The proposed SHORT PLAT NO. 89-599 is a 4 lot sinyle family
cesiriential plat to be constructed on appr4wimarely 2.3 acres in
East 5pokane County. The site is situated on the west sicfa of
Felts Road across from Desmet Avenve.
The proposed site is genecally flat with a shallow draw running
from aast to west along the southern boundacy. Composition of
the snil is Garrison gravelly loam (GgA). The Carrison gravelly
loams are found on slopes from 0 to 5%, are gcavelly, medium
texturad, somewhat excesssively drained soils formed in gravelly
glacial outwash material from a variety of acid, igneous parent
rock; on nearly level to modecately 31oping terraces. Dapth to

the soil is Garrison gravelly loam (GgA). The Garrisan gravelly
loams are found on slopes from 0 to 5%, are gravelly, medsum
textured, somewhat excessively drained soil forined in gravelly
glacial outwash material from a varlety of iyneuus parenti rock;
on nearly level to moderately slc,ping terraces. Depth to mi:tticre
oi sand, gravel, and cobbleskones ranges from 2-112 to 5 feet.

The prupdsed SHORT PLAT NG. 89-599 is a 4 lot sirigla family
cesidential plat to be constructed on approximately 2.3 acres i.n
East Spokane County. The site is situated on the west sida of
Fe 1 t s Road ac t- o s s f r om De sme t AvenuP.
The pruposed site is generaily flat with a snallow draw running
from east to west along the southern bc,undary. Composition of
the soil is Gacrison gcavelly loam (GgA). The Garrison gravelly
loams are fuund on slopes frnm Q to Sy, are gravelly, me3ium
textured, somewhat excessiveiy drained soil formed in gravelly
glacial oukwash material from a variety c►f igraeaus parznt rock;
on nearly level to mdderately sloping ± ereaces . Dapth t o mi}:tr.cre

Cataldo Lane, the private drive designed to give access to t2-te
two back loi.s, will be a gravel coad. Lcainage ditches shall t2
provided both along this private drive and along E'elts Ro,zd. No
additional paveaient is planned within the plat ak this time.
Runoff will collect in "208" and retention aceas which 1ha11 be
constructed as shown on the plan in the vl c-lr►i ty of ;t a~LnR 1+4n
Cataldo Lane. These swale areas will cont3in the runc,ff from the

DECLARATION OF COVSNANT:
In consideration of the approval by Spokane County of s/0 -a 9- 599
(hereinafter
referred to as the "Development"), the undersigned covenants and agrees that:
(1) A lot is served by a private road when: (a) the only road frontage for the
lot in the Development is on the private road; or (b) a lot having frontage on more
tiioit u►ie tuad (pubiic oL pr'Lvate) c:.ndtruct6 ar~ spFroach to the Frivate road.
(2) The owner(s) of any lot created by the Development or alteration thereof
and served by a private coad ehall be responeible for financing the construction and
maintenance of said private road.
(3) The road shall be improved consistent with Spokane County standards for
private roads.
(4) Maintenance method etandards and financing ahall be in a manner
determined by the owners of: the majoritq of lote served by such private road;
(b) the majority of frontage o ots aerved by such private road; (c) the majoritq of
equare footage of lota served by Buch private road; or (d)
(5) In the event such private road is improved to Spokane County standards for
public streeta and the County is willing to accept the dedication of such road, each
lot owner shall execute any documents necessary to accomplish such dedication.
(6) Owners of lots within the Development who are served by such road, may aue
and recover damages and attorneys' fees from any owner of any lot within the Develop-

financing, and mAintenance.
(7) WARNING: Spokane County has no responsibility to build, improve, or main-
tain or otherwise service the private roads contained within or providing service to
the property deacribed in this Development. By accepting this Development or subae-
quently by allowing a building permit to be issued for property on a private road,
Spokane County assumes no obligation for said private road aad the owners hereby
aGknowledge that the County has no obligation of anq kind or nature whatsoever to
establish, examine, survey, construct, alter, repair, improve, maintain, provide
drainage or snow removal on a private road.
(8) This covenant and agreement shall run with the land and sball be binding
upon the owner, their heira, succeseors or assigns, including the obligation to
participate in the maintenance of the private road as provided herein.

DECISIOiY
THIS MATTER, an application for subdivision of land, from Joe H. Schmidt has been
received and decided upon, pursuant to Spokane County Subdivision regulations, on
day oF19,
FINDINGS OF FACT AN'D CUIYCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately 2.3 acres into 41ots for residential development.
Proposed lots a.re of sufiicient Iot area and road frontage to allow duplexes on each lot.
3. The proposal is lncated west of and adjucent to Felts Road, approximately 650 feet north
of Broadway Avenue in the NE 1/4 Section 17, Township 25 North, Range 44 E.W.M.
4. The cunent zoning of the property is Agricultural Suburban. The proposed lot sizes,
frontage and intended uses are allowed within this zone.
S. The Spokane County Comprehensive Ylan designates this area as Urban. The
development and uses proposed are generally in accord with this category.
6. The required public notice was provided for this proposal and agencies having a potential
interest in the project were notifed and recommendaaons solicited.
7. No one in the area commented on the pmposal.
8. Access to Lots A& B is to be provided by a 30' wide easement/private road running
westerly from Felts Road through portions of Lots C& D.
9. Flanking street setbacks will be required from private road and measured from north and
south edge of 30 foot road easement. Final short plat will illustrate required setbacks.
lA. Recognizing the reCOmmended conditions and Spokane County development standards,
the proposed subdivision makes appropriate provisians for the public health, safery and
general welfare and that the public use and interest will be served by platting the
subdivision.
11. The projeet is exempt from envircanmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
AECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-89-599 is hereby APPROVED until November 1, 1992, subject to conditions noted
below. Most of the conditions of approval shaU be accomplished by the appUcant and/or
sponsor prior to finalization of the short subdivision. This decisian is final unless
appealed in writing, consistent with aciupted appeal procedures, on or bc;fore che close of

