1) Drainage easements, as platted and shown hereon, which are for the purpose of
installing, ope rating and maintaining drainage swales and d rainage facilities
to dispose of runoff, are hereby granted.
- The property owner' shall maintain the drainage
swale with a permaneat live cover of lawn turf, with optional shrubbery
and/or ttees, which do nnt obstruct the flow and percolation of storm
drainage water in the d rginage swale as indicated by the appro ved plans.

(4) Spokane County doee not accept the responsibility of maintaining the drainage
course on privaCe lots within drainage easements or floodplain areas, nor the
responsibility for any drainage, whatsoever, including but not limited to
inverse condemnation to any properties due to deficient construction and/or
maintenance of drainage courses in drainage easements on private property.
(5) Developaent within this subdivision shall conforan to the requirements of the
National Flood Insurance Program and Chapter 3.20 of the Spokane County
Code. The lowest floor, including basement floor, for any structure shall be
conetructed according to the requirements of the Spokane County Flood Zone
regulations in effect at the Cime a building permit is issued. Purchasers of
property in this subdivision are warned of possible flooding or ponding and
the potential requirement to purchase Flood Insurance. This warning shall be
carried in each and every deed drawn to transfer ownership of any and all
property within this plat in tbe Area of Special Flood Hazard.
(6) An approved lot grading plan exiats for Lots , , and ,

fixed through public hearings for service or benefit obtained by the
planning, design, constructing, maintaining, or operation of stormwater

(9) A statement must appear in the dedicatory language of the plat that
individual driveway access petmits be required prior to issuance of a
building permit for driveway approaches to the County road system. This
approach shall be constructed in accordance with the approved plan on f ile in
the Countq Engineer's office.

IN THE MATTER OF ) FINDINGS OF FACT,
SHORT PLAT NO. SP-689-91 } CONCLUSIONS AND
DECISION
THIS MATTER, an application for subd.ivision of land, from Don Henrichs has been
r+eceived and decided upon, pursuant to Spokane County Subdivision regulations, on the
~ day of May, 1991.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide 5 acres into Z lots for med.ical office uses.
3. The proposal is located on the southeast corner of Mission Avenue and McDonald Road
in the NW 1/4 of the NE 1/4 of Section 15, Township 25 North, Range 44 EWM,
Spokane County, Washington.
4. The current zoning of the property is Urban Residential-22 (UR-22) which was
established in 1989 (see File ZE-30-89). The proposed lot sizes, frontage and intended
uses are allowed wittun this zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are generally in accord with this category.
6. The required public notice was provided for this proposal and agencies having a potential
i.nterest in the project were notified and recommendations solicited.
7. No one in the area commented on the proposal.
8. A single medical office structure is under construction on the north Iot of the proposed
short plat. The site plan for the medical office under construction was approved in the
public hearing for ZE-30-89.
9. The proposed shorc plat will be served by a public water system.
10. Surrounding uses are residential, undeveloped and offices.
11. Recognizing the recommended conditions and Spokane County development standards,
the proposed subdivision makes appropriate provisioas for the public health, safety and
general welfare and that the pubiic use and interest will be served by platting the
subdivision.
12. The Spokane County Arterial Road Plan identifies McDonald Road as a Minor Arterial
with a proposed right of way width of 80 feet. The exisring width of 65 feet is
inadequate to implement the plan. A S foot future acquisition area shall be set aside in
reserve.
13. The Spokane County Arterial Road Plan identifies Mission Avenue as a Minor Arterial
with a proposed right of way width of SO feet. The existing width of 60 feet is
inadequate to implement the plan and 8 feet of future acquisition area shall be set aside in
reserve in add.ition to the requued 2 feet of roadway dedication.
14. The project is exempt from environmental review under the State Environmental Poliey
Act pursuant to WAC 197-11-500 (fi) (a).
DECISION
Based upon the above noted F'indings of Fact and Conclusions, Short Plat Applicution
SP-689-91 is hereby A.PPROVED until June 1, 1994, subject to conditions noted
below. Most of the eonditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.

These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. The preliminary plat of record approval is for the property legally described in the
application for this proposal.
2. The owner(s)/applicant shall comply with the candidons af approval for the zone
reclassificatian found in file ZE-30-89.
3. All conditions imposed by the Planning Department shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors.
4. The proposal shall comply with the Urban Residenval-22 (UR-22) zone(s) as amended.
5. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submittal aad approval.
6. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
7. Appropriate road name(s) shall be indicated.
8. The preliminary plat is given condidonal approval for three (3) years, specifically to
June 1, 1991. 1'he applicant may request an extension of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.
9. Three (3) current certificates of ride shall be furnished to the Planning Department prior
to filing the final plat.
10. The Spokaae County Planning Department shall prepare and record with the County
Auditor a Title Notice specifyiag a future land acquisition area for road right-of-way
and urilities. The reserved future acquisition area Title Notice shall be released, in full
or in part, by the Planning Department. The notice should be recorded within the same
time franae as an appeal and shall provide the following:
a. At least S feet of reserved future acquisition area for road right-of-way and
utilities, in additioa to the existing and/or newly dedicated right-of-way along
McDonald Road.
b. At least 8 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing and/or newly dedicated right-of-way along
McDonald Road. NOTE: The County Engineer has required 2 feet of new
dedication.
b. Future building and other setbacks mquired by the Spokane County Zoning Code
sball be measured from the reserved future acquisitaon area.
c. No required landscaping, pazking, '208' areas, drainfield or allowed signs should
be located within the future acquisition area for road right-of-way and utilides. If
any of the above improvements are made within this area, they shall be relocated
at the applicant's expense when roadway impmvements are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,
parldng, surface drainage, drainfield, signs or others) shall be considered interim
uses.
11. The final plat map shall indicate by a clear, dashed line the required yard setbacks frotn
all private, "Tract X" or public roads. The dedication shall contain the following
statement:
"Side yard and rear yard setbacks shall be determined at the time building perm.its are

requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on tlus plat may be varied from if proper zoning approvals are obtained."
12. A plan for water facilities adequate far domestic service and fim protection shall be
approved by the water purveyor, appropriate fire protection district, County Building &
Safety Department and County Health District. The agencies will certify on the Water
Plan, prior ti) the filing of a final plat, that the plaa is in confoa-mance with their
respecdve needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproducaon and be signed by the plat sponsar.
13. The water purveyor shall certify that appropriate contractual arrangements and scbedule
of improvements have beea made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule sball provide
for completion of the water system and inspection by the appropriate health authorities
prior to applicarion for building gernuts within the final plat. The arrangements or
agreements shall include a provi.sion holding Spokane County and the purveyor
hannless from claims by any lot purchaser refused a building permit due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.
14. The final plat dedication shall contain the following statement:
"The public water system, pUrsuant to the Water Plan approved by county and state
health authorities, the local fire protection district, County Building & Safety
Department and water purveyor, shall be installed within this subdivision, and the
applicant shall provide for individual domestic water service as well as fire protection to
each lot prior to sale of each lot and prior to issuance of a building pemzit for each lot."
15. No building permit will be issued for any lot within the fiaal plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuarit
to the approved Water Plan for the final plat" including a signed license stamp. The
certification may be in the faim of a letter, but is preferred to be certified on a copy of
the Water Plan as a schematic map showing the "as-built" water system.
16. A survey is required prior to the filing of a final plat.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right of-way and approval of the road system as indicated in the
preliminary plat of record.
2. Plans, profiles, and cross-sections as designed to County standards sbowing proposed
street centerline and curb grades shall be submitted to the County Engineer for approval
prior to construcdon and/or the filing of each finat plat; road plans to be prepared under
the direction of a licensed Professional Civil Engineer.
3. Drainage plans and design calculations showing the alignment of drainage facilities
shall be submitted to the Counry Engineer for approval prior to construction andlor the
filing of the final plat. Drainage plans to be prepared under the direcdon of a licensed
Professional Civil Engineer.
4. Constructioa within the proposed public streets and easements shall be performed
under tbe direct supervision of a licensed engineer/surveyor, who shall furnish the
Coun t y Engineer with "as-bui.lt" plans and a certificate in vvriting t hat all improvements
were installed to the lines and grades shown on the approved construction plans and
that all disturbed monuments have been replaced.
5. No construction work is to be performed within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and appmval by the County Engineer.
b. All construction within the euisting or proposed public right-of-way is to be completed
prior to filing each final plat, or a bond in the amount estimated by the County Engineer
to cover the cost of construction of improvements, construction certification, "as-built"
plans and monumenting the street centerlines shall be filed with the County Engineer.
7. Individual driveway access penruts are required prior to issuance of a building permit
for driveway approaches to the county road system.

8. Dedication of 2 feet of additional right-of-way along Mission Avenue is required.
9. Existing county roads providing direct access to the plat shall be paved and/or curbed to
Spokane County standards.
10. Sidewalks are required along the arterial(s) on Mission Avenue.
11. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
12. The County Engineer has designated Typical Roadway Secdon Number One,
Secondary Arterial standard for the improvement of Mission Avenue, which is adjacent
to the proposed development. This will require the addition of approximately 12-14
feet of asphalt aiong the firontage of the development. The construction of curbing and
sidewalk is also required.
13. The County Engineer has designated Typical Road.way Section Number One,
Secondary Arterial standard for the improvement of McDonald Road, which is adjacent
to the proposed development.
14. The pmposed subdivision shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
COIIStrt1Ct10A.
15. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
dedication of additional riglat-of-way and the roadway unprovements herein specified.
16. This propased subdivision or development proposal is located within a drainage basin
which has been identified by the Spokane County Engineer's office as having
stormwater runoff pmblems. Since this proposed subd.ivision or developmeot proposal
is affected by or is a contributor to stormwater flows, property owners should
participate in the planning and implementation of a future basinwide stormwater
management system. The following statement shall be placed in the plat ded.icadon:
"The owner(s) or successar(s) in interest agree to join in any County-approved
stonnwater management program and to pay such rates and charges as may be fixed
through public hearings for service or benefit obtained by the planning, design,
constructing, maintairing or operation of stormwater control faciliries."
17. The County Arterial Road Plan identifies Mission Avenue as a Minor arterial. The
existing right-of-way width of 60 feet is not consistent with that specified in the Plan.
In order to implement the Arterial Road Plan, in addition to the required right-of-way
dedicadon, a strip of property 8 feet in vvidth along the Mission Avenue frontage shall
be set aside in reserve. This property may be acquired by Spokane County at the rime
when arterial improvements are made to Mission Avenue.
18. The County Arterial Road Plan identifies 1VIcDonald Road as a Minor arterial. The
existing right-of-way width of 65 feet is not consistent with that specified in the Plan..
In order to implement the Arterial Road Plan, in add.ition to the required right-of-way
dedication, a strip of property 5 feet in width along the McDonald Road frontage shall
be set aside in reserve. This property may be acquired by Spokane County at the time
when arterial improvements are made to McDonald Road.
19. There may exist utilities, either underground or overhead, affecting the subject

