being the owners of the following described lands in consideration of Mutual Benefits to be
hereafter derived do for themselves, their heirs, grantees and assigns, hereby agree to the
following:
There may be a need in the future to construct a public road to serve the lands herein described.
Said road shall be constructed in accordaace with the then adopted Spokane County Road
Standards for public roads. Said road to follow, as near as practicable, the existing County road
right of way.
If additional right of way is required, the owners, their heirs andlor assigns agree to deliver to
Spokane County a properly sigaed and executed Right of Way Deed covering the required
additioaal right of way.
The owners or successors in interest agree to authorize Spokane County to include the below
described property in a Road Improvement District (RID) and to support the formation of a Road
Improvement District for improvement of the road(s) described below by requesting and
authorizing Spokane County to place their narne on a petitioa for formation of a Road
Improvement District pursuant to RCW 36.88.450, or by requesting and authorizing Spokane
County to c.ast their ballot in favor of a RiD being formed under the resolution method pursuant
to RCW 36.88.030, and/or by not filing a protest against the fonnation of a RID being formed
under the alternative resolution method provided for in RCW 36.88.065 and Chapter 35.43

If an RID is proposed for improvement of the road(s) described below, said owners and
successors further agree: (1) that the improvements or construction contemplated within the
proposed RIA are feasible, aad (2) that the benefits to be derived from the formation of the RID
by the property included thereia, together with the amount of any County participation, exceed
the cost aad expense of formadon of the RID, and (3) that the pmperty within the proposed RID
is sufficiently developed; provided, the owners or successors shall retain the right, as authorized
under RCW 36.88.090, to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the fonnation of a RID by either the petition or
resolution method under Chapter 36.88 RCW and to appeal to the superior court the decision of
the Board of Couaty Commissioners confirmi.ng the final assessment roll; provided further, it is
recognized that actual assessments may vary from assessment estimate so long as they do not
exceed a figure equal to the increased true and fair value the unprovement add to the property.
By allowing a building pennit to be issued on property having access from an unmaintained ,
County road, Spokane County assumes no obligation for said road, and the owners hereby
acknowledge that the County has no obligation of any kind or nature whatsoever to establish,
examine, survey, construct, alter, repau, improve, maintain, provide drainage or snow removal
on said road. The requirement is and shall run with the land and shall be binding upon the '
owners, their heirs, successors or assigns, until said road is improved to Spokane County Road
Standards and accepted by the County for maintenance. • The undersigned owners, their heirs, successors or assigns hereby release Spokane County, and
all its officers, employees and ageats from any responsibility or liability for any damage
whatsoever to the hereinabove described Iands and improvements thereoa as a result of allowing
a building permit to be issued on property which is served by a unmaintained County xoad.
This Agreement applies to the improvement of UNNAMED ALLEY EAST OF GIRARD STREET
,
RF No. 1978 , by grading, draiaing, surfacing, curbing, paving, and sidewalk
construction, including traffic confirol facilities and related work.
These requirements are and shall run with the land and shall be bind.ing upon the owners, their
heus, successors or assigns. T'he Road Improvement District (RID) waiver in this agreement
shall expire after ten (10) years frora the date of execution below.
The above conditions and covenant apply to the following described property:

