RE : Standard Drainage Language for the Dedication on SP
(1) Drainage easements, as platted and shown hereon, which are for the purpose of
installing, operating and maintainiag drainage swales and drainage facilities
to dispose of runoff, are hereby granted. The County of Spokane is hereby
granted Che right of ingress and egress to all drainage easements adjacent to
j the public right-of-way. The property owner shall maintain the drainage
' swale with a permanent live cov+er of lawn turf, with optional shrubbery
and/or trees, which do not obetruct the flow and percolation of storm
drainage water in the drainage awale as indicated by the appraved plans.

for proJect reviews and / or inspections plus a ten percent
administrative charge, and will be billed monthly as
accrued.

, DECISION S
THIS MATTER, an application for subdivision of land, from Robert Guthrie has been
received and decided upon, pursuant to Spokane County Subdivision regulations, on the 25th
day of October, 1989.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately 5.5 acres into 41ots for the development of
industrial or commercial land uses.
3. The proposal is located south of and adjacent to Montgomery Drive, approximately 1500
feet west of University Road in the NE 1/4 of Section 8 TWP 25N R44 EWNi.
4. The curnent zoning of the property is Restricted Industrial. The proposed lot sizes,
fronGage and intended uses are allowed within this zone.
5. The Spokane County Comprehensive Pian designates this area as Industrial. The
development and uses proposed are generally in accord with this category.
6. The required public nodce was provided for this proposal and agencies having a potential
interest in the project were notified and recommendadons solicited.
No one in the area commented on the pmposal.
8. Tract D of proposed short plat will be served by a 40 foot private road extending
southerly from Montgomery Drive though Tract B. Remainder of lots will front on
Montgomery Drive. Access to Montgomery Drive from Tracts C and B shall be via
proposed pnvate road, as per County Engineers recommendadon. Flanking street
setback will be required from easterly edge of 40 foot private road.
9. The Spokane County Arterial Road Plan indentifies Montgomery Drive as a minor
Urban Arterial. Existing right-of-way width of 60 feet is inadequate to implement the
Arterial Road Plan. To implement said plan it is reconimended that in addiaon to required
right-of-way dedicaation, a strip of property 5 feet in width along Montgomery I?rive be
reserved for future right of way.
10. Recognizing the recommended condidons and Spokane County development standards,
the proposed subdivision makes appropriate provisions for tbe public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
11. The project is exempt fiom environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Applicaaon
SP-89-598 is hereby APPROVED undl Navember 1, 1992, subject to conditions noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in wridng, consistent with adopted appeal procedures, on or before the close of
business hours on November 6,1989.

These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. The preliminary plat of record approval is for the property legally described in the
application for this proposal.
2. The final plat shall be designed substandally in conformance with tbe preliminary plat
of record as Iegally described and advertised. No increase of densiry or lot number
shall occur without a new application submittal and approval.
3. The Spokane C;ounty Planning Director/designee shall review any proposed final plat to
ensure compliance with these Findings and Condirions of Approval,
4. The preliminary plat is given condidonal approval for three (3) years, specifically to
November 1,1992. The applicant may request an extension of dme by submitting a
written request approximately forty-five (45) days prior to the above expiration date.
5. Appropriate road name(s) shall be ind.icated.
6. Appmpriate utiiity easements shall be indicated on copies of the proposed final plaL
Written approval of utility easements by appropriate utility companies raust be received
with the subauttal of the final plat.
7. Three (3) current certificates of title shall be furnished the County Planning Deparoment
prior to filing the final plaL
8. The following statement shall be placed in the final plat dedication: "No lot shall be
further subdivided far the purpose of crcating addiaonal lots, ownerships or building
sites without fust filing and receiving approval of a replat."
9. The final plat map shall indicate by a clear dashed line the required yard setbacks from
all private, "Tract X" ar public roads. The dedication shall contain the following
statement that: "Side yard and rear yard setbacks shall be determined at the time
building pernuts are requested. The setbacks indicated on this plat may be varied from
if pmper zoning approvals are obtained."
10. A plan for water faciliaes adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protecdon district, Spokane County
Building & Safety Department and Spokane County Health DistricL The agencies will
certify on the WATER PLAN, prior to the filing of the final plat or any phase of the
preliminary plat, that the plan is in conformance with their respective needs and
reguladons. The WATER PLAN and certificadon shall be drafted on a transparency
suitable for reproducdon and be signed by the plat sponsar.
11. The purveyor shall also certify that appropriate contractual anangements and scbedule
of improvements have been made with the plat sponsor for construcdon of the water
system in accordance with the approved WATER PLAN. The rime schedule shall
provide for completion of the water system and inspection by the appmpriate health
authorities prior to application for building permits within the final plat. The
arrangemeats or agreements shall include a provision holding Spokane County and the
purveyor harmless from claims by any lot purchaser refused a building permit due to
the failure of the subdivision sponsor to saasfactorily complete the approved water
system.
12. ne final plat dedieadon shall contain the following statement: "The public water
system, pursuant the WATER PLAN approved by County and State Health authorities,
the local fire protection district, County Building & Safety Department, and water
purveyor, shall be installed within this subdivision, and the subd.ivider/sponsor shall
provide for individual domestic water scrvice as well as fire protection to each lot prior
to sale of each lot and prior to issuance of a building permit for each lot.
13. No building permit will be issued for any lot within the final plat until certified by a
Washington State-licensed engineer that the water system has been installed pursuant
tro the approved WATER PLAN for the final plat," signed and stamped by said
engineer. The certification may be in the form of a letter, but is prefen-ed to be certified
r on a copy of the WATER PLAN as a schernatic map shawing the "as-built" water
system.
14. The Wata Plan and the abave four (4) conditi.ons of apgr+aval regarrding the WA1ER
PLAN may be waived by the Planning Di.rectorJdesignee upon receipt of Ietters firom
the aPproPriate water purveyor and fire pratecdan district stating chat simple

