lands herein deacribed. Said road ahall be conetructed in accordance with
the then adopted County road etandarde for public roads. Said road to

If additional right ot way ie reguired, the ownere, their heire and/or
aseigns agree to deliver to Spokane County a properly eigned and executed

The owner(s) or successor(e) in interest agree to authorize Spokane County
to place their name(s) o» a petitfon for the formation of a Road
Improvement District (RID) by the petition method pursuant to Chapter
36.88 RCW, which petition includes the owner(e) property, and further not
to object, by the eigning of a ballot, or not to protest to the formation
of a RYD by the resolution method pureuant to Chapter 36.88 RCW, which
reeolution includee the owner(s) property. If a RID is formed by either
the petition or resolution method, ae provided for in Chapter 36.88 RCW,
the owner(s) or succeeeor(e) further agree= (1) that the improvemente or
construction contemplated within the propoeed RID ie feaeible, (2) that
the benefite to be derived from the formation of the RID by the property
included therein, together with the amount of any County participation,
exceede the cost and expenae of formation of the RID, and (3) that the
property within the propoeed RID ie eufficiently developed. Provided,
further, the owner(s) or eucceseor(e) sbail retain tho right, as
authorized under RCW 36.88.090, to object to any seeeeement(e) on the
property ae a reeult of the improvemente called for in conjunction with
the formation of a RYD by either petition or reaolutian method under
Chapter 36.88 RCW and to appeal to the Superior Court the decision of the

Our client, Larry Peplinski, has been involved in
discussions with Pat Harper of your office and John Pederson
of the County Planning Department about reducing the number
of tracts in the plat to one and eliminating requirements
for public road dedications. Enclosed is a copy of a letter
from Mr. Peplinski officially requesting that this change be
made. There should be no need for private road easements or
covenants because the project has been revised to a one-
tract subdivision. We have shown a Tract "X" future public
right of way aliqnment and submitted a Tract "X" document
for your review. Please coordinate with the Planning
Department reqardinq these changes.

"TRACT X" IDENTIFIED FUTURE PUBLIC RIGHT-OF-WAY, SUBDIVIDER'S AGREEMENT
"AGREEMENT"
Tract X, as designated upon the short plat and described in the
Spokane County Comprehensive Plan as a'local access street or road' and in
accordance with the standards therein, may be required for future County
street, road or thoroughfare.
"(a) The owner(s), his grantees and assigns, hereby agree to
dedicate Tract X to Spokane County for right-of-way and street purposes at
such time as said Tract X is needed by Spokane County for that purpose. A
deed conveying Tract X to Spokane County shall be executed by the owner,
his grantees and assigns, and shall be delivered to Spokane County upon
demand."
"(b) The owner(s) or successor(s) in interest agree to authorize
Spokane County to place their name(s) on a petition for the formation of a
Road Improvement District (RID) by petition method pursuant to Chapter
36.88 RCW, which petition includes the owners' property, and further not to
object, by the signing of a ballot, to the formation of a RID by the
resolution method pursuant to Chapter 36.88 RCW, which resolution includes
the owner(s) property. If a RID is formed by either the petition or
resolution method, as provided for in Chapter 36.88 RCW, the owners(s) or
successor(s) further aqree: (1) that the improvements or construction
contemplated within the proposed RID is feasible; (2) that the benefits to
be derived from the formation of the RID by the property included therein,
toqether with the amount of any County participation, exceeds the cost and
expense of formation of the RID; and (3) that the property within the
proposed RID is sufficiently developed. Provided, further, the owner(s) or
successor(s) shall retain the right, as authorized under RCW 36.88.090, to
object to any assessment(s) on the property as a result of the improvements
called for in conjunction with the formation of a RID by either petition or
zesolution method under Chapter 36.88 RCW, and to appeal to the Superior
Court the decision of the Board of County Commissioners affirming the final
assessment roll.
It is further agreed that at such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the improvements
requfred (curb, sidewalk, drainaqe control and paving ) will be at the sole
expense of the undersigned owners(s), their heirs, grantees and assigns
without participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10)
years from the date of execution below. However, the Owner(s) or
successor(s) agree to construct the required improvements at their own
expense; pay to Spokane County the then estimated cost of the required
improvements to enable the County to complete the same; or furnish a bond
or other secure method suitable to the County, providing for or securing to
the County the actual construction of the improvements.

Al1 of the requirements of this agreement shall run with the land and
shall be binding upon the owners(s), their successor(s) or assign(s)."
11(c) Timing of the formation of said RID or other road improvement
project shall be determined by Spokane County consistent with RCW 36.88.
The street improvement authorized by the RID or other improvement project
shall call for the improvement of Tract X and its immediate street system
to at least the minimum Spokane County Road standards applicable to Tract X
and the immediate street system at the time the RID, or other road
improvement project, ff a majority of the property owners want a higher
standard, i.e. gutters, underground drainage, etc., that standard shall
prevail."
"(d) Any buildinq constructed on any parcel abutting Tract X shall be
set back from the Tract X boundary by the distance which equals the set
back requirements of the zone."

