CONCLr1STONS AhD QRD~]&",,~,'- INTptODUCTION ' This matter has come before the Hearing Examiner Conunittee on July 18, 1991. The members of the Committee present are Lunell Haught, Chairperson, Frank Yuse and Bud Skadan. PROPOSAL The sponsor, Rex Walker, requests deletion of County Engineer's Conditions Nos. 8, 11, 14, 16 and 19 fram an approved preliminary short plat, File No. SP-702-91, for the purpose of developing single family residences. FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located on the southwest corner of Adams Road and 18th Avenue in the NEI/4 of the NWI./4 of Section 26, Township 25 Narth, Range 44 EWM, Spokane County, Washington. 2. The committee adopts the Planning Department Report as a part of this record. 3. The existing land use in the area is residential. 4. The Compr+ehensive Plan designates this site as Urban. 1'he Urban category is for the purpose of residential uses, includ.ing residential densities of one unit per acre to 17 ~ uruts per acre. . 5. The Arterial Road Plan designates Adams Road as a Mi.nor Arterial, with a recommended right of way width of 80 feet. 6. The existing zoning of the property described in the applicarion is Urban Residenrial-3.5 (UR-3.5) previousiy established in 1991. 7. This proposal is exempt from the provisions of RCW 43.21C (The State Environmental Policy Act). i 8. The Iegal requirements for public notice have teen fulffiled. ~ ~ 9. The owners of adjacent lands expressed neither approva[ nor disapproval of the proposed use. 10. Tbe proposed change of condidons does iznplement a.nd conform to the Comprehensive Plan. 11. The applicant has demonstrated that exemption from the original, conditions nf appraval is justif ed. HEC Order for SP-70; Page 2 ; 12. The proposed change of cond.itions will not be detrimental to the public health, safety, morals or welfare. 13. The subdivision proposal is generally consistent with RCIA' 58.17 and the County subd.ivision regulations, promoting the public health, safety and general welfare in accordance with standards established by the state and Spokane County. 14. The Committee additionally finds/concludes: a. That the reason for appeal is based on cnnditions required by the County Engineer concerning road dedication and improvements. b. That allowing the applicant/owner to install the unprovements following the formation of a RID is less of a burden to a single lot owner than rzquiring installation prior to finalization. CONDITIONS OR CONTINGENCIES APPLIED TU THIS APPROVAL 1. All Conditions imposed by the Hearing Examiner Committee shail be binding on the "Applicant," which term shall include the owner or owners of the property, heus, assigns, and successors-in-interest. 2. The County Engineer conditions are modified to allow the roadway improvements to be installed by a future RID. These conditions are listed herein as Caunty Engineer Conditions numbers 20, 21, and 22. PLANNING DEPARTMENT CONDITIONS 1. The preliminary plat of record approval is for the property legally described in the applicarion for this proposal. 2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone(s) as acnended. 3. The final plat shall be designed substanrially in conformance with the preliminary plat of record. No inerease of densiry or number of lots shall occur without a change of condition application subnuttal and approval. 4. The Planning DirectorJdesignee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. 5. Appropriate road name(s) shall be ind.icated. 6. The preliminary plat is given condiaonal approval for three (3) years, specifically to July 1, 1994. The applicanc may request an extension of time by subrrutting a written request approximately forry-five (45) days prior to the above expiration date. Appropriate utility easemeats shall be indicated on capies of the proposed final plat. The reserved future acquisition area Title Notice shall be released, in full or in part, by the Planning Depaztment The notice should be recorded within the same time frame as an aPPea1 and shall Provide the following: a. At least 8 feet of reserved future acquisidon area for road right-of-way and utilities, in addition to the existing andJor newly dedicated right-of way alang Adams. NOTE: The County Engineer has required 12 feet af new dedicatian. b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. c. No required landscaping, parking, '208' areas, drainfield ar allowed signs should be Iocated within the futln-e acquisition area for road right-of-way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parlcing, surface drainage, drainfield, signs or others) shall be considered interi.m uses. 10. The final plat map shall indicate by a clear, dashed line the required yard setbacks from all private, "Tract X" or public roads. The dedication shall contain the following statement: "Side yard and mar yard setbacks shall be determined at the time building permits are requested unless these setbacks are specifically drafted on this final plat. The setbacks indicated on this plat may be varied from if proper zoaing approvals are abtained." 11. No water plan is required, and a simple tap is needed at the time of building pemut ~ release. 12. A snrvey is required prior to the filing of a final p1aG COUNTY ENGINEER'S DEPARTMENT CONDITIONS 1. The coaditional approval of the plat is given by the County Engineer subject to dedication of right-of-way and appmval of the road system as indicated in the preliminary plat of record. 