BEFORE THE SPOKANE COUNTY PLANNING DEPARTMENT
IN THE MATTER OF ) FINDINGS OF FACT,
SHORT PLAT NO. SP-619-90 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for subdivision of land, fram Richard C. Behm Jr. has been
rece'ved and decided upon, pursuant to k Spo ane County Subdivision regulaaons, on the
.~Z~'' day of February, 1990.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been psoperly delegated the responsibility for ~
rendering the decision by the Spokane County Director of Planning.
I
2. The proposal is to divide approximately 3 acres into 41ots fvr the development of three
single family residenoes, and to retain an existing church. ~
3. The pmposal is locaood at the northeast corner of Pines Road and 26th Avenue, in the
SW1/4 of Section 27, Township 25, Range 44 EWM.
4. The current zoning of the property is Agricultural Suburban. The proposed Iot sizes,
frontage and intended uses are allowed within this zone.
5. The Spokane County Comprehensive Plan designates tlus area as Urban. The
development and uses proposed are generally in accord with this category. ~
6. The required public notice was provided for this pmposal and agencies having a potential
interest in the project were nodfied and recommendations solicited.
7. No area prnperty owners comznented on the proposed Short Plat.
8. The Spokane County Arterial Road Plan ideutifies Pines Road as a Minor Arterial. The
existing right of way width is not consistent with that specified in said pla.n. To implement
the Arterial Road Plan, it is recommended that in addidon to the roquired right-of-way
dedication, a strip of property 8 fL in width along the Pines Rd. frontage be set aside in
reserve as a future acquisition area.
9. Recognizing the recommended cond.itions and Spokane County development standards,
the proposed subdivision makes appropriate provisions for the public health, safery and
general welfare and that the public use and interest will be served by platring the
~ subd.ivision.
10. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-1 I-800 (6) (a).
DECISION
Sased upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-619-90 is hereby APPROvED until March 1, 1993, subject to conditions noted
below. Most of the condidons of approval shall be accomplished by the appticant and/or
sponsor prior to finalization of the short subdivision. This deciSion is final unless
appealed in wridng, consistent with adopted appeal prvicedures.
These Conditions of Approvai apply to applicant(s), owner(s) of the
property, heirs, assigns or any successars-in•interest to property.
PLANNING DEPARTMENT CONDITIONS
1. The preliminary plat of record approval is for the property legally described in the
application for this proposal.
2. The final plat shatl be designed substandally in conforniance with the preliminary plat
of record as Iegally described and advertised. No increase of density or lot number
shall occur without a new application submittal aad approval.
3. The Spokane County Planning Director/designee shall review any proposed final plat to
ensure compliance with these Findings and Cond.itions of Approval.
4. The pneliminary plat is given conditional approval for three (3) years, specifically to I
March 1,1993. The applicant may request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.

5. Appropriate utility easements shall be indicated on copies of the proposed finel piat.
Written approval of utility easements by appropriate utility companies must be received
with the submittal of the fir►a1 plat.
6. Three (3) current certificates of title shall be furnished the County Planning Deparnnent
prior to filing the final ptat.
7. The following statement shall be placed in the finai plat dedication: "No more than one
(1) dwelling structure shall b►e placed oa any lot, nar shall any Iot be further subdivided
for the purpose of creating addidonal lots, ownerships or building sites without first
filing and reaeiving approval of a replat"
8. The final plat map shall indicate by a clear dashed liae the required yard setbacks from
a11 private, "Tract X" or public roads. The dedication shall contain the following
staternent that: "Side yard and rear yard setlacks shall be deterrnined at the dme
building percnits are r+equesied. The setbacks indicated on this plat may be varieti from
if proper zoning appmvals are obtained.,"
9. A swrvey is required prior to the fiIing of a final plaL
10. Spokane County Planaing Department is required to record with the County Auditor a
"Title Nodce," as prepaned and signed by the applicant, for a future acquisidon area for
road right-of-way and utilities to run with the land, and the future acquisibon area
reservation shall not be removed without prior approval by the Spokane County
Planning Department Notice shall be recorded pnor to the issuance of a builduig
pernut and shall provide the following:
a. 8 feet af future acquisition area for road right-of-way and utilides, in addition to the
existing right-of-way dedication required by the County Engineer, along Pines Road.
b. Building and other setbacks required by the Spokane County Zoning Code shall be
measured 25 ft. from the easterly edge of the Future Acquisition Area that is reserved
for road right-of-way and utiiities along Pines Road.
c. The following minimum improvements necessary to support the use within the zone
classification as required by the Spokane County Zoning Cade standards shall not be
lacated within the Future Acquisitian Area.