IN THE MATTER OF SHORT PLAT ) FINDINGS OF FACT,
NO. SP-1289-01 ) CONCLUSIONS AND
APPLICANT: RICK SOUZA ) OECISION
THIS MATTER, an application for short subdivision of land from Rick Souza, agent acting on behalf
of James B. Herb, has been received and was decided upon, pursuant to Spokane County
Subdivision regulations, on the 1e day of June, 2002.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been propedy delegated the responsibility for
rendedng the decision by the Director of Spokane County Division of Planning.
2. The proposal is to divide approximately 16,583 square feet into four (4) single-family
residential lots for those uses permitted in the Urban Residential-12 (UR-12) zone.
3. The proposal is Aenerally located approximately at the southeast comer of the intersection of
Girard Street and 41hAvenue in the NE% of Section 24, Township 25 North, Range 43
E.W.M., Spokane County, Washington. Property legally described in CE-136-02.
4. The existing zoning of the property is Urban Residential-12 (UR-12), which was established on
March 28, 2002 pursuant to the Hearing Examiner approval of Zone Reclassification ZE-16-01
and VE-15-01, previously designated as Urban Residential-3.5 (UR-3.5) in 1991. Pursuant to
the Revised Code of Washington (RCM 58.17.195, this proposal conforms to the
requirements of the existing Urban Residential-12 (UR-12) ione.
5. The Spokane County Comprehensive Plan, in effect at the time the application was submitted,
designates the site as Urban. The development and uses, as proposed, and conditioned, are
in compliance with the Urban category. The new Comprehensive Plan designation,
implemented as a result of the adoption of the Phase I Development Regulations by the Board
of County Commissioners on January 15, 2002, (Resolution #2-0161), is Medium Oensity
Residential (MDR).
6. Surrounding uses are primarily single-family residential and currently zoned Urban
Residential-3.5 (UR-3.5).
7. The Spokane County Arterial Road Plan identifies both Girard Street and 4`" Avenue as Local
Access Roads. Both Girard Street and 4`" Avenue cuRently have 60-foot rights-of-way.
Therefore, as conditioned (such as improvements, dedication, sidewalks and acquisition
areas) the proposal confonns to the Arterial Road Plan.
8. The proposed site is located within the Public Transportation Benefit Area (PTBA).
9. The proposed short plat will be served by a public water system. Wastewater disposal will be
as authorized by the Director of Spokane County Division of Utilities.
10. The subject property is located within the 30,000 foot Conical area for Felts Field.
11. The required public notice was provided for this proposal and agencies having a potential
interest in the project were notified and recommendations solicited. Two (2) letters of
comment have been received from area residents, both in support of the proposal.

12. Recognizing the recommended conditions and Spokane County development standards, the
proposed short plat makes appropriate provisions for the public heaith, safety and general
weifare and that the public use and interest will be served by platting the subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision
regulations, promoting the public health, safety and general welfare in accordance with
standards established bX the State and Spokane County. The County Division of Planning
has considered the provision of adequate public facilities as cited in RCW 58.17.110 (2).
More specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways . g. parks and recreation facilities
c. public and/or pnvate right-of-ways h. playgrounds
d. transit i. schools and school grounds
e. potable water j. sidewalks
13. The project is exempt ftom environmental review under the State Environmental Policy Act
pursuant to WAC 197-11-800 (6) (a).
14. The preliminary short plat lies inside the Aquifer Sensitive Area (ASA) Overlay Zone
and the Priority Sewer Servics Area (PSSA). ASA Overlay Zone standards for
residential development activities, as defined in Section 14.706.100 of the Spokane
County Zoning Code, shall apply to the proposed residential development of the site.
15. The project site is located inside the Urban Growth Area (UGA) boundary,
established by Board of County Commissioners' Resolution No. 2-0037 in response
to RCW 36.70A, the Growth Management Act.
DECISION
Based upon the above noted Findings of Fact and Conclusions. Short Plat application SP-1289-01 is
hereby APPROVED for five (5) years, specifically to June 18, 2007 and subject to conditions noted
below. This decision is final unless appealed in writing consistent with adopted appeal procedures.
CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant," which ternn shall include the
owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF PLANNING
1. The proposal shall comply with the Urban Residential-12 (UR-12) zone and other applicable
Zoning Code chapters, as amended.
2. The final short plat shall be designed substantially in conformance with the preliminary plat of
record. No increase of density or number of tracts shall occur without a change of condition or
subdivision applicaUon submittal and approval.
3. The preliminary short ptat is given conditional approval for five (5) years, specifically to June
18, 2007. The applicant may submit an extension of time application at least thirty (30) days
prior to the above expiration date, but no later than May 19, 2007. Application(s) for
extension of time shall be processed under the provisions of Chapter 12.100.118 (Extension
of Time) of the Spokane County Subdivision Ordinance, as amended.
4. Prior to filing the final short plat, the applicant shall submit to the County Division of Planning
Director/designee for review any proposed final short plats to ensure compliance with these
Findings and Conditions of Approval.

