SUBDIVISION; SP-1251-00 ) CONCLUSIONS AND
DEClSION
THIS MATTER, an applicatian for short subdivision from Ray Veley, has been received and was
decided upon, pursuant to Spokane County Subdivision regulations. on the 2Rd Day of October,
2000.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been properly delegated the responsibility for rendering
the decision by the Director of SpokanE County Division of Planning.
2. The application proposes to short subdivide 3.54 acres into 2 tracts, each intended fior the
construction of a single family dwelling and associated accessory structures as allowed by
the Spokane County Zoning Code. The subdivision site is legally described as the South
'/z of Tract 85 of Vera Plat, County Aud:tor Book 0, page 30. The Assessor's tax parczl
number for the project site is 45143.1 5..2.
3. The proJect site is adjacent to and east of Evergreen Road at the northeast comer of the
intersection of Evergreen and Valleyway, in the southwest %4 of Section 14, Township 25,
Range 44, E.W.M.
4. The existing zoning of the property is Urban RES+dential-3.5 (UR-3.5) which was
established in 1991. The conditions ot approval specified be(ow require that development
of the lo'ts be consistent with the County Zoning Code. Sufficient ar2a exist on each tract
to accommoaate a single family dwelling. Pursuant to Section 58.17.195 of the Revised
Code ofi Washington (RCW), this propcsal together with the conditions specified befow
conforms to the requirements of the ex'ssting UR-3.5 Zone.
5. The Spokane County Comprehensive P1an designates this area as Urban. The
development and uses proposed for this short subdivision and conditions attached hereto
are in accordance with the Urban land use Category. The Urban category is intended to
provide the opportunity for development of a"citylike" environment with intensive
residen#ial development including single family, two-family, and multi-family dwellings.
The Urban category also promotes "fill-in" devElopment in areas with public services
available such as water, sewer, storm sewer, transit and fire protection. This proposal is
essentially a"fill-in" development. This proposed short subdivision will have public water,
sanitary sewers, police and fire protection and public transit service.
6. The short subdivision is located within the Interim Urban Groti,ith Area (IUGA) and is
consistent with the Spokane County Interim Urban Gro•Mh Area requirc-aments as set forth
in Spokane County Resolution 97-0321. This proposal is compatibie with the surrounding
uses, which are primarily single family residential.
7. The project site fronts on Evergreen and Valleyway. The Spokane County Arterial Road
Plan identifies Evergreen as a Principal Arterial Road (without controlled access) with a
planned right-of-way width of 100 feet. The existing right-of-way width is 100 feet.
Valleyway Road is a Collector Arterial with a right-of-way width of 50 feet and a planned
right-of-way width of 70 feet. As conditioned below the proposal conforms to the County
Road Plan. The County Engineer has examined this short subdivision proposal and has
determined that its traffic impact upon the existing County Road System warrants the
roadway improvements speci7ied in the conditions below.
8. The short subdivision site is Iccated within the Public Transportation Benefit Area (PTBA).
The Spokane Transit Authoriiy (STA) P,oute 90 (Spokane Valley-East Sprague Route)
provides services to thE generGl vicinity of the short subdivision site. .
9. The project site is located within Critical Water Supply Service Area No. 3. The proposed
Short Subdivision will be served by a public water system provided by Vera Irrigation
District # 15. The District is willing and able to provide wat2r for domestic service.
10. Waste water disposal will be provided by Spokane County sanitary sewers. Each dwelling
unit on each tract will be connected to sanitary sewers now available to the project site.
11. The required public notice and comment period was provided for consistent with the
SpQkane County Subdivision Code. In addition, those agencies having a potential interest
in the proposal and adjacent property awners wefe notified and comments solicited. No
comments were received from any adjacent landowners.
12. In consideration of performance conditions specified below and the application of Spokane
County development standards, the proposed Short Subdivision makes appropriate
provisions for the public health, safety and general welfare and that the public use and
interest will be served by short subdividing the subject parcel. The short subdivision
proposal is generally consistent with VVashington State Subdivision Statute RCW 58.17
and the Spokane County Subdivision Ordinance. The County Division of Planning has
considered the provision of adequate public facilities as cited in RCW 58.17.110(2). More
specifcally:
a. open spaces f. sanitary waste disposal
b. drainage ways g. parks and recreation facilities
c. public and/or private right-of-ways h. playgrounds
d. transit i_ schools and school grounds
e. potable water j. sidewalks
13. The short subdivision is exempt from the environmental review under the State
Environmental Policy Act pursuant to WAC 197-11-800 (o) (a).
14. This short subdivision lies over the Spokane-Rathdrum Aquifer and is in a designated
aquifer sensitive area (ASA). The County Guidelines for Stormwater Management reGuire
that impervious area within the ASA must drain to grassed percolation area (GPA) swales.
The applicant or tract owners may need to conform to these requirements when a building
permit is obtained.

