being the ovmers of thc following described lands in consideration of Mutua! Benefits to be
hereafter derived do for thcrosetves, their heirs, grantees and assigns, hereby agree to the
following:
There m,ny be a need in the future to construct a publie road to serve the lands herein described.
Said road shalt be constructed in accordance with the then adopted Spokane County Road
Standacds for public roads. Said road to follow, as neaz as practieable, the existing County ioad
right of way.
If additional right of way is required, thc owners, their heirs and/or assigns agree to deliver to
Spokane Couaty a progeriy signed and executed Rig,ht of Way Deed covering the required
additional right of way.
The owners or svccessors in interest agme to authorize Spokane County to include the below
described property in a Road Impravement District (RID) and to support the formation of a Road
Iruprovement District for improvement of the mad(s) described below by requesting and
SUUlOTiT1AB SROICSt1E County to place their neme on a petition for formation of a Road
Improvement District pursuant to RCW 36.88.050, or by requesEing and authotizing Spokane
County to cast their ballot in favor of a RID bcing formed uader the resolution method pursuant
to RCW 36.88.030, and/or by not filing a protest against the foTmaiion of a RID being formed
under the aitecnative resolution method provided far in RCW 36.88.065 and Chapter 35.43

If an R1D is proposeci for improvement of the road(s) described below, said owners and
successors furiher agtee: (1) that the impr+ovements or construction concemplated within the
proposed RID are feasiblc, artd (2) that the benefits to be derived hom the fonnatian of the RID
by the property included themin, together witb the a,nount of any County participation, exceed
the cost and expense of farmation of the RID, and (3) that the pmperty within the proposed RID
is suff'icientty developal; provided, the ownets or succes,sors shall retain the right, as authorized
under RCW 36.88.090, to object to any assessmcnt(s) on the property as a milt of the
irnprovements called for ia conjunction with the faratation of a RID by either the pedtion cr
resolution method under Chapter 36.88 RCW and to appeal to the superior court the dccision of
the Board of County Commisstoners confirniing the final assesssaent roll; provided turther, it is
recognizod that actual essessments may vary from assessment estimate so long as they do not
excecd a Cgure equal to the increased true and fair value the improvement add lo the property.
By allowing a buildiag pernit to be issued on praperty having access fmm an unmaintained
County road, Spokane County assumes no obiigation for said road, and the owrters hereby
acknowledge that the County has no obGgadon of any kind or natiu+e whatsoever to establish,
examine, survey, construct, alter, repair, imprnve, maintain, provide drainage or snow c+emoval
on said road. The requirement is and shall ncn with the laad and shall be binding upon the
owners, their heirs, successors ar assigns, until said road is improved to Spokane County Road
Standards arid accepted by the County for rdaintenance.
The undersigned owners, their heirs, successors or assigns hereby release Spokane County, and
all its officers, emplvyces and agents from any rrsponsibility or Gebility for any damage
whatsoever to the hereinabove described lands and improvements ihereon as a r+esvlt of allowing
a building pertnit to be issued on property which is served by a unmaintalned County r+oad.
T'his Agreement upplies to the improvement of ALKI AVENUB ~
RF No. 2264 , by gcading, drainjng, surfacing, curbing, paving, and sidewalk
cotstruction, including traffic control facilities and related work.
These requir+ements are and shaU nm with the land and s}W1 be binding upon the owners, tbeir
heits, successors or assigns. The Road lmpmvement District (RID) waiver ia this agreemeni
shall expire aRer ten (10) years from the date of execution below.