PLANNING DEPARTMENT CONDITIONS
1. The preliminary plat of record approval is for the property legally described in the
application for this proposal.

2. The final plat shall be designed substantially in conforrnance with the preliminary plat
of record as legally described and advertised. No increase of density or lot number
shall occur without a new applicadon submittal and approval.
3. The Spokane County Planning Director/designee Shall review any proposed final plat to
ensure compliance with t~ese Findings and Conditions of Approval.
4. The preliminary plat is given cond.itional approval for chree (3) ye:irs, specifictilly to
November 1, 1992. The applicant may request an extension of time by submitting a
written request approximately forty-five (45) days prior to the above expiration date.
5. A final plat name/number shall be indicated before the final plat is filed, suth
name/nurnbc:r to be approved by the Couruy Planning Dirzctor/designee.
6. Appropriate road name(s) shall be indicated.
7. Appropriate udtity easements shall be indicated on copies of the proposed rinal plat.
Written anproval of utility easements by appropriate uality companies must be received
with the submittal of the final plat.
8. Three (3) current certificates of title shall be furnished the Counry Planning Department
prior to filing the final plat.
9. The following statement shall be placed in the final plat dedication: "No more than one
(1) dwelling structure shall be placed on any lot, nor shall any lot be further subdivided
for the purpose of creating additional tots, ownerships or building sites without first
filing and receiving approval of a replat"
10. The final plat map shall indicate by a clear dashed line the required yard setbacks froni
all private, "Tract X" or public roads. The dedication shall contain the following
statement that: "Side yard and rear yard setbacks shall be detemiineii at the time
building permits are requested. The setbacks indicated on this plat may be varied fmm
if proper zoning npprovals are obtained."
11. A plan for water faciliaes adequate for domescic service and flre protection shall be
approved by the water purveyor, appropriate fire protection district, Spokane County
Building & Safery Department and Spokane County Hettlth District. The agencies will
certify on the WATER PLAN, prior to the filing of the finttl plat or any phase of the
preliminary plat, that the plan is in conformance with their respec:tive needs and
reguladons. The WATER PLAN and certification shull be drafted on a transparency
suitable for reproduction and be signed by the plat sponsor.
12. The purveyar shall also certify that appropriate contractual azrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved WATER PLAN. The time schedule shall
provide for compledon of the water system and inspection by the appropriate health
authorities prior to application for building permits within the final plat. The
arrangements or agrreements shall include a provision holding Spokane County and the
purveyor harmless from claims by any lot purchaser rzfused a build.ing perrnit due to
the failure of the subdivision sponsor to saasfactorily complete the approved water
system.
13. 1'he final plat dedication shall contain the following statement: "The public water
system, pursuant the WATER PLAN approved by County and State Health authorities,
the local fire protection district, County Building & Safety Department, and water
purveyor, shall be installed within this subdivision, and the subdivider/sponsor shall
provide for individual domestic water service as well as fire protection to each lot prior
to sale of each lot and prior to issuance of a building perrnit for each lot."
14. No building permit will be issued for any lot within the final plat untii certified by a
Washington State-licensed engineer that "the water svstem bas been installed pursuanc
to the approved WATER PLAN for the final plat," signed and staniped by said
engineer. The certifiCation may be in the fonn of a letter, but is preferred to be certifieci
on a copy of the WATER PLAN as a schematic map showing the "as-built" water
system.

