BEFORE THE SPOKANE COUNTY PLANNING DEPARTMENT
IN THE MATTER OF ) FINDINGS OF FACT,
SHORT PLAT NO. SP-613-89 ) CONCLUSIONS AND
DECISION
THLS MATTER, an application for subdivision of land, from Harold Biggs has been
received and decided upon, pursuant to Spokane County Subd.ivision regulations, on the
day of February, 1990.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing bclow has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The propasal is to divide approximat+ely 6.5 acres into 31ots. The property is currendy
developed with office, storage, and manufacturing uses.
3. The pmposal is located on the northwest corner of Broadway and Fancher.
4. The current zoning of the property is M.anufacturing with Aquifer Sensitive Area Overlay
Zone. The proposed lot sius, frontage and intended uses are allowed within this zone.
5. The Spokane Couaty Comprehensive Plan designates this area as Industrial. The
development and used propused are generally in accord with this category: The proposed
shart plat requests division of existing developmenL Tract "A" of the prehminary short
plat of record has an existing office building. Tract "B" has frontage along Broadway
Avenue, and has three (3) exi.sting structores. Building #6 and building #5 both have
non-conforrning 5etbacks; approxi.mately 13 feet for front yard setbacks on building #6
and approximately ZO feet for fronryard, a setback on building #S (Setbacks required
today for new structures on Tract "B" would be 35 feet from the property line). Tract
"C" would bave frontage and access easement to Lake Road. the creadon of Tract "C"
would create a non-conforming front yard setback of 20 feet for existing structure called
building #4.
6. Based on curreat parldng standards Tract "A" wouid require 34 parldng spaces for office
use. Based on current parldng standards and uses Tract "B" parldng r+equirements are
estimated to be appmximately 38 parldng spaces. the proposed covered storage areas
would require 9 additional parldng spaces. Tract "C" based on Industrial use of Building
#4's 32,000 sq. ft. would require 80 parking spaces.
7. Both Broadway aad Fancher roads are indicated on the Comprehensive Plan as Principal
Arterials which if fully unplemented would impact Tract "A" and 'I'ract "B" of the short
plat requiring 20 feet of road dedicatioa and 35 foot setbacks measured from and in
addition to the 20 foot dedication. The County Engineer has r+eviewed the proposal and
has not recommended any further dedicadon on either Broadway or Fancher. Since
several of the existing buildings on site alneady encroach on setbacks along Broadway
and La►ke Road oely new structures would be required to meet frontyard setbacks. In the
Manufacturing Zone, frontyani setbacks are 35 feet or 65 feet from centerline of road
right-of-way. Only Tract "A" cwrrently meets setback requirements with existing right-of-
way, A approximately 40 foot setback exists oa Fancher road and approximately 20 feet
on Broadway. New structures on Tract "A" would be required to meet 35 foot and 20
foot setbacks respectively for manufacturing zoning. Both Broadway Avenue and
Fancher Roaa are improveri 41ane roads. Any fu.rther expansion of the right-of-way will
be very expensive for this section of Broadway and Fancher, as many improvements
exist in this property and in the vic'uiity.
8. The requireri public notice was provided for this proposal and agencies having a potential
interest in the project were nodfied and recommendations solicited.
9. No one in the area commented oa the proposal.
10. Recognizing the recommended conditions and Spokane County development standards,
the proposed subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
11. The project is exempt from environmental review under the State Envinonmental Policy
Act pursuant to WAC 197-11-800 (6) (a).

DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-613-89 is hereby APPROVED until February 1,1993, subject to conditions noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalizadon of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, 6eirs, assigns or any successors-in-iaterest to property.
PLANNING DEPARTMENT CONDITIONS
1. The final plat shall be designed substandally in oonfomnance with the proelirninary plat
of record as legally described and advertised. No increase of density or lot number
shall oocur without a new application submittal and approval.
2. The pre Eminary plat is given conditional approval for three (3) years, specifically to
February 1,1993.1he applicant may request an extension of time by submitting a
written request appmximately forty-five (45) days prior to the above expiradon date.
3. Any new development on the short plat shall comply with current zoning which is
Manufacairing and Aquifer Sensitive Overlay Zone.