, 5. A survey is required of the subject property prior to filing the final short plat.
6. Appropriate road names and street addresses shall be indicated on the final short plat map.
7. Appropriate utilitX easements shall be indicated on the final short plat map. Approval of utility
easements by utility companies must be received prior to filing the flnal short plat.
8. A filed Avigation Easement satisfactory to the Spokane Intemational Airport Board shall be
provided prior to filing of the final plat.
9. The dedication shall contain the following statement:
"Setbacks shall be determined at the time building permits are requested unless these
setbacks are specifically drafted on this final short plat. The setbacks indicated on this
subdivision may be vaned from if proper zoning or variance approvals are obtained."
10. Four (4) current Certificates of T'rtle shall be fumished to the County Division of Planning prior
to filing the final short plat.
11. The applicant shall comply with all conditions of approval for ZE-16-01 and VE-15-01.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
1. Applicant shall comply with all conditions of approval for ZE16-01 and VE-15-01.
2. Conditional approval of the plat by the County Engineer is given subject to approval of the
road system as indicated in the preliminary plat of record.
3. No cons#naction work is to be performed within the existing or proposed public right-of-way
unfll plans have been accepted by the County Engineer and a permit has been issued by the
County Engineer. All work is subject to inspection and approval by the County Engineer.
4. Approach PeRnits are required for any access to the Spokane County road system.
5. The applicant shall grant applicable border easements adjacent to Spokane County Right of
Way per Spokane County Standards.
6. To construct the road improvements stated herein, the applicant may, with the approval of the
County Engineer, join in and be a willing participant in any petition or resolution which
purposes is the formation of a Road Improvement District (RID) for said improvemerrts
Fursuant to RCW 36.88, as amended. At such time as an RID is created or any Road
mprovement Project is sanctioned by Spokane County, the improvements required (curb,
sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the
undersigned owner, their heirs, grantees and assigns. This provision is applicable to Fourth
Avenue and Girard Road.
7. As an altemative method of constructing the road improvement stated herein, the applicant
may, with the approval of the County Englneer, accomplish the road improvements stated
herein by joining and participating in a County Road Project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the improvements required (curb, sidewalk,
dramage control and paving to existing pavement) will be at the sole expense of the
undersigned owner, their heirs, grantees and assigns. This provision is applicable to Fourth
Avenue and Girard Road.
8. The following statements shall be placed in the dedicatory language of the final plat:

/ The property owners within this plat shall be held responsible for keeping open and
maintaining the surface path of natural or man-made drainage flow over and across their
respective properties. If the property owner(s) fails to maintain the surface path of natural
or man-made drainage flow, or the drainage swale, a notice of such failure may be given
to the property owner(s). If not coRected within the period indicated on said notice,
Spokane County has the right to coRect the maintenance failure, or have it corrected, at
the expense of the property owner.

