Proposal: Proposed alteration of the final short plat map to divide "Tract A" of
SP-700-91 into two single farnily residential tracts and to eliminate the "Tract X'A
(Future PubIic Road) agreement with Spokane County. ~
II. SITE INFORMATION
A. Site Size: Approximately 30,860 square feet (.71 acre)
Gross Density: Approximately 15,430 square feet per unit (.35 acre per unit)

B. Compreheasive Plan
1. Land Use Plan: The property is lncated within the Urban category of the
Comprehensive Plan and within the Priority Szwer Service Area (PSSA).
The Urban category is intended to provide the opportunity for
development of 3"city-like" environment which includes various land
uses, intensive residential development and public facilities and services
(water, sanitary storm and sewer lines, police and fire protection, and other
features). LTrban areas will be the most intensely developed of all
Comprehensive Plan categories and are primarily a residential category of
single faraily, two family, and multi-family dwellings. Residential net
densities are suggested to range from 1 unit per acre to 17 units per acre.
Low to moderate levels of noise and air pollution will most likely exist in
Urban areas due to the intensity of activities and the high volume of traffic
generated. Tbe more intensive land uses will be located aear the heavily
traveled streets while single family residential uses will be isolated from
noise and heavy traffic.
The proposed altered short plat is consistent with the Goals, Objectives
and Decisioa Guideli.nes of the Urban category of the Comprehensive
Plan.
2. Arterial Road Plan: The subject site is located at the terminus of 10`h
Avenue and west of and adjacent to unimproved Marigold Street. Both
10`" Avenue and Marigold Street are indicate as local access streets by the
Spokane County Arterial Road Plan. The Spokane County Division of
Engineering has requested compliance with all previous conditions of
approval for the original short plat approval, file no. SP-700-91 which
includes the dedication of 25 feet of additivnal right-of-way along 10``'
Avenue and north-south access road (Marigold Street). The altered short
plat.map does illustrate the required 25 foot right-of-way dedication along
10' Avenue and Marigold Street.
3. County Parks Pldn: Terrace View Park is the county park facility
located nearest to the subject site. Terrace View Park is located
approximately'/~ miles southwest of the proposal.
C. Site Characteristies: The subject site consists of Tract "A" of SP-700-91. The
property is a rectangular shaped parcel approximately 30,860 square feet in size.
The most northerly portion of the site is developed and is occupied by a single
family residence. Existing site improvements aze typical of single family
development found within the surrounding area including underground utilities,
septic systems and landscaping. The remaining, southerly portion of the parcel

is vacant and undeveloped. This portion of the site is clear of vegetation and
appears to have been recently graded. The topography of the site varies from
the developed portion of the site, which is relatively flat, to the undeveloped
portion of the site which slopes to the north. There exists an abrupt elevation
change of approximateiy nine feet between the developed portion of the site and
that portion left undeveloped due to a rock retaining wall located between these
two portions of the property (the undeveloped portion of the site being at a
higher elevation than the developed portion of the site). Marigold Street,
located east of and adjacent to the subject site is currently unimproved however
does include curbing along the west boundary of the parcel located immediately
to the east of Marigold Street.
D. Neig6borhood Characteristics: The surrounding neighborhood consists of
medium density single family residential development. Both underground and
overhead utilities exist in the area with roads paved and some with curbing.
E. Zoning Analysis:
Froposal: Urban Residendal-3.5 (UR-3.5) established in 1991, previously
established as Agricultural (A) in 1942 (ZE-60-42).
North: Urban Residential-3.5 (UR-3.5) established in 1991, previously

F. Land Use Analysis: Land uses within the vicinity of the
proposal include a miac of residential uses developed at various
densities. Properties located adjacent to the subject site range
from 10,500 square feet to 1.48 acres in size. Located east of and
adjacent to the subject site is Snoopy's Addition
(PE-1208-78). Snoopy's Addition consists of 17 lots on
approximately 4.55 acres with an overall density of three lots per
acre. Tupper's Addition (PE-751-70) is located appro.cimately
?OS feet north of the proposal and consists of eight lots on 2.32

(or 3.5 dwelling units per acre). HAV Addition (PE-1654-92) is

Addition is 2.7 units per acre. Located 220 feet west of the
proposal is Kralick Subdivision (PE-250-55). The Kralick
Subdivision consists of approximately 201ots on 9.55 acres with
an approximate overall density of two dwelling units per acre.
The proposed al tered short plat (SP-700A-91), with an overall
density of 15,430 square feet per dwelling unit (or 2.8 dwelling
units per acre) is generally consistent and compatible with land
use trends in the surrounding area.
Site: One single family residence and undeveloped.
North: Single family residential.
South: Single family residential.
East: Single family residential.
West: Single family residential.
G. CircuIation: Access to lots within the altered short plat will be provided by a
25 foot wide access easeruentlprivate driveway extending south from the
terminus of 10`h Avenue, located west of and adjacent to unimproved Mazigold
Street. The access easemendprivate driveway replaces the Tract "X" road
previously required as a condition of approval by the Spokane County Division
of Engineering for Shnrt Plat, file no. SP-700-91.
H. Design: The altered short plat proposes division of the original Tract "A" of
SP-700-91, (approximately 30,869 square feet in size) into two tracts for single
faruily residential development. Tract "1" is 16,560 square feet in size and is