, to filing the final short plat.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS 1. Conditional approval of the plat by the County Engineer is given subject to dedication of right-
of-way and approval of the road system as mdicated in the preliminary plat of record.
2. Drainage language will be drafted by Spokane County and provided to the Sponsol's Engineer
or Surveyor for inclusion with the final plat document.
3. No road and drainage plans or public road irriproy.lements for Alki Avenue are required for this
proposal at this time. Applicant shall execute a°Spokane County Notice to the Public No 4", ~R
which will allow for the construction of a private driveway within the Public Right-of way.
Construction of Evergreen Road will be constructed per County Road Project No. 2727.
4. No construction work is to be perfonned within the existing or proposed Public right-of-way
until a permit has been issued by the County Engineer. All work is subject to inspection and
approval by the County Engineer.
5. Appropriate provision be made that the following described property be held in trust until the
continuation of the streets be dedicated or deeded: A 1 foot stnp at the ends or edges of all
streets that terminate or border the plat boundary.
6. Approach Permits are required for any access to the Spokane County road system.
7. Dedication of 19 feet of right-of-way along the north boundary of Tracts "C" and °D" for the
extension of Alki Avenue. Right-of-way dedication shall include provisions for 1/2 of a
temporary cul-de-sac. The location of the temporary cul-de-sac shall be located along the
west boundary of Tract "C".

Plat Dedicatioa
The property owners within this plat shall be held responsible for keeping open and
maintaining the surface path of natural or man-made drainage flow over and across
their respective properties. If the property owner(s) fails to maintain the surface path of
natural or man-made drainage flow, or the drainage swale, a notice of such failure may
be given to the property owner(s). If not corrected within the period indicated on said
notice, Spokane County has the right to correct the maintenance failure, or have it
corrected, at the expense of the property owner.
There may exist properties located uphill and adjacent to this subdivision, which
periodically discharge stormwater runoff onto individual lots within this plat. Runoff
from nearby uphill propenies should be expected, and during snowmelt periods or wet
seasons the lots may be subjected to higher amounts of stormwater runoff that what is
normally observed or anticipated. Because stormwater runoff from adjacent properties
have discharged onto this plat prior to development, stormwater runoff will likely
continue to do so after development. It is the responsibility of the individual lot owners
to maintain existing surface paths of n.inoff through their respective lots and to grade
the lots in accordance with applicable rules and regulations, so as to prevent property
damage.
Any building that is constructed on a lot in this plat shall be set at such an elevation so
as to provide positive drainage away from any drainage entry point to the building
(including but not limited to a window well, a window unprotected by a window well, or a
doorway). Said positive drainage shall consist of a minimum slope of 3% away from
the building for a distance of at least 10 feet from the building. The lots shall be graded
so that either a) all runoff is routed away from the building, and conveyed over the lot to
a natural drainage swale or approved drainage facility, or b) drainage intercepted on
the lot is disposed of on the Iot in an approved drainage facility. The approved
drainage facility shall be constructed in accordance with any applicable accepted plans
on file at the County Engineer's Office. Any revisions to the accepted drainage plans
must be accepted by the County Engineer's Office prior to construction of said
revisions.
Spokane County does not accept the responsibility of maintaining the drainage course
on private lots or floodplain areas within private lots, nor the responsibility for any
damage whatsoever, including, but not limited to, inverse condemnation to any
properties due to deficient construction and/or maintenance of drainage courses in
drainage easements on private property.
The property owners within this plat shall maintain atl water quality swales ("208"
swales) and drainage ditches situated on their respective properties, and any portion of
a'208' swale situated in a public or private right-of-way adjacent to their respective
properties, with a permanent ground cover as specified in the currently approved and
accepted plans on fle at Spokane County's Engineer's Office. No structures, including
fences, shall be constructed directly over or within a`208'swale without the expressed
written consent of the Spokane County Engineer. Spokane County does not accept the
responsibility to inspect and/or maintain the drainage easements or drainage swales,
nor does Spokane County accept any liability for any failure by the lot owner(s) to
properly maintain such areas.

