(a) As a condition of accentance of this plat by thQ Spokane
County P18nning Commission, no lot in this subdivision shall be
sold until such lot is furnished a domestic water supply. .
(b) All lots in this subdiviaion ehall be class.ified and known as residential lots. (c) None but new structures shall be erected upon any lot
in this sub-division. (d) Not more than one structure sha11 be erected upon any
lot, except that one detached garage shall be permitted.
(e) Only single-family dwellings shall be permitted in this
sub-division. (See exception belaw.)
(f) No residential structure shall be erected having less
than 850 squsre f eet of f loor space upon the ground f loor, exclusive of cazports, breezeways, patfos, porches or other areae
not designed for indoor living quarters.
(g) No residential structure shall be erected nearer than 30 feet to the front property line of any lot, nor any detached •
garage nearer thaR 55 feet, nor shall any residence be nearer a
side property line than 10 feet, and all other construction shall
conform in all respects to the buildi ng regulations of Spokane

nor shall any such rearrangement be permitted that will leave

less front, side or rear clearance than that outlined above. _
(1) No business, industry, or commerce shall be permitted
within this eubdivision. -
(m) As a condition of acceptance of this plat, no structure
slzall be erected upon Lot 2 in Block .5 until such time that the
oc,mer or owners shall have acquired such sdditional and adjoining
land to permit construction of a structure that will comply with
the clearances outlined above and provisions of the Spokane
County Planning Commission. Such structure may be used as a community club or civic center. (n) The covenants above relating to size and location of
structures on any lot, shall not be invoked against any structure
in this subdivision completed prior to the date of execution of this

DECISION
THIS MATTER, an application for subdivision of land, from Fatmers and Merchants Bank
received and decided upon, pursuant to Spokane County Subdivisioa regulations, on

FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide 6.8 acres into 4 lots for the development of single family
residential uses.
3. The proposal is located on the southwest corner of 4th and Pierce.
4. The current zoning of the property is AgricultiuaI Suburban. The proposed lot sizes,
frontage and intended uses are allowed within this zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development aad uses proposed are genemlly in accord with this category/designation.
b. The required public notice was provided for this proposal and agencies having a potential
interest in the project were notified and recommendations solicited.
7. A number of persons in the area commented on the proposal. The chief cancerns
expressed were that the zoning in the area not be changed without notice to property
owners in the vicinity..
8. The proposed short plat is a portion of a napproved preliminary plat known as Scarano
Addition. The decision to approve th2s short plat will invalidate the preliminary plat. The
short plat will bevome the file of record for the properry. Also, a Certificate of
Exemption was approved to create the boundary of the short plat (CE-388-89).
9. The short plat application proposes single family residential uses. The existi~ng zoning on
the property is Agricultural Suburban. the z,oning of the property will not be changed
with the application for short plat and shall remeun the same as before. The Agricultural
Suburban zone allows single family use for both conventional built and double wide
manufactured homes, duplex use is allowed on lots of 11,000 sq.ft.of area with 90 feet
of frontage on a County Road. As proposed only lot number one would be large enough
to allow a duplex, however, both existing residences on this lat would have to be
removed to place a duplex on the lot. The zoning for the propeny would require that one
of the homes located on lot one be removed.
10. The County Arterial Road Plan identifies 4th Avenue as a Collector Arterial with a 70 fooc
right of way width with the r+ecommended 10 foot dedication along 4th would require an
additional 5 feet of right of way in the futvre be set aside for this purpose. Structures
should be set back in anticipation of the needed arterial right of way.
11. Recognizing the recommended conditions and Spokane County development standards,
the proposed subdivision makes appropriate provisions for the pubiic health, safety and
general welfare and that the public use and interest wil1 be served by platting che
subdivisiort.
12. The project is exempt from environmental r+eview under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Applicadon
SP-89-608 is hereby APPROVED until January 1,1993, subject to condiaons noted
below. Most of the cond.itions of appmval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.,

property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIUNS
1. That the preliminary plat of Scarano Addition PE-1522-85 will become null and void
with the approval of this short plat
2. That one of the exisdng homes on lot 1 of the preliminary plat of record will be
removed.
3. The preliminary plat of record approval is for the pmperty legally described in the
applicadon for this proposal.
4. The Spokane County Planning Director/desigmee shall review any proposed final plat to
ensure compliance with these Findings and Conditions of Approval.
5. The preliminary plat is given cond.irional approval far three (3) years, specifically to
January 1,1993.The applicant may request an exteasion of time by submitting a written
request approximately forty-five (45) days prior to the above expuation date.
6. A final plat name/number shall be indicated before the final plat is filed, such
name/number to be approved by the Counry Planning Director/designee.
7. Appropriate road name(s) shall be indicated.
8. Appmpriate udlity easements shall be iadicated on copies of the proposed final plat.
Wntten approval of udlity easements by appropriate uality companies must be received
with the submittal of the finai plat.
9. Three (3) cuirent certificates of tide shall be fumished the County Planning Department
prior to fiL'ng the final plat.
10. The following statement shall be placed in the final plat dedicatian: "No more than one
(1) dwelling structure shall be placed on any lot, nor shall any lot be further subdivided
for the purpose of creating additional lots, ownerships or buflding sites without first
filing aad receiving approval of a replaL "
11. The final plat map shall indicate by a clear dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement that: "Side yard and rear yard setbacks shall be determined at the time
building permits are requested. The setbacks indicat+ed on this plat may be varied from
if proper zomng approvals are obtained."

