In order for the `?OS' lot plans to be accepted for construction they necd to be stamped by a licensed enginecr. The.re are still several small but iinportant items on the mylar that need to be corrected. All oi' the utility poles (either 3 or 4) that neeci to be rzlocated need to be noted and shown. Also, the east enci of sidewalk cannot terminate at the top of curb due to ADA accessibility. There are numerous ways to deal with this, but the simplest is probably to add a curb cut & a small rectarigular landing slab behind the curb cut. The mylAr revision may be done by band change without runnitig a ncw mylar, if you desire. Please remember that the sidewalk change will also alter tbe `a08' plan for L,ot E. We will update lhe surety inspectian spreadsheet accordingly unless we hear differently from you. Two projects, SA1251A and PE 1750I), will be marked incomplete and require additional actioa. SP 611-90 - Single Residence Na information pertaining lo tbis project was found in any City of Spakane Valley file locatians. It is unpossible to dp additional research without knowing wbere or when this construction took place Recommendation - Consider this projec:t closed. SP 1251A - UR 3.5 Siagle Res. Alteratioa This project is located on the north side of Valley Way immediaiely east of Fvergreen Road. The only information found in the files was a single 2002 consiruction plan sheet and several designs for 208 drainage swales. No bonding information, certification package, or recard drawings available. All work (ACP paving on Valley Way, sidewalk, curb & gutter, drywells, swales, etc.) appears to have been completed except for seeding the Tract E drainage swale. Coastruction of a commercial bui.lding and two homes has been completed and construction of the remaining residence is almost finished. This project was recently constructed so there should be more information available. Is the main portion of the file located somewhere that we (and Julie) have not been able tn find? Could the information be found under a different file name? Is it possible that Simpson Engineers has the missing infonnation? Was a walk-through conducted by John or Sandra? Shouldn't this project require a warranty bond? We will not be able to update the current status of this proaect and make a recommendation without more infonnation. PE 1414B - Riverwalk 3'd Addition The construction bond was released on 5/27/99 by Bill Hemmings, Spoka.ae County Developmeat Services Fngineer, after Spokane County acknowledged receiving a$2,123.00 warranty bond. This warranty bond was to be limited to one year expiring on 4/20/00. However the actual warranty bond, bond number, or name of the banding company was not found in the files. A field review noted that the major part of the project is naw designated private roads. No deficiencies were noted on Tndiana Avenue, the only public road within the project limiis. Recommendation - Consider this praject closed without further actian. The warranty bond can be released later in the event it did not automatically expire. 3/9/2006 Page 2 of 3 . r PE 1750D - Shelley Lakc 4u' Addition Bob Graham, STI Norihwest Inc, requested a bond ceduction an 8/28/03 but no action has been taken on that request. Washington Trust Bank verified the $71,500 construciion Letter of Credit is still valid. We could not find that certification package deficiencies noted by Kevin Severance oa 12/3/04 have been addressed. We reviewed the punch list developed by John Hohman and Ryan Spidahl, Metro Engineering, on 7/16104. The cwrent condition of deficient items is described belAw: l. Catch basin raised and apron replaced - not done 2. Cracks in curb &gutter - large cracks filled with rubberized adbesive and smaller cracks patched with epoxy. , 3. Ponds A& B not finished - Pond A irrigated and seeded. Pond B still has not heen final graded or the weeds removed. 4. Pond A has crack in inlet - Crack has been epnxy patched. Cracking noted in several aproas on Pond A but do not appear significant enough to replace aprons. 5. Pond C relocated but not noted on as-builts - Pond C has evidently been constructed opposite Pond D in the undeveloped area. Both ponds have only bcen rough-graded. It also appears the size of Pond C will be decreased if Shelley Lane is extended. John Hohman requested a new cirainage plan to be submitted but no record in f les that tbis has been done. The developer may be wa.iting before finishing the ponds since bousing construction is still ongoing adjacent to the unfinished ponds. Recommendation - This constructioa is all on private roads. Does the City of Spokane Va11ey have an interest in roadway constructian in addition to the 208 ponds and will a warranty bond be required? In any case the redesigned plan for Pond C shauld be submitted and the punch list items resolved before