StiORT PLAT NO. SP-618-90 ) CONCLUSIONS AND
ROBERT MALLOY DECISION
THIS MATTER, an application for subdivision of land, from Robert Malloy has been
recei~yred and decided upon, pursuant to Spokane County Subdivision regulations, on the
~ ~s day of March, 1990.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibiliry for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide 3.92 acres into 21ots for the development of single family
residence.
3. The proposal is located on the south east corner of Blake road and 20th Avenue.
4. The current zoning of the propeny is Agricultural. The proposed lot sizes, frontage and
intended uses are allowed within this zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are generally in accord with this category/designation.
6. The required public nodce was provided for this proposal and agencies having a potential
interest in the project were notified and recommendations solicited.
7. No one in the area commented on the pmposal.
8. Neither adjacent roadway is designated as an arterial
9. Parcel "A" falls within the proposed Wolf Crest U.L.I.D. with sewer construction
expected to begin in 1991. Parcel "B" falls within the proposed Mountain View
U.L.I.D. with sewer construcdon expected to begin in 1992.
10. Recognizing the recommended condidons and Spokane County development standards,
che proposed subdivision makes appropriate provisions for the public health, safety aad
general welfare and that the public use and interest will be served by platting the
subdivision.
11. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-618-90 is hereby APPROVED until April 1, 1993, subject to conditions noted
below. Most of the conditions of approval shall be accomplished by the applicant andlor
sponsor prior to finalizadon of the short subd.ivision. This decision is final unless
appealed in wzitin~„ corsistent ~~zth adop:~ appeal Frocedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, beirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITION
1. The specific development plan will be submitted for Planning Department review and
approval prior to issuance of building perrruts.
2. Any division of land for the purpose of sale, lease or transfer, shall comply with RCW
58.17 and the Spokane County Platting Ordinances prior to issuance of bu'ding
permits.
3. The preliminary plat of rocord approval is for the property legally described in the
applicaaon for this proposal.
4. The final plat shall be designed substantially in conformance with the preliminary plat
of record as legally described and advertised. No increase of density or lot number shall ocxur without a new applicadon submittaZ and approval.
5. The Spokane County Planning Director/designee shall review any prnposed final plat to ~
ensure compliance with these Findings and Cond.itions of Approval.
6. The preliminary plat is given condiaonal approval for three (3) years, specifically to
Apri1.1,1993. The applicant may request an extension of time by submitting a written
request approximately fortyfive (45) days prior to the above expiration date.
7. A final plat number shall be indicated before the final plat is filed, such number to be
approved by the County Planning Director/designee.
8. Appropriate road name(s) shall be ind.icated.
9• Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utility easements by appropnate utility companies must be received
with the submictal of the final plat.
10. Three (3) current certificates of tide shall be furnished the County Planning Department
prior to filing the final plat
11. The following statement shall be placed in the final plat dedicadon: "No more than one
(1) dwelling structure shall be placed on any lot, nor shall any lot be further subdivided
for the purpose of creating additional lots, ownerships or building sites without first
filing and receiving approval of a rcplat"
12. No water plan is required and a simple tap is needed at the rime of building permit
release.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The condidonal approval of the plat is given by the County Engineer subject to
dedication of right-of-way.
2. The applicant should be advised that individual driveway access permits are required
prior to issuance of a building pernut for driveway approaches to the county road
system.
3. Dedication of S fL of additional right-of-way along 20th Avenue and a 20 ft. radius at
20th Avenue and Blake Road
4. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
5. To canstruct the raad unprovements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any peddon or resolution
which purpose is the formadon of a Road Improvement I}isorict (RID) for said
impmvements, pursuant to RCW 36.88, as amended. At such time as an RID is
cneated or any Road Improvement Project is sanctioned by Spokane County, the
impravements requirred (curb, sidewalk, dra.inage control and paving to existing
pavement) vwill br at tshe sole expense of the e:ndersigned o%vr.er(s), their heirs, grancees
and assigns.
6. As an alternative method of construcdng the road improvements srated herein, the
applicant may, with the approval of the Counry Engineer, accomplish the road
improvements stated herein by joining and participating in a Caunty Road Project
(CR.P) to the extent of the requued road improvements. At such time as an RID is
created or any Road Improvement Project is sancrioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns.