stormwater management program and to pay such rates and charges as may be fixed

APPLICANTS: DONALD & HELEN HADEN ) DECISION
THIS MATTER, an application for the short subdivision of land from Duane Helt, Simpson Engineers,
Inc., agent acting on behalf of Donald & Helen Haden, has been received and was decided upon,
pursuant to Spokane County Subdivision regulations, on the 1' day of August, 2000.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly deiegated the responsibility for
rendering the decision by the Director of Spokane County Divisian of Planning.
2. The proposal is to divide approximately 2.66 acres into four (4) parcels for one existing
residence and three (3) additional residential lots.
3. The proposal is generally located east of and adjacent to Evergreen Road, approximately 230
feet north of Valleyway Avenue, and more commonly known as 516 North Evergreen Road, in
the Southwest of Section 14, Township 25 North, Range 44 E.W.M., Spokane County,
Washington (Parcel No. 45143.1564).
4. The existing zoning of the property described in the application is Urban Resideniial-3.5 (UR-
3.5), which was established in 1991. Pursuant to Revised Code of Washington (RCW)
58.17.195, this proposal conforms to the requirements of the existing UR-3.5 zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The development
and uses, as proposed and conditioned, are in compliance with the Urban category.
6. Surrounding uses, to the north, east and south, are residential. Property to the west, across
Evergreen, is owned by Vera Irrigation District No. 15 and is host to the district office.
7. The Spokane County Arterial Road Plan identifies Evergreen Road as a Principal Arterial with
a future right-of-way width of 100 feet. The existing right-of-way wictth is 90 feet. The Spokane
County Arterial Road Plan identifies Alki Avenue as a Local Access Road with a future right-
of-way width of 60 feet. The existing right-of-way width is 60 feet with a 19 foot wide
extension through the northern boundary of SP-1034-95, adjacent to the east. In order to
implement the Arterial Road Plan, a strip of property 19 feet wide along the north boundary of
Tracts "C°" and "D" should be dedicated for the extension of Alki Avenue. Therefore, as
conditioned (such as improvements, dedication, sidewalks and acquisition areas) the proposal
conforms to the Road Plan.
8. The proposed site is located within the Public Transportation Benefit Area (PTBA).
9. The proposed short plat will be served by a public water system, being Vera Irrigation District
No. 15 (aka Vera Water and Power). Wastewater disposal will be as authorized by the
Director of Spokane County Division of Utilities.
10. The required public notice was provided for this proposal and agencies having a potential
interest in the project were notified and recommendations solicited. Spokane County Fire
District No. 1, Vera Water and Power Company, Central Valley No. 356, Spokane Regional
Transportation Councii, Washington State Department of Transportation and the 6oundary
Review Board were all sent notification of the project on June 20, 2000. No responses have
been received.
11. Recognizing the recommended conditions and Spokane County development standards, the
proposed short plat makes appropriate provisions for the public health, safety and general
welfare and that the public use and interest will be served by platting the subdivision.
The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision
regulations, pcomoting the public health, safety and general welfare in accordance with
standards established by the State and Spokane County. The County Division Planning has
considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). More
specifically:
a. open spaces f. sanitary waste disposal
b. drainage ways g. parks and recreation facilities
c. public and/or private right-of-ways h. playgrounds
d. transit i. schools and school grounds
e. potable water j. sidewalks
12. The project is exempt from environmental review under the State Environmental Policy Act
pursuant to WAC 197-11-800 (6) (a).
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-1243-00 is
hereby APPROVED for five (5) years, specifically to August 1, 2005 and subject to conditions noted
below. This decision is final unless appealed in writing, consistent with adopted appeal procedures.
CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant," which term shall include the
owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF PLANNING
1. The proposal shall comply with the Urban Residentia!-3.5 (UR-3.5) ione and other applicable
Zoning Code chapters, as amended.
2. The final short plat shall be designed substantially in conformance with the preliminary short
plat of record. No increase of density or number of tracts shall occur without a change of
condition application submittal and approval.
3. The preliminary short plat is given condftional approval for five (5) years, specifically to August
1, 2005. The applicant may submit an extension ofi time application at [east thirty (30) days
prior to the above expiration date, but no later than July 1, 2005. Application(s) for extension
of time shall be processed under the provisions of Chapter 12.100.118 (Extension of Time) of
the Spokane County Subdivision Ordinance. If the applicant complies with the criteria of
Chapter 12.100.118, the preliminary approval and conditions will be changed to reflect the
adopted policy and development regulations at the time of the extension application.
4. Prior to filing the final short plat, the applicant shall submit to the County Division of Planning
Director/designee for review any proposed final short plats to ensure compliance wi#h these
Findings and Conditions of Approval.
5. A survey is required of the subject property prior to filing the final short plat.
6. Appropriate road names and street addresses shall be indicated on the final short plat map.
7. Appropriate utility easements shall be indicated on the final short plat map. Written approval
of utility easements by utility companies must be received prior to filing the final short plat.
8. The dedication shall contain the foltowing statement:
"Setbacks shall be determined at the time building permits are requested. The setbacks
may be varied from if proper zoning or variance approvals are obtained."