THIS MATTER, an application for subdivision of land, from Lany Peplinski has been
recejyed and decided upon, pursuant to Spokarie County Subdivision regulations, on the
~ day of June, 1991.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane Counry Director of Planning.
2. The proposal is ta divide approximately 1/2 acre into 2 lots for the development of single
fatnily dwellings
3. The proposal is generally located west of lUth Avenue and approximately 200 feet east of
Adams Road in the SE 1/4 of Section 23, Township 25 North, Range 44 EWM, Spokane
County, Washington.
4. The current zoning of the property is Urban Residential-3.5 (UR-3.5). The proposed lot
sizes, frontage and intended uses are allowed within this zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The
development and uses proposed are generally in accord with this category.
6. The required public notice was provided for this proposal and agencies having a potential
interest in the project were notif'ied and recommendations solicited.
7. No adjacent property owners in the area cocnmented on the proposed short plat.
8. Recognizing the recommended condi.tions and Spokane County development standards,
the proposed subdivision makes appropriate provisions for the public health, safety and
general welfare and chat the public use and interest wilI be served by platting the
subdivision.
9. The project is exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Applicadon
SP-700-91 is hereby APPROVED until July 1, 1994, subject to conditions noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final unless
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. The preliminary plat of record approval is for the property legally described in the
application for this proposal.

2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) mne(s) as
ameoded.
3. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval.

compliance with these Find.ings and Conditions of Approval.
5. Appr+opriate road name(s) shall be indicated.
6. The prelicuinary plat is given conditional approval for three (3) years, specifically to
July 1, 1994. The applicant may request an extensian of time by submitting a wncten
re,quest approximately forty-five (45) days prior to the above expiration c3ate.
r; 7. Appropriate utility easements shall be indicated on copies of the proposed final plat.
Wntten approval of utility easements by appropriate utility companies shall be received
with the submittal of the final plat.
8. Three (3) current certificates of title shall be furnished to the Planning Department prior
to fil.ing the final plat.
9. The final plat map shall indicate by a clear, dashed line the required yard setbacks from
all private, "Tract X" or public roads. The dedication shall cootain the following
statement:
"Side yard and rear yard setbacks shall be determined at the time build.ing pennits are
requested unless these setbacks aze specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
10. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection distnct, County Building &
Safety Department and County Health District. The agencies will certify on the Water
Plan, prior to the filing of a final plat, that the plan is in conformance with their
respective needs and regulations. The Water Plan and certification shall be drafted on a
transparency suitable for reproducaon and be signed by the plat sponsor.
11. The water purveyor shall cestify that appropriate contractual arrangements and schedule
of improvements have been made with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. The time schedule shall provide
for completion of the water system and inspeceon by the appropriate health authorities
prior to applicativn for building pennits within the final plat. The arrangements or
agreements shall include a provision holding Spokane County and the purveyor
harmless from claims by any lot purchaser refused a building pennit due to the failure
of the subdivision sponsor to satisfactorily complete the approved water system.

12. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the local fire protection tlistrict, County Builtiing & Safety
Departrnent and water purveyor, shall be installed within this subdivision, and the
applicant shall provide for individual domestic water service as well as fue protectioa to
each lot prior to sale of each lot and prior to issuance of a building pemut for each lot."
13. The Water Plan and the above four (4) conditions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters &om the
appropriate water purveyor and fire protection district stating that sunple connections to
an existing, approved water system will provide adequate docnestic and fre protection
water to ensure the public health, safery and general welfare.
14. A survey is required prior to the f ling of a final plaL
COUNTY ENGINEER'S DEFARTMENT CONDITIONS
1. The conditional approval of the plat is given by the County Engineer subject to
ded.ication of right-of-way and agproval of the road system as ind.icated in the
preliminary plat of record.
2. Plans, profiles, and cross-sections as designed to County standards showing proposed
street centerline and curb grades shall be submitted to the County Engineer for approval
prior to construction andlor the filing of each final plat; road plans to be prepa,red under
the d.irection of a licensed Professional Civil Engineer.

