BOARD OF ADJUSTMENT FINDINGS AND ORDER
FINDINGS AND ORDER REGARDING A REVIEW OF ADMINISTRATIVE ACTION OF THE
SPOKANE COUNTY ZONING ADJUSTOR IN A DECISION TO DENTY APPLICANTS REQUEST
FOR A WAIVER OF VIOLATION.
WHEREAS, Application has been presented to the Zoning Adjustor of Spokane
County, Washington, by Herbert C. Ahl, requesting a Waiver of Violation. The
property in question is generally located as follows:
Section 24, Township 25, Range 43 E.W.M. Lots 1, 2, 3 of
Block 29 Miller Park Addition.
and,
WHEREAS, The Zoning Adjustor of Spokane County, did on the 23rd of
January, 1980, hold a public hearing as provided in Section 4.25 of Title IV
of the Spokane County Zoning Ordinance, on application of Herbert C. Ahl, for
a Waiver of Violation,
and,
WHEREAS, the Zoning Adjustor did after the 23rd of January, 1980, form-
ally act upon said application and did deny said application based upon find-
ings of fact and reason set forth in the official minutes dated the 14th of
February 1980,
and,
WHEREAS, an appeal from the decision of the Zoning Adjustor for Spokane
County was filed on the 20th day of February, 1980, by Herbert C. Ahl, an
objector,

WHEREAS, the Board of Adjustment of Spokane County, did on the flth day
of March, 1980 hold a public hearing as prescribed in Section 4.25 of Title IV
of the Spokane County Zoning Ordinance on the application of Herbert C, Ahl
for said
and,
WHEREAS, at said hearing, opportunity was afforded those favoring and
those opposing said application, and the Board of Adjustment having fully
considered the official records, evidence and testimony given and having made
an investigation of the matter does 'hereby find:

A. FINDINGS:
1. The Board felt that applicants waiver of violation did not constitute a
serious threat to public health, safety, and welfare.
2. That the applicant, subject to appropriate conditions could reduce any
possible hardships on adjoining properties.

B. CONCLUSION:
1. That subject application for waiver of violation is within the intent
of the waiver of violation provisions of the Spokane County Zoning
Ordinance and should be approved subject to appropriate conditions.
C. ORDER:
1. The applicant will obtain appropriate building permits for the attached
structure from Spokane County Building Codes Department and that the
applicant establish a one-hour fire waliont.theoWeat iyall•of. the add-
ition in conformance with requirements of $jlq S}ioklnel Qounty'Buiiding

2. Also, the applicant will obtain approval from the Spokane County Health
District for septic tank disposal on the site.