reducing or releasing the surety bond. Please let me know if there is more that we can do to speed up the process. The following files were not found either downstairs or across the street. We even had Julie check to make sure we didn't overlook them. PE 1339 - Alcott Grove Addition File not located. According to spreadsheet bond was issued in 1984 and released in 2001. Consider this fite closed since no otber inforniation available. PE 981- Sout6ern Mobilc Homc Park File not located. According to spreadsheet bond was issued in 1980 and released in 2000. Gonsider this file closed since no other information available. PE 1345 - Kirken Gut6rie/Carpenter File not located. Accarding to spreadsheet bond was issued in 1985 and released in 2001. Thus, the roadside swales can be in grassy strips adjaceat to the road, but within the County ROW (if you want them maintained by Spokane Couaty). I noticed two thin,gs that I thought I should bring to your attentioa: 1) The plan sheet shows a 40 ft width from back-of-curb to back-of-curb a.ad it should be 41 ft(37 ft paved width plus an additional 2 ft on each side to back of curb); and 2) the standard plan (A 1) for a typical road section includes a separated sidewalk. I realize that Evergreen's sidewalks may be directly adjacent to the road, and there would be a transition area, but that is the currerrt Road Standard requirement. Simpson Engineers FAX: 926-1323 Re: Road & Drainage Plan - Review Valleyway(SP-1251A ) 8c Silvey Commercial Chuck, I have completed my initial review of your submitted road improvement plans for Valleyway and the combined drainage pian for the roadway and contributing portion of the future commercial site. I do not want to review the on site portion of the comrnercial drainage plan, uatil there has been a building pernut application. General The construction plan to have the developer build the curb, swale, & sidewalk frontage improvements and have the ULID sewer project do the full width road paving based upon the new curb line is a good one and we thank Simpson Engineers for their coordinarion efforts. The short piat and IJLID improvement obligations versus those actually built by each should be more clearly identified on the section view. The right-of-way & border easement lirnits should also be shown on the section view. Please note that a 13.5' minimum border easement is needed on the final altered short plat for the planter strip width proposed. A 11.5' border was on the preliminary short plat. a208' lots plans will be needed for the short plat residential lots C-E but more as a formality, since the svvales should already be constructed along with the road improvements and aot at the tune of any future home construction. Drainaize Reoort The existing drainage report is satisfactory, except that minor adjustments will be needed to match the minor plan changes discussed below. The reference to 11flarble soils should be revised to the applicable Garrison type. 1026 W. However, the roadway swales along Valleyway receiving County road runof~ need to be shown and built off the road improvement plan and should be reference only on the commercial drainage plan. The proposed curb and road profile & cross-slopes are acceptable. The replacement pavement section vvill be prescribed and performed by the ULID sewer project. There are many labeling, note, and detail revisions that need to shovv up on the road mylar to allow plan acceptance. Please make the following minor changes on the mylar when submitted: • Relocate the curb inlet at STA 0+85 that is right next to corner slab to the end of the swale around STA 1+00, unless the present location is at a sag poini. •Expand the easterly most little swale in a convenieat manner to the available length, in order to accommodate any future needs from the up-road basin to the east. The proposal is to divide appraximately 1.69 acres into three (3) lots for single family residences through an alteration to a final short plat, SP-1251A-00, as provided for in Section 12.300.102 of the Spokane County Subdivision Ordiaance. 3. The subject property is generally located at the northeast corner of the intersection of Evergreen Road and Valleyway Avenue, ia the SW of Section 14, Township 25 North, Range 44 EWM, Spokane County, Washington. 4. The existing zoning of the properly described in this application is Urban Residentiai-22 (UR-22), established in 2002 (ZE-23-01), and Urban Residential-3.5 (UR 3.5), established in 1991, and was unaffected by the adoption of the Phase I Development Regulations by the Board of County Commissioners on January 15, 2002, Resolution #2-0037. The proposed lots are located within the existing Urban Residential-3.5 (UR 3.5) zone. Pursuant to Section 58.17.195 of the Revised Code of Washington (RCVV), this proposal conforms to the requirements of the existing Urban Residential-3.5 (UR-3.5) zone. 5. The purpose of the proposed alteration is to further divide Tract "B" of SP-1251-00 into thcee (3) lots, Tracts "C", "D" and "E"each approximately 25,000 square feet in size, for proposed single family residences. 