IN THE MATTER OF ) FINDINGS OF FACT,
SHQRT PLAT NO. SP-692-91 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for subdivision of land, from Edward Mertens has been
received and decided upon, pursuant to Spokane County Subdivision regulations, on the 11th
day of April, 1991.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The pmposal is to d.ivide 2.25 acres into 2 lots for the development of Light Industry.
3. The proposal is located between I-90 and Indiana Avenue and approximately'1300 feet
east of Pines Road in the SW 1/4 of Section 10, Township 25 North, Range 44 EWM,
Spokane County, Washington.
4. The cun-ent zoning of the property is Light Industry (I-2). The proposed lot sizes,
frontage and intended uses are allowed within this zone.
5. The Spokane County Comprehensive Plan designates this area as Major Commercial.
The development and uses proposed are generally i.n accord with this category.
6. The required public notice was provided far this proposal and agencies having a potential
interest in the project were notified and recommendations solicited.
7. No one in the area commented on the proposal.
8. Recognizing the recommended conditions and Spokane County development standards,
the proposed subdivision makes appropriate provisions for the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision. 9. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-692-91 is hereby APPROVED until May 1, 1994, subject to conditions noted
below. Most of the conditions of approval sball be accomplished by the applicant and/or
sponsor prior to finalization of the sbort subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of tbe
property, heirs, assigns or any' successors-in-interest to property.
PLANNING DEPARTMENT CONDITIQNS
1. The preliminary plat of record approval is for the prngerty legally described in the
appucation for this proposal.
2. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or number of lots shall occUr without a change of
condition applicadon submittal and approval.
3. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Condidons of Approval.

4. The preliminary plat is given conditional approval for three (3) years, specifically to
May 1,1994. The applicant may request an extensian of time by submitting a written
request approximately forty-five (45) days prior to the above expiration date.
5. Appropriate utility easements shall be indicated on copies of the proposed final p1aG
Written apgroval of utility easements by appropriate utility companies shall be received
with the submittal of the final plat.
6. Three (3) current certificates of tide shall be furnished to the Planning Department prior
to filing the final plat,
7. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement:
"Side yarri and rear yard setbacks shall be determined at the time building pennits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be vazied from if proper zoning approvals are abtained."
8. No water plan is required, and a simple tap is needed at the time of building permit
release. 9. A survey is required prior to the filing of a final plat.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedication of right-of-way and approval of the road system as lndicated in the .
prelim.inazy plat of record.
2. Drainage plans and design calculations showing the alignment of drainage facilides
shall be submitted to the County Engineer for approval pnor to construction and/or the
filing of the final plat. Drainage plans w be prepared under the direction of a licensed
Professional Civil Engineer.
3. No construction work is to be performed within the existing or praposed public right-
of-way until a penmt has been issued by the County Engineer. All work is subject to
inspection and approval by the County' Engineer.
4. Individual driveway access pemnits are required prior to issuance of a build.ing permit
for driveway approaches to the county road system.
5. Existing county roads providing direct access to the plat shall be paved andlor curbed to
Spokane County standards. -
6. Sidewalks are required along the arterial(s) on Indiana Avenue.
7. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
8. To construct the mad improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petidon or resolution
which purpose is the formarion of a Road Improvement District (RID) for said
improvements, pursuant ta RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Projecf is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to exisdng

"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the formation of a Road Improvement District
(RID) by the petition method pursuant to Chapter 36.88 RCW, which petition
includes the owner(s)' property, and further not to object, by the signing of a
ballot, to the formation of an RID by the resolution method pursuant to Chapter
36.88 RCW, which resolution i.ncludes the owner(s)' property. If an RID is
formed by either the petidon or resolution method as provided for in Chapter
36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement(s) or construcdon contemplated within the proposed
RID is feasible;
(b) that the benefits to be derived from the formaaon of the RID by the property
included therein, together with the amount of any County participatian,
exceed the cost aad expense of formation of the M; and
(c) that the property within the praposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as autharized under RCW 36.88.090, to object to any assessment(s) on tlie _
property as a result of the improvements called for in conjunction with the

estimated cost of the required improvements to enable the County to

providing for or securing to the County the actual construcaon of the
improvements.
All of the requirements of this agreement shall run with the land and shall be
binding upon the owner(s), their successor(s) or assign(s)." This provision
is applicable to Indiana Avenue.
11. Thc County Engineer has designated Typical Roadway Section Number One, Local
Access standard for the i.mprovement of Indiana Avenue, which is adjacent to the
proposed development. This will require the addition of approximately 2- 4 feet of
asphalt along the frontage of the development. The construction of curbing and
sidewalk is also required.
12. The proposed subdivision shall. be improved to the stanndards set forth in Spokane
County Board of Cominissioners Resolution No. 80-1592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
construction. 13. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
dedication of additional right-of-way and the roadway irnprovements herein specif'ied.
14. This proposed subd.ivision or development proposal is located within a drainage basin
which has been identified by the Spokane County Engineer's office as having
stormwater runoff problems. Since this proposed subdivision or development proposal
is affected by or is a contributor to stormwater flows, property owners should
participate in the planning and implementation of a future basinwide stormwater
management system The following statement shall be placed in the plat dedication:

15. There may exist utilities, either underground or overhead, affecring the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligadon for adjustrnents or relocation
regarding these utilities. Applicant(s) should check with the applicable utility purveyor
and the Spokane County Engineer to determine whether applicant(s) or the utility is
responsible for adjustment or relocarion costs and to make arrangements for any
necessary work.
COUNTY HEALTH DISTRICT CANDITIONS 1. The finaY plat•shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appmpriate utility easements shall be indicated on copies of the preliminary plat of -
record for distribution by the Planning Department to the utility companies, Spokane .
County Engineer and the Spokane County Health District. Written approval of the
easements by the utility companies must be received prior to the submittal of the final
plat.
3. A combined surface water and sewage disposal detailed plan shall be approved by the
Spokane County Engineer and the Spokane County Health District priar to the issuance
of any an-site sewage disposal pernut or building permit for this project. ,
4. Sewage disposal method shall be as authorized by the Directar of Utilities, Spokane
County.
5. Water service shall be coor+dinated through the Director of Utilides, Spokane County.
6. Wacer service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plaL
8. Disposal of sewage effluent beneath paved surfaces is currendy prohibited.
9. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Heatth District that suitable sites for on-site sevvage disposal systems
are available on both tracts.
10. Subject to specific application approval and issuance of permits by the Health Officer,
the use of individual on-site sewage disposal systems may be authorized.
11. The dedicatory language of the plat will state: "Subject to specific application approval
aad issuance of permits by the Health Officer, the use of individual on-site sewage
