DECISION
THIS MATTER, an application for subd,ivisian of land, from Richard Eastman has been '
T4jZed and decided upon, ptusuant to Spokane County Subdivision regulations, on the
day af February, 1990.
FIND
INGS OF FACT AND C4NCLUSIONS
1. The individual signing bclow has further been properly delegated the responsibility for
rendering the decWon by the Spokane County Director of Planning.
2. The proposal is to divide 30,000 square ft. into 2 lots for the development of single
family residential.
3. The proposal is located adjacent tv and east of Greeoacres road about 300 ft, north of the
intersection of Missioa and Greenacrres in Secdon 7, Township ZS N, Range 45 EWM.
4, The current zoning of the property is Agricultural. The proposed loi sizes, frontage and
intended uses are allowed within this zone. The Agricultural Zone requires 100 ft. of
frontage and 12,500 ft. of lot area.
5. Tbe Spokane County Comprehensive Plan desigpates this area as Urban. The
development and uses proposed are generally in accord with this category/designation. A
small strip of pmperty is located along Mission Avenue, a Minor Arterial on the Arterial
Road Plan.
6. The requireci public nodce was provided for this proposal and agencies having a potential
interest in the project were notified and reconunendadons solicited.

7. No one in the area commented on the proposal.
g. Recognizing the recommended conditions and Spokane County development standards,
the proposed subdivisioa makes appropriate pravisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
9. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197• 11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP 616-90 is hereby APPROVED until March 1, 1993, subject to conditions noted
betow. Most of the cond.itions of appr+aval shall be accomplished by the applicant andlor
sponsor prior to finalizadon of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. The final plat shall be designed substantially in confoanance with the preliminary plat
of record as legally d+cscribed and advertised. No increase of densiry or lot number
shall occur without a new application subnv.ttal and approval.
2. The preliminary plat is given conditional approval for three (3) years, specifically to
M,arch 1,1993.The applicant may request an extension of time by submimng a written
request approx,imately forty-five (45) days prior to the above expiration date.

3. Appropriate utiliry easements shall be indicated on copies of the proposed finat plat.
Written apgroval of utility easements by appropriate utility companies must be received
with the submittal of the final plat.
4. Three (3) current certificates of tide shall be furnished the County Planning Degartment
prior to filing the final plaL
5. The following statement shall be piaced in the final plat dedication: "No more than one
(1) dwelling structuurree shall be placed on any Iot, nor shall any Iot be further subdivided for the puipose of creating additional lots, ownerships or building sites without first
filing and receiving approval of a replat."
6. The final plat map shall indicate by a clear dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement that: "Side yard and rear yard setbacks shall be determined at the time
building perrmits are reqnested. The setbacks ind.icated on this pIat may be varied from
if proper zoning approvals are obtained."
7. A survey is required prior to the filing of a final plaL
8• Approval from the water purveyor Consolidated Irrigatian district is needed prior to
Final Plat appmval,
9. 10 feet of future acquisition area for road right of-way and udlities, in additian to the
euisting right-of-way dedication required by the County Engineer, aiong Mission shall
be shown on the final plat map and the fiaal plat dedication shall state: The 10 fL Future
Acquisition Area, until acquired by Spokane County, shall be private property and may
be used as allowed in the zone, except any improvements (such as landscaping,
parking, surface drainage, dra.infields, signs or others) shall be considered "interim"
uses.
The property owaer shall be responsible for relocating such "interim" impmvements at
the time Spokane County makes roadway improvements after acquiring said Future
Acquisidon Area
CC)UNTY ENGINEER'S DEPARTMENT CONDITIONS
1. 'The conditional approval of the plat is given by the County Engineer is given subject to
dedication of right-of-way
2. Dedication of 5 fL of additional right-of-way along Greenacres Rd.
3. Existing county rnads pnovid.ing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
4. The word "a licant" shall include the owner or owners of the PraP~Y>
PP his heirs>
assigns and successors.
5. To construct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any pedtion or resoludon
which purpose is the formadon of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such dme as an RID is
created or any Road Improvement Project is sanctioned by Spokane Counry, the
improvements required (curb, sidewalk, drainage control and paving to euisting
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns.
6. As an alternative method of constructing the road unprovements stated herein, the
applicanc may, with the appnoval of the County Engineer, accomplish the road
improvernents stated herein by joining and participating in a County Road Project
(CRP) to the extent of the requued road 'un ruvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane Counry, the
improvements required (curb, sidewallc, drainage control and paving to existing
pavement) will be at the sole expense of che undersigaed owner(s), their heirs, grantees
and assigns.
7. The foilowing statement be ptaced in the plat dedication: "The owner(s) or successor(s)
in interest agree to authorize the County to place their name(s) on a petiaon for the
forniation of a Road Improvement District (RID) by the petition methai pursuant to
Chapter 36.88 RCW, which petition includes the owner(s)' property, and further not to
object, by the signing of a ballot, to the form.ation of an RID by the resolution method
. ~
pursuant to Chapter 36.88 RCW, which resoiution includes the owner(s)' property. If
an RID is formed by either the perition or resoludon method as provided for ia Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construction contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from the farmatioa of the RID by the property included
therein, together with the amount of any County participation, exceed the cost and '
expense of foimation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized
under RCW 36.88.090, to object to any assessment(s) on the property as a result of the
improvements called for in conjuncdon with the fortnation of an RID by either pedtion
or resoludon acethod under Chapter 36.88 RCW, and to appeal to the Superior Court
the decision of the 8oard of Counry Commissioners a1Efirm'ing the final assessment m1I.
It is further agreed that at such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the unprovements required (curb, sidewalk,
dminage conmol and paving) will be at the sole expense of the undersigneti owner(s),
their heirs, grantees and assigns without participaaon by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execudon below. However, the owner(s) or successor(s) agree that if said RID
waiver expires without conswction of the required improvements, the owner(s) or
successor(s) agree to construct tlie required improvements at their own expense, pay to
Spokane County the then estunated cost of the requined imprnvements to enable the
County to complete the same, ar furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement) providing
for or securing to the County the actual construction of the unprovements.
All of the requirements of this agreement shall iun with the land and shall be binding
upon the owner(s), their successar(s) or assign(s).
8. The Counry Engineer has designated Typical Roadway Secrion Number Two Access
Street Hazard standard for the unpmvement of Greenacres Road, which is adjacent to
the proposed-Zevelopment This will require the addition of approximately 8 to 10 feet
of asphalt along the frontage of the development, The construcdon of curbing is also
requined. The County Engineer has designated Typical Roadway Section Number Two
Secondary Arterial Standard for the unprovements of Mission Avenue, which is
adjacenc to the proposed development. This will require the add.ition of approximately
12 to 14 feet of asphalt,along the frontage of the development. The construcaon of
curbirig and sidewallc is also required.
9. The praposed plat shall be improved to the standards set forth in Spokane County
Board of Commissioners Resolution No. 80• 1592, as amended, which establishes
regulations for roads, approaches, drainage and fees in new construction.
10. The County Engineer has examined this develapment proposal and has determined that
the impact of this proposal upvn the existing county road system wamants the
dedication of additional right-of-way and the roadway improvements herein specified.
11. The County Arterial Road plan identifies Mission Ay&= as a Minor Arterial. The
~ existing right of way width of fO fL is not consistent with that specified in the plan. In
order to implement the Arterial Road Plan it is recommended that in addidon to the
required right of way dedication, a strip of property $ fL in width along the Mission
Avenue frontage be set aside in reserve. This praperty may be acquired by Spokane
Counry at the tinne when Arterial Improvements are made to Mission Avenue.
CC) UNTY HEALTH DISTRICT CONDITIONS
1. Appropriate utility easements shall be indicated on copies af the preliminary piat of
record for distribution by the Planning Department to the utility companies, Spokane
County Engiueer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
2. Prior to fding the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat,