BEFORE THE SPOKANE CUUNTY PLANNING DEPARTMENT
IN THE MATTER OF ) FINDINGS OF FACT,
SHQRT PLAT NO. SP-700-91 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for subdivision of land, from Larry Peplinski has been
received and decided upon, pursuant to Spokane County Subdivision regulations, on the
-AP*' day of June, 1991.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane Counry Director of Planning.
2. The proposal is to divide approximately 1/2 acre into 21ots for the development of single
family dwellings
3. The proposal is generally located west of lOth Avenue and approximately 200 feet east of
Adams Road in the SE 1/4 of Section 23, Township 25 North, Range 44 E;WM, Spokane
County, Washington.
4. The cunrent zoning of the property is Urban Residential-3.5 (UR-3.5). The proposed lot
sizes, frontage and intended uses are allowed wi.thin this zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are generall.y in accord with this category.
6. The required public notice was provided for this proposal and agencies having a potential
interest in the project were notified and recommendations solicited.
7. No adjacent property owners in the area conunented on the proposed short plat.
8. Recognizing the recommeaded Cdnditions and Spokane County development standazds,
the proposed subdivision makes appropriate provisions far the public health, safety and
general welfare and that the public use and interest will be served by platting the
subdivision.
9. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application
SP-700-91 is hereby APPROVED until July 1, 1994, subject to conditions noted
below. Most of the conditions of approval shall be accompli.shed by the applicant and/or
sponsor prior to finalizarion of the shart subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) or the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. The preliminary plat of record approval is for the property legally described in the
application for this proposal.
2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone(s) as
amended.
3. The final plat shall be designed substantially in conformance with the preliminary plat
of record No increase of density or number of lots shall occur without a chaage of
condition application submittal and approval.

4. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Conditions of Approval.
5. Appropriate road name(s) shall be indicated.
6. The preliminary plat is given conditional approval for three (3) years, specifically to
July 1, 1994. The applicant may request an extension of time by subnutting a written
request approximately forty-five (45) days prior to the above expiration date.
. 7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appmpriate utility companies shall be received
with the submittal of the final plat.
8. Three (3) current certificates of title shall be fumished to the Planning Department prior

9. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall contain the following
statement:

10. A plan for water facilities adequate far domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection disaict, County Buildi.ng &
Safety Department and County Health District. The agencies will certify on the Water
Plan, prior to the filing of a final plat, that the plan is in canforniance with their
respective needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
11. The water purveyor sha11 certify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for campletion of the water system and inspection by the appropriate health authorides
prior to application for building per,mits withiri the final plat. The arrangements or
agreements shall include a provision halding Spokmne County and the pinveyor
harmless from claims by any lot purchaser refused a building germit due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.

The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection district, County Buildi.ng & Safety
Deparnnent and water putveyor, shall be installed within this subdivision, and the
applicant shall provide for individual domestic water service as well as fire protection to
each iot prior to sale of each lot and prior to issuance of a building permit for each lot."
13. The Water Plaa and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning I?irector/designee upon receipt of letters from the
appropriate water purveyor and fire protecrion district stating that simple connecdons to
an existing, approved water system will provide adequate domestic and fire protecrion
water to ensure the public health, safety and general welfare.
14. A survey is required prior to the filing of a final plaL
COUNTY ENGINEER'S DEPARTMENT CONDTTIONS
1. The conditional approval of the plat is given by the County Engineer subject to
dedicatioo of right-of-way and approval of the road syst,em as indicated in the
preliminary plat of record.
2. Plans, profiles, and cross-sections as designed to County standards showing proposed
street centerline and curb grades shall be submitted to the County Engineer for approval
prior to construction aad/or the filing of each final plat; road plans to be prepared under
the direction of a licensed Professional Civil Engineer.