COUNTY HEALTH DISTRICT CONDTTIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appnopriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Plazuung Deparnnent to the utility companies, Spokane
County Eagineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
3. A combined surface water and sewage disgosal detailed plan shall be approved by the
Spokane County Engineer aad the Spokane County Health District prior to the issuance
of any on-site sewage disposal pernut or building permit for this project.
4. Sewage disposal method shall be as authorized by the Director of Urilities, Spokane
County.
5. Water service shall be coord.inated through the Director of Utilities, Spokane County
b. Water service shall be by an exisdng public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
7. Prior to filing the fiaal plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve ehe plat.

11. The dedicatory language of the plat will state: "Subject to specific application approval

12. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
13. The plat dedication will contain a statement to the effect that: "The public water system,
as approved by county and state health authorities, the local fire district and purveyor,
will be installed within this plat, and the subdivider will provide for individual domestic
water service as well as fire protection to each lodtract pnor to sale of each lot/tract."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
on compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
permits by the Health Di.strict.
2. The dedication shall state:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the fonnation of ULID by petition method pursuant to RCW
36.94, which petition includes the owner(s)' property; and further not to object by the
signing of a protest petition agai.nst the formation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall aot prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the property as a result of improvements called for in conj uncdon
with the formation of a ULID by either petition or resolution method under RCW
Chapter 36.94."

3. Any water service for this project shall be provided in accordance with the Coor+di.nated
Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for
connection to future areawide collection systems."
5. Applicant shall make connection to public sewer system as soon as it becomes
available. Sewer connection permit is required.
BUILDING AND SAFETY DEPARTMENT CONDTTIONS
1. The applicant shall contact the Department of Building and Safety at the earliest possible
stage of design/development in order to be infornaed of code requirements
administered/enforced by the department, e.g., State Building Code Act regularions,
such as requirements for fire hydrant/flow, fire apparatus access roads, street address
assignment, barrier-free regulations, energy code regulations and general coordination
with other aspects of project implementarion.

Proposal: A request to rezone an approximate 5 acre parcel from Agricultural Suburban
(AS) to Urban Residential-22 (UR-22) for the purpose of developing medical offices.
Location: Generally locaoed at the sautheast corner of Mission Avenue and McDonald
Road in the N.E. 1/4 of Section 15, Township 25 North, Range 44, E.W.M.,
Spokane County, Washi.ngton.
II. SITE ANALYSIS
Comprehensive Plan: Category is Urban
Iaside General Sewer Service Area (GSSA) Boundary
Inside Priority Sewer Service Area (PSSA) Boundary
Inside Urban Impact Area (UTA) Boundary
The Urban category is a land use designation suitable for residential uses at various
densities, and cerrain non-residential uses. Criteria for type and density of a
particular development is dependent upon site specific considerations included are
land use and zoning pattern, location, proximity to arterials, and development
trends. The Conlprehensive Plan recommends that specific measures be considered
to insure compaability between proposed developments and existing or funure
developments. This is especially pertinent in regard to high density residential or
non-residential uses adjacent to low density residential neighborhoods. Measures
to consider may include landscaping, physical separation, height limitations, access
restricaons, screening, and change or modificaaon in intensity of proposed land
use.
Arterial Road Plan:
Mission Avenue and McDonald Road are designated as Minor Arterials. The
Spokane County Arterial Road Plan right of way width is 80' feet as suggested by

the plan, with a recoaunended setback of 35' feet from ultimate right of way on
bath arterials. Existing rights of way of 60' feet are inadequate to unplement the
plans, future dedication and acquisition will be required.

The mixed zoning and land use generally reflects aansition of the iaamediate
area from Rural to Urban. The predominant forces behind the c,hange are the
meidical and service related facilides associated with Valley General Hospital,
which is located approximately 1/4 mile west of the subject property. Existing
single family develvpments, west and sonth of this site are somewhat removed
from Mission Avenue and McDonald Road and are isolated fiom uaffic
associated with medical service uses. Isolation is due to incomplete residential
samets dat dead end without pmviding access between two aroerials. More
recendy, newer offioe and medical related proposals have been approved along
east side of Vercler Road, south of Missioa Aveoue (see file #'s ZE-29-87, ZE-
48-839 ZE-53-86).

