In consideration of the approval by Spokane County of
S"oRT PL,AT 85-4-09 (hereinaPter referrecl to as the
"Development"), the undexsigned covenants and aqrees that:
1. The subdivider/sponaor will construct the prfvate roads and lissociated
drainage facilities in canformance with the approved plans on fJ],e in the
County Enqineer's Off ice.
2. A lot is served by a private raad when: a. the only road frcintage for
the lot in the Development is on the private road, or; b. a lot having .
frontage on more than one road(public or private) constructs an al:proach to
the private road.
3. The owner(s) of any lot created by the Development or alternation thereof
and served by a private road shall be regponsfble for maintenance of said
private road, inGiudilrg associdted drainage facilities in confornance with
approved plans on file with the County Engineers office,
4. Maintenance financfng of the private reads and associated drainage
facil ies shall be in a manner determined by the owners of:
a the majority of lots sezved by such private road;

described in this Development. By acceptfnq this Development or subsequently

1. The subdiviider/sponsor will constxuct the private roads and cissociated ~
drainage gacilities in conformance with the approved plans on f31e in the
County Engincer's Office. .
2. A lot is servsd by a private road when: a. the only road frcintage for •
the lot in the Development is on the private road, or; b. a lot havinq .
frontage on more than one road(public or private) constructs an aliproach to
the private raad. '
3. The owner (s) of any lot created by the Development or alternatic,n thereof
and served by a private road shall be responeible for maintenance of said
private road, includinq associated drainage facilities in conforaance with
approved plans on Pile with the County Engineers office.

4. Maintenance financing of the private roads and associated drainage Pacilities shall be in a manner determined by the owners of:

7. WARNZNV: Spokane County has no responribility to build, imXorove, or
maintain or otherwfse service the private roads, including ansociated

described in this Development. By accepting this Development or sub::equently
by allowing a building permit to be issued for property on a privFtte road,
Spokane County assumes no obliqation for said private road and tr.e owners
hereby acknowledge that the County has no obligation of any kind cof nature
whatsoever to establish, examine, suzvey, construCt, alter, repair improve,

BEFORE THE SPOKANE COUNTY SHORT PLAT ADMINISTRATOR
IN THE MATTER OF ) FIHDINGS OF FACT,
SHORT PLAT N0. SP-85-409 ) CONCLUSION AND DECISION
THIS MATTER, an application by Terry McAvoy for the approval of a Short
Plat, pursuant to Spokane County Resolution No. 78-291, came before the
Spokane County Short Plat Administrator on the 14th day of November, 1985.
Having reviewed the records and files in this matter, the Spokane County
Short P1 at Admi ni strator makes the fo11 owi ng:
FINDINGS OF FACT AND CONCLUSION
I.
That the SPokane County Comprehensive Plan indicates this site to be
wi thi n the Suburban Category and wi thi n the Pri ori ty Sewer Servi ce Area.
II.
That the uses and density proposed by the plat sponsor appear to be
consistent wlth the fill-in policies of the Comprehensive Plan and compatible
with ad3acent land uses.
III.
That the exi sti ng zoni ng for thi s si te i s R-2.
IV.
That proper legal notification was given for this proposal.
V.
That two adjacent property owners expressed disapproval of this proposed
use citing as major concerns the increased density resulting in traffic
conjestion and loss of privacy, potential decline in property values due to
the construction of dupl exes of unknowm qual i ty, and the abi 1 i ty to provi de
adequate sewage systems to service the new units. The two property owners
also expressed preference for single family dwellings in this area rather than
duplexes.
VI.
That the property has been zoned R-2 since 1968 and duplexes are an
allowed use.
VII.
That the site now contains one single family structure, older
outbuildings and vacant land and is bordered on the west by Center Road and on
the north by Utah Avenue and the railroad right of way.
YIII.
That appropriate provision have been made for sewage disposal, water
supply, stornt water control, circulation, fire protection and other necessary
public facilities and utilities.
IX.
That the proposed short plat is not detrimental to the general purpose
or otherwise harmful to the public health, safety and welfare.
X
That no significant adverse environmental impact will likely result from
approval of thls proposal.
THEREFORE, the Spokane County Short Plat Administrator hereby issues this

Short Plat Application SP-85-409 is hereby subject to conditions which
shall be complied with by the applicant and/or sponsor prior to finalization
of the short plat.

CONDITIONS OF APPROYAL FOR SHORT PLAT #5P-85-409
PLANNING
1. That the preliminary plat be given conditional approval to December 1,
1988. The Short Plat Administrator may administratively approve a
request for a one year extension of time if the sponsor submits a
written request forty-five (45) days prior to the above expiration
date. A request for an Extension of T1me may subject the proposal to
new conditions required by reviewing agencies.
2. That the plat be designed as indicated on the preliminary plat of record
and/or attached sheets as noted.
3. That a statement be placed in the dedication to the effect that no more
than one dwelling structure be placed on any one lot, nor shall any lot
be further subdivided for the purposes of creating additional lots or
building sites without filing a replat.
4. That appropriate street names be indicated.
5. That appropriate utility easements be indicated on copies of the
approved preliminary plat for distribution to the Planning Departnent
and the utility companies. Written approval of the easements by the
utility company must be received prior to the submittal of the final
plat.
6. That a certificate of title be furnished the Planning Department prior
to the filing of the final plat.
7. That a survey be required prior to the filing of a final plat.
SPOKANE COUNTIf ENGI NEER DEPARTMENT
1. That conditlonal approval of the plat by the County Engineer is given
subjecte to dedication of right-of-way and approval of the road system as
indicated in the preliminary plat of record.
2. That drainage plans and design calculations showing the alignment of
drainage facilities be submitted to the County Engineer for approval
prior to construction and/or the filing of each final plat. Drainage
plans to be prepared under the direction of a licensed Professional
Civil Engineer.
3. A statement must appear in the dedicatory language of the plat that
individual driveway access Permits be required prior to issuance of a
building permit for driveway approaches to the County road system.
4. Dedicaton of 5 ft. additional Right of Way along Center Road; 10 ft.
additional Ri ght of Way al ong Utah Avenue.
5. Existing County roads providing direct access to the plat shall be paved
and/or curbed to Spokane County standards.
6. Public Road Standard TYPICAL Roadwa4Y Section: (1) Section Number 2 for
Center Road Minimum Paving width Access Standard; (2) Section Number 2
for Utah Avenue Minimum Paving width Access standard.
7. The word "applicant" shall include the owner or owners of the property,
his heirs, assigns and successors.
8. To construct the road improvements stated herein, the applicant may,
with the approval of the County Engineer, Join in and be a willing
parti ci pant i n any peti ti on or resol uti on whi ch purposes i s the
formation of a Road Improvement District (RID) for said improvements
pursuant to RCW 36.88, as amended. At such time as an RID is created or
any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned owner,
their heirs, grantees and assigns.