preliminary plat of recard.
2. Plans, profxles, and eross-sections as designed to Caunty standards shawing proPosed
street centerline and curb grades shall be submitted to the Caunty Engineer far apprQVa1

the clirecdon of a Iicensed Professional Civil Engineer. This cantlition also applies to
the proposed privace road. Curbing is not requixaed for griwate raad. Road plans for

3. Drainage plans and design calculatians showing the alignment af drainage facilities
s,W be submitted to the Caunty Engineer for approval priar to constrcjction andlor the
filing of the ~'inal plat. I)rainage plan5 to be prepared under the direction of a liGenSed
Frofessional Cirril Engineer. The drainage pian for on site starmwater disposal may be
submitted prior to the rejease of a building permit for each site. The drainage plan far 'the private rvad must be submitted for review and approval prior to recording vf the

4. Construction within the proposed public streets and easements shall be perforcned
under the direct supervision of a Iicensed engineer/surveyor, who shall fumish the
County Engineer with "as-built" plans snd a certificate in writing that all improvements
were installed to the lines and grades shown on the approved conswction plans and
that all disturbed monuments have been replaced.
5. No construcdon work is to be performed within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and appr+oval by the County Engineer.
6. All construction within the existing or proposed public right-of-way is to be completed
prior to filing each fwal plat, or a bond in the amount estimated by the County Engineer
to cover the cost of consuuction of improvements, consavction certi.ficaaion, "as-built"
plans and monumenting the street centerlines shall be filed with the County Engineer.
7. All construcdon within the existing or proposed Publi~ Right-of-Way is to be
completed prior to release of a building permit or a bond in the amount estimated by the
County Engineer to cover the cost of construction of improvements. Construcdon
certificadon, "As Built" plans and monumenting the street centerlines shall be filed
with the County Engineer.
8. 1'he applicant should be advised that individual driveway access permits are requirerl
prior to issuance of a building pernut for driveway approachcs to the County road
system.
9. Dedication of S ft. of addirional right-of-way along Montgomery Drive. This
ded.ication requirement shall be for the roadway frontage along that portion of Tract 18
of Fruitland Addition contained within the proposed plat.
10. A statement shall be placed in plat dedication that no direct access be allowed from lots
to "C" and "B" to Montgomery Drive.
11. Access to Montgomery Drive from lots "C" and "B" shall be via the proposed private
road. This requinement is placed upon the plat in the interest of traffic safety.
Accessing Montgomery Drive via the private road will reduce the locations along the
arterial where turning movements may take place. The requirement is also necessitated
by the alignment of Montgomery Drive at this location. The County Engineer may
requcst a sight distance evaluation at the proposed intersection of the private road with
Montgomery Drive. This evaluarion if required will have to be conducted prior to
filing of the plat. The results of this evaluation may necessitate the redesign of the plat
in the interest of traffic safety. Specific access language for the final plat may be
required upon completion of the evaluation.
12. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane Counry standards.
13. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
14. The County Engineer has designated Typical Roadway Section Number One,
Secondary Artenal Standand for the improvement of Montgomery Drive which is
adjacent to the pr9oposed deveiopment. This will require the addition of approximately
7 to 10 feet of asphalt along the frontage of the development. The construction of
curbing and sidewalk is also required. Roadway improvernents wiU be required prior
to the release of building pennits. The applicant may provide a surety (in an amount
detennined by the County Engineer) which will guarantee the construction of the
required roadway improvements.
15. The proposed private road(s) as shown on the preliminary plat serving Three lots with
no extension possible; extension to is approved by the County Engineer. This approval
is subject to approval by the Counry Engineer of the locarion of the proposed
intersection.
16. Private road(s) shall be improved to Spokane County standard for a private road
Urban-Suburban Standard serving three lots. The minimum width of proposed
roadway surface is to be 24 ft. Subject to approval under Secdon 10.207 of the
Spokane County Fire Code.
17. All vested owners shall sign and record private road documents as prescribed by the
Spokane County Engineer. These docurvents shall be reviewed and approved by thc
Spokane Counry Engineer prior to recording with the Spokane County Auditor.
Recording numbers shall be referenced in the dedicatory language of the plat.