7. The following statement be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of a Road Improvement I?istrict (RID) by the
~
petition method pursuant to Chapter 36.88 RCW, wluch petition includes the owner(s)'
property, and further not to object, by the signing of a ballot, to the formation of an
RID by the resolution method pursuant to Chapter 36.88 RCW, which resoludon
includes the owner(s)' property. If an RID is fomed by either the pedtion or resolution
method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further
agre,e:
(a) that the improvement(s) or Construction contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from the fornaation of the RID by the property
included therein, together with the amount of any County participation, exceed the
cost and expense of formadoa of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized
under RCW 36.88.090, to object to any assessment(s) on the properry as a result of the
improvemenis called for in conjuncaon with the formadon of an RID by either petition
or resoludon method under Chapter 36.88 RCW, and to appeal to tbe Superior Court
the decision of the Board of County Commissioners affirming the final assessment roll.
It is further agreed duat at such time as an RID is created or any Road Improvement
Froject is sancdoned by Spokane County, the improvements required (curb, sidewalk,
drainage control and paving) will be at the sole expense of the undersigned owner(s),
their heirs, grantees and assigns without participation by Spokane County.
The RID waiver contained in this agrmment shall expire after ten (10) years from the
date of execution below. However, the owner(s) or successor(s) agree that if said RID
waiver expires without construcdoa of the required improvements, the owner(s) or
successor(s) agree to construct the required improvements at their own expense, pay to
Spokane County the then esdmated cost of the required imprnvements to enable the
County to complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreenzent) providing
for or securing to the County the actual construcdon of the improvements.
All of the requirements of this agreement shall nin with the land and shall be binding
upon the owner(s), their successor(s) or assign(s).
g. The County Engineer has designated Typical Roadway Secrion Number two, Access
Screet stand.ard for the unprovement of 20th, which is adjacent to the proposed
developmenc Tlis will require the addition of approximately 8 to 12 feet of asphalt
along the frontage of the development, The construcdon of curbing and sidewalk is
also required.
9. The proposed subd.ivision shall be improved to the staadards set forth in Spokane
County Board of Commissioners Resoludon No. 80-1592, as amended, which
resolution establishes regulaaons for roads, approaches, drainage and fecs in new
construction.
10. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
dedicadon of additional right-of-way and the roadway improvements herein specified.
11. This plat or development prvposal is located within a dra.inage basin which has been
idendfied by the Spokane County Engineer's office as having stormwater runoff
problems. Since this propose3 subdivision or development proposal is affected by or
is a contributor to stormwater flows, property owners should participate in the planning
and implementaaon of a future basinwide stormwater management system. The
following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to join in any Counry-approved
stormwater management program and to pay such rates and charges as may be fixed
through public hearings for service or benefit obta.ined by the planning, design,
construcdng, maintaining or operaaon of stormwater control facilities."
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Deparnnent to the udlity companies, Spokane
County Engineer and the Spokane County Health DistricL Written approval of the
easemnts by the utility companies must be received prior to the subrruttal of the final
plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated througb the Director of Udlides, Spokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Social & Health Services.
6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plaL
Prior to filing the final plat, the sponsor shall demonstrate to the satisfacdon of the
Spokane County Health District that a suita►ble site for an on-site sewage disposal
system is availabte oa tract A.
8. .Prior to filing the final plat, the sponsor shall demonstrate tio the satisfaction of the
Spoka►ne County Health District that the existing on-site sewage disposal system
serving the residence located on Tract B is wholly located within the boundaries of the
tract.
9. Subject to specific application approval and issuance of permits by the health officer,
the use of individual on-site sewage disposal systems may be authorized.
10. The ded.icatory language of the plat will state that: "Subject tio specific applicadon
approval and issuance of pernits by the Health Officer, the use of (an) on-site sewage
system(s) may be autborized."
11. The dedicatDry language on che plat shall state: "Use of private wells and water
systems is prohibited."
12. The plat dedication will contain a statement to the effect that: "The public water system,
as approved by County and state health authorities aad the local fine district and
purveyor, wiU be installed within this plat, and the subdivider will provide for
individual domesdc water service, as well as fire protection, to each lot/tiract prior to
sale of each loVtract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Comrnissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is cond.itioned
on compliance with all rules and reguladons of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
pennits by the Health DistricL
2. The dedication shall state: "The owner(s) or suvicessor(s) in interest agree to authorize
the County to place their name(s) on a petidon for the formadon of ULID by peddon
method pursuant to RCW 36.94, which the petition includes the owner(s)' property;
and further not to object by the signing of a protest pedtion against the fonnaaon of a
ULID by resoluaon method pursuant to RCW Chapter 36.94 which includes the
owner(s)' property. PROVIDED this conditioa shall not prohibit the owner(s) or
successor(s) from objecring to any assessment(s) on the property as a result of
unprovements called for in conjuncdon with the formation of a ULID by either petition
or resolution method under RCW Chapter 36.94."
3. Any water service for this project sball be provided in accordance with the Coord.inated
Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for
connection to future areawide collection systems."