There may exist properties, Iocated uphill and adjacent to this.subdivision, which
periodicaliy discharge stormwater runoff onto individual fots withm this plat. Runoff from
nearby uphill properties should be expected, and during snowmelt periods or wet seasons
the lots may be subjected to higher amounts of stormwater runoff that what is normally
observed or anticipated. Because stormwater runoff from adjacent properties have
discharged onto this plat prior to development, stormwater runoff will likely continue to do
soafter development. It is the responsibility of the individual lot owners to maintain
existing surface paths of runoff through their respective lots and to grade the lots in
accordance with applicable rules and regulations, so as to prevent property damage.
Any building that is constructed on a lot in this plat shall be set at such an elevation so as
to provide positive drainage away from any drainage entry point to the building (including
but not limited to a window well, a window unprotected by a window well, or a doorway).
Said posifive drainage shall consist of a minimum slope of 3% away from the building for a
distance of at least 10 feet from the building. The lots shall be graded so that either a) all
runoff is routed away from the building, and conveyed over the lot to a natural drainage
swale or approved drainage facility, or b) drainage intercepted on the lot is disposed of on
the loi in an approved dramage faGlity. The approved drainage facility shall be
constructed in accordance with any applicable accepted plans on file at the County
Engineers Off'ice. Any revisions to the accepted drainage plans must be accepted by the
County Engineer's Office prior to c4nstruction of said revisions.
Spokane County does not ac.cept the responsibility of maintaining the drainage course on
private lots or floodplain areas withm private lots, nor the responsibilfty for any damage
whatsoever, including, but not limfted to, inverse condemnation to any properties due to
deficient construction and/or maintenance of drainage courses in dramage easements on
private property.
The owner(s) or successor(s) in interest agree to join in any County-approved stormwater
management program and to pay such rates and charges as may be fixed through public
hearings for service or benefit obtained by the ptanning, design, constructing, maintaming
or operation of stomnwater control facilities.
This short plat is located within the Aquifer Sensitive Area (ASA). Treatment of storm
- runoff from driveways shall be provided. The preferred method of treatment is to have the
runoff from driveways sheet flow over lawn turf or native-type grasses. tf a ditch is to be
a used to collect runoff from driveways, then the ditch is to be grass-lined.
That in consideration of Mutual 8enefits now or to be hereafter derived, do for themselves,
their heirs, grantees: assigns and successor(s) in interest hereby request and authorize
Spokane County to mclude the above described property in a Road Improvement District
(RID) and to support the formation of a Road Improvement District for improvement of the
road(s) described below by requesting and authorizing Spokane County to place their
name(s) on a petition for the formation of a Road Improvement District pursuant to RCW
36.88.050, or by requesting and authorizing Spokane County to cast their ballot in favor of
a RID being formed under the resolution method pursuant to RCW 36.88.030, and/or by
not filing a protest against the fornnation of a RID being formed under the altemative
resolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW.
If a RID is proposed for improvement of the road(s) described below, said owner(s) and
successor(s)further agree: (1) that the improvements or construction contemplated within
the proposed RID are feasible and (2) that the benefits to be derived from the formation of
the RID by the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID, and (3) that the
grgperty within the proposed RID is sufficiently developed; provided, themselves, their
eirs, grantees, assigns and successor(s) shall retain the nght, as authorized under RCW
36.88.090, to object to any assessment(s) on the property as a result of the improvements
called for in conjunction with the formation of a RID by either the petition or resolution
method under Chapter 36.88 RCW and to appeal to the Superior Court the decision of the

11. The proposed plat shall be improved to the standards set forth in Spokane County Board of
Commissioners Resolution No. 1-0298, as amended, which establishes negulations for roads,

additional Right of Way and the roadway improvements herein specified.
13. The applicant shall execute a Spokane County Notice to Public No. 4 for the purposes of

SPOKANE COUNTY DIVISION OF UTILITIES
1. As per the Spokane County Zoning Code Phase One Development Regulations the dedication
shall state:
A public sewer system will be made available for the plat, and individual services will be
provided to each lot prior to sale. Use of individual on-site disposal systems shall not be
authorized.
2. Applicant shall submit expressly to Spokane County Division of Utilities "under separate
cover", only those plan sheets showing sewer plans and specifications for the pubtic sewer
connections and facilities for review and approval. Commercial developments shall submit
historical and or estimated water usage as part of the sewer plan submittal.
3. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the finalization of
the project.
4. Any water service for this project shall be provided in accordance with the Coordinated Water
System Plan for Spokane County, as amended.

SPOKANE REGIONAL HEALTH DISTRICT
1. The final piat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for
distnbution by the Planning Department to the ublity companies, Spokane County Engineer,
and the Spokane Regional Health District. Written approval of the easements by the utility
companies shall be received prior to the submittal of the final plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County.
4. Water service shall be coordinated through the Director of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the Regional
Engineer (Spokane). State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane
Regional Health District that an adequate and potable water supply is available to each lot of
the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the
recorded service area of the water system proposed to serve the plat.
8. A public sewer system will be made available for the plat and individual service will be

9. A statement shall be placed in the dedication to the effect that:

The Spokane County Division of Engineering and Roads has reviewed the above referenced
application. The following "Conditions of Approva!" are submitted to the Spokane County Division of
Planning for inclusion in the "Findings of Fact, Conclusions and Order/Decision" should the request be
approved.
1. Applicant shall comply with all conditions of approval for ZE 16-01 and VE-15-01.
2. Conditional approval of the plat by the County Engineer is given subject to approval of the road

3. No construction work is to be perFormed within the existing or proposed public right-of-way until
plans have been accepted by the County Engineer and a permit has been issued by the County