18. The following statement shall be placed in the plat dedication: "WA►RNING: Spokane
County has no responsibility to build, improve, maintain or otherwise service the
private roads contauied withui or provide service to the property described in this plat.
By acceptiag this plat or subsequently by allowing a building pernut to be issued on
pruperty on a private road, Spokane County assucnes no obligarion for said private
raad, and the owners hereby acknowledge that the County has no obligaaon of any
kind or nature whatsoever to establish, exannine, survey, construct, alter, repair,
unprove, m.aintain or provide drainage or snow rernoval on a pnvate road. This
requirement is and shall run with the land and shall be binding upon the owner(s), their
heus, successars or assigns, including the obligadon to participate in the maintenance
of the private road as provided herein".
19. The proposed plat shall be improved to the stanciards set forth in Spokane County
Board of Commissioners Resolution No. 80-1592, as amended, which establishes
regulations for roasis, approaches, drainage and fees in new construction.
20. The County Engineer bas examined this development proposal and has determined that
the impact of this proposal upon the exisdng county road system warrants the
dedicanon of addiaonal right-of-way and the roadway improvements herein speeified.
21. The following statement must be placed in the plat dedication: "The private road as
shown hereon is an easement which provides a nieans of ingress and egress for those
lots within the plat having frontage thereon."
22. The County Arterial Road plan indentifies Montgomery Drive as a Minor Urban
Arterial. The existing right of way width of 60 feet is not consistent with that specified
in the Plan. in order to implement the Arterial Road Plan it is recommended that Yn
addidon to the required right of way dedicadon, a strip of properry 5 feet in vvidth along
the Montgomery Drive frontage be set aside in reserve. This property may be acquired
by Spokane County at the time when Arterial Improvements are made to Montgomery
Drive.
COUNTY HEALTH DISTRICT CONDITIONS
1. The funal plat shall be designed as indicated on the preliminary plat of record and/or any
attacbed sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
recard for distdbution by the Planning Department to the udlity companies, Spokane
County Engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the subcnittal of the final
plat.
3. A combined surface water and sewage disposal detailerd plan shall be approved by the
County Engineer and the Spokane Counry Health District prior to the issuance of any
build.ing permit for this project.
4. Sewage disposal method shall be as authorized by the Director of Utiliaes, Spokane
County.
5. Water service shall be coordinated througb the Director of Utiliaes Spokane County. ~
6. Water service shall be by an eacisdng public water supply when approved by the I
Regionsil Engineer (Spokane), State Department of Social & Health Sernces.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the necorded service area of the water system praposed to serve the plat.
8. Disposal of sewage effluent beneath paved surfaces is currently prohibited.
9. Prior to filiag the final plat, the sponsor shall demonstrate to the satisfacdon of the
Spokane County Health District that suitable sites for on-site sewage disposal systems
are available on Tracts B, C and D.
10. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane Counry Health District that the existing on-site sewage disposal system
serving the structure located on Tract A is wholly located within the boundaries of the
tract.

11. Subject tio specific applicatioa approval and issuance of pemnits by the health officer,
the use of an individual on-site sewage disposal system may be authorized.
12. 'Ihe dedicatory language of the plat will state that: "Subject to specific application
approval and issuance of germits by the Health Officer, the use of (an) on-site sewage
system(s) rnay be authorized."
13. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
14. The plat dedication will contain a statement to the effect that: "The public water system,
as approved by County aad state health authorities and the lvcal fire district and
purveyor, will be installed within this plat, and the subdivider will provide for
individual domesdc water service, as well as fire protection, to each lot/tract prior to
sale of each lot/tract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
on campliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
permits by the Health District.
2. The dedication shall state: "The owner(s) or successor(s) in interest agree to authorize
the Counry to place their name(s) on a petition for the fornmtion of ULID by petition
method pursuant to RCW 36.94, which the petition includes the owner(s)' property;
and furthes not to object by the signing of a protest petition against the formation of a
ULID by resoludon method pursuant to RCW Chapter 36.94 which includes the
owner(s)' property. PROVIDED this condition shall not prohibit the owner(s) or
successor(s) from objecting to any assessment(s) on the property as a result af
improvements called for in conjuncdon with the formation of a ULID by either petidon
or resolution method under RCW Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Each new structure shall be double plumbed for
connection to future anea-wide collecdon systems.
BUILDIlVG AND SAFETY DEPARTMENT CONDITIONS
1. The applicant shall contact the Department of Building and Safety at the earliest possible
stage of design/development in order to be infomaed of Code requirements
administered/enforced by the department, e.g., State Building Code Act regulations
such as requirements for fire hydrant/flow, fire apparatus access mads, street address
assignment, barrier-free reguladons, energy code reguladons, and general coordination
with otber aspects of pmject implementadon.
2. The issuance of a building perniit by the Department of Building and Safety is required.
3. Requirements of Fire I?istrict No. 1 need to be satisfied during the building permit
process.
