senefits to be hereafter derived do for themselvee, their hefre, grantees and
assigne, hereby agree to the following:
There may be a need in the future to conetruct a public road to eerve the
lands herein c3eecribed. Said road ehall be constructed in accordance with
the then adopted County road etandarde for public roads. Said road to
follow, as near ae practicable, the exieting County road riqht of way.
If adciitional right o€ way is required, the ownera, their heire and/or
assigne agree to deliver to Spokane County a properly eiqned and executed
Right of way Deed caverinq the required additional right of way.
The owner(s) or successor(s) in interest agree to authorize Spokane County
to place their name(e) on a petiti,on for the formation of a Road
Imgrovement District (RID) by the petition method pureuant to Chapter
36.88 RCW, which petition includee the owner(e) property, and further not
to object, by the signing of a ballot, or not to protest to the formatfon
of a RID by the resolution method pursuant to Chapter 36.88 RCW, which
resolution includes the owner(e) property. 2f a RID ie formed by either
the petition or resolution method, ae grovided for in Chapter 36.68 RCW,
the owner(s) or aucceeeor(8) further agree: (l) that the improvemente or
construction contemplated within the propoeed RID ie feaeible, (2) that
the benefite to be derived from the fvrmaticn of tbe RID by ,erty

af any kind or nature whateoever to eetabliah, examine, eurvey, construct,
alter, re8air, improve, maintain, provide drainaqe or enow removal on eaid
road. The requfrement ie and shall run with the land and ehall be binding
upon the owners, their heirg, eucceeeore or aseigne, until eaid road is
improved to County atandards and accepted by the County for maintenance.

Dear Gary:
Enclosed is a site plan showing the proposed 3 lot, 1.6 acre
short plat superimposed on a contour map of the surrounding area. The
soils within the plat are Garrison gravelly loams with a small amount
of rock outcropping (See soils map enclosed). The 100-year flood
elevation of 2028 is shown on the site plan and it is evident that
there are three building sites available outside the flood elevation.
Since the development of the short plat only involves the
addition of two single family residences, we feel that the slight
increase in impervious area will have little or no effect on the
stormwater runoff from the plat. Therefore, we do not anticipate the
construction of storm drainage improvements as with the development of
this short plat.

Dear Gary:
Enclosed is a site plan showing the proposed 3 lot, 1.6 acre short
plat superimposed on a contour map of the surrounding area. The soils
within the plat are Garrison gravelly loams with a small amount of
rock outcroppinq (See soils map enclosed). The 100-year flood
elevation of 2028 is shown on the site plan and it is evident that
there are three building sites available outside the flood elevation.
Since the development of the short plat only involves the addition of
two single family residences, we feel that the slight increase in
impervious area will have little or no effect on the stormwater runoff
from the plat. Therefore, we do not anticipate the construction of
storm drainage improvements as with the development of this short
plat.

still owns property adjacent to the proposed shoxt plat.
A].thouqh Mr. Wirth is nat oppdsed to the short plat,
there ar,e three items which concern him regardin,q the
proposed short plat.
Mr. Wirth owns Lot 2, Bloak S of I Apple tTalley
Fstates 2nd Addition which ig a one foot strip af
property lyinq between Flora Road and the praposecl short
plgt, when Mr. Wirth cieveloped his property, the County
required thfs one foot stxip to prevent the property riow
owned by Mr. Ma1lfCOat from being subdivided wfthout
Caunty approval. Some arrangementg muRt be made
regarding this one foot strip to provide Mr. Mallicoai,
with access to hia propertx if the short plnt is '
a pproved.
Thexe ie a draindqe ditch which runs throuqh Mr.
Wirth's property ahd may aantinue across Mr. Mallicoat's i
propertX. Thfs is a dzainaqe ditch from the Salteee
Flats and if obstructed, will cauQe water to back up on
Mr. Wirth's propextx. Approval of the short plat should
he conditioned upon the maintenance of this drafnage
ditch by Mr. Ma1liCoat and hf s 8ucceseors in an '
unobstructed and unaltered manner.
Finally, it appears that Flora Road w~ll be the
accsess to the lots Mx. Mallicoat is ghort plattinq.
Since anly.-that portfon of Flora Road Iyinq north of 5th
Avenue hag been paved, consideration ehould be qiven in
this short plat to paving that portion of Flora Road

Spokane County to place their name(s) on a petition for the
formation af a Road Improvement District (RID) by the petition
methiDd pursuant to Chapter 3E.88 RCW, which petition includes
the owner(s) property, and further not ta object, by the signing
of a ballot, the formativn of a RID by the resolutian meth4d
pursuant to Chapter 36.e8 RCW, which resolutian includes the
owner(s) property. If a RID is formed by either the petitinn or
resolution method, as provided for in Chapter 36.88 RCW, the
owner (s) or successor (s) further aqree: (1) that the
improvements or construction contemplated within the propUsed
RID is feasible, C2> That the benefits to be derived from the