3. Prior to filing the final plat, the sponsor shall demonstrate tio the sarisfaction of the
Spokane Counry Health District that a suitable site for on-site sewage disgosal systems
are available on nrarct A.
4. Prior to filing the final plat, the sponsor shall demonstrate to the sadsfaction of the
Spokane County Health District that the existing on-site sewage disposal systern
serving the residence located on Tract B is wholly located within the boundaries of the
tract. •
5. Subject to specific application approval aad issuance of permits by the health officer,
the use of (an) individual on-site sewage disposal system(s) may be authorized.
6. The dedicatory language of the plat will state that: "Subject to specific application
approval and issuance of permits by the Health Officer, the use of (an) on-site sewage
system(s) may be authorized,"
7. 1'he dedicat,ory language on the plat shall state: "Use of private wells and water
systems is prohibited."
8. The plat dedication will contain a statement to the effect that: "'I'he public water system,
as approved by County and state health authorities and the local fire distnct and
purveyor, will be installed within this plat, and the subdivider will provide for
individual domesdc water service, as well as fire protecdon, to each tract prior to sale of
each tract."
CUUNTY UTILITIES DEPARTMENT CONDITIONS
1. The Planning Director/designee shall approve a specific exterior lighting plan for the
approved area prior to installation of such lighting. (Such plan shall attempt to confine
~ illum.ination to the area with full consideration to adjacent properties).
2. No free-stand.ing sign on the premises shaU exceed forty (40) square feet in area or
thirty-five (35) feet in height. All signs may be illuminated provided that they shall not
be animated nor flashing and shall be of low intensity, not exceeding the equivalent of
four hundred twenty-five (425) milliamperes fluorescent tubing behind plexiface,
spaced on seven (7) inch or more centers, or of exposed neon not exceeding thirty (30)
milliamperes.
3. Approval is required by the Planning Director/designee of a specific lighting and
signing pian for the described property prior to the release of any building permits.
4. The applicant shall develop subject property generally in accordance within the concept
presented to the Hearing Examiner Committee. Vanations, when approved by the
Planning Director/designee, will be permitted, including, but aot limited to the
following changes: building location, landscape plans, and general allowable uses of
the permitted zone. All variations must conform to regulations set forth in the
ZONIlVG CODE FOR SPOKANE COUNTY. The onginal intent of the development
plans shall be maincained.
BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. We have no requirements for this proposal - existing conditions.