A previaus zone change request from Agricultural and Agricultural Suburban to
Urban Residendal-22 for a church, office, and residential use for the subject
property (see file #ZE-23-86) was denied by the Hearing Exaaniner Committee
concluded that development of a large parcel (29.75 acres) without specific
details or detailed site plan, would have a great imgact upon the immediate ama.
However, the Hearing Examiner Committee and opponents of record did
recognize that the development trend occurring immediatelv adjacent to Mission
Avenue would not be to single family residenrial. Further urbanization of the
immediate area occurred when the Board of County Commissioner appruved
Wilmar Mission, a preliminary plat and zone change (see file #'s Z.E-59-87, PE-
1551-87) to develop 9.6 acres into 5 lots for single family dwellings and 102
multi-family dwelling units in the Urban Residendal-3.5 and Urban Residential-
12 Zones. This proposal is located approximately 1/4 mile east of the subject
property.
Aceording to Program to implement Spokane County Zoning Code, on January
1, 1991, existing zoning classifications in area will cross over to new zoning
code as follows: Agricultural and Agricultural Suburban become Urban
Residential-3.5; Residential Office becomes Urban Residential-22.

Site Plan Considerarions:
The applicant proposed development of the_ medical off ce building on the northerly,
1.5: acres of the total 5.03 acre site. The remaining 'southeTly-,portion of ttie rezone
site is not detailed on,the proposed site plan-,, however, proposed Urban Residential-
22 Zone would;peimit, future professional office or 22 apartment.s ~per acre and other
uses permitted in Urtian Residential-22 zone.

Proposed medical office building is designed as a single story structure,
approxirnately 26 feet in height with a"residential" appeamce and character.
_ Majority of off-street parldng areas are oriented to the east portion of the site
abutting an exisring 150 foot wide Bonneville Power Administraaon easenaent
which is traversed by overhead and below-ground lines. Orientation of parldng
toward the power line and vacant property to east and south mitigates impact upon
single family development to west
Proposed site plan provides for future dedication and a,cquisition areas along
Mission Avenue and McDonald Road, with required setbacks measured from future
right of way. Access is shown both w Mission Avenue and McDonald Road.
Type I landscaping is indicated on the east portion of the site adjacent to off-saeet
parking are, (but outside power line easement) and along porcion of proposed
structure. No landscape details are indicated for southerly portion of the site.

The site plan submitted for review by the Zoning Hearing Examiner Committee
is general in nature. DeWed review to detes,mine compliance with all Or+dinance
regularions and coaditions of approval is recommended to be administrative and
to occur at the Building Peraait stage.
I V. SITE DEVELOPMENT RECOMMENDATIONS
Design: The proposed design concept, featuring a medical office with a r+e,sidential
appearance, orientation of parlang to undeveloped areas, and location at inmrsection
of two minor z%ri.als, is consistent with development trend along Mission Road far
similar parcels t,o west of subject property, and is an appropriate buffer design.
Higher intensity ofFice uses should be found in close proximity to Mission Avenue
with a transition south along McDonald Roa,d to less intensive use.s.
Lsndscaping: The site plan generally indicates landscaping on the Mission Avenue and
McDonald Road frontage, adjacent to off-smeet parldng areas and around the
proposed strvcture. Specifically, the landscaping is inconsistent with Spokane
County Zoning Code standards as follows. The site plan indicates 10 to 15 feet of
Type III landscaping along Mission Avenue and McDonald Road. However, the
Spokane County Zoning Code requir+es Type III landscaping along a street to a width
of 20 feeG Zoning Code requirements also specify provision of 20 feet of Type I
landscaping, a six foot site obscuring fenCe or wall, or solid landscaping, adjacent to
a Urban Residential-3.5 zone. However, existing Bonneville Power Administration
easement and overhead power lines may prevent installation of nequired landscaping
and fence/wall on east property line. Detailed review for compliance with standards
will occur at building permit stage. LJse of power line easement for required
landscaping, screening, drainfield, and "208" area will require approval of Bonneville
Power Administration.
Signage: As per Urban Residential-22 Zone requirements.

Ciirculation/Access: The Spokane County Engineer requires dedication of Z feet along
McDonald Road and Mission Avenue and a 20' radius at the intersection of said
suwts for improvements to consist of additional asphalt, curbing, and sidewallcs. To
nutigate tiraffic impacts to adjoining single famity residences to west, the Hearing
Examiner Committee may want to prohibit vehicular access to McDonald Road.
Easements: Use of existing easement for "208" area and drainfield will require letter of
approval from Bonneville Power Administration prior to release of building pennit.
V. SEPA ENVIRONMENTAL REVIEW
An Environmental Checklist was submitted by the sponsor and was reviewed by the
County Plaaning Department The review considered the specifics of the proposal,
other available information, County ordinances, other regulations and laws, possible
standard Conditions of Approval, the Ge.neralized Comprehensive Plan, and other
County policies and guidelines. The 7oning Administranor has determined that "No
pmbable significant adverse unpacts" would result from the pmposal being developed
and has issued a D,ernruna ' n n-SiQnifcance ("DNS").
The "DNS" was cinulated oo 10 other agencies of jurisdiction and other
agencies/departments affected by the future development for review and commenL The
"DNS"/"1VIDNS" comment period ends September 19,1989 aad was advertised 15
calendar days before said date in the newspaper, by letter to adjacent pmperty owners
within 400 feet of the proposal, and by notice on a sign posted on the proposal site.
The Hearing Facaminer may consider additional envimnmental related testimony and the
"DNS" at the public hearing.
YI. PLANNING DEPARTMENT SUMMARY
1. The Comprehensive Plan within the Urban Category supports high density
residential a.nd service rel,a,ted non-residential uses along major artrerials where
impacts to residendal development can be mitigated.
2. Both Mission Avenue and McDonald Road are arterials that provide good access to
the site. Traffic can direcdy access these arterials without circulating through
adjoiaing single family areas.
3. That proximity of Valley General Hospital has encouraged a change in land use to
medical, office, and multi-family uses that is slowly expanding, in a transition
pattern east along Mission Avenue. The proposed zone reclassification is consistent
with this development trend.
4. That existing Bonneville Power Administration easement and power lines, togethcr
with assoeiated development restrictions makes the site less desirable for low-
density residendal development.
5. The Spokane County Zoning Code will provide buffering techniques and landscape
standards that will provide aesthetic amenities to the proposed development.