1. i.andscaping
2. Surface drainage
3. Drainfields
4. Parking
5. Other
d. The 8 ft. Future Acquisirion Area, undl acquired by Spokane County, sball be private
property and may be used as allowed in the zone, except any unprovements (sueh as
landscaping, parking, surface drainage, drainfields, signs or others) shall be considered
"interim" uses.
The property owner shall be responsible for relocating such "interim" unprovements at
the time Spokane County makes roadway improvements after acquiring said Future
Acquisition Ar+ea,
e. This "Title Nodce" shall be signed by the applicant to serve as official notice and
acknowledgement of said Future Acquisition Area for road right-of-way and utilities.
11. A plan for water facilides adequate for domestic service and fire protecdon shall be
approved by the water purveyor, appropriate fire protecdon d.istrict, Spokane County
Building & Safety Department and Spokane County Health DistncL The agencies will
cera.fy on the WATER PLAN, prior to the filing of the final plat or any phase of the
preliminary plat, that the ptan is in copformance with their r+especave needs and
regulations. The WATER PLAN and certification shall be drafted on a trsnsparency
suitable for reproducdon and be signed by the plat sponsor.
12. The purveyor shall also certify that appropriate contmctual anangements and schedule
of improvements have been made with the plat sponsor for construcdon of the water
system in accordaince with the approved WATER PLAN. The time schedule shall
provide for completion of the water system and inspection by the appropriate health
authorities prior to applicadon for building pernnits within the final plat. The
an angements or agreements shall include a provision holding Spokane County and the
pun►eyor harmless from claims by any lot purchaser refused a building permit due to
the failure of the subdivision spansor to sadsfactorily complete the approved water
system.
13. The final plat dedication shall coatain the following statement: "The public water
system, pursuant the WA1'ER PLAN approved by County and State Health authorides,
the local fire protecdon district, Counry Building 8t Safety Department, and water
purveyor, shall be installed within this subdivision, and the subdivider/sponsor shall
provide for individual domesac water service as well as fire protection to each lot prior
to sale of each lot and prior to issuance of a building per,mit for each lot"
14. No building permit will be issued for any lot within the fin.al plat until oertified by a
Washington State-licensed engineer that "the water system has been installed ptnsuant
0o the approved WATER PI.AN for the final plat," signed and stamped by said
engineer. The certification may be in the form of a letter, but is preferned to be certified
on a copy of the WATER PLAN as a schematic map showing the "as-built" water
system.
15. The Water Plan and the above four (4) cond.itions of approval regarding the WATER
PLAN may be waived by the Planaing DiTector/designee upon receipt of letters fjrom
the appropriate water purveyor and fire protecdon district stadng that simpie
connecdons to an existing, approved water system, will provide adequate domestic and
fine protection water to ensure the public health, safety and generdl welfare.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
I. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and appruval of the road system as indicated in the
preliminary plat of record.
2. The applicant should be advised that individual driveway access permits are required
prior to issuance of a building pennit for driveway approaches to the County road
system.
3. Dedication of 2 ft. of addidonal right-of-way along Pines Rd.
4. To construct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petition or resolution
which purpose is the formation of a Road Improveraent District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an R1D is
created or any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns.
5. As an altemadve method of construcdng the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
unprovements stated herein by joining and participating in a Counry Road Projeet
(CR.P) to the extent of the required road improvemenu. At such rime as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, die
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns.
6. The following statement be placed in the piat dedication: "The owner(s) or successor(s)
in intere.st agree oo authorize the County to plaoe their name(s) on a petition for the
formation of a Road Improvement District (RID) by the petition method pursuant to
Chapter 36.88 RCW, which petition includes the owner(s)' property, and further not to
object, by the signing of a ballot, to the fornmtion of an RID by the resolution method
pursuant to Chapter 36.88 RCW, which resolution includes the owner(s)' property. If
an RID is formed by either the perition or resolution method as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construcdon contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from the formadon of the RID by the property included
themin, togethcr with the amount of any County participation, exceed the cost and
expense of formadon of the RID; and
(c:) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized
under RCW 36.88.090, to object to any assessment(s) oa the property as a result of the
improvements called for in conjuncdon with the formation of an RID by either peddon
or resoludon method under Chapter 36.88 RCW, and to appeal to the Superior Court
the decision of the Board of County Commissioners affirming the final assessrnent roll.
