"Of ~ BEFORE THE SPOKANE COUNTY DIVISION OF PLANNING IN THE MATTER OF PRELIMINARY FINDINGS OF FACT, SHORT PLAT SP-1302-02 CONCLUSIONS AND DECISION THIS MATTER, an application for subdivision of land from Mark McManus has been received and was decided upon, pursuant to Spokane County Subdivision regulations, on the 25th day of April 2002. FINDINGS OF FACT AIdD CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendecing the decision by the Director of Spokane County Division of Planning. 2. Preiiminary short subdivision application to divide approximately 30,992 square feet into four (4) lots for those uses permitted in the existing Urban Residential-7 (UR-7) Zone. Lot D will be devetoped with a duplex and the remaining 3 lots will be developed with single family dwellings. 3. Generally tocated south of and adjacent to 3rd Avenue at the intersection of Sommer Road and 3td Avenue and north of and adjacent to 4t'Avenue in the NE % of Section 23, Township 25 North, Range 44 EWM, Spokane County, Washington, Assessor's Tax Parcel No. 45231.1208. 4. The existing zoning of the property described in the application is Urban Residential-7 (UR-7), which was established on January 15, 2002 with the adoption of Phase I Development Regulatiosn (see Resolution #2-0037). Pursuant to Revised Code of Washington (RCV1l) 58.17.195, this proposal confomns to the requirements of the existing UR-7 Zone. 5. The Spokane County Comprehensive Plan designates this area as Medium Density Residential (MDR). The short subdivision and uses, as proposed and conditioned, are in compliance with the MDR category of the Comprehensive Plan. 6. This proposal is compatible with the surrounding uses which are primarily single family residences on urban sized parcels. 7. The Spokane County Arterial Road plan designates 41hAvenue as a Collector Arterial Road. The County Engineer requires additional right-of-way be dedicated along 4"' Avenue and additional road improvements. Third Avenue is designated a Local Access Road by the County Arterial Road Plan. The County Engineer nequires road improvements along 3nd Avenue. The County Engineer has examined this development proposal and has determined that the impact of this proposat upon the existing County Road System warrants the dedication of additional right of way and the roadway improvements herein specified. This preliminary short plat application is exempt from the transportation concurrency review provisions of the Phase I Development Regulations per Section IV (13)(2e)(ii). 8. The proposed site is located within the Public Transportation Benefit Area (PTBA). The Spokane Transit Authority (STA) Route No. 97 provides transit service in the vicinity of the short subdivision. 9. The proposed short plat will be served by a public water system operated by Vera Irrigation District #15. The Spokane County Sewer System wiil provide wastewater s ~ disposal service. The utilfty purveyors issued Certificates of Concurrency for Water and Sewer services as required by County Resolution 2-0037. 10. The required public notice was provided for this proposal, and agencies having a potential interest in the project were notified and recommendations solicited. No comment was received from the public. 11. Recognizing the recommended conditions of approval and confonnance of the proposal to Spokane County development standards, the proposed short plat makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by platting the subdivision. The subdivision proposal is generally consistent with RCW 58.17 and County Subdivision regulations promoting the public health, safety and general welfare in accordance with standards established by the State and Spokane County. The Division of Planning has considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). More specifically: a. open spaces f. sanitary waste disposal b. drainage ways g. parks and recreation facilities c. public and/or private right-of-ways h. playgrounds d. transit i. schools and school grounds e. potable water j. sidewalks 12. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6)(a). 13. The preliminary short plat lies within the Aquifer Sensitive Area (ASA) Overlay Zone and the Priority Sewer Service Area (PSSA). ASA Overlay Zone standards far residential development activities, as defined in Section 14.706.100 of the Spokane County Zoning Code, shall apply to the proposed residential development of the site. 14. The project site lies within the Urban Growth Area (UGA) boundary established by Board of County Commissioners' Resolution No. 2-0037 in response to RCW 36.70A, the Growth Management Act. The development of the site, as proposed and conditioned, is in accordance with Resolution No. 2-0037. 15. The preliminary short plat lies within the Conical Area (CA) of the Airport Overlay (AO) Zone. AO Overlay Zone General Use Restrictions, as defined in Section 14.702.060 of the Spokane County Zoning Code shall apply to the proposed development of the site. DECISION Based upon the above noted Findings of Fact and Conclusions, Preliminary Short Plat, Applicatjon SP-1302-02, is hereby APPROVED for five (5) years, specifically to April 25, 2007 and subject to the conditions specified below. This decision is final unless appealed in writing, consistent with the adopted appeal procedures. CONDITIONS OF APPROVAL All the below conditions imposed shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns and successors. Findings nnsi Decision SP-1302-02 2 r I SPOKANE COUNTY DIVISION OF PLANNING 1. The proposai shall comply with the requirements of the Urban Residential-7 (UR-7) Zone, Airport Overlay (AO) Zone, Aqujfer Sensitive Area Overlay (ASA) zone, and other applicable Zoning Code chapters, as amended. Prior to final short plat approval the garage on Lot D shall comply with all UR-? Zonesetback requirements. 2. The final short plat map shall be prepared in accordance with Section 12.300 of the ~ Spokane County Subdivision Ordinance. 3. The final short plat shall be designed substantiatly in conformance with the preliminary short plat of record. 4. The preliminary short plat is given conditional approval for five (5) years, specifically to April 25, 2007. The applicant may submit an extension of time application at least thirty (30) days prior to the above expiration date, but no later than March 26, 2007. An appiication for an extension of time shatl be processed under the provisions of Chapter 12.100.118 (Extension of Time) of the Spokane County Subdivision Ordinance. If the applicant complies with the criteria of Section 12.100.118, the preliminary approval and ~ conditions will be changed to reflect the adopted policy and development regulations at the time of the extension application. Submission of a time extension request following March 26, 2007 will not be accepted and the preliminary short plat wjll be null and void on April 25, 2007 if the final short plat is not recorded in the County Auditor's Office. 5. Prior to filing the final short plat, the applicant shall submit to the Division of Planning DirectoNdesignee for review any proposed final short plat to ensure compliance with these Findings and Conditions of Approval. 6. A survey is required of the subject property prior to filing the final short plat. 7. Appropriate road names and street addresses shall be indicated on the final short plat map. 8. Appropriate utility easements shall be indicated on the final short plat map. Approval of utility easements by utitity companies shall be submitted with the final short plat. 9. The final short plat dedication shall include the following statement: "Setbacks shall be determined at the time building permits are requested unless these setbacks are specifically drafted on this final short plat. 10. Four (4) current Certificates of Title shafl be furnished to the County Division of Planning prior to filing the final short ptat. 11. The Spokane County Division of Planning shall prepare and record with the Spokane County Auditor a"Title Notice" noting that the properfy in question is subject to a variety of special conditions imposed as a result of the land Lse action i Findings und Decision SP-1302-02 3 ~ ~ herein. This "Title Notice" shall serve as official public notice regarding conditions of approval affecting the property in question. The "Title Notice" shaii be recorded within fifteen (15) days of Final Short Plat approval and shall only be extinguished by the Spokane County Division of Planning. SPOKANE COUNTY DIVISION OF UTILITIES 1. As per the Spokane County Zoning Code Phase One Development Regulations the dedication shall state: Public sewers shall be constructed to provide for the connection of each parcel to the County's system of sewerage. Uses on properties within the project shall be required to connect to the sewer and pay applicable charges per the County Sewer Ordinance. Sewer connection permits shall be required. 2. The applicant shall submit expressly to Spokane County Division of Utilities "under separate cover, " only those plan sheets showing sewer plans and specifications for the public sewer connections and facilities for review and approval. Commercial developments shall submit historical and or estimated water usage as part of the sewer plan submittal. 3. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the finalization of the project. 4. ARangements for payment of applicable sewer charges must be made prior to issuance of sewer connection permit. Sewer charges may include special connection charges and general facilities charges. Charges may be substantial depending upon the nature of the development. 5. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. SPOKANE COUNTY DIVISION OF ENGINEERING & ROADS 1. Conditional approval of the short plat by the County Engineer is given subject to dedication of right-of-way and approval of the road system as indicated in the preliminary plat of record. 2. No construction work is to be performed within the existing or proposed public rightof-way plans have been accepted by the County Engineer and a permit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 3. Approach Permits are required for any access to the Spokane County road system. 4. Dedication of 2.5 feet of additional dghtof-way is required along 4th Avenue. 5. The applicant shall grant applicable border easements adjacent to Spokane County Right of Way per Spokane County Standards. 6. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purposes is the formation of a Road Improvement District (RID) for said improvements pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and Findings and Decision SP-1302-02 4 ~ assigns. This provision is appiicable to 3`dand 4~' Avenues. 7. As an altemative method of constructing the road improvement stated herein, the appiicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvement. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and assigns. This provision is applicable to 3t0 and 4th Avenues. 8. The following statements shall be placed in the dedicatory language of the final short plat: "The property owners within this short plat shall be held responsible for keeping open and maintaining the surface path of natural or man-made drainage flow over and across their respective properties. If the property owner(s) fails to maintain the surface path of natural or man-made drainage flow, or the drainage swale, a notice of such failure may be given to the property owner(s). If not corrected within the pe(od indicated on said notice, Spokane County has the right to correct the maintenance failure, or have it corrected, at the expense of the property owner. There may exist properties, located uphill and adjacent to this sbrt plat, which periodically discharge stormwater runoff onto individual lots within this p1at. Runoff from nearby uphill properties should be expected, and during snowmelt periods or wet seasons the lots may be subjected to higher amounts of stormwaterrunoff that what is normally observed or anticipated. Because stormwater runoff from adjacent properties have discharged onto this plat prior to development, stoRnwater runoff will likely continue to do so after development. It is the responsibility of the individual lot owners to maintain existing surface paths of runoff through their respective lots and to grade the lots in accordance with applicable rules and regulations, so as to prevent property damage. Any building that is constructed on a lot in this short plat shall be set at such an elevation so as to provide positive drainage away from any drainage entry point to the building (including but not limited to a window we11, a window unprotected by a window well, or a doorway). Said postive drainage shall consist of a minimum slope of 3% away from the building for a distance of at least 10 feet from the building. The lots shall be graded so that either a) all runoff is routed away from the building, and conveyed over the lot to a natural drainage swale or approved drainage facility, or b) drainage intercepted on the lot is disposed of on the lot in an approved drainage facility. The approved drainage facility shall be constructed in accordance with any applicable accepted plans on file at the County Engineer's Office. Any revisions to the accepted drainage plans must be accepted by the County Engineer's Office prior to construction of said revisions. Spokane County does not accept the responsibility of maintaining the drairage course on private lots or floodplain areas within private lots, nor the responsibility for any damage whatsoever, including, but not limited to, inverse condemnation to any properties due to deficient construction and/or maintenance of drainage courses in drainage easements on private property. The fees will be based on actual satary costs incurred by Spokane County for project reviews and / or inspections plus a ten percent administrative charge, and will be billed monthly as accrued. Any billing amounts due, including any expenses incurred in the collection of an overdue aceount, must be paid prior to the County's acceptance of the project for filing. If a project is approved and/or filed with a balance stilt owing, the unpaid balance shall be paid within 30 days of the invoice date. 2.