6. Approval of portion of proposed zone reclassification is consistent with previous
land use actions in area, as cvidenced by approval of high density residential
prnposal to east of subject property, and approval of seveTO medical related zone
change requests to west of site.
7. Denial of remainder of proposed zone change request is supported by previous land
use action for subject property, in which no specific details of future development
were disclosed. Therefore, potieatial impacts could aot be measured, nor
consistency with adjacent uses evaluated.
VII. CONDTTIONS OF APPROVAL
All Conditions imposed by t6e Hearing Examiner Committee shalt be
binding on the "Applicant", w6ich term shall inctude the owner or
owners of the property, 6eirs, assigns, and successors.
COUNTY PLANr1ING DEPARTMENT
1. Legal description:
Starting at the N.W. corner of the N.E. 1/4 of Section 15, Township 25 North,
Range 44 Easterly on Mission 325' then southerly 675' tben westeriy 325' then
northerly 675' to point of beginning. 2. Approval is required by the Planning Director/designee of a specific lighting and
signing plan for the described property prior to the release of any building permits.

3. A specific landscape plan, planting schedule and provision for maint,enance
acceptable to the Planning Director/designee shall be submitted with a peifoxmance
bond for the project prior to release of building pernrits. L,andscaping shall be
installed and maintained such that sight distance at access points is not obscured or
' aired.

4. The applicant shall develop subject property generally in accardance within the
concept presented to the Hearing Examiner Comtnittee. Variations, when approved
by the Planning Director/designee, will be permitted, includ.ing, but not limited to
the following changes: building location, landscape plans, and general allowable
uses of the permitted zone. All variatioas must conform to regulations set forth in
the ZONAVG CODE FOR SPOKANE COUNTY. The original intent of the
development plans shall be maintained.
5. The specific development plan will be submitted for Planning Department review
and approval prior to issuance of building perrnits.
6. All cuurent standards of the Urban Residendal-22 (LTR-22) Zone, as amended,
shall be complied with in the development of this site.
7. The present proposal is not detailed enough to determine whether or not the use of
or materials stored on the site are in compliance with Section 14.706 (Aquifer
Sensitive Area Overlay Zone) of the ZONING CODE FOR SPOKANE C4UNTY.
Accordingly, as a condition of approval, the sponsar/applicant shall be required to

file with the Spokane County Auditor, within thirty (30) days of the signing of
F'indings and Onder of the final decision in this matter, a"Notice to the Public"
which shall provide in rnaterial as follows:

8. Applicant shall comply with 208' recommendations conceming soonnwater runoff
and pmvide necessary landscaping for runoff.
9. Any division of land for die pcnpose of sale, lease or transfer, shall camply with
RCW 58.17 and the Spokaue County Platting Ordinances priar to issuance of
building permits.
10. Spokane County Planning Deparmaent recard with the County Audioor a'"Tide
Notive," prepared and signed by the applicant, for a future aQquisition area for road
right of way and utilities to run with the Iand The future acquisidon area reservation
shall not be reraoved without prior approval by die Spokane County Planning
Deparmnent The nodce shall be recorded prior to the issuance of a building permit
and shall provide the following:
a. At least 8 feet of future acquisidon area for roa,d right of way and utilities, in
additi on to the existing right of way, along Mission Avenue and McDonald Road.
b. Building and other setbacks required by the Spokazie County Zoning Code shall be
measured from the future acquisition area reserved for road right of way and
utilities.
c. No required landscaping, parking, '08' areas, drainfield or allowed signs shaU be
withia the future acquisition area for road right of way and utilities. If any of the
above improvements are made within this area, they shall be relocated at the
applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired by Spokane County, shall be private
property and may be used as allowed in the zone except any improvements (such as
landscaping, parlcing, surface drainage, drainfields, signs, or others) shall be
considered "interim" uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after
acquiring said future acquisidon area.
f. This "Tide Notice" shaU be signed by the appiicant to serve as official notice and
aclrnowledgment of said future acquisition area for road right of way and utilities.

11. The Spokane County Planning Department shall prepare and record with the
Spokane County Auditor a"Tide Notice" noting that the pmperty in question is
subject to a variety of special conditions unposed as a result of approval of a land
use action. This "Title Nodce" shall serve as official public nodce regarding
conditioas of approval affectiag the property in quesdon. The "Tide Notice" shall
be recorded within fifteen (15) days of final d.isposition of the approved land use
action and shall only be extinguished by the Spokane County Planning Deparament.
The '"Tide Notice" shall generally provide as follows:
The parcel of property legally described as (legal description and taz parcel
number) is the subject of a land use action, imposing a variety of
speciat development conditions, by a Spokane County Hearing Body
or Administrative Official on (date) and as maybe amended, altered or

COUNTY ENGINEERING DEPARTMENT

1. Applicant shall dedicate 2 feet on McDoaald Road and Mission Avenue and a 20
foot radius at the McDonald - Mission int,ersection for right of way.
2. Access pernnits far approaches co the County Road System shall be obtained from
the Spokane County Engineer. .
3. Applicant shall submit for approval by the Spolcaae Counry Engineer road,
drainage, and access plans.
4. The applicant shall submit for approval by the Spokane County Engineer and the
Spokane County Health District a detadled combined on-site sewage system plan
and surface water disposal plan for the entire project or any portion thereof, if the
development is to be phased.
5. A paridng plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, locadon, and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for ainy portion of
the project which is to be oeeupied or traveled by vehicles.
f. The County Engineer has designated Typical Roadway Section Number One,
Secondary Arterial Standard for the improvements of Mission Avenue and
McDonald Road, which are adjacent to the proposed developmenL This will
require the addition of approximately 12 to 14 feet of asphalt along che frontage of
the development. Curbing and sidewalk must also be constructed.
7. All requir+ed innprovements shall conform to the curnent State of Washington
Standard Specificadons for Road and Bridge Consavction, and other applicable
County standards and/or adopted resolutions pertaining to Road S tnndards and
Stoimwater Management in effect at the date of conscrucaon, unless otherwise
approved by the County Engineer.

8. Roadway standards, typical roadway secdons and drainage plan requirements are
found in Spokane Board of County Commissioners' Resolution No. 80-1592 as
amended and are applicable to this proposal.
9. No consuuction work is to be performed within the existing or proposed public
right-of-way until a peranit has been issued by the County Engineer. All work is
subject to inspection and approval by the Counry Engineer.
10. All required constructioa within the existing or proposed public right of way is to
be completed prior to the release of a building pemnit or a bond in the ainount
estimated by the County Engineer to cover the cost of construction of impmvements
shall be filed with the County Engineer.
11. The county Arterial Road plan identifies M'ission Avenue and McDonald Road as
Minor Arterials. The existing right of way width of 60 ft is not consiscent with that
specified in the Plan. Ia order to implem+ent the Artecial Road Plan it is
recommended that in addidon to the required right of way dedicadon, a strip of
praperty 8 ft. in width along the Mission and McDonald frontages be set aside in
reserve. This property may be acquired by Spokane County at the time whea
Arttmial Impravements are made to Niission ar McDonald.
COUNTY UTILTTIES DEPARTMENT-
1. Pursuant to the Board of County C:omnussioners Resolution No. 80-0418, the use
of on-site sewer disposal systems is hereby authoiized. This authorization is
conditioned on compliance with all rules and regulations of the Spokane County
Health District and is fiutiher conditioned and subject m specific application
approval and issuance of pemuts by the Health District
2. The dedication shall state: '"The owner(s) or successor(s) in interest agree to
authorize the County m place their name(s) on a petition for the farmation of ULID
by petition method pursuant to RCW 36.94, which the pedtion includes the
owner(s)' property; and further not to object by the signing of a protest pedtion
against the foranation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the owner(s)' property. PROVIDED this condition shall not

1. Water Purveyor is Modern Electric Water Company and they will supply the site
with adequate water for domestic, fire and irrigation uses.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All air pollution regulations must be met. This includes but is not limited to the
followin e:
2. Air pollution regulations require that dust emissions during demolition, excavation
and construction projects be controlled. This may require use of water sprays,
tarps, sprinklers, or suspension of activity during certain weather conditions. Haul
roads should be treated and emissions from the transfer of earthen material must be
controlled as well as emissions from all other construcaon related activides.
3. Measures must be taken to avoid the deposiaon of dirt and mud from unpaved
su.rfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immed.iately to clean these surfaces.
4. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved
and kept clean.

