FINDINGS OF FACT
1. The preliminary subdivision was approved by ihe Short Plat Administrator on
August 29, 1985.
2. Since the original approval, the applicant has done nothing to advance the progress
of the preliminary subdivision status. However, the applicant notes on the
Extension of Time request fonn that he has been awaiting progress of the public
sewer scheduled in the area of the project. However, a requirement for sewering
was never a pan of the approved project. The applicant has not provided a
satisfactory expianation as to why the subdivision has not been finalized. On the
other hand, since the Planning Department (although not required to solicit
renewals) has Qeneraliy had a policy of advising applicants of renewai times, but
failed to do so in Juiy of 1988, the appiicant is entitied to a late oonsideration for
an extensan.
3. Additional oondMons of approval have been reoommended by the Spokane County
Engineer's Office. These are irtoorporated below as revised conditions of approval.
4. That this is the first request foP agme extension.
5. Extension of Time r+tequests for subdivisions are based on RCW 58.17.140 and
Chapter III. Section G of ihe Spokane County Subdhvision Orclinance. Although, the
applicant does rrot meet these cxiteria, the County must oontinue its demonstration
of good faith by grenting a one-year extenston, since it extended the offer after the
proposal had gone null and void due to ladc of renewal.
DECISION
Based on the foregoing findings, the Spokane County Planning Department grants an
extension of time for one (1) year to June 1. 1990, subject to the following
conditions.
Conditions of Approval
1. All those oonditions of aaproval as attached with the Findings of Fact Conclusfon and
Decision, with the modification that preliminary subdivisian approval shall be
extended to June 1, 1990; exoept that the following oonditions are added to and/or
supersede as indicated below.
2. The following language shall replace the language stipulate in County Engineers
Condition No. 9 in the "Findings of Fact and Conclusion" dated August 29, 1985.

a The following statement shall appear within the dedicatory language of the finai
plat and be binding upon the owner(s), their suocessor(s) or assign(s):
i. The owner(s) or sua:essor(s) in interest agree to authorize Spokane County to
place their name(s) on a petition for the fomnation of a Road Improvement District
(RID) by the petition method pursuant to Chapter 36.88 RCW. which petition
includes the owner(s) property, and further not to object, by the signing of a
ballot, the formation of a RID by the resofufion method pursuant to Chapter 36.88
RCW, which resolution includes the owner(s) property. If a RID is formed by
either the petition or resolution method, as provided for in Chapter 36.88 RCW,
the owner(s) or successor(s) further agree: (1) that the improvements or
construction contemplated within the proposed RID is feasible, (2) that the
benefits to be derived from the formation of the RID by the property included
therein, together with the amount of any County panicipation, exceeds the cost and
expense of fonnation of the RID, and (3) that the property within the proposed RIO
is sufficiently developed. Provided, funher, the owner(s) or successors(s) shall
retain the right, as authorized under RCW 36.88.090, to object to any
assessment(s) on the property as a result of the improvements celled for in
conjunction with the formation of a RID by either petition or resolution method
under Chapter 36.88 RCW, and to appeal to the Superior Coun the decision of the
Boarci of County Commissioners affirming the final assessment roll.
i 1. It is further agreed that at such time as a RID is created or any Road Irnprovement
Project Is sanctioned by Spokane County, the improvements required (curb,
sidewalk, drainage oontrol and paving) will be at the sole expense of the
undersigned owner, their heirs, graniees and assigns without participation by
Spokane County.
i i i. The RID waiver oontained in ihis agreement shall expire aRer ten (10) years from
the date of execution betow. However, the owner(s) or successor(s) agree that if
said rid waiver expires without construction of the required improvements, the
owner(s) or sucxessor(s) agree to consttict the required improvements at their
own expense; pay to Spokane County ihe then esdmated oost of the requlred
improvements to enabfe the County to complete the same; or furnish a bond or
other secure method suitable to the County, providing for or securing to the County
the actual construction of the improvements.
3. The Spokane County Planning Department shall prepare and reconi with the
Spokane Caunty Auditor a"Title Notice" noting that the property in question is
subject to a variely of special oonditions imposed gs a result of approval of a land
use action. This 'Title Notice" shall serve as official public notice regarding
conditions of approvel affecting the property in quesiion. The "Title Notice" shall
be reoorded within fifteen (15) days of flnal disposition of the approved land use
action and shall only be extinguished by the Spokane County Planning Department.
The "Title Notice" shall generally provide as follows:
