ALVIN SEVERSON ) DECISION
THIS MATTER, an application for subdivision of land from Alvin Severson has been received
and was decided upon, pursuant to Spokane County Subdivision regulations, on the 9th day of
May 2002.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Director of Spokane County Division of Planning.
2. The proposal is to divide approximately .53 acres into two (2) lots for the development of
a duplex in the existing Urban Residential - 7(UR-7) zone. The subject site is currently
developed with an existing duplex and attached garage.
3. The proposal is located north of and adjacent to Nora Ave. and south of and adjacent to
Interstate - 90 (I-90) in a portion of the SW of Section 8, Township 25 North, Range
44 E.W.M.. Spokane County, Washington. Assessors Tax Parcel #45083.0497.
4. The existing zoning of the property described in the application is Urban Residential - 7
(UR-7), which was established pursuant to a Zone Reclassification (ZE-27-01) approved
by the Spokane County Hearing Examiner on April 3, 2002. Pursuant to Section
58.17.195 of the Revised Code of Washington (RCV1), this proposal, together with the
conditions of preliminary approval specified herein, conforms to the requirements of the
existing Urban Residential - 7(UR-7) zone.
5. The Spokane County Comprehensive Plan designates this area as Low Density
Residential. The Low Density Residential category is intended to provide the opportunity
for development of residential uses with a density range of 1 to and including 6 dwelling
units per acre. Efficient deveiopment pattems will be guided by locating residential
development in areas where facilities and services can be provided in a cost-effective
and timely rnatter. Urban character and design shall be maintained and enhanced
through urban design standards and pertormance standards. As conditioned, the
proposed short subdivision is in compliance with the Low Density Residential category of
the Comprehensive Plan.
6. This proposal is compatible with the surrounding uses, which are primarily developed
parcels .25 acres and greater in size.
7. The proposed short plat will be served by a public water system (Modem Electric Water
Company). Wastewater disposal will be as authorized by the Director of Spokane
County Division of Utilities.
8. The required public notice and comment period was provided for this proposal. In
addition, those agencies having a potential interest in the proposal were notified and
comments solicited. No written public comments were received.

9. Recognizing the recommended conditions of approval and Spokane County
development standards, the proposed short subdivision makes appropriate provisions
for the public health, safety and general weifare and that the public use and interest wiil
be served by approving the subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County
Subdivision regulations, promoting the public health, safety and general welfare in
accordance with standards established by the State and Spokane County. The Spokane
County Division of Planning has considered the provision of adequate public facilities as
cited in RCW 58.17.110 (2). More specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g. parks and recreation facilities
c. public and/or private right-of-ways h. playgrounds
d. transit i. schools and school grounds
e. potable water j. sidewalks
10. Pursuant to the Washington State Administrative Code (WAC) 197-11-800 (6)(a), this
proposed short plat is exempt from the State Environmental Policy Act (SEPA)
environmental review.
11. West Valley School District No. 363 was sent notification of the project on April 19, 2002.
No response was received.
12. The preliminary short plat lies inside the Aquifer Sensifive Area (ASA) Overlay Zone and
the Priority Sewer Service Area (PSSA). ASA Overlay Zone standards for residential
development activities, as defined in Section 14.706.100 of the Spokane County Zoning
Code, shall apply to the proposed residential development of the sde.
13. The proposed site is located within the Public Transportation Benefit Area (PTBA).
The Spokane Transit Authority (STA) Route No. 73 & 95 provide transii service in the
vicinity of the short subdivision.
14. The project site is located inside the Urban Growth Area (UGA) boundary, established
by Board of County Commissioners' Resolution No. 2-0037 in response to RCW 36.70A,
the Growth Management Act.
15. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing County Road System waRants the roadway
improvements specified in the conditions of approval identified below.
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-1305-02 is hereby APPROVED for five (5) years, specifically to May 9th, 2007 and subject
to the conditions specified below. This decision is final unless appealed in writing, consistent
with the adopted appeal procedures.

CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant,° which term shall include
the owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF PLANNING
1. The proposal shail comply with the Urban Residential - 7(UR-7) zone and all other
applicabie Spokane County Zoning Code chapters, as amended.
2. The final short plat map shall be prepared in accordance with Section 12.300 of the
Spokane County Subdivision Ordinance.
3. The final short plat shall be designed substantialiy in conformance with the preliminary
short ptat of record. No increase of density or number of tracts shall occur without a
change of condition application submittal and approval.
4. The preliminary short pfat is given conditional approval for five (5) years, specifically to
May 9th, 2007. The applicant may submft an extension of time application at least thirty
(30) days prior to the above expiration date, but no later than April 9th, 2007. An
application for an extension of time shall be processed under the provisions of Chapter
12.100.118 (Extension of Time) of the Spokane Caunty Subdivision Ordinance. If the
applicant complies with the criteria of Chapter 12.100.118, the preliminary approval and
conditions will be changed to reflect the adopted policy and development regulations at
the time of the extension application. Submission of a time egtension request following
April 9th, 2007 will not be sccepted, and the preliminury short plat will become nnll
and void on May 9th, 2007 if tUe final short plat is not recorded in the Connty
Auditor's Oifice.
5. Prior to flling the final short plat, the applicant shatl submit to the Division of Planning
Director/designee for review any proposed final short plat to ensure compliance with these
Findings and Conditions of Approval.
6. A survey is required of the subject property prior to filing the final short plat.
7. Appropriate road names and street addresses shall be indicated on the final short plat
map prior to preparation of the final mylar (Note: The Division of Building and Code
Enforcement reserves the right to confirm the actual address at the time of bullding
permit).
8. Appropriate utility easements shall be indicated on the final short plat map. Approval of
utility easements by utitity companies shall be submitted with the final short plat.
9. The dedication shall contain the following statement: " Front, side and rear yard setbacks
shall be determined at the time building permits are requested."
10. The Spokane County Division of Planning shall prepare and record with the Spokane
County Auditor a"Title Notice" noting that the property in question is subject to a variety