BEFORE THE SPOKANE COUNTY PLANNING DEPARTMENT
IN THE MATTER OF ) FINDINGS OF FACT,
SHORT PLAT NO. SP-689-91 ) CONCLUSIONS AND
DECISION
THIS NIATTER, an application for subdivision of Ia.nd, from Don Henrichs has been
received and decided upon, pursuant to Spokane County Subdivision regulations, on the
~ day of May, 1991.
FINDINGS OF FACT AND CONCLUSIONS
1. The ind.ividual signi.ng below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to d.ivide 5 acres into 21ots for medical office uses.
3. The proposal is located on the southeast corner of Mission Avenue and McDonald Road
in the NW 1/4 of the IVE 1/4 of Section 15, Township 25 North, Range 44 ENVNi,
Spokane County, Washington.
4. The current zoning of the property is Urban Residential-22 (UR-22) which was
established in 1989 (see File ZE-30-89). The proposed lot sizes, frontage and intended
uses are ailowed within this zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are generally in accord with this category.
6. The required public notice was provided for this proposal and agencies having a potential
interest in- the project were notified and recommendations solicited.
7. No one in the area comunented on the proposal.
8. A single medical office structure is under construction on the north lot of the proposed
shon plat. The site plan for the medical office under consmaction was approved in the
public hearing for ZE-30-89.
9. The proposed short plat will be served by a public water system.
10. Surround.ing uses are residential, undeveloped and offices.
11. Recognizing the recommended conditions and Spokane County development standards,
the proposed subdivision makes appropriate provisions for the public health, safery and
general weifare and that the public use and interest will be served by platting the
subdivision.
12. The Spokane County Arterial Road Plan identifies McDonald Road as a Minor Arterial
with a proposed right of way width of 80 feet. The existing width of 65 feet is
inadequate to implement che plan. A 5 foot future acquisition area shall be set aside in
reserve.
13. The Spokane County Arterial Road Plan identifies Mission Avenue as a Minor Anerial
wich a proposed right of way width of 80 feet. The existing width of 60 feet is
inadequate ta implement the plan and 8 feet of future acquisition area shall be set aside in
reserve in addidon to the required 2 feet of madway dedicarion.
14. ne project is exempt from environmental review under the State Environmental Policv
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat gpplicaaan
SP-689-91 is hereby APPROVED until 7une 1, 1994, subject to conditions noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
apFealed in writing, consistent with adopted appeal procedures.

These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. 1'he preIiminary plat of record approval is for the property legally described in the
applicarian for this proposal.
2. The owner(s)/applicant shall comply with the conditions of approval for the zone
reclassification found in file ZE-30-89.
3. All conditions imposed by the Planning Department shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heirs,
assigns and successors.
4. The pragosal shall comply with the Urban Residential-22 (UR-22) zone(s) as amended.
5. The final ptat shall be designed subscantially in conformance with the preli.minary plac
of record No increase of density or number of lots shall occur without a change of
cond.ition application submittal and appmval.
6. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
7. Appropriate road name(s) shall be indicated.
8. The preli.minary plat is given cond.itional approval for thme (3) years, specifically to
June 1, 1991. The applicant may request an extension of time by subrYUtting a writcerz
request approximately forty-five (45) days prior to che above expiration date.
9. Three (3) current certificates of title shall be furnished to the Planning Departinen[ prior
to filing the final plat.
10. The Spokane County Planning Department shall prepare and record with the Countr
Aud.itor a Tide Notice specifying a future Iand acquisition area for road right-of-way
and utilities. The reserved future acquisition area Title Notice shall be released, in fuli
or in part, by the Planning Department. The notice should be recarded within the same
time frame as an appeal and shall provide the following:
a. At least 5 feet of reserved future acquisition area for road right-of-way and
urilities, in addition to the existing artd/or newly dedicated right of-way along
McDonald Road.
b. At least 8 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing andlor newly ded.icated right-of-way along
McDonaid Road. NOTE: The County Engineer has required 2 feet of new
dedication.
b. Future building and othes setbacks required by the Spokane County Zoning Cnde
shall be measured from the reserved future acquisidon area.
c. No required landscaping, parking,'20$' areas, drainfield or allowed signs should
be located within the future acquisition area for road right-of-way and utilides. If
any of the above impmvements are made within this area, they shall be relocaced
at the applicanes expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,
parlang, surface drainage, drainfield, signs or others) shall be considered interim
uses.
11. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedicadon shall contain the following
statement:
"Side yard and rear yard setbacks shall be determined at the time building peYmits are

requested unless these setbacks are specifically clrafted on this final plat. The setbacks
indicated on this plat may be varied fiom if proper zoning approvals are obtained."
12. A plan for water facilities adequaie for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection distnct, County Building & ~
Safety Dcpartment and County Health DistricG The agencies will certify on the Wacer Plan, prior to the filing of a final plat, that the plan is in conformance with their
respective needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
13. The water purveyor shall certify that appropriate conaactual arrangements and schedule
of unprovements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for completion of the water system and inspection by the appropriate health authorities
prior to application for building permits within the final plat. The arrangemeots or
agreements shall include a provision holding Spokane County and the purveyor
hannless from claims by any lot purchaser refused a building permit due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.
14. The final plat dedicazion shall contain the following statement:
"The public water system, pursuant to the Water PIan approved by county and stace
health authoriaes, the local fire protecdon district, County Building & Safety
Depaztment and water purveyor, shall be installed within this subd.ivision, and the
applicant shall provide for individual domestic water service as well as fire protection to
each lot prior to sale of each lot and prior to issuance of a building pennit for each lot."
15. No building pernlit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pursuan c
to the approved Water Plan for the final plat" including a signed license stamp. The
certification may be in the form of a letter, but isprefened to be certified on a copy of
the Water Plan as a schematic map showing the "as-buiIt water system.
16. A survey is required prior to the filing of a final plat.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The cond.iaonal approval of the plat is given by the County Engineer subject to
dedication of right of-way and approval of the road system as indicated in the
preliminary plat of record.
2. Plans, profiles, and cross-sections as designed to County standards showing proposed
sueet centerline and curb grades shall be submitted to the County Engineer for approval
prior to constiuction and/or the filing of each final plat; road plans to be prepared under
the direction of a licensed Professional Civil Engineer.
3. Drainage plans a.nd design calculations showing the alignment of drainage faciliaes
shall be subnutted to the County Engineer for approval prior to construction and/or the
filing of the fiaal plat. Drainage plans to be prepared under the direction of a licensed
Professional Civil Engineer.
4. Construcaon within the proposed public streets and easements shall be performed
under the direct supervision of a licensed engineerjsurveyor, who shall furnish the
County Engineer with "as-built" plans and a certificate in writing that all improvemencs
were installed to the lines and grades shown on the approved construction plans and
that all disturbed monurnents have been replaced.
5. No construction work is to be performed within the existing or praposed public righr-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
b. All construction within the existinng or proposed public right-of-way is to be completed
prior to fil.ing each final plat, or a bond in the amount estimated by the Counry Engi.neer
to cover the cost of construction of improvements, construetion certification, "as-built"
plans and monumenting the smeet canterlines shall be filerl with the County Engineer.
7. Individual driveway access permits are required prior to issuance of a building perniic
for driveway approaches to the county road system.