3. Construcaon within the proposed public streets and easements shall be performed
under the direct supervision of a licensed engineer/surveyor, who shall fumish the
County En,gineer with "as•built" plans and a certificate in writing that all improvements
were installed to the lines and grades shown on the appraved construction plans and
that all disturbed monuments have been replaced.
4. No construction work is to be performed within the existing or proposed public right-
of-way until a pernut has been issued by the County Engineer. A►ll work is subject to
inspection and approval by the County Engineer.
5. All construcdon within the existing or proposed public right-of-way is to be completed
prior to filing each final plat, or a bond in the amount escimated by the County Engineer
to cover the cost of construction of improvements, construction certification, "as-built"
plans and monumenting the street centerlines shall be filed with the County Engineer.
6. Road design, construction, and drainage control for one-half (1/2) rights-of-way and
stub road connections are che responsibility of the owner, developer or applicant.
' 7. Appmpriate provision shall be made thac the following-described property be hcld in
trust until the continuation of the streets be dedicated or deeded: a one (1)-foot strip at
the ends or edges of all streets that terminate or border the subd.ivision boundary.
(Temporary cul-de-sacs are required when streets temunate at the subdivision

8. Individual driveway access permits are requised prior to issuance of a building permi,t

16. The County Engi.neer has examined this development proposal and has determined that
the impact of chis proposal upon the existing counry road system wamants the

The southerly half of the site is nine feet higher than the northerly half, and the halves are
separated by a rock retaining wall.
Surrounding Conditions: The northeast corner of the site is located at the westerly
terminus of 10" Avenue. The unimproved half right of way of Marigold Street abuts the site
along the easterly border of the northerly portion of the site. The surrounding neighborhood
consists of inedium density single-family residential developruent. Both underground and
overhead utilities e3cist in the area with paved road with some curbing. Tract "A' is bordered on
the west
Project Description: The applicant has requested alteration of the final plat map of Short
Plat No. SP-700-91 to divide the original Tract "A" (approximately 30,$69 square feet in size)
into two tracts for single family residential devclopment. Tract "1" is 16,560 square feet in size
and is occupied by an existing single-family residence. Tract "2" is 14,300 square feet in size
and is currently vacant, undeveloped land. The applicant has also requested alteration of the final
plat map and dedication to eliminate the Tract "X" future road agreement and easement, and to
grant a 25-foot easement along the easterly boundary of proposed Tract "1" for the benefit of
proposed Tract "2".

C. PLAT ALTERATION ANALYSIS:
1. The annlication for short plat alteration contains the siLrnatures of a majoritv of those
nersons havine an ownershin interest in the subdivision lot to be altered.
RCW 58.17.060 provides that when an alteration to a short plat involves a public
dedication, the alteration shall be processed in the same manner as the alteratioa to a subdivision
under RCW 58.17.215. RCW 58.17.215 and RCW 58.17.330 authorize plat alteration
appIications to be heard by a hearing examiner. RCW 58.17.215 authorizes the alteration of a
subdivision or any portion thereof upon application by any person to the local government where
the subdivision is located. The application must contain the signatures of a majority of those
persons having an ownership interest of lots, tracts, sites or divisions in the subdivision or
portion thereof to be altered; provided that the application must contain 100 % of such signatures
if the proposed alteration would result in the violation of a covenant.
The record indicates that the applicants, Larry and Theresa Peplinski, are the legai owners
of the entire short plat property. Both the applicants signed the application for alteration of the
short plat.
2. The nublic use and interest will be served by approval of the proposed plat alteration.
RCW 58.17.215 requires that the decision-maker determine the public use and interest in
the proposed alteration and deny or approve the application. The applicants desires to create an
additional lot for single-family development by dividing Tract "A" of the short plat in hatf. The
applicants also desire to eliminate the Tract "X" future road dedication and agreement and
substitute a private driveway easement.
Proposed Tracts "1 and "2" both exceed the minimum lot area and minimum lot frontage
requirements of the Urban Residencial-3.5 (LJR-3.5) zone specified in Section 14.616.325 of the
Spokane County Zoni.ng Code. As indicated in the staffreport, the division of land is generally
consistent with the surrounding land uses and developmeni trends in the area. The proposed
alteration also implements tbe Urban category of the Comprehensive Plan, in terms of use,
recommended residential densities and adequacy of public services.
County Engineering testified that the Tract "X" is not needed because the County has no
intention of extending Marigold Street through to the south, and such extension is not needed for
platted property to the southeast.
There was no opposition to the proposed alteration by public agencies or properiy owners
in the area. The mylar of the proposed short plat alteration appears acceptable for signature by
the Board of County Commissioners. The requested short plat alteration is obviously in the
public interest.
The applicants requested that they be allowed to delay submittal of a drainage report until a
building permit appiicarion was submitted for development of proposed Tract "2" of the site.
County Engineering indicated that the majority of the work had been done on the project and that
this was acceptable.

III. DECISION
Based on the Findings of Fact and Conclusions above, the application to alter the dedication
and map of the above-referenced final short plat is hereby approved, subject to the conditions of
approval attached to Short Plat No. SP-700-91 dated June 13, 1991, and the following additional
conditions.
Failure to comply with the conditions of this approval may result in revocation of this
approval by the Hearing Examiner.
SPOKANE COUNTY DIVISION OF BUILDIIYG AND PLANNING (UPDATED)
1. The applicant shall produce a revised drawing of the alteration of the short plat, which
after signature of the Board of County Commissioners, as provided for in chapter 58.17 RCW,
shall be filed with the Spokane County Auditor and be considered a lawful amendment of the
short plat.