9. Four (4) current Certificates of Title shall be fumished to the County Division of Planning prior
to flling the final short plat.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
1. Conditional approvat of the plat by the County Engineer is given subject to dedication of right-
of-way and approval of the road system as indicated in the preliminary plat of record.
2. Drainage language will be drafted by Spokane Counfy and provided to the Sponsor's Engineer
or Surveyor for inclusion with the final plat document.
3. No road and drainage pfans or public road improvements for Alki Avenue are required for this
proposal at this time. Applicant shall execute a°Spokane County Notice to the Public No 4",
which will allow for the construction of a private driveway within the Public Right-of way.
Construction of Evergreen Road will be constructed per County Road Project No. 2727.
4. No construction work is to be performed within the existing or proposed Public right-of-way
until a permit has been issued by the County Engineer. All worlc is subject to inspection and
approval by the County Engineer.
5. Appropriate provision be made that the foilowing described property be held in trust until the
continuation of the streets be dedicated or deeded: A 1 foot strip at the ends or edges of all
streets that terminate or border the plat boundary.
6. Approach Permits are required for any access to the Spokane County road system.
7. Dedication of 19 feet of right-of-way along the north boundary of Tracts °C" and GD" for the
extension of Alki Avenue. Right-of-way dedication shall include provisions for 1/2 of a

the RID or served by the 'tmprovements without any monetary participation by Spokane
County.
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below. This provision is applicable to Alki Avenue.
12. The County Engineer has designated a Local Access Roadway Section for the improvement
of Alki Avenue which is adjacent to the proposed development. This will require the addition
of approximately 30 feet of asphalt along the frontage of the development. The construction
of curbing and sidewalk is also required.
13. The proposed plat shall be improved to the standards set forth in Spokane County 6oard of
Commissioners Resolution No. 99-0265, as amended, which establishes regulations for
roads, approaches, drainage and fees in new construction.
14. The County Engineer has examined this development proposal and has determined that the
impact of this proposal upon the existing County Road System warrants the dedication of
additional Right of Way and the roadway improvements herein specified.

15. The appiicant shouid be advised that there may exist utilities either underground or overhead
affecting the applicants property, including property to be dedicated or set aside future
acquisition. Spokane County will assume no financiai obligation for adjustments or relocation
regarding these utilities. The applicant should check with the applicable utilities and Spokane
County Engineer to determine whether the applicant or utility is responsible for adjustment or
relocation costs and to make arrangements for any necessary work.
SPOKANE COUNTY DIVISION OF UTILITIES
1. The dedication shall state:
"Public sewers shall be constructed to provide for the connection of each parcel to the
County's system of sewerage. Uses on properties within the project shall be required to
connect to the sewer and pay applicable charges per the County Sewer Ordinance.
Sewer connection permits shall be required."
2. The dedication shall state:
"A public sewer system will be made available for the plat, and individual services will be
provided to each lot prior to sale. Use of individual on-site disposal systems shall not be
authorized."
3. The dedication shall state:
"Individual tracts shall be subject to payment of current applicable sewer connection
charges and/or general facilities charges prior to the issuance of a sewer connection
permit."
4. Applicant shall submit expressly to Spokane County Division of Utilities "under separate
cover', only those plan sheets showing sewer plans and specifications for the public sewer
connections and facilities for review and approval. Commercial developments shall submit
historical and or estimated water usage as part of the sewer plan submittal.
5. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the finalization of
the project.
6. The dedication shall state:
uArrangements for payment of applicable sewer charges must be made prior to issuance
of sewer connection permit. Sewer charges may include special connection charges and
general facilities charges. Charges may be substantial depending upon the nature of the

