Qear Mr. Harper:
EncZosed is a request far design deviatian concerning appraval of
S.P. 673-90.
I was involved in the closing of transfer of property t❑ T3an and
Paulette Neis in 5eptember ❑f 1989 from Narthwood Properties. The
property being transferred included an existing bui],ding which had
been leased toGeneral Electric. Because ❑f the existing building
we were scsmehvw led t❑ believe that shart platting this praperty
was nat necessary priar t❑ the transfer as abtaining aCertificate
4f Exemptipn and eventually having the prQperty seqregated far tax
purposes was routine and wvuld easily be granted.
Accardingly, hecause of certairc time constraints and the desire to
complete the transaction immediately, we closed the transaction and
then applied for a Certificate of Exemptivn. Upon denial of the
exemptian. Mr. Gunning eventually filed for a short glat thraugh
Simpson Engineers. It raas at that time that we learned of the
County's requiremeny that certain ac3uitiondl ,~~opericy be granf.ed t❑
the County for future widening of Montgmmery 5treet.
[]nfartunately, Mr. anci Mrs. Neis wauld have nv part of this as they
paid for the property already transferred. We have subsequently
attempted to reacquire the necessary portian of their praperty t❑
the narth to satisfy the County' s requirement but Mr. and Nrs. Neis
refuse to coaperate. Instead, they have threatened to sue Mr.
Gunning in the event the short plat is not approved in the near
future. Please undLerstand that this process has been angoing for
almost three years now.
Because of this peculiar situation, we axe filing a Request for
Design Deviation cancerning the approval of the short plat. I
wauld agpreciate yaur reviewing the request I have prepared an