7. As an alternative method of constructing the road improvement stated herein, the applicant
may, with the approval of the County Engineer, accomplish the road improvements stated
herein by joining and participating in a County Road Project (CRP) to the extent of the required
road improvement. At such time as an RID is created or any Road Improvement Project is
sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control
and paving to existing pavement) will be at the sole expense of the undersigned owner, their
heirs, grantees and assigns. This provision is applicable to Fourth Avenue and Girard Road.
8. The following statements shall be placed in the dedicatory language of the final plat:
• The property owners within this plat shall be held responsible for keeping open and maintaining
the surface path of natural or man-made drainage flow over and across their respective
properties. If the property owner(s) fails to maintain the surface path of natural or man-made
drainage flow, or the drainage swale, a notice of such failure may be given to the property
owner(s). If not corrected within the pe(od indicated on said notice, Spokane County has the
right to correc# the maintenance failure, or have it corrected, at the expense of the property
owner.
• There may exist properties, located uphill and adjacent to this subdivision, which periodically
discharge stormwater runoff onto individual lots within this plat. Runoff from nearby uphill
properties should be expected, and during snowmelt periods or wet seasons the lots may be
subjected to higher amounts of stormwater runoif that what is normally observed or anticipated.
Because stormwater runoff from adjacent properties have discharged onto this plat prior to
development, stormwater runoff will likely continue to do so after development. It is the
responsibility of the individual lot owners to maintain existing surface paths of runoff through their
respective lots and to grade the lots in accordance with applicable rules and regulations, so as to
prevent property damage.
• Any building that is constructed on a lot in this plat shall be set at such an elevation so as to
provide positive drainage away from any drainage entry point to the building (including but not
limited to a window well, a window unprotected by a window well, or a doorway). Said positive
drainage shall consist of a minimum slope of 3% away from the building for a distance of at least
10 feet from the building. The lots shall be graded so that either a) all runofF is routed away
from the building, and conveyed over the lot to a natural drainage swale or approved drainage
facility, or b) drainage intercepted on the lot is disposed of on the lot in an approved drainage
facility. The approved drainage facility shall be constructed in accondance with any applicable
accepted plans on file at the County Engineer's Office. Any revisions to the accepted drainage
plans must be accepted by the County Engineer's Office prior to construction of said revisions.
• Spokane County does not accept the responsibility of maintaining the drainage course on private
lots or floodplain areas within private Iots, nor the responsibility for any damage whatsoever,
including, but not limited to, inverse condemnation to any properties due to deficient construction
and/or maintenance of drainage courses in drainage easements on private property.
• The owner(s) or successor(s) in interest agree to join in any County-approved stormwater
management program and to pay such rates and charges as may be fixed through public

hearings for service or benefit obtained by the planning, design, cvnstructing, maintaining or
operation of stormwater control facifities.
• This short plat is located within the Aquifer Sensitive Area (ASA). Treatment of storm runoff
from driveways shall be provided. The preferred method of treatment is to have the runoff from
driveways sheet fiow over lawn turf or native-type grasses. If a ditch is to be used to collect
runoff from driveways, then the ditch is to be grass-lined.
• That in consideration of Mutual Benefits now or to be hereafter derived, do for themselves, their
heirs, grantees, assigns and successor(s) in interest hereby request and authorize Spokane
County to include the above described property in a Road Improvement District (RID) and to
support the formation of a Road Improvement District for improvement of the road(s) described
below by requesting and authorizing Spokane County to place their name(s) on a petition for the
formation of a Road Improvement District pursuant to RCW 36.88.050, or by requesting and
authorizing Spokane County to cast their ballot in favor of a RID being formed under the
resolution method pursuant to RCW 36.88.030, and/or by not filing a protest against the
formation of a RID being formed under the alternative resolution method provided for in RCW
36.88.065 and Chapter 35.43 RCW.
If a RID is proposed for improvement of the road(s) described below, said owner(s) and
successor(s)further agree: (1) that the improvements or construction contemplated within the
proposed RID are feasible and (2) that the benefits to be derived from the formation of the RID
by the property included therein, together with the amount of any County participation, exceeds
the cost and expense of formation of the RID, and (3) that the property within the proposed RlD
is sufficiently developed; provided, themselves, their heirs, grantees, assigns and successor(s)
shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on
the property as a result of the improvements called for in conjunction with the formation of a RID
by either the petition or resolution method under Chapter 36.88 RCW and to appeal to the
Superior Court the decision of the Board of County Commissioners confirming the final
assessment roll; provided further, it is recognized that actual assessments may vary from