1. The final plat shall be designed as indicated on ihe preliminary plat of record and/or any
attached sheets as noted.
Appropriate utility easements shall be indicated on the final plat of record for distribution by
the County Division of Planning to the utility companies, Spokane County Engineer, and the
Spokane Regional Health District. Written approval of easements by the utility companies
shall be received prior to the submittal of the final plat.
3. Sewage disposal method shatl be as authorized by the Director of the Spokane County
Division of Utilities.
4. Water service shall be coordinated through the Director of the Spokane County Division of
Utilities.
5. Water service shall be by an existing public water supply when approved by the Regional
Engineer (Spokane), State Department of Health.

6. Prior to filing the final short piat, the sponsor shall demonstrate to the satisfaction of the
Spokane Regional Heaith Distnct that an adequate and potable water suppiy is available to
each tract of the plat.
7. Prior to filing the final short plat, the sponsor shall present evidence that the plat lies within the
recorded service area of the water system proposed to serve the plat.
8. The dedicatory language on the final short plat shall state:
"A public sewer system wili be made available for the plat and individual service will be
provided to each tract prior to sale. Use of individual on-site sewage disposai systems
shall not be authorized."
9. The dedicatory language on the final short piat shall state:
"Use of private wells and water systems is prohibited."
10. The final short pfat dedication wili contain the foilowing statement:
"The public water system, pursuant to the Water Plan approved by County and State
Health authorities, the local Fire District, County Division of Building Code Enforcement,
and water purveyor, shall be installed within this subdivision, and the applicant shall
provide for individual domestic water service as well as fire protection to each tract prior to
sale of each tract and prior to issuance of a building permit for each tract."

The Spokane County Engineering Department has reviewed the above referenced appiication. The
following "Conditions of Approval" are submitted to the Spokane County Planning Department for
inclusion in the "Findings of Fact, Conclusions and Order/Decision" should the request be approved.
1. Conditional approval of the plat by the County Engineer is given subject to dedication of right-of-
way and approval of the road system as indicated in the preliminary plat of record.
2. Drainage language will be drafted by Spokane County and provided to the Sponsor's Engineer
or Sunreyor for inclusion with the final plat document.
3. No road and drainage pfans or public road improvements for Alki Avenue are required for this
proposal at this time. Applicant shall execute a"Spokane County Notice to the Public No 4",
which witl allow for the construction of a private driveway within the Public Right-of way.
Construction of Evergreen Road will be constructed per County Road Project No. 2727.
4. No constnuction work is to be performed within the existing or proposed Public right-of-way until
a permit has been issued by the County Engineer. All work is subject to inspection and
approval by the County Engineer.
5. Appropriate provision be made that the following described property be held in tnust until the
continuation of the streets be dedicated or deeded: A 1 foot.strip at the ends or edges of all
streets that terminate or border the plat boundary.
6. Approach Permits are required for any access to the Spokane County road system.
7. Dedication of 19 feet of right-of-way along Alki Avenue. Right-of-way dedication shall include
provisions for %z of a temporary cul-de-sac. The location of the temporary cul-de-sac shall be
located along the west boundary of Tract "C".