' 15. Conditioc► 11 below in the County Engineer and Road Section of this document
requires reserving the front 10 feet of Tract A and B along Valieyway for future road
construction. it is necessary and appropriate in furtherance of the public heaith and
safety that the building front yard setback required in Section 14.616.325(A) of the
County Zoning Code be measured from the boundary of said road reserve area.
16. The existing single family home on Tract A is in noncompliance with the flanking yard
setback requirement specifiEd in Section 14.616.325(A) of the Zoning Code.
Improvements ofi the existing dwelling that cause it to furthEr encroach into the
required flanking yard setback shall nc# be pesmitted.
17. The County Engineer has examined th;s development proposal and has dztermined that
the impact of this proposal upon the existing County Road System warrants the dedication
of additional Right of Way and the roadway improvements herein specified.
18. This proposed short subdivision is loc2ted within a drainagp basin which has been
identified by the Spokane County Enaineer's and Utilities offices as having stormwaier
runoff problems. Since this proposed subdivision or development proposal is affected by
or is a contributor to stortnwater flows, propeRy owners should participate in the planning
and implementation of a future basinwide stormwater management system.
DECISION
Based upon the above noted Findings of Fact and Conclusions, Short Subdivision Application
SP-1251-00 is hereby GRANTED PRELIMfNARY APPRQVAL for five (5) years, specifically to
October 1, 2005, and is subject to the conditions speciried below. This decision is final unless
appealed in writing, consistent with appeal procedures set forth in County Subdivision
Ordinance, Szction 12.100.126.
CONDITIONS OF APPROVAL
All the below condi#ions imposed shall be binding on the "Applicant," which term sha(I include
the owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF PLANNING
1. The proposa) shall comply with the Urban Residential-3.5 (UR-3.5) Zone and aPl other
applicable County Zoning Code requirements and the Spokane County Subdivision
Ordinance, as amended.
2. The ftnal short subdivision shal) be designed substantially in conformance with the
approved preliminary short subdivision of record. No increase ofi density or number of
tracts shall occur without a change of cvndition application submjttal and approval.
3. The prefiminary short subdivision is giUen conditional approval for five (5) years,
specifically to October 1, 2005. The applicant may submit an extension of time applic2tion
no less than thirty (30) days prior to the above expiration date, or September 2, 2005.
Application(s) for extension of time sha11 be processed under the provisions ofi Chapter
12.100.118 (Extension of T'ime) of the Spokane County Subdivision Ordinance. If the
applicant complies with the criteria of Chapter 12.100.118, the preliminary short

subdivisian appraval and conditrons thereto will be changed to reflect the adopted policy
and devefopment regulations at the time of the ex#ension application. Submissian of a

5. Four (4) current certiicates of tit1e shall be furnished to the County Division cf Planning
prior to fling of the final short subdiuision.