4. APPI'oPriate road aaaae(s) shall be indicated.
' S. Appmpri.ate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies must be received
with the submittal of the fuial plat,
6. Three (3) cuirent certificaves of tide shall be fiunished the County Planning Departmcnt
prior to filing the final plat
7. The final plat map shall indicate by a clear dashed line the required yard setbacks from
all privace, "Tract X" or public roads. The dedication shall contain the following
statement that: "Side yard snd rear yard setbacks shall be deterinined at the time
building penmits are requested. The setbacks indicated on this plat may be varied from
if proper zoning approvals are obtained."
8. 5 feet of future aoquisition area far road right-of-way and utilities, in addition existing
right-af-way along Fancher Road shall be shown on the final plat along with a 35 foot
building setback measuned from the eastern edge of the acquisition area. If Tract A is
incorporated inLD property to the north a title noace shall be filed with the County
Auditor for Tract "A" in regard to the above limitations.
9. Frontyard setback on Broadway and Lake Road shall be 35 feet from propercy and shall
be indicated as stated in condition #6. Above setback is for new structures only
existing buildings as shown on the plat of record shaU have non-conforming setbacks
Building #4,5 & 6.
10. Prior to final plat approval by the county approval from the City of Spokane Public
Works for adequate water sesvice to each parcel shall be required.
11. A survey is required prior to the filing of a final plat
12. Any phased finalization of the short plat shall roquire approval by the Planning
Depardment and agencies who have Cond.itions of Approval attached to this short plat.
13. Prior t,o any finalization of the short plat, a Parldng Plan showing the number and
locarion of parldng stalls in oompliance with the parking standards of the zone shall be
submitted and approved by the Planning Department.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
i. The applicant should be advised that individual driveway access pennits ar+e nequined
prior to issuance of a building pernut for driveway approaches to the County road
system.

2. Existing county roads pivvid.ing direct access to the plat shall be paved and curbed to
Spokane County standards.
3. The word "applicant" shall iaclude the owner or owners of the property, his heus,
assigns and successors.
4. To canstruct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing pardcipant in any petidon or resoluaon
which purpose is the foimation of a Road Improvement District (RID) for said
improvements, pursuant to RC"vV 30.88, as amended. At such time as an RID is
created or any Road Improvement Project is sancrioned by Spokane Counry, the
improvements required (curb, sidewalk, drainage control aad paving to existing
pavement) will be at the sole expease of the undersigned owner(s), their heirs, grantees
and assigns.
5. As an alternative method of construcdng the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required road improvements. At such time as an RID is
creaced or any Road Improvement Project is sanctioned by Spokane County, the
irnpmvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns.
6. The following statement be placed in the plat dedication: "The owner(s) or successor(s)
in interest agree tn authorize the County to place their nwme(s) on a pedtion for the
fonnation of a R,oad Improvement District (RID) by the petition method pursuant to
Chapter 36.88 RCW, which peddon includes the owner(s)' property, and further not to
object, by the signing of a ballot, to the formadon of an RID by the resolution method
pursuant oo Chapter 36.88 RCW, which resolution includes the owner(s)' property. If
an RID is fornaed by either the petition or resolution method as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construcdon contemplated within the pmposed RID is
feasible;
(b) that the benefits to be derived from the formation of the RID by the property included
therein, together with the amount of any County participation, exceed the cost and
expense of fannation of the RID; and
(c) that the property within the proposed RID is sufficiendy developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized
under RCW 36.88.090, to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of aa RID by either petition
or resoludon method under Chapter 36.88 RCW, and to appeal to the Superior Court
the decision of the Board of County Commissioners alffirming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the improvements required (curb, sidewalk,
drainage control and paving) will be at the sole expense of the undersigned owner(s),
their heirs, grantees and assigns without participadon by Spokane Couaty.
The RID waiver contained in this agreement shall expire after ten (10) years from the
dat,e of execution below. However, the owner(s) or successor(s) agree that if said R.ID
waiver expires without construcdon of the required unprovements, the owner(s) or
successor(s) agree to construct the required 'unprovements at tneir own expense, pay to
Spokane County the then estimated cost of the required improvements to enable the
County to complete the same, or fumish a bond or other secure method suitable to the
Counry (which may include the execudon of another ItID waiver agreement) providing
for or securing to the County the actual construcdoa of the i,nprovements.