2. Plans, profiles, and cross-sections as designed to County standards showing proposed street centerline and curb gradcs shall be submitted to the County HEC Order for SP-7C l Page 4 Engineer for approval prior to construction and/or the filing of each finat plat; road plans to be prepared under the direction of a licensed Professional Civil Engineer. 3. Drai.nage plans and design calculations showing the alignment of drainage facilities shall be submitted to the County Engineer for approval pnor to construction and/or the filing of the final plat. Draunage plans to be prepared under the direction of a licensed Professional Civil Engineer. 4. Construcrion within the proposed public streets and easements shall be performed under the direct supervision of a licensed engineer/surveyor, who shall furnish the County Engineer with "as-built" plans an d a certifcate in writing that all improvements were installed to the lines and grades shown on the approved construction plans and that all disturbed momunents have been replaced. 5. No construction work is to be performed within the existing or proposed public right-of-way until a pernut has been issued by the County Engine.er. All work is subject to inspection and approval by the County Engineer. b. All construction within the existing or proposed public right-of-way is to be completed prior to filing each final plat, or a bond in the amount esrimatod by the County Engineer to cover the cost of construction of irnprovements, construcaon certification, "as-built" plans and monumenting the street centerlines shall be filed with the County Engineer. 7. Individual driveway access pennits are requixed prior to issuance of a building permit for driveway approaches to the county road system. 8. Dedication of 12 feet of addivonal right-of-way along Adams Road is required. 9. Existing county roads providing direct access to the plat shall be paved and/or curbed to Spokane County standards. 10. All public roads within the plat shall be designed and constructed to Spokane County standards. 11. Sidewalks are required along the arterial(s) on Adams Road. 12. The word "applicant" shai] include the owner or owners of the property, his heus, assigns and successors. 13. The County Engineer has designated Typical Roadway Section Number Two, Local Access standard for the improvement of 18th Avenue, which is adjacent to the proposed development. 14. The County Engineer has designated Typical Roadway Section Number Two, Minor Arterial standard for the improvement of Adams Road, which is adjacent to the proposed development. This will require the addition of approximately 7- 9 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 15. The proposed subdivision shall be improved to the standards set forth in Spokaae County Board of Commissioners Resolution No. 80-1592, as amended, which / ~ ~ HEC 4rder for SP 702 91 Page S resolution establishes regulations for roads, approaches, drainage and fees in new construction. 16. The County Engineer has examined this development proposal and has detennined that the impact of this proposal upon the existing c.ounty road system warrants the dedication of additional right-of-way and the roadway improvements herein specified. 17. This proposed subdivision or development proposal is located within a drainage basin which has been identified by the Spokane County Engineer's office as having stormwater runoff problems. Since this proposed subclivision or development proposal is affected by or is a contributor to stormwater flows, property owners should participate in the planning and implementation of a future basinwide stormwater management system. The foUowing statement shall be placeri in the plat dedication: "The owner(s) or successor(s) in interest agree to join in any County-apprroved stormwater management program and to pay such rates and charges as may be fixed through public hearings for service or benefit obtained by the planning, design, constructing, maintaining or operation of storinwater control facilities." 18. The County Arterial Road Plan identifies Adams Road as a Minor arterial. The existing right-of-way width of 50 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in addition to the required right-of-way dedication, a strip of property 8 feet in width along the Adams Road frontage shall be set aside in reserve. Tlus property may be acquired by Spokane County at the time when arterial improvements are made to Adams Road. 19. There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocation regarding these utilities. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to determine whether applicant(s) or the udlity is responsible for adjustment or relocation costs and to make a.nangements for any necessary work. 20. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the formation of a Road Improvement 1?istrict (RID) for said 'unprovements, pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to eacisting pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provision is applicable to Adamms Road. 21. As an alternative method of constructing the road improvements stated herein, the applicant may, wi.th the approval of the County Engineer, accomplish the road improvements stated herein by joi.ning and participating in a County Road Project (CRP) to the extent of the required road improvements. At such time as an RID is created or any Road Improvement Project is sancrioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to exdsting pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This provisian is applicable to Adams Road. e 6 HEC Order for SP-71 1 Pag 22. The following statement shall be placed in the plat dedication: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a Road Impmvement I?istrict (RID) by dje peetion method pursuant to Chapter 36.88 RCW, which perition includes the owner(s)' property, and further not to object, by the signing of a ballot, to the formabon of an RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the owner(s)' property. If an RID is formed by eicher the petition or resolution method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agm,e: (a) that the i.mprovement(s) or construction contemplated within the proposed RID is feasible; (b) that t11e benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceed the cost and expense of formation of the RID; and (c) that the property withia the proposed RID is sufficiently developed. Providzd further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the fornaarion of an RID by either petition or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of County Commissioners affirming the final assessment roll. It is further agreed that at such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns without participation by Spokane County. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execurion below. However, the owner(s) or successor(s) agree that if said RID waiver expires without construction of the required improvements, the owner(s) or successor(s) agree to construct the required improvements at their own expense, pay to Spokane County the then estimated cost of the required improvements to enable the Counry to complete the same, or furnish a bond or other secure method suitable to the County (which may include the execution of another RTD wa.iver agreement) provicling for or securing to the County the actual conswction of the improvements. All of the requirements of this agreement shall run with the land and shall be binding upon the owner(s), their successor(s) or assign(s)." This provision is applicable to Adams Road. , . The final plat shall be designed as indicated on the preliminauy plat of record and/ar any attached sheets as noted. 2. Appropriate utility easements shall be indicated on copies of the preliminary piat of record for distribution by the Planrung Depamnent to the utility companies, ~ Spokane County Engineer and the Spokane County Health District. Written ~ approval of the easements by the utility companies must be received prior to the submittal of the final plat. 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 4, Water sernice shall be coordinated through the Director of Utilities, Spokane County 5. Water service shall be by an existing public water supply when approved by the Regianal Engineer (Spokane), State Deparcment of Health, 6. Prior to fding the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. 7. A public sewer system will be made available for the plat, and individual service will be provided to each tract prior to sale. Use of individual on-site sewage disposal systems shall not be authorized. 8. A statement shall be placed in the dedication to the effect that: "A public sewer system will be made ava.ilable for the plat, and individua.l setvice wxll be provided to each tract prior to sale. Use of individual on-site sewage disposal systems shall not be authorized." 9. The dedicatory language on the plat shall state: "Use of private wells and water systems is prohibited." ~ 10. The proposed short plat of approximntely 1.33 acres into two lots is in accord with the density g-uidelines of the Urban category. B. Arterial Road Ptan: Z'he Arterial Road Plan identifies Adams Road as a Minor Asterial with an exisdng right of way width of SU feet and a proposed width of 80 feet. To implement the plan, the Counry Eng-ineer has requested 12 feet of dedicaaon and 8 feet of Future Acquisition Area (FAA). Eighteenth Avenue is designated as a Local Access Strect wich an existing 50 foot right of way. Zoning: The current zoning of the proposed short plat and surrounding a.xea is Urban Residential-3.5 (UR-3.5) established in 1991. The site was originally zoned Agricultural in 1942. Most of the surrounding area has been platted -and rezoned to R-1 (single family residential) which is now Urban Residential-3.5 (UR-3.5) zoning. 7`he Early Dawn subdi.vision, located to the north and west was approved in 1973. Other approved p1aGs include South Adams Add.ition (1978) to the northeast, Vera Crest (1977) and Kanna Addition (1984) to the east and Lehi 1 st Addition SOU feet ta the south. D. Land UselDensity: The approved preliminary short plat is consistent with densities of surrounding platted lots and the requirements af the Urban . Residential-3.5 zone. III. ANALXSIS OF THE APPLICATION AND APPEAL THE APPLICATION AND DECISION An applicarion for a two lot short plat was received by the Planning Department on April 19, 1991. The Findings and Order, Conclusion and Uecision was issued on . June 11, 1991 and appealed by Mr. Walker on June 19, 1991. The preLivai.nary short plat conditions of approval incorporated all the recommended condidons from various counry agencies including those submitted by the County Engineer. THE APPEAL AND DEPARTMENT