapter III, Section G of the Spokane County Subdivision Ordinance and have been used as a basis for this decision. 7. The Compr+ehensive Plan designates this area of the prelimi.nary plat as Urban, and the locaeon is within the Priority Sewer ServiCe Area. The Comprehensive Plan designation r+emains the same since the original preliminary plat approval. 8. Conditions have been updated by the various reviewing agencies and depaztments, including the Counry Engineefs Office, County Health District, County Utilities to reflect curnent county regulations. 9. Bowdish Road is designated as a Minor Arterial on Spokane County's Arterial Road Plan. The existing 60 foot right of way is inadequate aad the County Engineer has requested 2 feet of dedication and 8 feet as a future acqwsirion area. 10. This is the first request for a time extension. The total life of the prelimiriary plat has been approximately three years with four additional years as an expired preliminary plat. . 11. The foUowi.ng facts are also relevant. a. Mr. Tripp agreed to follow all of the various department's ugdated conditions of approval. b. No rational purpose would be senred by starting the process over with a new preliminary plat since the Comprehensive Plan has remained the same and recommended conditions are essentially the same. c. Mr. Tripp has agreed to submit a final plat if a time extension is granted. 12. This extension of time is granted based upon a self imposed hardship. Future exteasions will likely aot be granted. ~ Extension of Time Findings SP-335-84 Page 2 . , CONCLUSIONS BASED UFON A REVIEW of (a) the criteria for approving an extension of rime of the expiration date for a preliminary plat and (b) the above Findings of Fact, the following conclusions are made. 1. A one year tine extension is jusrified to complete finalization of the preuminary plat. 2. The applicantlowner should complete finalization of the preli.mi.nary plat Additional extensions of rime will not be granted. DECISION BASED UPON T'HE ABOVE Findings of Fact and Conclusions, an extension of time request for applicarion SP-335-84 is hereby APPROVED until September 1, 1992. CONDITIONS OF APPROVAL II 1. Subsequent extension of time will only be considercd upon a finding of substantial co liaace with Chapter III, Section G, of the Subdivision Ordinance; otherwise the preliminary subdivision appraval will become null and void. PLAN1vING DEPARTMENT CONDITIONS (UPDATED) 1. The final plat shall be designed substantially in conformance with the preliminary plat of record. No increase of density or number of lots shall occur without a change of condition application submittal and approval. 2. The Planning Director/designee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. 3. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utillity easements by appropriate utility companies shall be received with the submittal of the final plat. 4. Three (3) current ceraficates of dtle shall be furnished to the Planning Department prioz to filing the final plat. 5. The Spokane County Planning Department shall prepare and record with the County Auditor a Title Notice specffying a future land acquisition area for road right-of-way and utilities. The reserved future acquisition area Tide Notice shall be released, in full or in part, by the Planning Depardment. The notice should be recorded within the same d.me frrame as an appeal aind shall provide the following: a. At least eight feet of reserved future acquisition area for road right-of-way and utilities, in addition to the existing andlor newly dedicated right-of-way along Bowdish Road. NOTE: The County Engineer has required two feet of new dedication. b. Futum building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be Iocated within the future acquisition area for road right-of-way and utilities. If any of the above improvetnents a.re made within this area, they shall be relocated at the applicant's expense when roadway impravements are made. d. The future acquisition area, until acquired, shall. be private property and may be used as allowed in the zone, except that a.ny improvements (such ais landscaping, parking, surface drainage, drainfield, signs or otbers) shall be considered interim uses. 6. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all private, "Tract X" or public roads. The dedication shall contain the following statement: "Side yard and rear yard setbacks shall be determined at the time building permits are requested unless these setbacks are specifically drafted on this final plat. 'The setbacks indicated on this glat may be varied from if proper zoning approvals are obtained." 1 • Extension of Time Findings SP-335-84 Page 3 ~ . 7. A plan for water facilities adequate for domestic service and fire protection shall be approved by the water purveyor, appropriate fire protection district, County Building & Safety Department and County Health Distnct. The agencies will certify on the Water Plan, priar to the filing of a final plat, that the plan is in conformance with their respective needs and r+egulations. The Water Flan and certification shall be drafted on a transparency suitable for reproducdon and be signed by the plat sponsor. 8. The water purveyor shall certify that apprapriate contractnal anrangements and schedule of improvements have been made with the plat sponsor for construction of the water system in accordance with the approved Water Plan. The time schedule shall provide for completion of the water system and inspection by the appropriate health authorities prior to application for building permits within the final plat. The arrangements or agreements shall include a provision holding Spokane Couaty and the purveyor harmless from claims by any lot purcbaser refused a build.ing pernut due to the failure of the subdivision sponsor tA satisfactorily complet,e the approveti water system. 9. The final plat dedicatian shall contain the following statement: "The pubiic water system, pursuant to the Water Plan approved by county and state health authorities, the local fire pmtection district, County Building & Safety Department and water purveyor, shall be installed within this subdivision, and the applicant shall provide for iundividual domestic water service as well as fire protection to each lot prior to sale of each lot and prior to issuance of a building pernait for each Iot" 10. No building permit will be issued for any lot within the final plat until certified by a VVashington state-Iicensed engineer that "tbe water system has been installed pursuant to the ~ approved Water Pla.n for the final plat" including a signed license stamp. The certification may be in the form of a lerter, but is preferned to be certified on a copy of the Water Plan as a schematic map showing the "as-built" water systenL 11. The WaLer Plan and the above four (4) conditions of approval regarding the Water Plan may be waived by the Planning I?irectorJdesignee upon receipt of letters from the appropriate water purveyor aad fire protection district stating that simple connections to an elcisting, approved water system will provide adequate domestic and fire protection water to ensure the public health, safety and general welfare. 