15. The VVgter Plan and the abave four (4) conrlitions of approval rc:garding the VVATER
PLAN may be waived by the Planning Director/designee upon rec;eipt of letters from
the appropriate water purveyor and fire protection district stating that simple
connections to an existing, approved water system, will provide adequate domesric and
fire protection water to ensure the puhlic he7lth, safety and generll welfare.
16. A survey is required prior to the filing of a final plat.
C()UNTY ENGINEER'S DEPARTNIENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedicarion of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. Plans, profiles, and cross-sections as designed to County standards showing private
screet centerline and curb grades shall be submitted to the County Engineer for approval
prior to construction end/vr the filing of each final ptat; road plans to be prepared under
the direction of a licensed Professional Civil Engineer.
3. Drainage plans and design calculations showing the alignment of drainage faciliues
shall be submitted to the County Engineer for approval prior to construccion and/or the
filing of the final plat. Drainage plans co be prepared under the ciirection of a licenseci
Professional Civil Engineer.
4. The applicant should be advised that individual driveway access pemiits are requireti
prior to issuance of a building permit for driveway approaches to the County road
system.
5. Dedicaaon of 10 feet of additional right-of-way along Felts Road as depicted on the
preliminary plat.
6. Existing counry roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
7. The word "applicant" shall include the ow+ner or owners of the property, his heirs,
assigns and successors.
8. The County Engineer has designated Typical Roadway Section Number Two, Access
Sueet Standard for the improvement of Felts Road, which is adjacent to the proposed
development This will require the addition of approximately 8 to 10 feet af asphalt
along the frontage of the development. The constniction of curbing is also required.
9. The proposed private road(s) as shown on the preliminary plat serving two lots with no
extension possible is approved by the County Engineer.
10. Private road(s) shall be improved to Spokane County standard for a private road
Urban-Suburban standard serving ? lots, subject to appravul under Secdon 10.207 of
the Spakane County Fire Code.
11. All vested owcicrs shall sisn and recorci private road documents as preseribed by the
Spokane County Engineer. These doc:uments shall be reviewed and approved by the
Spokane County Engineer prior to recording with the Spokane County Auditor.
Recording numbers shall be referenc;ed in the dedicatory language of the pla(.
12. The following statement shall be placed in the plat dedication: "WAR;NING: Spokane
County has no responsibility to build, improve, maintain or ocherwise seTVice the
private roads contained within or provide service to the property described in this plat.
By accepting this plat or subsequently by allowing a building pemnit to be issued on
properry on a private road, Spokane County assumes no obligation for said private
road, and the owners hereby acknowledge that the County has no obligation of any
kind or nature whatscever to establish, examine, survey, construct, alter, repair,
irnprove, m;iintain or provide drainage or snow removal on a private road. This
requirement is and shall run with the land and shall be binding upon the nwner(s), their
heirs, successors or axsigns, inclutiing the obligation to panicipate in the maintenance
of the private road as pravided herein".

Findings of Fact Conclusions and Decision
13. The proposed plat shall be improved to t}le standards set forth in Spokane County
Board of Commissioners Resolution No. 80-1592, as nmended, which establishes
regulations for roads, appraaches, drainage and fees in new construction.
14. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the exisdng county road system warrants the
declication of additional right-of-way and the roadway improvements herein specified.
15. The following statement rraust be plac:ed in the plat ded.ication: "The private road as
shown hereon is an easement which provides a means of ingress and egress for those
lots within the plat having frontage thereon."
16. To construct the road improvements stated herein, the applicant may, with the approval
of the County Enginec:r, join in and be a willing participant in any petition or resolution
which purpose is the formation of a Road Improvement District (RID) for said
improvements, pursulnt to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanccioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavenient) will be at [he sole expense of the undersignzd owner(s), their heirs, grantees
and assigns.
17. As an alternative method of constructing the road improvements stated herein, the
applicant rnay, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the requued road improvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns.
18. The following scatement be placed in the plat dedication: "The owner(s) or successor(s)
in interest agree to authorize the Counry to place their name(s) on a petiuon for the
fonnation of a Road Improvement District (RID) by the petition method pursuant to
Chapter 36.88 RCW, which petition includes the owner(s)' property, and further not to
object, by the signing of a ballot, to the formation of an RID by the resolution method
pursuant to Chapter 36.88 RCW, which resolution iricludes the owner(s)' property. If
an RID is formed by either the petition or resolution method as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) funher agree:
(a) that the improvement(s) or construction contemplated within the proposed RID is
feasible;
(b) chat the benefits to be derived from the fonnation of the RID by the property included
therein, togecher with the amount of any County panicipation, exceed t}ie cost and
expense of formltion of the RTD; and
(c) that the properry within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized
under RCW 36.88.090, to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of an RID by either petition
or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court
the decision of the Board of County Comnussioners affirming the final assessment roU.
It is further agreed that at such time as an RID is created or any Road Improvement

COUN'TY IIEALTII DISTRICT CONUITIONS
1. The final plat shall be designed as inciicated on the preliminary plat of record and/or a.ny
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for d.istriburion by the Planning Department to the utility companies, Spokane
County Engineer and the Spokane County Health District. Written approval of the
easements by the utiliry companies must be received prior ta the submittal of the final
plaL
3. Sewage disposal method shall be as authorized by the DireCtor of Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Utilities Spokane County.
5. Watzr service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Social & Health Services.
6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
che recorded service area of the water system proposed to serve the plat.
7. Prior to filing the final plat, the sponsor shall demonsorate to the satisfaction of the
Spokane County Health District that suitable sites for on-site sewage d.isposal systems
are available on all lots.
8. Subject to specific application approval and issuance of permits by the health officer,
the use of individuul on-site sewage disposal systems may be authorized.
9. The dedicatory language of the plat will state that: "Subjeet to specific application
anproval and issuance of permits by the Health Ofricer, the use of individual on-site
sewage systems may be auchorized."
10. The ded.icatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
11. The plat dedication will contain a statement to the effect that: "The public water system,