7. Appropriate road names and street addresses shall be indicated on the fnal short plaLL
map.

14. The Spokane County Division of PIanning shall prepare and record with the Spokane
County Auditar a"Titie Notice" noting that the prcaperty in questian is subject tv a variety of
special conditians irnposed as a result of the land use actifln herein. This "TitCe Notice"
shall s2rve as offciaI public notice regaraing candEtions of approval affecting the property
in question. The "TitEe Notice" shall be recorded wi#hin frfteen (15) days of Finaf Shart Plat
approval and shair only be extinguisried by the 5pokane County pivision of Planning.
11. The Spakane Caunty Qivision of Current Planning shall prepare and record wi#h tne
County Auditar a Titxe Natice including the warding in items "a" thraugh "e" belorrv, This
notice may be extinguished in fual or in part, or1ly by the Divisian of Planning. The noiice
should be recorded within the same time frame as an appeal of the approval granted herein
and shall provide the falkowing:
a. At leas# twenty (10) feet of future acquisition area is reserved on Tracts A, and B
adjacent to and parallea to Valleyway Avenue for raad right-of-way and utilifies.
b. Future buiiding front yard setbacks required by the Spokane Zoning and
Develapmen# Codes shall be measured from the resenred future acquisition area as
depicted on the final short plat map.
c. Na required Iandscaping, parking, '208' dralnage areas, drainfiield or 2Ilowed signs
should be focated within the future acquisition area for raad right-of-way and
utilities. If any of the aboue improvernents are made within this area, fhey shall be
relocated at the applicant's or tract owner expense when rfladway impravements
are made.

d. The future acquisition area, until acquired, shall be private property and may be
used as allowed in the zone, except that any improvements (such as landscaping,
parking, surface drainage, drainfield, signs and others) shall be considered interim
uses.
e. The property owner shall be responsible for relocating such "interim" improvements
at the time Spokane Caunty makes roadway improvements after acquiring said
future acquisition area.
12. The building setback required in Section 14.616.325(A) and (B) of the County Zoning
Code shall be measured from the boundary of the road reserve area required in
condition 11 in the Engineering and Roads Section of this document.
13. The existing single family homE on Tract A is in noncompliance with the flanking yard
setback requirement specified in Section 14.61 6.325(A) of the Zoning Code.
Improvement of the existing dwelling that causes it to further encroach into the
required flanking yard setback is prohibited.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
1. Conditional approval of the short plat by the County EnginEzr is given subject to approval or
the road system as indicated in the preliminary plat of record.
2. A Professional Engineer, licensed in the State of Washington, shall submit fnal road and
drainage plans, a drainage report and caiculations that conform to all standards and laws
that are apolicabfe to this project if road improvements are required. Final drainage plans
and a drainage report shall receive the County Engineer's acceptance prior to release of a
construction vr building permit or approval of the final pfat. Following plan acceptance by
the Spokane County Engineer, drainage language will oe drafted by Spokane County and
provided ta thE Sponsor's Engineer or Surveyor for inclusion in the final plat document.
~ 3) This proposed short subdivision is located within a drainage basin which has been
identified by the Spokane County Engineer's and Utilities offic2s as having stormwater
runoff problems. Since this proposed subdivision or development proposal is affected by
or is a contributor to stormwater flows, property owners should participate in the planning
and implementation of a future basinwide stormwater management system. The fol(owing
statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to join in any County-approved
s#ormwater managEment program and to pay such rates and charges as may be fixed
through pubfic hearings for service or benefit obtained by the planning, design,
constructing, maintaining or operation of stormwater contro) faci(ities."
4. Aparoach Permits are required for any access to the Spokane County road system.
5. The applicant shall grant applicable border easements adjacent to Spokane County Right
of Way per Spokane County Standards.
6. To construct the road improvements stated herein, the applicant may, with the approval oi
the County Engineer, join in and bz a wil(ing participant in any petition or reso!ution which