RESPON5E Mr. Walker is appealing County Engineer conditions number 8, 11, 14, 16 and 19. ' These cond.itions refer to the detiication and improvement of Adams Road. Adams Road is designated as a Minor Arterial an the Counry's Arterial Road Pian. Dedicadon of additional right of way is a standard condition of approval for those . plats located on roadways which require upgrading due to their Road Plan designation. Other plats located along Ad3ms Road have been conditioned for similar dedication and improvements. The improvements to Adams Road, wluch include paving and sidewall:s, are consistent with RCW 58.17.110. ApProval of a plat must inclucie findings that sidewalks and other planning features that assure safe walking conditions for students who only walk to and from school . . . " The site is located less chan one mile from Evergreen Jr. High School and Sunrise Elementary School. CONCLUSYUN AND RECOMMENDATION The short plat, as approved and conditioned, meets aIl stace and local regulaaons. NOTE: 1'he County Engine.er has required 12 feet of new dedication. b. Future building and other setbacks required by the Spokane County Zcming Cade shall be measured from the reserved future acquisition area. c. No required landscaping, parking, '208' areas, drainfield or allowed signs shouid be located within the future acquisition area for road right-of-way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The future acquisition area, until acquired, sliall be private praperty and may be used as allowed in the zone, except thae any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. 10. The final plat map shall indicate by a clear, dashed line the required yard setbacks from aIl private, "Tract X" ar public roads. The dedication shall canta.in che following statement: . Plans, profiles, and cross-sections as designed to County standards showing proposed street centerline and curb grades shall be submitted to the County Engin.eer for approval prior to construction and/or the filing of each finai plat; rcaad plans to be prepared under the direction of a licensed Professional Civil Engineer. 3. Drainage plans and design calculations showing the alignment of drainage facilities shall be submitted to the County Engineer for approval prior to construction and/or the ffling of the final plat. This wil] require the addition of approximately 7- 9 feet of asphalt along the frontage of the development. The construc[ion of curbing and sidewalk is also required. 15. Tlle proposed subdivision shall be improved to the standards set forth in Spokane County Board of Comuussioners Resolucion No. 80-1592, as amended, which resolution establishes regulations for roads, approaches, drainage and fees in new construction. 16. This property may be acquired by Spokane Caunty at the ame when artcria1 improvements are made to Adams Road. 19. There may exist utilities, either underground or overhead, aftecang the subject property, including property to be dedicated or set aside for future acquisxtion. Spokane County assumes no financial obligation far adjusmnents or relocation • regarding these utilities. Applicant(s) should check with the applicable utility purveyor and the Spokane Counry Engineer (o deternune whether applicant(s) or the urility is responsible for adjustment or relocaaon costs and to make arrangexnents for any necessary work. SP-702-91 ) CONCLUSIONS AND DECISION THIS MATTER, an application for subdivision of land, from Rex Walker has beereceived and decided upon, pursuant to Sgokane County Subdivision regulations, on the jj day of June, 1991. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. 2. The proposdl is to divide 1.33 acres into 21ots for the development of single fannily residences. ' 3. T'he progosal is located on the southwest corner of Adams and 18th Avenue in the NE1/4 of the NW1/4 of Section 26, Township 25 North, Range 44 EWM, Spokane County, Washi.agton. 4. The current zoning af the property is Urban Resxdential-3.5 (UR-3.5). The proposed lot sizes, frontage and intended uses are allowed within this zone. Suirounding uses aze single family residential. Lot A of the proposed short plat has an existing single family residence and accessory structtues. Lot B is covered with native grasses and contains a 16 x 20 starage shed. 5. The Spokane County Comprehensive Pl.an designates this area as Urban. The development and uses praposed are generally i.n accord with this category. 6. The required public notice was provided for this proposal and agencies having a pooenrial interest in the project were notified and recommendations solicited. 7. No one in the area commented on the proposal. 8. The Spokane County Arterial Road Plan identifies Adams Road as a Minor Arterial with a proposed right of way width of 80 feet. The existing right af way width of 50 feet is inadequate to implement the plan and 12 feet of dedication will be required. In addidon to the reqwized dedication, a strip of property 8 feet in width shall be set aside in reserve as a future acquisirion area. 9. Eighteenth Avenue has mi existing right of way width of 50 feet and will not require additional right of way dedication. 10. The praposed short plat will be served by an existing public water system. Connection to a public sewer, for wastewater disposal, is required. 11. Recognizing the recommended conditions and Spokane County development standards, the proposed subdivision makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by platting the subdivision. 12. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800 (6) (a). DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-702-91 is hereby APPROVED until July 1,1994, subject to conditions noted below. Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization of the short subdivision. This decision is final uriless appealed in writing, coasistent with adopted appeal procedures. These Conditions of Approval apply to applicant(s), owner(s) of the propertp, heirs, assigns or any successors-in-interest to property. • FINDINGS AND DECISION SP-702-91 Fage 2 PLANNING DEPARTMENT CONDITIONS 1. The preliminary plat of record approval is for the property Iegally described in the application for this proposal. 2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone(s) as ainended. 3. The final plat sha11 be designed substantially in conformance with the preliminary plat of record No iacrease of density or number of lots shall occur without a change of condition application submittal and approval. 4. The Planning Director/designee shall revi.ew any proposed final plat to ensure campliance with these Findings and Conditions of Approval. 5. Appropriate road name(s) shall be indicated. 6. The prel,iminary plat is given conditional appmval for three (3) years, specifically to July 1,1994. The applicant may request an extension of time by submitting a written request approximately forty-five (45) days prior to the above expiration date. 7. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written appmval of utility easements by appropriate utility companies shall be received with the submittal of the final plat. 8. Three (3) current certificates of title shall be fumished to the Planning Deparnnent prior to filing the final plat. 9. The Spokane County Planning Department shall prepare and record with the County Auditor a Tide Notice specifying a future land acquisition area for road right-of-way and utilides. The reserved future acquisition area Title Notice shall be released, i.n full or in pait, by the Planning Departiment. The notice should be recorded within the same time frame as an appeal and shall provide the following: a. At least 8 feet of reserved future acquisition area for rQad right-of-way and utilities, in additiaa to the existing a.ad/or newly dedicated right-of-way along Adams. NOTE: The County Engineer has requir+ed 12 feet of new dedication b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area, ~ c. No requir+ed landscaping, parldng, '208' areas, drainfield ar allowed signs should be located within the future acquisitian area for rroa,d right-of-way and utilities. If any of the above improvements are made within this are.a, they shall be relocated ~ at the applicant's expense when roadway improvements are made. d. The futiu9e acquisitioa area, until acquired, shall be private praperty and may be used as allowed in the zone, except that any irnprovements (such as landscaping, parking, surface drainage, drdinf'eld, signs or others) shall be considered interim uses. 10. The final plat map shall indicate by a clear, dashed Iine the required yard setbacks from all private, "Tract X" or public roads. The dedication shall contain the following statement: "Side yar+d and rear yard setbacks shall be determined at the time building permits are requested unless these setbacks are specifically drafted on this final plat. The setbacks indicated on this plat may be varied from if proper zaning approvals are obtained." 11. No water plan is required, and a simple tap is needed at the time of building permit release. 12. A survey is required priar to the filing of a final plat. . FINDINGS AND DECISION SP-702-91 Page 3 COUNTY ENGINEER'S DEPARTMENT CONDITIONS 1. The conditional approval of the plat is given by the County Engineer subject tio dedication of right-of-way aad apgroval of the road system as indicatai in the preliminary plat of record. 2. Plans, profiles, and cross-sections as designed to County standards showing proposed street centerline and curb grades shall be submitted to the County Engineer for approval prior tio construction andlor the filing of each final plat; road plans to be prepared under the direction of a licensed Professional Civil Engineer. 3. Drainage pians and design calculations showing the alignment of drainage facilities shall be submitted to the County Engineer for approval pnor to construction andlor the filing of the final plat. Urainage plans to be prepared under the direction of a licensed Professional Civi1 Engineer. 4. Construction within the proposed public streets and easements shall be performed under the direct supervision of a licensed engineer/surveyor, who shall fumish the County Engineer vvith as-built" plans and a cerrtifificate in writing that all improvements were installed to the lines and grades shown on the approved construction plans and that all disturbed monuments have been replaced. 5. No construcdon work is to be performed within the existing or proposed public right- of-way until a permit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 6. All construction within the existing or proposed public right-of-way is to be completed prior to filing each final plat, ar a bond in the amount estim,atad by the County Engiaeer to cover the cost of coastruction of imgrovements, construction certification, "as-built" plans and monumenting the street centerlines shall be filed with the County Engineer. 