shali serve as official public notice regarding conditions of approval affeciing the property
in question. The 'Title Notice" shall be recorded within fifteen (15) days of Final Plat
approval and shall only be extinguished by the Spokane County Division of Planning.
11. Four (4) current Certificates of Tit1e shall be fumished to the Division of Planning prior to
filing the final short plat.
12. The final short plat map shall illustrate the minimum ftontage requirements for the
development of a duptex pursuant to Section 14.618.315 of the Spokane County Zoning
Code.
13. The final short plat map shall illustrate appropriate labels for the two (2) proposed lots.
SPOKANE COUNTY DIVISION OF ENGINEERING & ROADS
1. Conditional approval of the plat by the County Engineer is given subject to approval of the
road system as indicated in the preliminary plat of record.
2. No construction work is to be performed within the existing or proposed public right-of-
way until plans have been accepted by the County Engineer and a permit has been
issued by the County Engineer. All work is subject to inspection and approval by the

notice, Spokane County has the right to correct the maintenance faiiure, or have it
corrected, at the expense of the property owner.
• There may exist properties, located uphill and adjacent to this subdivision, which
periodically discharge stormwater runoff onto individual lots within this plat. Runoff from

roads, approaches, drainage and fees in new construction.
11. The County Engineer has examined this development proposal and has determined that

13. The Spokane County Engineer has reviewed this project for transportation concurrency
and determined that it is exempt under the Phase I- Development Regulations - Secction

SPOKANE REGIONAL HEALTH DISTRICT
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County Engineer, and the Spokane Regional Health District. Written approvat of the
easements by the utility companies shall be received prior to the submittal of the finat
plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane Regional Health District that an adequate and potable water supply is available
to each lot of the plat.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the
recorded service area of the water system proposed to serve the plat.
8. A public sewer system will be made available for the plat and individual senrice will be
provided to each lot prior to sale. Use of individual on-site sewage disposal systems
shall not be authorized.
9. The existing on-site sewage system must be abandoned in accordance to the Spokane
Regional Health District rules and regulations for sewage disposal.

system, pursuant to the Water Plan approved by county and state health authorities, the
local fire protection district, County Building and Safety Department and water purveyor,
shall be installed within this subdivision and the applicant shall provide for individual
domestic water servioe as well as fire protection to each lot prior to sale of each lot and
prior to issuance of a building permit for each lot.
SPOKANE COUNTY DIVISION OF UTILITIES
1. As per the Spokane County Zoning Code Phase One Development Regulations the
dedicatjon shall state: Public sewers shall be constructed to provide for the connection
of each parcel to the County's system of sewerage. Uses on properties within the
project shall be required to connect to the sewer and pay applicable charges per the
County Sewer Ordinance. Sewer connection permits shall be required.
2. Applicant shall submit expressly to Spokane County Division of Utilities "under separate
cover', only those plan sheets showing sewer plans and specifications for the public
sewer connections and facilities for review and approval. Commercial developments
shall submit historical and or estimated water usage as part of the sewer plan submittal.
3. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the
finalization of the project.
4. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
SPOKANE COUNTY FIRE DISTRICT N0.1
1. The Spokane County Valley Fire Department will require that the driveway to the north

I'hat the individuals and parties narued herein as having an interest in tbe above described properry or project agree
to the following:
1. Reimburse Spokane County for project review and inspection fees as specified in Chapter 9.14 of
the Spokane County Code. The fees will be based on actual salary costs incurred by Spokane
County for project reviews and / or inspecdons plus a ten percent administrative charge, and will
be billed monthly as accrued. Any billing amounts due, including any expenses incurred in the
collection of an overdue account, must be paid prior to the County's acceptance of the project for
fiUng. If a project is approved andlor filed with a balance still owing, the unpaid balance shall be
paid within 30 days of the invoice date.
2. The undersigned agrees that these fees are due and payable upon receipt of the biliing as specified
above.
3. Any invoices not paid within 30 days of the invoice date will be considered detinquent. [f any
outstanding balance on the account for this project is not paid within 30 days of the invoice dace,
no further reviews of the projeet documeats will be conducted until the entire account balance is
paid. Any, balance on the account for this project not paid withia 65 days of the invoice date may'
result in legal action or the initiation of odier collection procedures, including referral to a
collection agency. The Sponsor will be liable for any and alI expenses incurred by the County for
' the collection of overdue accounts.