purposes is the formation of a P.oad Improvement Distnct (R!D) for said improvements
pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road
Improvement Project is sanctianed by Spokane County, the improvements required (curb,
sidewalk, drainage control and paving to existing pavement) wili be at the sole expense of
the undersigned owner, their heirs, grantees and assigns. This provision is apRlicable to
Valleyway Avenue.
7. As an alternative method of constructing the road improvement stated herein, the applicant
may, with the approval of thz County EnginEer, accomplish the road improvements stated
herzin by jcining and participa'Ling in a County Road Project (CRP) to the extent of the
required road improvemEnt. A.t such time as an P.ID is created or any Raad Improvement
Project is sanctianed by Spokane County, the improverrrents required (curb, sidewalk,
drainage control and paving ta existing pavemznt) wi11 be at the sole expense of the
undzrssgned owner, their heirs, grantees and assians. This provision is applicable to
Valleyway Avenue.
8. The following statements shall be placed in the dedicatory language of the final plat:
That in consideration of Mutual Benefits now or to be hereafter derived, do for themszlves,
their heirs. grantpes, assigns and succzssor(s) in interest hereby request and authorize
Spokane County to include the above described property 'sn a Road Improvement District
(P,ID) and to support the formation of a Road ImprovEment District for improvement of the
road(s) described bzlow by requesting and authorizing Spokane County to place their
name(s) on a petition for the formation of a Road lmprovement District pursuant to RCW
36.88.050, or by requesting and authorizing Spokane County to cast their ballot in favor of
a RI D bEing formed under the resolution method pursuant to RCW 36.88.030, and/or by not
filing a protest against the formation of a RID being formed under the alternative resolution
method provided for in RCW 36.88.065 and Chapter 35.43 RCW,
li a RID is proposed for improvement of the road(s) described below, said owner(s) and
successor(s)further agree: (1) that the improvemEnts or construction contemplated wiihin
the proposed RID are feasible and (2) that the benEfits ta be derived from the formation of
the RID by 'the property included therein, together with the amount of any County
participaticn, exceeds the cost and expense of fomiation of the RlD, and (3) that the
property within the proposed RID is sufficiently developedi provided, themsefves, their
heirs, grantees, assigns and successor(s) shall retain the right, as authorized under RCW
36.88.090, to objcct to any assessment(s) on the property as a result of the improvements
called for in conjunction with the formaiion of a RID by either the petition or resolution
method under Chapter 36.88 P,CW and to appeal to the Superior Court the decision of the
Board of County Commissioners confirming the final assessment roll; provided further, ii is
recognizzd that actual assessments may vary from assessment estimate so long as they
do nat exczed a figurz equal to the incrEased true and fair value improvement(s) add(s) to
the property.
{t is further acknowledged and agreed that at such time as a R(D is created or any County
Road ImprovEmznt project is authorized by Spokane County, the improvements required
shall be at the sole expense of the owner(s) of property within the RID or sErvesl by the
improvements without any monetary participation by Spokane County. The RID waiver
contained in this agrEement shall expire after ten (10) years from the date of Execution
below. This p; ovision is applicable to Valleyway Avenue.

9. The County Engineer has designated a Collector Arterial Roadway Section for the
improvement of Valleyway Avenue which is adjacent to the proposed development. This
will require the addition of approx+mately 8.5-10.5 feet of asphalt along the frontage of the
development. The construction of curbing and sidewalk is also required.
10. The proposed short piat shail be improved to the standards set forth in Spokane County
Board of Commissioners Resolution No. 99-0265, as amended, which establishes
regulations for roads, approaches, drainage and fees in new construction.
11. The County Arterial Road Plan identifies Valleyway Avenue as a 70 foot Collector Arterial.
The existing right of way width of 50 feet is not consistent with that specified in the pian. In
order to implement the Arterial Road Plan a strip of property 10 feet in width along the
Valleyway Avenue frontage shall be set aside in reserve. This property may be acquired by
Spokane County at the time when arterial improvements are made to Valleyway Avenue.
12. The appiicant should be advised that there may exist utilities either underground or
overhead affecting the appiicants property, including property to be dedicated or set aside
future acquisition. Spokane County will assume no financial obligation for adjustments or
relocation regarding these utiiities. The applicant should check wifh the applicable utilities
and Spokane County Engineer to determine whether the applicant or utility is responsible for
adjustment or relocation costs and to make arrangements for any necessary work.
13. Any applicable stormwater management systems and roads for this short plat shall be
constructed and certified to be constructed in accordance with the accepted road and
drainage plans, or all the required improvements must be bonded for in accordance with
Spokane Gounty regulations, prior to the recording of the final short plat. Record drawings
and all construction documentation shall be submitted with the proper certification
statement.
SPOKANE COUNTY DIVISION OF UTILITIES
1. The dedication shall state: Public sewers shall be constructed to provide for the connection
of each parcel to the Coun#y's system of sewerage. Uses on properties within the project
shall be required to connect to the sewer and pay applicable charges per the County Sewer
Qrdinance. Sewer connection permits shall be required.
2. The dedication shall state: A pub(ic sewer system will be made availabie for the plat, and
indfvidua) services wiil be provided to each lot prior to sa1e. Use ofi individual on-site
disposal systems shall not be authorized.
3. Applicant shall submit expressly to Spokane County Division of Utilities "under separate
cover", only those plan sheets showing sewer plans and specifrcations for the public sewer
connections and facilities for review and approval. Commercial developments shall submit
historical and or estimated water usage as part of the sewer plan submittal.
4. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the issuance of
the sewer connection permit.

5. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
SPOKANE REGIONAL HEALTH DISTRICT
1. The final short plat shall be designed as indicated on the preliminary short plat of record
and/or any attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary sho►t plat of
record for distribution by the Planning DEpartment to the utility companies, Spokane County

the utility companies shall be rec2ived prior to the submittal of the final plat.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County.
4. Water service shall be coordinated through the Director of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the Regional
Engineer (Spokane), State Department or Health.
6. Prior to filing the final short plat, the sponsor shall demonstrate to the satisfaction of the
Spokane Regional Health District that an adequate and potable water supply is available to
each tract of the short plat.
7. Prior to filing the final short plat, the sponsor shall present evidence that the short plat lies
within the recorded service area of the water system proposed to senre the plat.
8. A public sewer system will be made available for the short plat and individual service will be
provided to each tract prior to safe. Use of individual on-site sewage disposal systems shall
not be authorized.
9. A statement shall be placed in the dedication to the effect that: "A public sewer system will
be made available for the short plat and individual service will be provided to each tract prior
to sale. Use of individual on-site sewage disposal systems shall not be authori2ed."
10. The dedicatory language on the short plat shall state: "Use of private wells and water
systems is prohibited."
11. The final plat dedication shall contain the following statement: "The public water system,
pursuant to the Water Plan approved by county and state health authorities, the local fire
protection district, County Building and Safety Department and water purveyor, shall be
installed within this subdivision and the applicant shall provide for individual domestic water
service as well as fire protection to each tract prior to sale of each tract and prior to issuance
of a building permit for each tract."

The Spokane County Engineering Department has reviewed the above referenced application. The
following "Conditions of Approval" are submitted to the Spokane County Planning Department for
inclusion in the "Findings of Fact, Conclusions and Order/Decision" should the request be approved.
1. Conditional approval of the plat by the County Engineer is given subject to approval of the road
system as indicated in the preliminary plat of record.
2. Drainage language will be drafted by Spokane County and provided to the Sponsor's Engineer
or Surveyor for inclusion in the final plat document.
3. This proposed subdivision or development proposal is located within a drainage basin which has
been identified by the Spokane County Engineer's and Utilities offices as having stormwater
runoff problems. Since this proposed subdivision or development proposal is affected by or is a
contributor to stormwater flows, property owners should participate in the planning and
implementation of a future basinwide stormwater management system.
4. Approach Permits are required for any access to the Spokane County road system.
5. The applicant shall grant applicable border easements adjacent to Spokane County Right of
Way per Spokane County Standards.
6. To construct the road improvements stated herein, the applicant may, with the approval of the
County Engineer, join in and be a willing participant in any petition or resolution which purposes
is the formation of a Road Improvement District (RID) for said improvements pursuant to RCW
36.88, as amended. At such time as an RID is created or any Road Improvement Project is
sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control
and paving to existing pavement) will be at the sole expense of the undersigned owner, their

