SP-1245-00 ) CONCLUSIONS AND APPLICANT(S): STEPHEN & PATTI GUY ) DECISION THIS MATTER, an appiication for short subdivision of land from Stephen & Patti Guy has been received and was decided upon, pursuant to Spokane County Subdivision regulations, on the 221 day of May, 2001. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibiiity for rendering the decision by the Director of Spokane County Division of Planning. 2. The proposal is to divide approximately .56 acre into two (2) lots for those uses permitted in the existing Urban Residential-3.5 (UR-3.5) zone. 3. The proposal is generally located at the northwest comer of the intersection of Raymond Street and 2811' Avenue in the SE'/. of Section 29, Township 25 North, Range 44 E.W.M., Spokane County, WA. The site address is 2714 South Raymond Street. Tax Parcel No. 45294.0521. 4. The existing zoning of the property is Urban Residential-3.5 (UR-3.5), which was established in 1991 , previously classified as Agricultural (A) in 1956. Pursuant to the Revised Code of Washington (RCV11) 58.17.195, this proposal conforms to the requirements of the existing Urban Residential-3.5 (UR-3.5) zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses, as proposed and conditioned, are in compliance with the Urban category. 6. Surrounding uses are primarily single-family residential and currently zoned Urban Residential-3.5 (UR-3.5). Lot sizes range between .38 acre and 5.45 acres. 7. The Spokane County Arterial Road Plan identifies Raymond Street as a County Local Access with a future right-of-way width of 60 feet. The existing right-of-way width of 60 feet is consistent with that specified in the Arterial Road Plan. The Spokane County Arterial Road Plan identifies 281 Avenue as a County Local Access with a future right-of- way width of 60 feet. The existing right-of-way width of 60 feet is consistent with that specified m the Arterial Road Plan. Therefore, as conditioned (such as improvements), the proposal conforms to the Arterial Road Plan. 8. The proposed site is located within the Interim Urban Growth Area (IUGA), Priority Sewer Service Area (PSSA), Aquifer Sensitive Area (ASA), Urban Impact Area (UTA), and Public Transportation Benefit Area (PTBA). 9. The proposed short plat will be served by Spokane County Water District No. 3 for domestic water. Wastewater disposal will be as authorized by the Director of Spokane County Division of Utilities. 10. The proposal is located within a 100-year flood plain, Zone A6, per FIRM 294C. 11. The required public notice was provided for this proposal and agencies having a potential interest in the project were notifred and recommendations solicited. ~ y 6. Appropriate road names and street addresses shall be indicated on the final short plat map. 7. Appropriate utility easements shall be indicated on the final short plat map. Approval of utility easements by utility companies must be received prior to filing the final short plat. 8. The dedication shall contain the following statement: "Setbacks shall be determined at the time building permits are requested unless these setbacks are specifically drafted on this final short plat. The setbacks indicated on this subdivision may be varied from if proper zoning or variance approvals are obtained." 9. Four (4) current Certificates of Title shall be furnished to the Division of Planning prior to filing the final short plat. SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS 1. Conditional approval of the plat by the County Engineer is given subject to approval of the road system as indicated in the preliminary plat of record. 2. Drainage language will be drafted by Spokane County and provided to the Sponsor's Engineer or Surveyor for inclusion with the final ptat document. 3. This proposed subdivision or development proposal is located within a drainage basin which has been identified by the Spokane County Engineer's and Utilities offices as having storrnwater runoff problems. Since this proposed subdivision or development proposal is affected by or is a contributor to stormwater flows, property owners should participate in the planning and implementation of a future basinwide stormwater management system. 4. That the regulations of the National Flood Insurance Program shall be observed since the proposed plat is affected by a Flood Hazard Zone. A development peRnit shall be obtained from the County Engineer before construction or development begins within any area of special flood hazard (reference Spokane County Ordinance 88-0521). This condition is applicable to driveway approaches, driveways and private roads constructed on the site for access. 5. fVo construction work is to be perfomned within the existing or proposed Public right-of- way until plans have been accepted by the County Engineer and a permit has been issued by the Counry Engineer. All work is subject to inspection and approval by the County Engineer. 6. Approach Permits are required for any access to the Spokane County road system. 7. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, jom in and be a willing participant in any petition or resolution which purposes is the formation of a Road Improvement Djstrict (RID) for said improvements pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and assigns. This provision is applicable to Raymond Road. Findings and Decision SP-1245-00 3 r 10. The County Engineer has designated a Local Ac.cess Roadway Section for the improvement of Raymond Road, which is adjacent to the proposed development. This will require the addition of approximately 5-7 feet of asphalt along the frontage of the development. The construction of curbing and sidewaik is aiso required. 