SHORT PLAT NO. SP-703-91 ) CONCLUSIONS AND
DECISIAN
'rHIS MATTER, an applicarion for subdivision of land, from Ric Berg has been received
and decided upon, pursuant to Spokane County Subdivision regulatians, on the day of
June, 1991.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been praperly delegated the responsibility for
rendering the decislon by the Spokane County Duecctor of Planning.
2. The proposal is to d.ivide 2 acres into 31ots far the development of single family
residences. The original short plat approval (SP-521-87) was for 21ots of 1 acre each.
This redivision was authorized under the standards of RCW 58.17.060(1).
3. The proposal is generallly located east of Riverway Avenue at the intersection of
Riverway Avenue and Montgomery Avenue in Section 7, Township 25 North, Range 45
EWM, Spokane County, Washington.
4. The current zoning of the property is Urban Residential-3.5 (UR-3.5). The proposed lot
sizes, frontage and intended uses are allowed within this zone. The Urban Resldential-
3.5 zone does allow duplexes for lots which are twice the minunuoa required for single
family units, or 20,000 square feet.
5. The Spokane County Comprehensive Pla-a designates this area as Urban. The
development and uses proposed are generally in accord with this category.
6. A portion of this site is located within the Pastoral area designation of the Spokane
County Shorelines program. The Pastoral area is intended to protect and maintain those
sharelinPs which have histarically been subject to limited human interference and have
preserved their nattuml quality as wildlife habitat and places of scenic beauty.
7. The required public notice was provided for this proposal and agencies having a potential
interest in the project were norified and recomunendations solicited.
8. No one in the area conunented on the proposal.
9. Large anirnal keeping is an existing nonconfomiing use on Lot B of SP-521-87.
Redivision of this conriguous short plat will terminate those nonconforming rights to
keep large animals.
10. Recognizing the recommended condidons and Sgokane County development standards,
the proposed subdivision makes appropriate proviszons for the public health, safety and
general welfare and that the public use and .interest will be served by platti.ng tlie
subdivision.
11. The proposed short plat is located adjacent to the Centennial Trail and the Washington
State Parks and Recreation Comrnission has commented. There is a dispute with the
property owner on the location of the property line adjacent to state park property. Any
recorded discrepancy in the legal descnpuon of the owners property will be shown on the
required Tide Report prior to finalization of this short plat and will affect the owners
ability to finalize the plat. This decision dces not influence or affect this dispute.
12. The proposed shorc plat will be served by a public water system. Waste water disposal
wiil be as authorized by the Director of Utilities.
13. The project is not exempt from environmeatal review under the State Environmental
Policy AcG An environmental checklist and other data have been reviewed and the
project has been fouad to not have any probable significant adverse impacts to the
physical environment. A Detennination of Nonsignificance (DNS) was issued on May 6,
1991 and sent to eight agencies of jurisdiction. The agencies reviewing the checklist
neither indicated that a more detailed envimnmental revrew should be pravided nor
commented that the DNS should be reconsidered.

DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Applicarion
SP-703-91 is hereby APPROVED until July 1, 1994, subject to conditions noted
below. Most of the conditions of approval shall be accomplished by the applicant and/or
sponsor prior to finalization of the short subdivision. This decision is final uniess
appealed in writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of tbe
property, heirs, assigns or any successors-in-interest to property.
PLANNIlVG DEPARTMENT CONDITIONS
1. The preliminary plat of record approval is for the property legally described in the
application for this proposal.
2. Upon finalization of the proposed short plat the nonconforming rights for laarge animal
keeping shall expire.
3. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone as amended.
4. The final plat shall be designed substantially in conformance with the preliminary plat
of record. No increase of density or number of lots shall occur without a change of
condition application submittal and approval.
5. The Planning Director/designee shall review any proposed final plat to ensure
compliance with these Findings and Cond.itions of Approval.
6. Appropriate road name(s) shall be indicated.
7. The preliminary plat is given conditional approval for three (3) years, specifically to
July 1, 1994. The applicant may request an extension of rime by submitting a written
request approximately forty-five (45) days prior to the above expiration date.
8. Appmpriate utility easements shall be indicated on copies of the proposed final plat.
Written approval of utility easements by appropriate utility companies shall be received
with the submittal of the final plat.
9. Three (3) current certificates of ride shall be furnished to the Planning Department prior
to filing the final plat.
10. The final plat map shall indicate by a clear, dashed line the required yard setbacks firom
all private, "Tract X" or public roads. The dedication shall coatain the following
stat,emenc:
"Side yard and rear yard setbacks shall be determined at the time building pennits are
requested unless these setbacks are specifically drafted on this final plat. The setbacks
indicated on this plat may be varied from if proper zoning approvals are obtained."
11. A plan for water facilities adequate for domestic service and fire protection shall be
approved by the water purveyor, appropriate fire protection d.istrict, County Building &
Safety Department and County Health DistricL The agencies will certify on the Water
Plan, prior to the filing of a final plat, that the plan is in conformance with their
respecdve needs and regulations. Tlie Water Plan and certification shall be drafted on a
transparency suitable for reproduction and be signed by the plat sponsor.
12. The water purveyor shall certify that appropriate contractual arrangements and schedule
of improvements have been mad.e with the plat sponsor for construction of the water
system in accordance with the approved Water Plan. 1'he rime schedule shall provide
for completion of the water system and inspection by the appropriate heaith anthorities
prior to application for building permits within the final plat. The airangements or
agreements shall include a provision holding Spokane County and the pinveyor
harailess from claims by any lot purchaser refused a building permit due to the failare
of the subdivision sponsor to satisfactorily complete the approved water system.

