Re: Response to Information Request Regarding Flanking Street Yard
Setbacks for 15305 East 3rd Avenue
You have previously advised Kevin Snyder, AICP, Current Planning Manger, of your
interest to construct a carport that would protrude into the existing flanking street
yard setback applied to the subject property identified as Parcel No. 45231.1013
further addressed as 15305 East 3rd Avenue. The subject property is currently
developed with an existing single-family residence constructed in 1970.
Pursuant to Section 14.506.020.8.a. (Allowed Exceptions for Administrative
Exceptions) of the City of Spokane Valley's Interim Zoning Code: "At the time the
subject parcel was legally created the property was zoned under a zoning
classification of the pre-January 1, 1991 Spokane County Zoning Ordinance, and
subsequently on January 1, 1991 a new zoning classification form the Zoning Code
of Spokane, Washington was assigned to the subject property;"
On April 20, 2004, I spoke with Kathy in the Spokane County Planning Department
regarding zoning standards for setbacks in Spokane County's adopted Zoning Code
in effect in 1970 that would pertain to the above mentioned property. . Kathy
confirmed that the standards in Spokane County's 1970 Zoning Code for a flanking
street yard setback in a residential zone was fifteen (15)feet.
Based on this information, the Current Planning Division would be able to process
an administrative exception application for a reduction in the flanking street yard
setback from 25 feet to 15 feet. Please submit a completed Administrative
Exception application (see attached). t

Under Section 14.412.041 of the City Zoning Code, any person aggrieved by this administrative determination has
the right to appeal this administrative decision to the City of Spokane Valley Hearing Examiner. An appeal must
be filed by submitting the appropriate appeal application together with the required fee to the Department. of
Community Development Current Planning,within fourteen(14) calendar days after the decision is issued. Upon