9. As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by 3oining and
participating in a County Road project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any
Road Improvement Pro3ect is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned owner,
their heirs, grantees and assigns.
10. That the following statement be placed in the plat dedication: The
owners, their heirs, grantees and assigns, agree to join in the
formation of a County Road Improvement District pursuant to RCW 36.88 at
such time as a Road Improvement District is created or ar~y Road
Improvement Project is sanctioned by Spokane County. The improvements
required (curb, sidewalk, drainage control and paving) will be at the
sole expense of the owner, their heirs, grantees and assigns.
11. The proposed private road(s) as shown on the preliminary plat serving 1
lot with no extension possible is approved by the County Engineer.
12. That private road(s) be improved to Spokane County standard for a
private road Urban-Suburban standard serving 1 lot. Subject to approval
under Section 10.207 of the Spokane County Fire Code.
13. That the following statement be placed in the plat dedication:
WARNING:Spokane County has no responsibility to build, improve,
maintain, or otherwise service the private roads contained within or
providing service to the property described in this plat. By accepting
this plat or subsequently by allowing a building permit to be issued on
property on a private road, Spokane County assumes no obligation for
said private road and the owners hereby acknowledge that the County has
no obligation of any kind or nature whatsoever to establish, examine,
survey, construct, alter, repair, improve, maintain, provide drainage or
snow removal on a private road. This requirement is and shall run with
the land and shall be binding upon the owner, their heirs, successors or
assigns including the obligation to participate in the maintenance of
the private road as provided herein.
14. The proposed plat sha11 be improved to the standards set forth in
Spokane County 8oard of Commissioners Resolution No. 80-1592, as
amended, which establishes regulations for roads, approaches, drainage,
and fees in new construction.
15. The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional right-of-way and the
roadway improvements herein specified.
16. All vested owners shall sign and record private road documents as
prescribed by the Spokane County Engineer. These documents shall be
rev9ewed and approved by the County Engineer prior to recording with the
Spokane County Auditor. Recording numbers shall be referenced in the
dedicatory language of the plat.
COUNTY HEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plan shall be
approved by the County Engineer and the Spokane County Health District
prior to the issuance of any building permit for this proJect.
2. The dedicatory 1 anguage of the pl at wi 11 state that: "Subject to
specific application approval and issuance of permits by the Health
Officer, the use of (an) on-site sewage system(s) may be authorized."

3. Water service shall be by an existing public water supply when approved
by the Regional Engineer (Spokane), State Department of Social 8 Health
Services.
4. Prior to filing the final plat, the sponsor shall present evidence that
the plat 11es within the recorded service area of the water system
proposed to serve the plat. The dedicatory language on the plat shall
state: "Use of private wells and water systems is prohibited."
5. The plat dedication will contain a statement to the effect that: "The
public water system as approved by County and State health authorities
and the local fire district and purveyor will be installed within this
plat, and the subdivider will provide for individual domestic water
service as well as fire protection to each lot prior to sale of each

6. Prior to filing the final plat, the sponsor shall demonstrate to the
satisfaction of the Spokane County Health District that suitable sites
for on-site sewage disposal systems are available on the 3 undeveloped
lots.
7. Prior to filing the final plat, the sponsor shall demonstrate to the
sati sfaction of the Spokane County Heal th Di stri ct that the exi sti ng
on-site sewage disposal system serving the residence located is wholly
located within the boundaries of the newly created lot.
COUNTY UTILITIES DEPARTMENT
1. Pursuant to the Board of County Conmissioners Resolution No.80-0418, the
use of on-site sewer disposal systems is hereby authorized. This
authorization is conditioned on compliance with all rules and
regulations of the Spokane County Health Oistrict and is further
conditioned and subject to specific applicaton approval and issuance of
permits by the Health District.
2. The dedication shall state: "The owner(s) or Successor(s) in interest
agree to authorize the County to place their name(s) on a petition for
the formation of ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to object by the
signing of a protest petition against the formation of a ULID by
resolution method pursuant to RC w Chapter 36.94 which includes the
Owner(s) property. P RaVIDED, this condition shall not prohibit the
owner(s) or successor(s) from objection to any assessment(s) on the the
property as a result of improvements called for in con3unction with the
formation of a ULID by either petition or resolution method under RCW
Chapter 36.94.
3. Any water service for this project shall be provided in accordance with
the Coordinated Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Each new dwelling unit shall be double
plumbed for connection to future area-wide collection systems."
BUILDING 8 SAFETY DEP ARTMENT
1. Prior to finalization, the sponsor shall provide the Building & Safety
Department with written verification from Fire District #1 that all fire
protection requirements have been provided for.