13. The final plat dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state
health authorities, the lvcal fire protection disaict, County Building & Safety
Department and water purveyor, shall be installed within this subdivision, and the
applicant shall provide for ind.ividual domestic water service as well as fire protection to
each lot prior to sale of each lot and prior to issuance of a building permit for each Iot."
14. No building pennit will be issued for any lot within the final plat until oertified by a
Washington state-licensed engineer that "the water system has been installed pursuant
to the approved Water Plan far tbe final plat" including a signed license stamp. The
certification may be in the form of a letter, but is preferned to be certified on a copy of
the Water Plan as a schematic map showing the "as-built" water system.
15. The Water Plan and the above four (4) coadirions of approval regarding the Water Plan
may be waived by the Planning Director/designee upon receipt of letters from the
appr~opriate water purveyor and fire protection district stating that simple connectioas to
an exisdng, approved water system will provide adequate domestic and fire protection
water to ensure the public health, safety and general welfare.
16. A survey is required priar to the filing of a final plat
17. The plat sha11 delineate the ordinary high-water mark (OHWK, the 200 feet of
Shoreline Act jurisdiction and the 50- and 100-foot horizontal setbaclc lines from the
OH[WM. The dedication on the final plat shall state:
"At the time of approval of the final plat, a portion of this property falls under the
jurisdiction of the Washington State Shoreline Management Act, RCW 90.58, and the
Spokane County Shoreline Program, WAC 173-19-400. Any development of this
property shall only proceed in strict compliance with the Shoreline Act rules and
regulations in effect at the time of permit issuance."
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The condirional approval of the plat is given by the County Engineer subject to
deriication of right-of-way and approval of the road system as indicated in the
preliminary plat of r+ecord.
2. The regulations of the National Flood Insurance Program shall be observed. A
development pernut shall be obtained from the County Engineer before construction or
development begins within any area of special flood hazard (reference Spokane County
Ordinance No. 81-0726).
The following statement shall appear within the dedicatory language of the plat:
"Development within this subdivision shall confonn to the requirements of the National
Flood Insurance Prograzn and the Spokane County Flood Zone Ordinance. Purchasers
of the property within this subdivision are warned of possible flooding or ponding and
the potential requirement to purchase flood inswrance. This warning shall be carried in
each and every deed drawn to transfer ownership of any and all property withi.a the plat
in the area of special flood hazard. This condition is applicable to driveway
approaches, driveways and private roads constructed on the site for access."
3. No construction work is to be performed within the exisdng or proposed public rigbt-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
4. Individual driveway access pemnits are required prior to issuance of a building pernut
for driveway approaches to the county road system.
5. The word "applicant" shall include the owner ar owners of the property, his heirs,
assigns and successors.
6. To construct the road improvements stated herein, the applicant may, with the approval
of the County Engineer, join in and be a willing participant in any petition or resolution

7. As an alternative method of constructing the road unprovements stated herein, the
applicant rnay, with the approval of the County Engineer, accomplish the road
unprovements stated herein by joining and participating in a County Road Project
(CR.P) to the extent of the required road improvements. At such time as an RID is
created or any Road Improvement Project is sancrioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to existing
pavement) will be at tile sole expense of the undersigned owner(s), their heirs, grantees
and assigns. This provision is applicable to Riverway Road.
8. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the formation of a Road Improvement District
(RID) by the petition method pursuant to Chapter 36.88 RCW, which petition
includes the owner(s)' property, and further not to object, by the signing of a
ballot, to the formation of an RID by the resolution method pursuant to Chapter

36.88 RCW, and to appeal to the Superior Court the decision of the Board

It is further agneed that at such time as an RID is created or any Road
Improvement Project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving) will be at the sole
expense of the undersigned owner(s), their heirs, grantees and assigns
without participadon by Spokane County.
The RID waiver contained in this agreement shall eupire after ten (10) years
fr+om the date of execution below. However, the owner(s) or successor(s)
agree that if said RID waiver expires without construction of the required
unprovements, the owner(s) or successor(s) agree to construct the required
improvements at their own expense, pay to Spokane County the then
estimated cost of the required improvements to enable the County to
complete the same, or fiunish a bond or other secure method suitable to the
County (which may include the execution of another RID waiver agreement)
providing for or securing to the County the actual constnxction of the
improvements.
All of the requuements of this agr+eement shall run with the Iand and shall be
binding upon the owner(s), their successar(s) or assign(s)." This provision
is applicable to Riverway Road.
9. The County Engineer has designated Typical Roadway Section Number Two, Local
Access standard for the improvement of Riverway Road, vvhich is adjacent to the
proposed development. This will require the add.ition of approximately 8-10 feet of
asphalt along the frontage of the development. The construction of curbing is also
required.

