N. 1115 Pines Road Spokane, Washington 99206 Brian, Drainage Language for Short Plat 1250 Please include the following drainage language on the plat dedication sheet: The property owners within thls plat shall be held responsible for keeping open and maintaining the surface path of natural or man-made drainage flow over and across their respedive properties. If the property owner(s) fails to maintain the surface path of natural or man-made dralnage flow, or the drainage swale, a notice of such failure may be given to the property owner(s). If not corrected within the period indicated on said notice, Spokane County has the right to correct the mairrtenance failure, or have it corrected, at the expense of the property owner. There may exist properties, located uphill and adjacent to this subdivision, which periodically discharge storrnwater runoff onto individual lots within this plat. Runoff from nearby uphill properties should be expected, and during snowmeft pedods or wet seasons the lots may be sub)eded to higher amounts of stormwater runoff that what is normally observed or anticipated. Because stormwater runoff from adjacent properties have discharged ontv this plat prior to development, stormwater nunoff will likely continue to do so after development. It is the responsibility of the individual lot owners to maintain existing surface paths of nmoff through their respective Iots and to grade the lots in accorclance with applicable rules and regulations, so as to prevent property damage. Any building that is constructed on a lot in this plat shall be set at such an elevation so as to provide positive drainage away from any drainage entry point to the building (including but not limited to a window well, a window unprotected by a window well, or a doorway). Said positive drainage shall consist of a minimum slope of 3% away from the bullding for a distance of at least 10 feet from the building. The lots shall be graded so that either a) all runoff is routed away from ihe building, and conveyed over the lot to a natural drainage swale or approved drainage facility, or b) drainage intercepted on the lot is disposed of on the Iot in an approved drainage facility. The approved drainage facility shall be constructed in accordance with any applicable accepted plans on file at the County Engineer's Office. Any revisions to the accepted drainage plans must be accepted by the County Engineer's Office prior to construction of said revislons. Spokane County does not accept the responsibility of maintaining the drainage course on private Iots or floodplain areas within private lots, nor the responsibility for any damage wha#soever, including, but not Ijmited to, inverse condemnation to any properties due to deficaerrt construdion and/or maintenance of drainage courses in drainage easements on private property. la26 W. House has been received and was decided upon, pursuant to Spokane County Subdivlsion regulations, on the 2V' day of August 2000. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Director of Spokane County Division of Planning. 2. The proposal is to divide approximately 1.25 acres into three (3) tracts for those uses permitted in the Urban Residential-3.5 (UR-3.5) zone. 3. The proposal is generally Iocated north of and adjaoent to 8`" Avenue approximately 350 feet east of Evergneen Road in the NW'/. of Secton 23, Township 25 North, Range 44 E.W.M., and more commonly known as 14007 East St' Avenue, Spokane County, Washington. Parcel No. 45232.9039. 4. The existing zoning of the property is Urban Residential-3.5 (UR-3.5) which was established in 1991. Pursuant to the Revised Code of Washington (RCV1n 58.17.195, this proposal conforms to the requirements of the existing Urban Residenfial-3.5 (UR- 3.5) zone. 5. The Spokane County Cornprehensive Plan designates this area as Urban. The development and uses, as proposed and conditioned, are in compliance with the Urban category. 6. Surrounding uses ane primarily single-family cesidential on the south, east and west and curnently zoned Urban Residenfial-3.5 (UR-3.5). The properties immediately north and northeast of the proposal are vacant, but elso zoned Urban residential-3.5 (UR 3.5). 7. The Spokane County Arteriai Road Plan identifles 81' Avenue as a minor arterial with a future right-of-way width of 80 feet. The existing right-of-way width of 40 ieet is not consistent with that specified in The Plan. In order to implement the Arterial Road Plan it is necommended that in addition to the required 7 foot right-of-way dedicaflon, a strip of property 13 feet in width along the 8t' Avenue frontage be set aside in reserve. Therefone, as condrtioned (such as improvements, dedication, sidewalks and aoquisition areas) the proposal conforms to the Road Plan. 8. The proposed site is tocated wkhin the Public Transportation Beneflt Area (PTBA). 9. The proposed short plat will be served by the Vera Water & Power. Wastewater disposal w'ill be as authorized by the Director of Spokane County Dryision of Utilites. 10. The required public notice was provided for this proposal and agencies having a potenfial interest in the project were notified and recommendations solicited. 11. No written comments were received from any adjoining property owners. . , 12. Recognizing the recommended conditions and Spokane County development standards, the proposed short plat makes appropriate provisions for the public heafth, safety and general weffare and that the pubiic use and interest will be served by piatting the subdivision. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations, promoting the pubiic health, safety and general welfara in accordance with standards established by the State and Spokane County. The County Division of Planning has considered the provision of adequate public facildies as cited in RCW 58.17.110 (2). More specifically: a* open spaces f. sanitary waste disposal b. drainage ways g parks and recreetion facilities c. public and/or private right-of-ways h. playgrounds d. transft i. schools and school grounds e. potable water J. sidewalks 13. DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP- 1250-00 is hereby APPROVED for five (5) ~ears, specifically to August 25~', 2005 and subject to conditions noted below. This deasion sfinal unless appealed in wrifing consistent wfth adopted appeal procedures. CONDITIONS OF APPROVAL All the below conditions imposed shall be binding on the "Applicant,° which term shall include the owner or owners of the property, heirs, assigns and successors. SPOKANE COUNTY DIVISION OF PLANNING 1. The proposal shall compty with the Urban Residential-3.5 (UR-3.5) zone and other appticable Zonmg Code chapters, as amended. 