7. Individual driveway access permits are required prior to issuance of a building permit for driveway approaches to the county road system. 8. Ded.ication of 12 feet of additional right-of-way along Adams Road is required. 9. Existing county roads providing direct access to the plat shall be paved andlor curbed to Spokane County standards. 10. All Fublic roads within the plat shall be designed and constructed to Spokane County standards. 11. Sidewalks are required along the arterial(s) on Adams Road. 12. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. 13. The County Engineer has designated Typical Roadway Section Number Two, Local Access standard for the improvement of 18th Avenue, which is adjacent to the propased development, 14. The County Engineer has designated Typical Roadway Section Number Two, Minor A.rteri.al standard for the imgrovement of Adams Road, which is adjacent to the proposed development. This will require the addition of approximately 7- 9 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 15. The pmposed subdivision shall be improved to the standards set forth i.n Spokane County Board of Commissioners Resolution No. 80-1592, as amended, which resolution establishes regulations far roads, approaches, drainage and fees in new construction. 16. The County Engineer has examined this develapment pmposal and has detennined that the impact of this proposal upon the existing couaty road system warraats the dedication of addiaonai nght-of-way and the roadway improvements herein specified. 17. This proposed subdivision or development proposal is located within a drainage basin which has been identified by the Spokane County Engineer's office as having stormwater runoff problems. Since this proposed subdivision or development proposal = FINDINGS AND DECISION SP-702-91 Page 4 is affected by or is a contributor to stormwater flows, property owners should pardicipate in the planning and implementation of a future basinwide stormwater management system. The following statement shall be placed in the plat dedication: "The owner(s) or successor(s) in interest agree to join ia any County-approved stormwater management grogram and to pay such rates and charges as may be fixed through public hearings for service or benefit obtained by the planni.ng, design, constructing, maintaining or operation of stormwater control facilities." 18. The County Arcerial Road Plan identifies Adams Road as a Minor arterial. The existing right-of-way width of SU feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in add.ition to the required right-of-way dedicadon, a strip of pmperty 8 feet in width along the Adams Road frontage shall be set aside in reserve. This property may be acquired by Spokane County at the time when arterial unprovements are made to Adains Road. 19. There may exist utiliries, either underground or overhead, affecting the subject pmperty, including property to be dedicated or set aside for future acquisidon. Spokane Couaty assumes no financial obligation for adjusmnents or relocation regarding these utilities. Applicant(s) should check with the applicable utility puiveyor and the Sgokane County Engineer to determine whether applicant(s) or the utility is responsible for adjustment or relacation costs and to make arrangements for any necessary work. Special Conditions 20. Applicant shall dedicate the applicable radius on 18th Avenue and Adams Road 21. Applicant shall request the dedication of the 1 foot strip known as Lot 11, Block 21 of Early Dawn Second Addition for roadway purposes. COUNTY HEALTH DISTRICT CQNDITIONS ' 1. The final plat shall be designed as indicated on the preliminary plat of record and/or any attached sheets as not,ed. 2. Appropriate utiliry easements shall be i.ndicated on copies of the preliminary plat of record for distribution by the Planning Departaaent to the utility companies, Spokane County Engineer and the Spokane County Health Ilistrict. Wntt,en approval of the easements by the utility companies must be received prior to the submitral of the final plat. 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 42 Water seivice shall be coordinated thr+ough the Director of Utilities, Spokane County 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), S tate Department of Health. ~ 6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat 7. A public sewer system will be made avai.lable for the plat, and individual service will be provideci to each tract prior to sale. Use of individual on-site sewage disposal systems shall not be authorized. 8. A statement shaU be placeri in -the dedication to the effect that: "A public sewer system will be made available for the plat, and individual service will be providai to each tract prior to sale. Use of individual on-site sewage disposal systems shall not be autharized." 9. The dedicatory language on the plat shall state: "Use of private wells and water systems is prohibited." 10. The plat dedication will contain a statement to the effect that: "The public water system, as approved by county and state health authoriries, the local fire district and purveyor, I FINDINGS AND DECISION SP-702-91 Page 5 will be installed within this plat, and the subdivider will provide for individual domestic water service as well as fine protecrion to each lot/tract prior to sale of each lotltract."