10. The proposed subd.ivision shall be unproved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
resolution establishes regulatioos for roads, approaches, drainage and fees in new
construcaon.
11. 1'he County Engineer has examined this development proposal and has determined that
the impact of this proposal upon the existing county road system warrants the
dedication of additional right-of-way and the roadway improvemeats herein specified.
12. This proposed subdivision or development proposal is located within a drainage basin
which has been identified by the Spokane County Engineer's office as having
stormwater runoff problems. Since this proposed subdivision or development proposal
is affected by or is a contributor to stormwater flows, property owners should
participate in the planning and implementation of a future basinwide stonnwater
management system. The following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to join in any County-approved
stormwater management program and to pay such rates and charges as may be fixed
through public hearings for service or benefit obtained by the planning, design,
construcang, maintairung or operatioa of stormwater control facilities."
COUNTY HEALTH DISTRICT CONDITIONS
1. The final plat shall be designed as indicated on the preliminary plat of record and/or any
attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary plat of
record for distribution by the Plan.ning Department to the utility companies, Spokane
County Engineer and the Spokane County Health Distict Writt,en approval of the
easements by the utility companies must be received prior to the submittal af the final
plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
Couaty.
4. Water service shall be coordinated through the Director of Utilities, Spokane County
5. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Deparmnent of Health.
6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within
the recorded service area of the water system proposed to serve the plat.
7. Prior to filing the final plat, the sponsor shall demonstrate to the satisfacaon of the
Spokane County Health District that a suitable site for an on-site sewage disposal
system is available on tract B.
8. Subject to specific application approval and issuance of pemuts by the health officer,
the use of individual on-site sewage disposal systems may be authorized.
9. The dedicatory language of the plat will state: "Subject to specific application approval
and issua.nce of permits by the Health Officer, the use of individual on-site sewage
systems may be authorized."
10. The dedicatory languagz on the plat shall state: "Use of private wells and water
systems is prohibited."
11. The plat dedication will contain a statement to the effect that: "'I'he public water system,
as approved by county and state heaith authorities, the local fire district and purveyor,
will be installed within this plat, and the subdivider will provide for individual domestic
water service as well as fire protection to each tract prior to sale of each tract"
COUNTY UTILI'TIES DEPARTMENT CONDITIONS
1. Pursuant to the Boazd of County Commissioners Resolution No. 80-0418, the use of
on-site sewer disposal systems is hereby authorized. This authorization is conditioned
on compliance with all rules and regulations of the Spokaae County Health District and

is further condidoned and subject to specific application approval and issuance of
pennits by the Health District
2. The dedication shall state:
"The owne.T(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of ULID by petition method pursuant to RCW
36.94, which pedtion includes the awner(s)' property; and further not to object by the
signing of a protest petition against the fonnation of a LJLID by resolution method
pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED,
this condition shall not prohibit the owner(s) or successor(s) from objecting to any
assessment(s) on the groperty as a result of improvements called for in conjunction
with the fonmation of a ULID by either petition or resolution method under RCW
Chapter 36.94."
3. Any water service for this project shall be provided in accor+dance with the Coordinated
Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Each new dwelling unit shall be double-plumbed for
connection to future areawide collection systems."
BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. Requirements of Fire I?istrict No. I need to be satisfied during the building pemait
process.
2. Hydrant distribution will be as follows: Fire hydrants shall be located at roadway
intersecrions wherever possible and the maximum average distance between them shall
be no further than 900 feet and these hydrants shall be placed so no portion of the
structures are in excess of 450 feet from a hyd.rant.
SPOKANE COUNTY AIR POLLUTION CQNTROL AUTHORITY CONDITIONS
1. Air pollution regulations require that dust emissions during demolidon, consrruction
and excavation projects be coatrolled. This may require use of water sprays, tarps,
sprinklers or suspension of activiry during certain weather conditions. Haul roads
should be treated, and emissions fnom the transfer of earthen material must be
coatrolled, as well as emissions from all other construction-related activities.
2. Measures must be taken to avoid the deposition of d.irt and mud from unpaved surfaces
onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be
taken immediately to clean these surfaces.
3. Demolition and renovation projects must comply with the requirements of GFR 40, Part
61, Subpart M. Intent to Demolish and Renovate fomas are available at the SGAPCA
office.
4. Solid fuel heating device(s) shall meet provisions of SCAPCA Regulation I, Article
VIII.
5. Debris generated as a result of tbis project must be disposed of by means other than
burning.