2. The final short plat shall be designed substantially in conformance with the preliminary plat of record. No increase of density or number of trec°ts shall occur vvithout a change of condftion or subdivision apptication submittal and approval. 3. The pr+eliminary short plat is given cond~tional approval for five (5) years, specifcally to August 25a', 2005. The applicant may submit an extension of time application at least thirty (30) days prior to the above expiration date, but no later than July 2r, 2005. Appitcation(s) for extension of time shall be processed under the provisions of Chapter 12.100.118 (Extension of Time) of the Spokane County Subdfvlsion Ordinanae, as amended. 4. Prior to filing the final short plat, the applicant shall submit to the County Division of Planning DirectoNdesigme for review any proposed flnal short plats to ensure complianc;e with these Findings and Conditions of Approval. 5. A survey is required of the subject property prior to flling the final short plat. 6. Appropriate road names and street addresses shall be indicated on the frnal short plat • map. 7. Four (4) current Certificates of Title shall be fumished to the County Division of Planning prior to filing the flnal short plat. 10. The Spokane County Division of Building and Planning shall prepare and record with the County Auditor a"Titie Notice" specifying a future lend acquisition area for road right-of- way and utilities. The reserved future acluilding ulsition area Title Notice shall be released, in fuil or in part, by the County Division of and Planning. The notice should be recorded the same time as tFie final short plat and shall provide the followin9: a. A strip of property 13 feet from the existing right-of-way is reserved for future acquisition area for additlonal road right-of-way along 8 Avenue. Note: The County Engineer required a dedicaaon of four (4) feet of additional right-of way along EverBreen Road. b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisition area. c. No required landscaping, parlcing, '208' areas, drainfleld or allowed signs should be located within the future acquisftion area for road ri8ht-of-way and utilfties. If any of the above improvements are made within this area, they shall be relocated at the applicanrs expense when roadway improvements are made. d. The future acquisition area, until acquired, shall be private property and may be used as aIlowed in the zone, exoept that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. e. No construction work is to be perfonned vvithin the existing or proposed Public right-of- way until plans have been accepted by the Courrty Engineer and a permit has been issued by the County Engineer. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join In and be a w111ing participant in any petition or resolution which purposes is the formation of a Road Improvement District (RID) for said improvements pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project Is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage conlrol and paving to existing pavernent) will be at the sole expense of the undersigned awner, their heirs, grantees and assigns. This provision is applicable to 8~' Avenue. 10. As an altemative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participabng In a County Road Project (CRP) to the extent of the required road improvement. The County Engineer has examined this development proposal and has detennined that the impact of this proposai upon the existing County Road System warrants the dedication of additional Right of Way and the roadway improvements herein specified. 15. The County Arterial Road plan identifies e Avenue as a 80 foot Minor Arterial. The existing right of way width of 40 feet is not consistent wtth that specified in The Plan. In or+der to implemerrt the Aiterial Road Plan it is recommended that in addition to the required right of way dedicatfion, a strip of property 13 feet in width along the e Avenue - frontage be set aside in reserve. This authorization is conditioned in compliance with all rules and r+egulations of the Spokane County Health Dietrict and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. The dedication shall state: To facilitate connection to the firture public sewer system, each new buildlnA shall be double plumbed with a dry side sawer for connec#ion to future areaanride wastewater collection systems. NOTE: Plans acceptable to the Division of Utilifies may be required. 3. The applicant shall grant applicable border easements adjacent to Spokane County Right of Way per Spokane County Standards. 9. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purposes is the formation of a Road Improvement District (RID) for said improvements pursuant to RCW 36.88, as amended. It is further acknowiedged and agreed that at such time as a RID is created or any County Road Improvement project is authorized by Spokane County, the improvements required shall be at the sole expense of the owner(s) of property within the RID or served by the improvements without any monetary participation by Spokane County. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. This provision is applicable to 8~' Avenue. 12. The County Engineer has designated a 3-Lane Minor Arterial Roadway Section for the improvement of 8`r' Avenue which is adjacent to the proposed development. This will require the addition of approximately 12-14 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 13. The proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 99-0265, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. 14. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing County Road System warrants the dedication of additional Right of Way and the roadway improvements herein specified. 15. The County Arterial Road plan identifies 8' Avenue as a 80 foot Minor Arterial. The existing right of way width of 40 feet is not consistent with that specified in The Plan. In order to implement the Arterial Road Plan it is recommended that in addition to the required right of way dedication, a strip of property 13 feet in width along the 8' Avenue frontage be set aside in reserve.