It is further agmed that at such time as an RID is created or any Road Improvement
Project is sancdoned by Spokane County, the impmvements required (curb, sidewalk,
drainage control and paving) will be at the sole expense of the undersigned owner(s),
their heirs, grantees and assigns without participadon by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below. However, the owner(s) or successor(s) agree that if said RID
waiver expires without construction of the required impmvements, the owner(s) or
successor(s) agree to construct the required improvements at their own cxpense, pay to
Spokane County the then estimated cost of the required impmvements to enable the
County to complete the same, or furnish a bond or other secure method suitable to the
County (which may include the execudon of another RID waiver agreement) providing
for or securing to the County the actual construction of the improvements.
All of the requirements of this agreement shall run with the land and shall be binding
upon the owner(s), their successor(s) or assign(s).
7. The County Eagineer has designated Typical Roadway Section Number Two,
Secondary Arterial Standard for the improvements of Pines Road, which is adjacent to
the proposed development, This will require the addition of approximately 12 to 14
feet of asphalt, along the frontage of the development. The construcaon of curbing and
sidewalk is also required.
8. The proposed plat shall be improved to the standards set forth in Spokaue County
Board of Comm.issioners Resolution No. 80-1592, as amended, which establishes
regulations for roads, approaches, drainage and fees in new construcrion.
9. The Counry Engineer has examined this development proposal and has deterrnined that
the impact of this proposal upon the existing county road system warrants the
dedicadon of additional right-of-way and the roadway improvements herein specified.
10. This plat or development prnposal is located within a drainage basin which has been
idenrified by the Spokane County Engineees office as haviag stormwater runoff
probleans. Since this plat vr development proposal is affected by or is a eontributor to
stormwater flows, property owners should participate in the planning and
implementarioa of a future basinwide stormwater management system. The following
statement shall be placed in the plat dedication: "That the owner(s) or successor(s) in
interest agree to join in any County-approved stormwater management program and to
pay such rates and charges as may be fixed through public heanngs for service or
benefit obtained by the planning, design, constructing, maintaining or operation of
stormwater control facilities."
11. The shape of the parcel upoo which the church is constructed (as depicteri on the
preliminary plat) is not consistent with the road right-of-way records on file in the
offce of the County Engineer or the County Assessor's Map. The final plat map shall
accurately depict the shape of the parcel and the County Road Right of Way.
12. The County Arterial Road plan identi.fies Fines Road as a Minor Arterial. The existing
right of way width of 60 ft. is not consistent with that specified in the plan. In order to
implement the Arterial Road Plan it is recommended that in addition to the required right
of way dedicadon, a strip of property 8 fL in width along the Pines road froncage be set
aside in reserve. this property may be acquired by Spokane County at the dme when
Arterial Improvements are made to Pines Road.
COUh'TY HEALTH DISTRICT CONDITIONS
1. Appropriate utility easeaients shall be indicated on copies of the preliminary plat of
record far distribution by the Planning Department to the udlity companies, Spokane
County Engineer and the Spokane County Health DistricL Written approval of the
easemencs by the utility companies must be received prior to the subrnittal of the final
plat.
2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
3. Water service shall be coordinated through the Director of Utilides Spokane County .
4. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Social & Health Services.
5. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the wat,er system proposed to serve the plaL
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfacrion of the
Spokane Counry Health District that suitable sites for on-site sewage disposal systems
are available on the three smallesLtracts.
7. Subject to specific application approval and issuance of perniits by the health officer,
the use of iadividual on-site sewage disposal systems may be authorized.
8. The dedicatory language of the plat will state that: "Subject to specific application
approval and issuance of permits by the Health Officer, the use of individual on-site
sewage systems may be authorized."
9. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
10. The plat dedication will conta.in a statement to the effect that: "Me public water system,
as approved by County and state health autharities and the local fire district and
purveyor, will be installed within this plat, and the subdivider will provide for
ind.ividual domestic water service, as well as fire protection, to each lotltract prior to
sale of each lot/tract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
on compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific applicadon approval and issuance of
permits by the Health DistricL
2. The dedication shall state: "The owner(s) or successor(s) in interest agree to authorize
the County to place their naine(s) on a peticion for the formation of ULID by petition
method pursuant to RCW 36.94, which the petition includes the owner(s)' property;
and further not to object by the signing of a protest petition against the formation of a
ULID by resoludon method pursuant to RCW Chapter 36.94 which includes the
owner(s)' property. PROVIDED this condition shall not prohibit the owner(s) or
successor(s) from objecting to any assessment(s) on the property as a result of
improvements called for in conjunction with the fonnation of a ULID by either peation or resoludon method under RCW Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amendeti. i
4. The dedication shall state: "Each new dwelliog unit shall be double-plumbed for
connection to futune areawide collecdon systecns."
5. This Short Plat falls within the proposed Hillview ULID. Sewer Construction is
expected to begin in 1991.