3. Construction within the proposed public streets and easements shall be perfonned
under the direct supervision of a licensed engineer/surveyor, who shall furnish the
County Engineer with "as-built" plans and a certificaLe in writing that all improvements
were instaUed to the lines and grades shown on the approved construction plans and
that all disturbed monuments have been replaced.
4. No construction work is to be performed within the existing or proposed public right-
of-way until a perinit has been issued by the County Engi.neer. All work is subject to
inspection and approval by the Counry Engineer.
5. All construction witbin the existing or proposed public right-of-way is to be completed
prior to filing each final plat, or a bond in the amount estimated by the County Engineer
to cover the cost of construction of improvements, construction certification, "as-built"
plans and monumenting the street centerlines shall be filed with the County Engineer.
6. Road design, construction, aad drainage control for one-half (1/2) rights-of-way and
stub road connections are the responsibility of the owner, developer or applicant.
7. Appropriate provision shall be made that the following-described pmperty be held in
trust until the continuation of the streets be dedicated or deeded: a one (1)-foot strip at
the ends or edges of all streets that terminate or border the subdivision boundary.
(Temporary cul-de-sacs are required when streets terminate at the subdivision
boundaries.)
8. Individual driveway access pernnits are required priar to issuance of a buildi.ng pennit
for driveway approaches to the county road system.
9. Dedicaaon of 25 feet of addidonal right-of-way alang lOth avenue and north-south
access road is required.
10. Existing counry roads providing d'xrect access to the plat shall be paved and/or curbed to
Spokane County standards.
11. All public roads within the plat shall be designrd and constructed to Spokane County
standards.
12. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
13. The County Engineer has designated Typical Roadway Section Number Two, Local
Access standazd for the improvement of lOth Avenue, which is adjacent to the
proposed developmenL This will require the addition of approximately 18 feet feet of
asphalt along the frontage of the development. The construcdon of curbing is also
required.
14. The County Engineer has designated Typical Roadway Section Number Two, Local
Access standard for the unprovement of north-south access road, whicb is adjacent to
the proposed developmenL This will require the addition of approximately 16 feet of
asphalt along the frontage of the development. The construction of curbing is also
required.
15. The proposed subdivision shall be improved to the standards set forth in Spokane
County Boazd of Cornmissioners Resolution No. 80-I592, as amended, which
resolution establishes regulations for roads, approaches, drainage and fees in new
construction.
16. The County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system wairants the
dedicadon of additional right-of-way and the roadway impmvements herein specified.
17. This proposed subdivision or develapment proposal is located within a drainage basin
which has been identified by the Spokane County Engineer's office as having
stormwater ninoff problems. Since this proposed subd.ivision or deveiopment proposal
is affected by or is a contributor to stormwater flows, property owners should
participate in the planning and implementation of a future basinwide stormwater
management system. The following statement shall be placed in the plat dedication:
'"The owner(s) or successor(s) in interest agree to join in any County-approved
stormwater management program and to pay such rates and charges as may be fixed

~ through public hearings for senrice or benefit obtained by the planning, design,
constructing, maintaining or operation of stormwater control facilities."
18. There rnay exist utilities, either underground or overhead, affecting the subject
property, including property tio be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjusmnents or relocation
regarding these utilities. Applicant(s) should check with the applicable utiliry purveyor
and the Spokane County Eagineer to determine whether applicant(s) or the utility is
responsible for adjustment or relocation costs and to make arrangements far any
aecessary work.
19. The applicant shall incorporate that portion of 14th Avenue as part of this shart plat
which will provide for the required nght of way for the intersection of lOth Avenue and
the north-south access road.

21. The applicant shall only be responsible for construction of a private road width private
road (16 foot paved) vsnth curb, along the firontage north-south access rvad and
extending from the existing lOth Avenue. The applicant shall sign and record a"Notice
to the Public #4" to allow for the use of public right of way far a private road serving
lots A and B.
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Planning Department to the utility companies, Spokane
County Engineer and the Spokane Counry Health District Written approval of the
easements by the utility companies musc be received prior to the submittal of the final
plat
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
4. Water service shall be coordinated through the Director of Urilides, Spokane County
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
b. Prior to filing the fuial plat, the sponsor shall present evidence that the plat lies within
the recorded senrice area of the water system pmposed to serve the plaL
7. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the
Spokane County Health District that suitable sites for on-site sewage disposal systems
are availabte on tracts A and B.
8. Subject to specific applicarion approval and issuance of perrnits by the health officer,
the use of individual on-site sewage disposal systems may be authorized.
9. The dedicatory language of the plat will state: "Subject to specific application approval
~ and issuance of permits by the Health Officer, the use of individual oa-site sewage
~ systems may be authorized."
10. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
COUNTY UTILITIES DEPARTMENT CONDITIONS
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
oa-site sewer disposal systems is hereby authorized. This authorization is conditioned
on compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific application approval and issuance of
permits by the Health District.

Enclosed please f ind two copies of the draft f inal short
plat referenced above, revised per your comments of first
review. I have made changes highlited in yellow. Please
review for final approval.
I have also revised the Tract "X" agreement per your
comments and made a small revision in the first paragraph,
deleting a reference to private roads which does not apply
to our plat. I have also enclosed a copy of the deed Larry
Peplinski obtained for a parcel which the County wishes to
obtain as additional right of way for lOth Avenue. Please
give to the Right of Way Department for their use in
preparing a riqht of way deed.