12. A plan for water facilities adequate for domestic service and fue prvtecaon shall be
approved by the water purveyor, appr+opriate fire protection district, Spokane County
Build.ing & Safety Department and Spokane County Health District. The agencies will
certify on the WATER PLAN, prior to the filing of the final plat or a.ny phase of the
preliminary plat, that the plan is in conformance with their respective needs and
regulations. The WATER PLAN and certification shall be draf'ted on a transparency
suitable for reproduction and be signed by the plat sponsor.
13. The purveyor shall also certify that appropriate contractual ar,rangements and schedule
of improvements have been cnade with the plat sponsor for construction of the water
system in accordance with the approved WATER PLAN. 1'he time schedule shall
pr+ovide for completion of the water system and inspection by the appropriate health
auLhorities prior to appLcation for buildinb pe:mits within the final plat. The
I arrangements or agreements shall include a rovision holdin S okane Coun and the
purveyor hara~iess from claims by any lot pwrchaser refused a building pemvt due to
the failure of the subdivision sponsor to satisfactorily compiete the approved water
system.
14. The final plat dedication sha11 contain the following statement: "The public water
system, pursuant the WATER PLAN approved by County and State Health authorities,
the local fire protection district, County Building & Safety Department, and water
purveyor, shall be installed within this subdivision, and the subdivider/sponsor shall
provide for individual domestic water service as well as fire protection to each lot priar
to sale of each lot and prior to issuance of a building permit for each Iot."

8. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining aad participating in a County Road Project
(CR.P) to the extent of the reqwred road impmvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane Counry, the
improvements required (curb, sidewallc, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns.
9. The following statement be placed in the plat dedication: "The owner(s) or successor(s)
in interest agree to authorize the County to place their name(s) on a petiaon for the
foranation of a Road Improvement Distnct (RID) by the petition method pursuant to
Chapter 36.88 RCW, which petition includes the owner(s)' property, and further not to
object, by the signing of a ballot, to the formation of an RID by the resolution method
pursuant to Chapter 36.88 RCW, wtuch resolution includes the owner(s)' property. If
an RID is formed by either the petition or resolution method as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from the foanation of the RID by the property included
therein, together with the amount of any County participation, exceed the cost and
expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized
under RCW 36.88.090, to object to any assessment(s) on tbe properry as a result of the
improvements called for in conjunction with the formation of an RID by either petition
or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court
the decision of the Board of Counry Commissioners affircning the final assessment roll.
It is further agreed that at such rime as an RID is created or any Road Improvemeat
Project is sanctioned by Spokane County, the impravements required (curb, sidewalk,
drainage control and paving) will be at the sole expense of the undersigned owner(s),
cheir heirs, grantees and assigns without participation by Spokane Counry.
The R.ID waiver concained in this agreement shall expire after ten (10) years from the
date of execution below. However, the owner(s) or successor(s) agree that if said RID
waiver expires without construction of the required improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own expense, gay to
Spokane County the then estimated cost of the required improvements to enable the
County to complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement) providing
for or securing to the County the actual construction of the improvements.
All of the requir+ements of this agreement shall run with the land and shall be binding
upon the owner(s), their successor(s) or assiga(s).
10. The County Engineer has designated Typical Roadway Section Number two, Access
Street Standard for the improvements of 4th Avenue, which is adjacent to the proposed
development. This will require the addition of approximately 8 to 10 feet of asphalt,
curb and sidewalk along the frontage of the development. The construcdon of curbing
is also required.
11. The proposed plat shall be improved to the standards set forth in Spokane County
Board of Commissioners Resolution No. 80-1592, as amended, which establishes
regulaaons for roads, approaches, drainage and fees in new consvuction.
COUNTY HEALTH DISTRICT CONDITIONS
1. Appropriate utiliry easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County Engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the subnuttal of the final
plat.
2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
Count.
3. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to senre the plaL
4. Frior to filing the final plat, the sponsor shall demonstrate to the saasfaction of the
Spokane County Health District that suitable sites for on-site sewage d.isposal systems
are available on lots.

5. Prior co filing the final plat, the sponsor shall demonstrate to the sadsfaction of the
Spokane County Health District that the existing on-site sewage disposal system
serving the residence located on tracts l, 3, and 4 are wholly locaterl within the
boundaries of the tract.
b. Subject to specific application approval and issuance of pernnits by the health officer,
the use of (an) individual on-site sewage disposal system(s) may be authorized.
The dedicatory language of the pZat will state that: "Subject to specific applicarion
approval and issuanoe of perrnits by the Health Offcer, the use of (an) on-site sewage
system(s) may be autborized."
8. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
9. The plat dedicadon will c;oatain a staternent to the effect that: "The public water system,
as approved by County and state health authorities and the local fir+e district and
purveyor, will be installed within this plat, and the subdivider will provide for
individual domesdc water service, as well as fire protecdon, to each IoVtract prior to
sa]e of each lot/tract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resoludon No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
on compliance wnth all rules and regulations of the Spokane County Health District and
is further condidoned and subject to specific application approval and issuance of
permits by the Health District '
2. The dedicadon shall state: "The owner(s) or successor(s) in interest agree to authorize
the County to place their name(s) on a petition far the fornlation of ULID by petition
method pursuant to RCW 36.94, which the pedtion includes the owner(s)' property;
and funher not to object by the signing of a protest petition against the formation of a
ULID by resolution method pursuant to RCW Chapter 36.94 which includes the
owner(s)' property. PROVIDED this con+d.iaon shall not prohibit the owner(s) or
snccessor(s) from objecting to any assessment(s) on the praperty as a result of
improvements called for in conjuncaon with the formation of a ULID by either perition
or resolution method under RCW Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for
connecdon to future areawide collection systems."
BUILDING AND SAFETY DEPARTMEHT CONDITIONS
1. The issuance of a building pesmit by the Department of Building and Safety is required.
2. Requirements of F'ue District No. 1 need to be sadsfied during the building pernzit
process.