11. The proposed plat shali be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 99-0265, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. 12. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing County Road System warrants the roadway improvements herein specified. 13. The Applicant shall dedicate applicable border easements per Spokane County Standards. SPOKANE COUNTY DIVISION OF UTILITIES 1. The dedication shall state: Public sewers shall be constructed to provide for the connection of each parcel to the County's system of sewerage. Uses on properties within the project shall be required to connect to the sewer and pay applicable charges per the County Sewer Ordinance. Sewer connection permits shall be required. 2. The dedication shall state: A public sewer system will be made available for the plat, and individual services will be provided to each lot prior to sale. Use of individual on-site disposal systems shall not be authorized. 3. Applicant shall submit expressly to Spokane County Division of Utilities "under separate cover"', only those plan sheets showing sewer plans and specifications for the "double plumbed dry side sewee' for review and approval. 4. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the finalization of the project. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. SPOKANE REGIONAL HEALTH DISTRICT 1. The final plat shall be designed as indicated on the preliminary plat of record and/or any attached sheets as noted. 2. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for distribution by the Division of Planning to the utility companies, Spokane County Engineer, and the Spokane Regional Health District. Written approval of the easements by the utility companies shall be received prior to the submittal of the final plat. 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 4. Water senrice shalt be coordinated through the Director of Utilities, Spokane County. 5. Water service shall be by an existing public water suppfy when approved by the Regional Engineer (Spokane), State Department of Health. 6. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane Regional Heakh District that an adequate and potable water supply is available to each tract of the plat. 7. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. The following statements shall be placed in the dedicatory language of the final plat: • "The owners or successors in interest agree to join in any County-approved stormwater management program and to pay such rates and charges as may be fixed through public hearings for service or benefit obtained by the planning, design, constructing, maintaining or operation of stormwater control facilities." • "Development within this subdivision shall conform to the requirements of the National Flood Insurance Program and Chapter 3.20 of the Spokane County Code. Purchasers of the property within this subdivision are warned of possible flooding or ponding and the potential requirement to purchase flood insurance. This warning shall be carried in each and every deed drawn to transfer ownership of any and all property within the plat in the area of Special Flood Hazard." • That in consideration of Mutual Benefits now or to be hereafter derived, do for themselves, their heirs, grantees, assigns and successor(s) in interest hereby request and authorize Spokane County to include the above described property in a Road Improvement District (RID) and to support the formation of a Road Improvement District for improvement of the road(s) described betow by requesting and authorizing Spokane County to place their name(s) on a petition for the formation of a Road Improvement District pursuant to RCW 36.88.050, or by requesting and authorizing Spokane County to cast their ballot in favor of a RID being formed under the resolution method pursuant to RCW 36.88.030, and/or by not filing a protest against the formation of a RID being formed under the alternative resolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW. Page ~ f t- s0uG SF-1245 If a RID is proposed for improvement of the road(s) described below, said owner(s) and successor(s)further agree: (1) that the improvements or construction contemplated within the proposed RID are feasible and (2) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceeds the cost and expense of formation of the RID, and (3) that the property within the proposed RID is sufficiently developed; provided, themselves, their heirs, grantees, assigns and successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of a RID by either the petition or resolution method under Chapter 36.88 RCW and to appeal to the Superior Court the decision of the Board of County Commissioners confirming the final assessment roll; provided further, it is recognized that actual assessments may vary from assessment estimate so long as they do not exceed a figure equal to the increased true and fair value improvement(s) add(s) to the property. It is further acknowledged and agreed that at such time as a RID is created or any County Road lmprovement project is authorized by Spokane County, the improvements required shall be at the sole expense of the owner(s) of property within the RID or served by the improvements without any monetary participation by Spokane County. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. This provision is applicable to Raymond Road. 10.