8. Dedication of 2 feet of additional right-of-way along Mission Avenue is required.
9. Existing county roads groviding direct access to the plat shall be paved andlor curbed to
Spokane County standards.
10. Sidewalks are required along the arterial(s) on Mission Avenue.
11. The word "applicant" shall include the owner or owners of the propercy, his heirs,
assigns and successors.
12. The County Engineer has designated Typical Roadway Section Number One,
Secondary Arterial standazd for the impmovement of Mission Avenue, which is adjacent
to the proposed development. This will require the addition of approximately 12-14
feet of asphalt along the frontage of the developmenL The construction of curbing and
sidewalk is also required.
13. The County Engineer has designated Typical Roadway Section Number 4ne,
Secanciaiy Arterial standard for the improvement of McDonald Road, which is adjacent
to the pr+oposed development.
14. The proposed subdivision shall be unproved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
construction.
15. The County Engineer has examined this deveiopment proposal and has determined that
the impact of this proposal upon the existing county road system wazrants the
dedicatian af addiaonal right-of-way and the roadway improvements herein specified.
16. This proposed subdivision ar development proposal is located within a cirainage basin
which has been identified by the Spokane County Engineees office as having
stormwater runaff problems. Since this proposed subd.ivision ar development proposzi l
is affected by or is a contributor to stormwater flows, property owners should
participate in rhe planning and implementation of a future baslnwide stormwater
management system. The followuig statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to join in any County-approved
stonnwater management program and to pay such rates and charges as may be fixed
through public hearings for service or benefit obtained by the planning, design,
constructing, maintairung or operation of stonnwater eontrol facitiaes."
17. The County Arterial Road Pian identifies Mission Avenue as a Minor arterial. The
existing right-of-way width of 60 feet is not consistent with that specified in the Plan.
In order to implement the Arterial Road P1an, in addition to the required right-of-wav
dedicadon, a strip of property 8 feet in width along the Mission Avenue frontage shall
be set aside in reserve. This property may be acqulred by Spokane County at the time
when arterial improvements are made to Mission Avenue.
18. The County Arterial Road Plan identifies McDonald Road as a Minor arterial. The
existing right-of-way width of 65 feet is not consistent with that specified in the Plan.
In order to implement the Arterial Road Plan, in addition to the required right-of-way
dedicadon, a stnp of property S feet in width along the McDonald Road frontage shall
be set aside in reserve. This property may be acqwrzd by Spokane County at the time
when arterial improvements are made to McDonald Road.
19. There may exist utilities, either underground or averhead, affecting the subject
property, including property to be dedicated or set aside for future acquisidon. .
Spokane County assumes no financial obligation for adjustments or relocation
regarding these ualities. Applicant(s) should check with the applicable utility purveyor
and the Spokane County Engineer to determine whether applicant(s) or the uriliry is
responsible for adjustment or relocadon costs and to make arrangements for any
necessary work.
Special Condidons
20. The applicant shall comply with all cond.idons of approval of ZE-30-89 a rezone
applicarion approved for the subject property.

C4UNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record andJor any
attached sheets as noted.
2. Appropriate urility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planni.ng Departiment to the utility companies, Spokane
County Enginecerr and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
3. A combined surface water and sewage disposal detailed plan shall be approved by the
Spokane County Engineer and the Spokane County Health District prior to the issuanr.e
of any on-site sewage disposal permit or building permit for tbis project.
4. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
5. Water service shall be coordinated through the Director of Utilides, Spokane County

1. Pursuant to the Board of County Comnussioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. Thi,s authorizatian is condidoned
on compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific apglication approval and issuance of
permits by the Health District
2. The dedication shall state:
"The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the fonnation of ULID by petition method pursuant to RCW
36.94, which geution includes the awner(s)' property; and further not to object by the
signing of a protest petition against the formarion of a ULID by resoluuon method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecdng to any
assessment(s) on the property as a result of improvements callerl for in con1unction
with the formation of a ULID by either pedtion or resolution method under RCW