All of the requirements of this agreement shall run with the land and shall be binding
upon the owner(s), their successor(s) or assign(s).
7. The County Engineer has designated Typical Roadway Secdon Number one Access
Street Standard for the improvement of Lake Road, which is adjacent to the proposed
developmenL This will require the addition of approximately ZO to 30 feet of asphalt,
along the frontage of the development The construcdon of curbing and sidewalk is
also required.

8. The proposed plat shall be unproved tv the standards set forth in Spokane County
Board of Comanissioners Resoludon No. 80-1592, as amended, which establishes
reguladons for roads, approaches, drainage and fees in new construction.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shaU be designed as indicated on the preliminary plat of record andlor any
attached sheets as notied.
2. Appropriate utility easements shall be ind.icated on copies of the preliminary plat of
reconi for distribudon by the Planning Department to the utility companies, Spokane
County Engineer aad the Spokane County Health I?istrict. Written approval of the
easements by the utility companies must be received prior to tbe submittal of the final
plac.
3. A combined surface water and sewage dispasal detailed plan shall be approved by the
County Engineer and the Spokane County Health District prior to the issuance of any
building permit for this projecL
4. Prior tio filing the final plat, the sponsor shall pmesent evidence that the plat lies within
the recorded service area of the water system pr+oposed to seive the plaL
5. Disposal of sewage effluent beneath paved surfaces is cuirently prohibited.
6. Prior to filing the final plat, the spoasor shall demonstrate to the satisfaction of the
Spok,ane County Health District that the e3dsang on-site sewage disposal systems
serviag the structures located on all tracts are wholly located within boundaries of the
tract.
7. Subject to specific application approval and issuance of pennits by the health officer,
the use of (an) individual on-site sewage d.isgosal system(s) may be authorized.
8. The dedicatory langua►ge of the plat will state that: "Subject to specific application
approval and issuance of permits by the Health Off'icer, the use of (an) on-site sewage
system(s) may be authorized."
9. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
10. The plat dedication will contain a statemeat to the effect that: "The public water system,
as approved by Counry and state health authorities and the local fire district and
purveyor, will be installed within this plat, and the subdivider will provide for
individual domestic water service, as well as Sre protection, to each tract prior to sale of
each tract."
COUNTY UTII.TTIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorizadon is conditioned
on compliance with all rules and regulations of the Spokane County Health District and
is further coadidoned and subject to specific application approval and issuance of
permits by the Health DistricG
2. The dedication shall state: "The owner(s) or successor(s) in interest agree to authorize
the Counry to place their name(s) on a petition for the formation of ULID by petition
method pursuant to RCW 36.94, which the petition includes the owner(s)' groperty;
and further not to object by che signing of a protest petition against the fonnation of a
ULID by resolution method pursuant to RCW Chapter 36.94 which includes the
owner(s)' property. PROVIDED this condition shall not prohibit the owner(s) or
successor(s) from objecting to any assessment(s) on the property as a result of
improvements called for in conjuncdon with the fomiation of a ULID by either petition
or resolution method under RCW Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for
connection to future areawide collection systems."
BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. The applicant shall contact the Department of Building and Safety at the earliest possible
stage of design/development in order tio be informed of Code requuements
administered/enforced by the deparmaent, e.g., State Building Code Act regularions
such as requirements for fire hydrantlflow, fire apparatus access roads, street address
assignment, barrier-free reguladons, energy code regulations, and general coord.inarion
with other aspects of project implementation.
2. The applicant needs to contact Ken 3effreys (456-3675) to discuss yard separations and
building construction types.
SPOKANE CTTY PUBLIC WORKS DEPARTMENT
1. That the applicant sign an L.I.D. petition for sewer service to this site prior to Final
Short Plat appmvaL This would obligate the site to participate in any future L.I.D.
whicb would be foraaed to bring sewer seivice to this area.
2. Prior to F'uial Short Plat appraval that each parcel have its own domesdc water seavice
and meet aay azid all fire protection requirements as deemed necessary by the local fire
departmenL If additional mains with hydrdnts aze required than what pmesendy exists to
accomplish this, the applicant would have to secure the installation of these facilities.