8. The applicant shall grant applicable border easements adjacent to Spokane County Right of
Way per Spokane County Standards.
9. To construct the road improvements stated herein, the applicant may, with the approval of the
County Engineer, join in and be a willing participant in any petition or resolution which purposes
is the formation of a Road Improvement District (RID) for said improvements pursuant to RCW
36.88, as amended. At such time as an RID is created or any Road Improvement Project is
sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control
and paving to existing pavement) will be at the sole expense of the undersigned owner, their
heirs, grantees and assigns. This provision is applicable to Alki Avenue.
10. As an alternative method of constructing the road improvement stated herein, the applicant
may, with the approval of the County Engineer, accomplish the road improvements stated
herein by joining and participating in a County Road Project (CRP) to the extent of the required
road improvement. At such time as an RID is created or any Road Improvement Project is
sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control
and paving to existing pavement) will be at the sole expense of the undersigned owner, their
heirs, grantees and assigns. This provision is applicabie to Alki Avenue.
11. The foilowing statements shall be placed in the dedicatory language of the final plat:
• "No direct access shall be allowed from Tract uA" to Alki Avenue until such time as authorized by
the County Engineer."
• "The owners or successor$ in interest agree to join in any County-approved stormwater
management program and to pay such rates and charges as may be fixed through public
hearings for service or benefit obtained by the planning, design, constructing, maintaining or
operation of stormwater control facilities."
• That in consideration of Mutual Benefits now or to be hereafter derived, do for themselves, their
heirs, grantees, assigns and successor(s) in interest hereby request and authorize Spokane
County to include the above described property in a Road Improvement District (RID) and to
support the formation of a Road Improvement District for improvement of the road(s) described
below by requesting and authorizing Spokane County to place their name(s) on a petition for the
formation of a Road Improvement District pursuant to RCW 36.88.050, or by requesting and
authorizing Spokane County to cast their ballot in favor of a RID being formed under the
resolution method pursuant to RCW 36.88.030, and/or by not filing a protest against the
formation of a RID being formed under the alternative resolution method provided for in RCW
36.88.065 and Chapter 35.43 RCW.

if a RID is proposed for improvement of the road(s) described below, said owner(s) and
successor(s)further agree: (1) that the improvements or construction contemplated within the
proposed RID are feasible and (2) that the benefits to be derived from the foITnation of the RID
by the property inciuded therein, together with the amount of any County participation, exceeds
the cost and expense of formation of the RID, and (3) that the property within the proposed RID
is sufficiently developed; provided, themselves, their heirs, grantees, assigns and successor(s)
shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on
the property as a result of the improvements called for in conjunction with the formation of a RID
by either the petition or resolution method under Chapter 36.88 RCW and to appeal to the
Superior Court the decision of the Board of County Commissioners confirming the final
assessment roll; provided further, it is recognized that actual assessments may vary from
assessment estimate so long as they do not exceed a figure equal to the increased true and fair
value improvement(s) add(s) to the property.
It is further acknowledged and agreed that at such time as a RID is created or any County Road
Improvement project is authorized by Spokane County, the improvements required shall be at
the sole expense of the owner(s) of property within the RI D or served by the improvements
without any monetary participation by Spokane County.
The RlD waiver contained in this agreement shall expire after ten (10) years from the date of
execution below. This provision is applicable to Alki Avenue.
12. The County Engineer has designated a Local Access Roadway Section for the improvement of
Alki Avenue which is adjacent to the proposed development. This will require the addition of
approximately 30 feet of asphalt along the frontage of the development. The construction of
curbing and sidewalk is also required.
13. The proposed plat shall be improved to the standards set forth in Spokane County Board of
Commissioners Resolution No. 99-0265, as amended, which establishes regulations for roads,
approaches, drainage and fees in new construction.
14. The County Engineer has examined this development proposal and has determined that the
impact of this proposal upon the existing County Road System warrants the dedication of
additional Right of Way and the roadway improvements herein spec'rfied.
15. The applicant should be advised that there may exist utilities either underground or overhead
affecting the applicants property, including property to be dedicated or set aside future
acquisition. Spokane County will assume no financial obligation for adjustments or relocation
regarding these utilities. The applicant should check with the applicable utilities and Spokane
County Engineer to determine whether the applicant or utility is responsible for adjustment or
relocation costs and to make arrangements for any necessary work.
