SHORT PLAT NO. SP-691-91 CONCLUSIONS AND
DECISION
THIS MATTER, an application for subdivision of land, from Kelvin Kerbs has been
receir•ed and decided upon, pursuant to Spokane County Subdivision reglilations, on the
.1X 7"* day of Apri1, 1991.
FINDINGS OF FACT AND CONCLUSIONS
1•. The individual signing below has further been properly delegated the responsibility far
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to divide approximately 2.87 a.cres intv 21ots for the development of
single family residences. The proposed lot sizes are .55 acres and 2.3 acres.
3. The proposed short plat is generally located east of and adjacent to Evergreen Road,
approximately 750 feet south of the intersection of Wellesley and Evergreen Road in the
NW 1/4 of Section 2, Township 25 North, Range 44 EWM, Spokane County,
Washington.
4. The current zoning of the property is Urban Residential-3.5 (UR-3.5). The proposed lot
sizes, frontage and intended uses are allowed within this zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
devclopment and uses proposed are generally in accord with this category.
6. T'he required public notice was provided for this proposal and agencies having a potential
interest in the project were notified and recommendations solicited..
7. No one in the area commented on the proposal.
8. One lot contains an existing single family residence with accessory structure(s).
Surrounding uses are residential. ,
The proposed.lots will be servicai by an exisring public water system.
9. The Spokane County Arterial Road plan identifies Evergrzen Road a a Major Arterial with
a projected right of way width of 100 feet. The eacisting width of 60 feet is inadequate to
implement the arterial road plan. In addition to the required roadway dedication, a strip
of land 16 feet wide is reserved as a Future Acquisition Area.
10. Recognizing the recommended conditions and Spokane County develapment standards,
the proposed subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
11. The project is exempt from environmeQtal review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).

DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Applicaaon
SP-691-91 is hereby A►PPROVED until May 1, 1994, subject to conditions noted
below. Most of the conditions of approval shali be accomplished by the applicant andlor
sponsor prior ta finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.

10. The Spakane County Planning Departm+ent shall prepare and record with the County
Auditvr a Title Notice specifying a tuture land actltn'sition area for raad right-af-way
and uribties. The reserved future acquisitian axea Title Notice shall be released, in full
or in part, by the Planning Degartment. Z'he notice shonld be recordeti within the same
rime frame as arr appeal and shall pmvide the followi.ng:
a. At least 16 feet of reserved future acquusition area for road right-af-way and
utilitzes, in additian ta the existing andlor newly dedicated right-of-way alang
Evergreen Road. NOTE: The Caunty Engineer has nequired 4 feet of new
dedicatian. ,
b. Futtue bui.lding and a[her setbacks required by the Spokane Cflunty Zaning Cade
shall be measured frnm tbe resrveci futvre aequisition area.
C. No required landscaping, parldng, '20$' areas, draiafield or allowed signs sbould
be lacated wittiin the future acquisition area for road n.ght-af way and utaities. Tf
any of the above impravements are made withift this area, tbey shall be Xelacated
at rhe appiicant's expense when roadway improvements axe made.
d. The future acquis7itian area, until acquireti, shatl be private property and may be
used as allowed in the zane, except that any i.mprvvements (such as landscaging,
parldng, surface drainage, drainfield, signs or athers) shall ae considered inrerim
uses.
11. 'Ihe final plat map shall indicate by a clear, dashed line the r+cequir+ed yard setbacks from
all private, "Tract X" or public mads. The d+edicatiun shaR contain the fallawfng
statement: "Side yar+d and rear yard setbacks shall b+e determi.ned at the time building perrnits are
requested urless these setbacks are spe.cificaUy drafted on this final plat. The setbacks

13. The water pmveyor shall certify that apprapriate contractual amangements and schedule

system in accordance with the approved Water Plan. The time schedule shall grovide
for completion of the water system and inspection by the appropriate health authoriries
prior to application for building permits within the final p1aG The arrangemeats or
agreements shall include a provision holding Spokane County and the purveyor
hannless from claims by any lot purchaser refused a building perrnit due to the failure
of the subd.ivision sponsor to sansfactorily complete the approved water system.
1•4. The final plat dedication shall contain the following statement:
"The public water system, pursnant to the Waier Plan approved by county and state
health autharities, the local fire grotection district, County Building & Safety

15. No building pennit will be issued for any lot within the final plat until certified by a
Washington state-licensed engineer that "the water system has been installed pwsuant
to the approved Water Plan for the final plat" including a signed license stamp. The
certification may be in the form of a letter, but is prefezred to be certified on a copy of
the Water Plan as a schematic map showing the "as-built" water system.
16. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appropriate water purveyor and fire protection district stating that simple connections to
an existing, approved water system will provide adequate domestic and fire protection
water to enswe the public health, safety a.ad general welfare.
17. A survey is required priar to the filing of a final plat.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
ded.ication of right-of-way and approval of the road system as indicated in the
preliminary plat of record.
2. No construction work is to be perfonned within the existing or proposed public right-
of-way until a permit has been issued by the Counly Engi.neer. All work is subject to
inspection and approval by the Counry Engineer.
3. Individual driveway access permits a,re reqnired prior to issuance of a building pernut
for driveway approaches to the county road system.
4. Dedicatioa of 4 feet of additional right-of-way along Evergreen Road is required.

7. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
8. To construct the road 'unprovements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petidon or resolution
which purpose is the formation of a Road Improvement District (RID) for said
improvements, pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane Counry, the
improvements requh-ed (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provisioa is applicable to Evergreen Road.
9. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road

(CRP) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane County, the

pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This pravision is applicable to Evergreen Road.
10. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in inter+est agree to authorize the County to place
their name(s) on a pedtion for the formation of a Road Tmprovement District
(RID) by the petition method pursuant to Chapter 36.8$ RCW, which petition
. includes the owaer(s)' property, and further not to object, by the signing of a
ballot, to the formation of an RID by the resolution method pursuant to Chapter
36.88 RCW, which resolution includes the owoer(s)' property. If an RID is
fermed by either the petition or resolutian method as provided for in Chapter
36.$8 RCW, the owner(s) or successar(s) further agree:
(a) that the unprovement(s) or construction contemplated within the proposed
RID is feasible;

(c) that the property within the proposed RID is sufficiendy developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment(s) on the
property as a result of the improvements called for in conjunction with the
formation of an RID by either petition or resolution method under Chapter
36.88 RCW, and to appeal to the Superior Court the decision of the Board
of County Commissioners affirming the final assessment roll.
It is further agreed that at such time as an RID is created or any Road
Improvement Project is sanctioned by Spokane County, the i.mprovements
required (curb, sidewalk, drainage control and paving) will be at the sole
expense of the undersigned owner(s), their heirs, grantees and assigas
without participation by Spokane County.
The RID waiver contained in this agreemenx shall expire after ten (10) years
frorn the date of execudon below. However, the owner(s) or successor(s)
agree that if said RID waiver expirzs without construction of the required
improvements, the owner(s) or successor(s) agree to construct the required
improvements at their own expense, pay to Spokane County the then
estimated cost of the required improvements to enable the County to
complete the same, or flnnish a bond or other secure method suitable to the
Coanty (which may include the execution of another RID waiver agreement)
providing for or securing to the County the actual construction of the
improvements.
All of the requirements of this agreement shall run with the land and shall be
binding upon the owner(s), their successor(s) or assign(s)." This provision
is applicable to Evergreen Road.
11. The County Engineer has designated Typical Roadway Section Number One Major
Arterial standard for the improvement of Evergreen Road, which is adjacent to the
proposed development This will require the add.irion of approximately 11-13 feet of
asphalt along the frontage of the development The construction of curbing and
sidewalk is also required.
12. The proposed subdivision shall be improved to the standards set forth ia Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes reguladons for roads, approaches, drainage and fees in new
construcdon.
13. The County Engineer has examined this development proposal and has determined that
the impact of this pmposal upon the existing county road system wazrants the
dedication of add.itional right-of-way and the roadway improvements herein specified.

14. This praposed subdivision or development proposal is locate.d within a drainage basin
which has been identified by the Spokane County Engineer's office as having
starmwater runoff problems. Since this proposed subclivision or development proposal
is affected by or is a contributor to stormwater flows, property.owners should
participate in the planning and implementation of a future basinwide stormwater
management system. The followulg statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to join in any County-approved
stonnwater management program and ta pay such rates and charges as may be fixed
through public hearings for service or benefit abtained by the planning, design,
constructi.ng, maintaining or operation of stoimwater control facilities."
15. The County Arterial Road Plan identifies Evergreen Road as a Principal arterial. The
existing right-of-way width of 60 feet is not coasistent with that specified in the Plan.
In order tD implement the Arterial Road Plan, in addition to the required right-of-way
dedicatioa, a strip of property 16 feet in width along the Evergreen Road frontage shaU
be set aside in reserve. This property may be a,cquired by Spokane County at the time
when arterial unprovements are made to Evergreen Road.
16. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicaied or set aside far future acquisition.
Spokane County assumes no financial obligatioa for adjustments or relocation
regarding these utiliries. Applicant(s) should check with the applicable utility purveyor
a.ad the Spokane County Englneer to detenaaine whether applicant(s) or the utility is
responsible for adjusunent or relocation costs and to make arrangements for any
neeessary work.
CQUNTY HEALTH DISTRICT CONDITIONS