7. As an altemative method of constructing the road improvement stated herein, the applicant
may, with the approval of the County Engineer, accompiish the road improvements stated
herein by joining and participating in a County Road Project (CRP) to the extent of the required
road improvement. At such time as an RID is created or any Road Improvement Project is
sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control
and paving to existing pavement) will be at the sole expense of the undersigned owner, their
heirs, grantees and assigns. This provision is applicable to Valleyway Avenue.
8. The following statements shall be placed in the dedicatory language of the final plat:
• "The owners or successors in interest agree to join in any County-approved stormwater
management program and to pay such rates and charges as may be fixed through public
hearings for service or benefit obtained by the planning, design, constn.icting, maintaining or
operation of stormwater control facilities."
• That in consideration of Mutual Benefits now or to be hereafter derived, do for themselves, their
heirs, grantees, assigns and successor(s) in interest hereby request and authorize Spokane
County to include the above described property in a Road Improvement District (RID) and to
support the formation of a Road Improvement District for improvement of the road(s) described
below by requesting and authorizing Spokane County to place their name(s) on a petition for the
formation of a Road Improvement District pursuant to RCW 36.88.050, or by requesting and
authorizing Spokane County to cast their ballot in favor of a RID being formed under the
resolution method pursuant to RCW 36.88.030, and/or by not filing a protest against the
formation of a RID being formed under the alternative resolution method provided for in RCW
36.88.065 and Chapter 35.43 RCW.
If a RID is proposed for improvement of the road(s) described below, said owner(s) and
successor(s)further agree: (1) that the improvements or construction contemplated within the '
proposed RID are feasible and (2) that the benefits to be derived from the formation of the RID
by the property included therein, together with the amount of any County participation, exceeds
the cost and expense of formation of the RID, and (3) that the property within the proposed RID
is sufficiently developed; provided, themselves, their heirs, grantees, assigns and successor(s)
shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on
the property as a result of the improvements called for in conjunction with the formation of a R1D
by either the petition or resolution method under Chapter 36.88 RCW and to appeal to the
Superior Court the decision of the Board of County Commissioners confirming the final
assessment roll; provided further, it is recognized that actual assessments may vary from
assessment estimate so long as they do not exceed a figure equal to the increased true and fair
value improvement(s) add(s) to the property.
!t is further acknowledged and agreed that at such time as a RID is created or any County Road
Improvement project is authorized by Spokane County, the improvements required shall be at
the sole expense of the owner(s) of property within the RID or served by the improvements
without any monetary participation by Spokane County.

The RID waiver contained in this agreement shall expire after ten (10) years from the date of
execution below. This provision is applicable to Valleyway Avenue.
9. The County Engineer has designated a Collector Arterial Roadway Section for the improvement
of Valleyway Avenue which is adjacent to the proposed development. This will require the
addition of approximately 8.5-10.5 feet of asphalt along the frontage of the development. The
construction of curbing and sidewalk is also required.
10. The proposed plat shall be improved to the standards set forth in Spokane County Board of
Commissioners Resolution No. 99-0265, as amended, which establishes regulations for roads,
approaches, drainage and fees in new construction.
11. The County Engineer has examined this development proposal and has determined that the
impact of this proposal upon the existing County Road System warrants the dedication of
additional Right of Way and the roadway improvements herein specified.
12. The County Arterial Road plan identifies Valleyway Avenue as a 70 foot Collector Arterial. The
existing right of way width of 50 feet is not consistent with that specified in The Plan. In order to
implement the Arterial Road Plan it is recommended that in addition to the required right of way
dedication, a strip of property 10 feet in width along the Valleyway Avenue frontage be set aside
in reserve. This property may be acquired by Spokane County at the time when Arterial
Improvements are made to Valleyway Avenue.
13. The applicant should be advised that there may exist utilities either underground or overhead
affecting the appficants property, including property to be dedicated or set aside future
acquisition. Spokane County will assume no financial obligation for adjustments or relocation
regarding these utilities. The applicant should check with the applicable utilities and Spokane
County Engineer to determine whether the applicant or utility is responsible for adjustment or
relocation costs and to make arrangements for any necessary work.

That the individuals and parties named herein as having an interest in the above described property or project agree
to the following:
1. Reimburse Spokaae County for project review and inspection fees as specified in Cuapter 9.14 of
the Spokane County Code. The fees will be based on actual salary costs incurred by Spoka»e
County for project reviews and ! or inspections plus a teil percent,admiciistrative cliarge, and will
be billed mondily as accrued. Any billing ainounts due, including any expenses iucurrecl in the
. cvllection of an ovecdue account, must be paid prior to die County's acceptance of the project fnr
f ling. If a project is approved andlor filed. witli a balance still owing, t12e unpaid balance sliall be
D paiel witliin 30 days of the invoice cAate. '
2. 'I`lle undersigned agcees that these fees are due and pAyable upon receipt of the billing as specified
above.
3. Any invoices not paid widlin 30 days of the invoice date will be considered delinquent. If any
outstanding balance oa tlie account for tUis projeet is not paid within 30 days of ttie invoice date,
no further reviews of the project dacuments wifl be conclucted until the entire account balance is
paid. Any balance on the account for this project not paid withiu GS days of tlie invoice dnte may
result in legal action oc tlie initiation of oUier collectiou procedures, InCludit7g CeferCal to a
collection agency. Tue Sponsor will be liable for any and all expenses iiicurred by the County for
the collectioa of overdue accounts.