12. A survey is required prior to the filing of a final plaL 13. Prior to finalization, the lot line between Tracts "B" and "C" shall be relocated or the garage indicated to be overlapping Tracts "B" and "C" shall be moved so that the st=ucture is complet,ely on one uact. C4UNTY ENGINEER'S DEPARTMENT CONDITIONS (UPDATED) 1. Individual driveway access permits are required prior to issuance of a building pemnit far driveway approaches to the county road system. 2. Dedication of 2 feet of additional right of-vvay along Bowdish Road is required. 3. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. 4. The proposed subdivision shall be unproved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80-1592, as amended, which resolution establishes regulations for roads, approaches, drainage and fees in new construction. 5. The County Engin+eer has examined this development proposal and has determined that the impact of this proposal upon the existing county road system wan-ants the dedication of additional right of-way and the roadway improvements herein specified. 6. This proposed subdivision or development proposal is located withiii a drainage basin which has been identified by the Spokane County Engi.aeef s office as having stormwater nuioff problems. Since this proposed subdivision or development proposal is affected by or is a contributor to stormwater flows, property owners shonld participate in the pl,anning and implementation of a future basinwide stormwater management system. The following statemeot shall be placed in the plat dedication: "The owner(s) or successor(s) in interest agree to join in any County-approved stormwater management program and to pay such rates and charges as may be fixed through public ' Extensioa of Time Findings SP-335-84 Page 4 , s hearings for service or benefit obtained by the planning, design, constructing, mainLaining or operation of stormwater control facilities." 7. The County ArLerial Road Plan identifies Bowdish Road as a Minor Arterial. 1'he existing right-of-way width of 60 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plaa, in add.ition to the requimd nght-of-way dedication, a strip of property 8 feet in width aiong the Bawdish Raad frontage shall be set aside in reserve. This property may be acquired by Spokane County at ttie time when arterial unprovements are made to Bowdish Road. 8. There may exist utilities, either underground or ovearhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocation regarding these utilities. Applicant(s) should check with the applicable utility purveyor and the Spokane Caunty Engineer to deternune whether applicant(s) or the utility is responsible for adjustrnent or relocation costs and to make arrangements for any necessary work. COUNTY HEALTH DISTRICT CONDITIONS (UPDATED) 1. A combined surface water and sewage disposal detailed plan shaU be approved by the Spokane County Engineer and the Spokane County Health District priar to the issuance of any on-site sewage disposal permit or building perrnit for this project. 2. The dedicatory language of the plat will state: "Subject to specific application appr4val and issuance of pennits by the Health Officer, the use of (an) oo-site sewage system(s) may be authorized." 3. Water service shali be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 4. Prior to filing the final plat, the sponsor shaU present evidence that the plat lies within the recorded service area of the water system progosed to serve the plat 5. The dedicatory language on the plat shall state: "Use of private wells and water systems is prohibited." 6. The plat dedicarion will contain a statement to the effect that: "The public water system, as approved by county and state health authorities, the local fue district and purveyor, will be installed within this plat, and the subdivider will provide for individual domestic water service as well as fire protection to e,ach lotltract prior to sale of each lot/tracL" 7. Prior ta filing the final plat, the sponsor shall demonstrate to the satisfacrion of the Spokane County Health District that a suitable sites for on-site sewage disposal systems are available on lots A and B. 8. That the preliminary plat be given conditional approval to October 1, 1987. The Short Plat Administrator may administratively approve a request for a one year extension of time if the sponsor submits a written request forty-five (45) days prior to the above expiration date. A request for an Extensi on of Time may subject the proposal to new conditions required by reviewing agencies. 2. That the plat be designed as indicated on the preliminary plat of record and/or attached sheets as noted. 3. That a statement be placed in the dedication to the effect that no more than one dwelling structure be placed on any one lot, nor shall any lot be further subdivided for the purposes of creating additional lots or building sites wlthout filing a replat. 4. That appropriate utility easements be indicated on copies of the approved preliminary plat for distribution to the Planning Department and the utility companies. .W ritten approval of the easements by the uti 1 i ty compartiy must be recei ved pri or to the submi ttal of the f i nal pl at. 5. COlNTY ENGDNEER CQdDITIQNS 1. That conditional approval of the plat by the County Engineer is given. 2. A statement must appear in the dedicatory language of the plat that i ndi vi dual dri veway access permi ts be requi red prior to i ssuance of a bui 1 di ng pe rmi t f or dri veway approaches to the County Road system. 3. The word "applicant° shall include the owner or owners of the property, his heirs, assigns, and successors. 4. The proposed plat shall be improved to the standards set forth in Spokane County Board of Conmissioners Resolution No. 80-1592, as amended, which establishes regulations for roads, approaches, drainage, and fees in new construction. HEALTH DISTRICT 1. A combined surface water and sewage disposal detailed plan shall be approved by the County Engineer and the Spokane County Health District prior to the issuance of aRy building permit for this project. 2. The dedicatory language of the plat will state that: "Subject to specific application approval and issuance of permits by the Health Office r, the use of individual on-site sewage systems may be authorizedu. 3. .W ater service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social b Health Services. 4. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. The dedicatory language on the plat shall state: "Use of pri vate wel l s and water systems 1 s prohi bi ted. " 6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that suitable sites for on-site sewage disposal systems are available on lots A& B. 7. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that the existing on-site sewage disosal system serving the residence located on lot C is wholly lccated within the boundaries of the lot. COINTY UTILITIES 1. Pursuant to the Board of County Comn1 ssi oners Resol ution N o. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Heal th District. ° 2.