It is further agreed that at such time as an RID is created

Spokane County.
The RID waiver cantained in this agreement sha11 expire
af ter ten (10) years f rom the date of execution below. However,
the owner(s) or successor(s) aqree that if said RID waiver
expires witF+out construction of the required improvements, the
owner(s) ar successor(s) aqree to construct the required
improvements at their own expense; pay ta Spokane County trie
then estimated cost of the required impravements ta enable the
County to complete the same; or fiurnish a bond or other secure
method suitable to the Caunty (which may include trie execution
of another RrD waivPr aqreement), providing fior ar securing to
the Crunty the actual canstruction of the impravements.
All ofi the requirements of this agreement shall run with
the land and shal l be binding upon the Qwner (s) , their
successor(s) or assign(s).
E24- The County Enqineer has desiqnated Typical Roadway Section
Number Two, Access Street Standard for the impravement af Fourth
mavenue and that portion of Flara Road lying to the South of
Fiifth Avenue which are adjacent to the proposed development.
This will require the addition of approximately 18 t4 20 ft. of
asphalt along the frontage of the development. The constructiQn
of curbing is alsa required.
E32- The praposed plat shall be improved to the standards
set forth in Spokane County Loard of Commissianers Resoloation
No. 80-15922 as amendedt which establishes regulations far
roads, approaches, drainage and fees in new construction.
E33- The County Engineer has examined this development propcrsal
and has determined that the impact of this proposal upvn the
existing County Road System warrants the dedi cation of
additional Right of Way and the roadway improvements herein
specified.
E34- This plat or development praposal is located within a
drainaqe basin which has been identified by the SpoE;ane County
Enpineers Office as having stormwater runoff problems. 5ince
this plat or development proposal is affected by or is a
contriautur to stormwater filows, property owners should
participate in the planning and implementation of a future
basinwide st4rmwater management system. The followinq statement
shal l be placed in the plat dedication: "That the owner Cs> or

DECISION
THIS MATTER, an application for subdivision of land, finm John E. Mallicoat has been
received and decided upon, pursuant to Spokane Counry Subd.ivision regulaaons, on the
day of 91913.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly deiegated the responsibility for
rendering the decision by d1e Spokane County Director of Planaing.
2. The proposal is to divide 1.62 acres into 3 lots for the development of residential lots, one lot
with exisang horne.
3. The proposal is located on the southwest corner of 4th Avenue and Flora Road intersection in
Secrion 24, Township 25 North, Range 44, E.W.M., Spokane County, Washington.
4. The currenc zoning of the property is Agricultural. The proposed lot sizes, frontage and
intended uses are allowed within this zone.
5. The Spokane County Comprehensive Plan designates tbis anea as Suburban. The
development and uses proposed are generally in accord with this category/designation.
6. The required public notice was provided for this proposal and agencies having a potential
incerest in thc project were notified and recommendadons solicited.
7. One wriaen response was received. The chief concerns expressed were regarding road
access and road improvements to the short plat and drainage on the short plaL
8. That the County Engineer has reviewed the proposal and recommended condidons of
approval regarding road 'unprovements and drainage.
9. Recognizing the recomalended conditions and Spokane County development standards, the
proposed subdivision makes appropriate provisions for the public health, safety and general
welfane and that the public use and interest will be sen+ed by platting the subdivision.
10. The project is exempt from environmental roeview under the State Environmental Policy Act
pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-
89-597 is hereby APPROVED until November 1, 1992, subject to conditions noted below.
Mosc of the condidons of approval shall be accomplished by the applicant and/or sponsor

These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLaNNihiG DEPARTMENT CONDiTIONS
1. The final plat shall be designed substantially in conformaace with the preliminary plat of
record as legally described and advertised. No increase of density or lot number shall
occur without a new applicaaon submittal and approval.
2. The Spokane Couaty Planning Director/designee shall review any proposed final plat to
ensure compliance with these Find.ings and Cond.itions of Approval.
3. The preliminary plat is given conditional approval for three (3) years, specifically to
ovem ber .1 .71e applicant may request an extension of ti~me by submitting a written
request approximately forty-five (45) days prior to the above expiration date.
4. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of udlity casements by appropriate utility companies must be received

prior to filing the final plat.

developmenL The construction of curbing is also required,
10. The proposed plat shall be improved to the standards set forth in Spakane County Board of

CpUNTY HEALTH DISTRICT CONDITIONS
1. Appropriate utility easements shall be indiceted on copies of the preliminary plat of record
for d.istnbution by the Planning Dcparmaont to the utility cvmpanies, Spokane County
Engineer and the Spokane County Heatth District. Written approval of the easements by
the utility companies must be received prior to the subanittal of the final plat.
2. A public sewer system will be made ava.ilable for the plat/project, and ind.ividual service
will be provided to each lot/aract prior to sale. Use of individual on-site sewage disposal
systems shall not be authorized. Note: The existing residence located on Tract A must also
connect to the public sewer system prior to final plat appmval.
3. The ded.icatory language on the plat shall state: "Use of private wells and water systems is
prohi bited."
4. The plat dedicadon will contain a statement to the effect that: "The public water system, as
approved by County and state health anthorities and the local fire district aad purveyor, will
be inscalled within this plat, and the subdivider will provide far individual domestic water
service, as well as fire protection, to each lot/cract prior to sale of each loVtract."
COUNTY UTILTTIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-
site sewer disposal systems is hereby authorized. This authorization is condidoned on
compliance with all rules and regulations of the Spokane County Health District and is
