SP-703-91 ) CONCLUSIONS AND DECISIAN 'rHIS MATTER, an applicarion for subdivision of land, from Ric Berg has been received and decided upon, pursuant to Spokane County Subdivision regulatians, on the day of June, 1991. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been praperly delegated the responsibility for rendering the decislon by the Spokane County Duecctor of Planning. 2. The proposal is to d.ivide 2 acres into 31ots far the development of single family residences. The original short plat approval (SP-521-87) was for 21ots of 1 acre each. This redivision was authorized under the standards of RCW 58.17.060(1). 3. The proposal is generallly located east of Riverway Avenue at the intersection of Riverway Avenue and Montgomery Avenue in Section 7, Township 25 North, Range 45 EWM, Spokane County, Washington. 4. The current zoning of the property is Urban Residential-3.5 (UR-3.5). The proposed lot sizes, frontage and intended uses are allowed within this zone. The Urban Resldential- 3.5 zone does allow duplexes for lots which are twice the minunuoa required for single family units, or 20,000 square feet. 5. The Spokane County Comprehensive Pla-a designates this area as Urban. The development and uses proposed are generally in accord with this category. 6. A portion of this site is located within the Pastoral area designation of the Spokane County Shorelines program. The Pastoral area is intended to protect and maintain those sharelinPs which have histarically been subject to limited human interference and have preserved their nattuml quality as wildlife habitat and places of scenic beauty. 7. The required public notice was provided for this proposal and agencies having a potential interest in the project were norified and recomunendations solicited. 8. No one in the area conunented on the proposal. 9. Large anirnal keeping is an existing nonconfomiing use on Lot B of SP-521-87. Redivision of this conriguous short plat will terminate those nonconforming rights to keep large animals. 10. Recognizing the recommended condidons and Sgokane County development standards, the proposed subdivision makes appropriate proviszons for the public health, safety and general welfare and that the public use and .interest will be served by platti.ng tlie subdivision. 11. The proposed short plat is located adjacent to the Centennial Trail and the Washington State Parks and Recreation Comrnission has commented. There is a dispute with the property owner on the location of the property line adjacent to state park property. Any recorded discrepancy in the legal descnpuon of the owners property will be shown on the required Tide Report prior to finalization of this short plat and will affect the owners ability to finalize the plat. The agencies reviewing the checklist neither indicated that a more detailed envimnmental revrew should be pravided nor commented that the DNS should be reconsidered. , • , FTNDINGS AND DECISION SP-703-91 Page 2 DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Applicarion SP-703-91 is hereby APPROVED until July 1, 1994, subject to conditions noted below. Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization of the short subdivision. This decision is final uniess appealed in writing, consistent with adopted appeal procedures. These Conditions of Approval apply to applicant(s), owner(s) of tbe property, heirs, assigns or any successors-in-interest to property. PLANNIlVG DEPARTMENT CONDITIONS 1. The certification may be in the form of a letter, but is preferned to be certified on a copy of the Water Plan as a schematic map showing the "as-built" water system. 15. The proposed subd.ivision shall be unproved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80-1592, as amended, which resolution establishes regulatioos for roads, approaches, drainage and fees in new construcaon. 11. 1'he County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing county road system warrants the dedication of additional right-of-way and the roadway improvemeats herein specified. 12. This proposed subdivision or development proposal is located within a drainage basin which has been identified by the Spokane County Engineer's office as having stormwater runoff problems. Since this proposed subdivision or development proposal is affected by or is a contributor to stormwater flows, property owners should participate in the planning and implementation of a future basinwide stonnwater management system. SPOKANE COUNTY AIR POLLUTION CQNTROL AUTHORITY CONDITIONS 1. Air pollution regulations require that dust emissions during demolidon, consrruction and excavation projects be coatrolled. Haul roads should be treated, and emissions fnom the transfer of earthen material must be coatrolled, as well as emissions from all other construction-related activities. 2.