6. The Spokane County Compreheasive Plan designates this area as Low Density Resideatial. The deveiopment and uses, as conditioned, are in consistent wit6 the Low Density Resideotial category. The proposal is also compatible with the surrounding uses that consist primarily of single family residences on similarty sized lots. 7. The subject property is located adjacent to and accessed by Valleyway. The Spokane County Arterial Road Plan identifies Valleyway Avenue as a Collector Arterial. The Spokane County Division of Engineering and Roads has not requested additional right-of-way dedication or Future Acquisition Area (FAA) along Valleyway Avenoe. Therefore, as conditioned, the proposal conforms to the Road Plan. 8. The proposed site is located withi.n the Public Transit Benefit Atea (PTBA). 9. The proposed short plat shall be served by a public water system. Waste-water disposal will be as authorized by the Director of the Spokane County Division of Utilities. 10. The required public notice and comment period was provided for this proposal. In addition, those agencies having a potential interest in the proposal were notified and comments solicited. No written comments were received from any adjoining property owner regarding this proposal. 11. The subject property is locat6d within the Urban Growth Area (UGA) adopted by the Board of County Commissioners (BOCC). , T 12. Recognizing the recommended conditions and Spokane County development standards, the proposed short plat makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by platting the subdivision. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations, promoting the public health, safety and general welfare in accordance with standards established by the State and Spokane County. The County Division of Planning has coasidered the provision of adequate public facilities as cited in RCW 58.17.110(2). More specifically: a. open spaces f. sanitary waste disposal b. drainage ways g. parks and recreation facilities c. public and/or private right-of-ways h. playgrounds d. transit i. schools and school gounds e. potable water j. sidewalks 13. Pursuant to the Washington Administrative Code (WAC) 197-11-800(6)(a), this proposed short plat is exempt from the State Environmental Policy Act (SEPA) environmental review. DECISION Based upon the above-noted Findings of Fact and Conclusions, Short Plat Applicaiion SP-1215A-00 is hereby APPROVED for five (S) years, specifically to June 18, 2007, and subject to conditions noted below. This decision is final unless appealed in writing consistent with adopted appeal procedures. CONDTITONS OF APPROVAL AU the below conditions imposed shall be binding on the "Applicant," which term shaU include the owner or owners of the property, heirs, assigns and successors. SPOKANE COUNTY DMSION OF PI,ANNING 1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone, Urban Residential-22 (UR-22) and all other applicable Spokane County Zoning Code chapiers, as amended and conditions of ZE-23-01. 2. The final short plat shall be designed substantially in conformance with the preliminary short plat of record. No increase of density or number of tracts shall occur without a change of cooditions application submittal and approval. 3. The preliminary short plat is given conditionat approval for five (5) years, specifically to June 18, 2007. The applicant may submit an extensioa of time application no later than thirty (30) days prior to the above expiration date. Application(s) for extension of time shall be processed under t6e provisions of Chapter 12.100.118 (Extension of Time) of the Spokane County Subdivision Ordinance. If the applicant complies with the criteria of Chapter 12.100.118, the preliminary approval aad conditions will be changed to reflect the adopted policy and development regulations at the time of the extension apptication. 4. Prior to recording the final short plat, the applicant shall submit to the County Division of Planning Director/designee for review any proposed final short plat to ensure compliance with these Findings and Conditions of Approval. 5. A survey is required of the subject property prior to recording the final short plat. 6. Appropriate road name(s) and street addresses for each tract shall be indicated on the final short plat map. Findings and Decision SP-1251 A-00 2 ~ . ' 7. Appropriate utility easements shall be indicated on the final short plat map. Approval of utility easements by utitity companies must be received prior to recording the final short plat. 8. Tha final short plat map shall indicate by a dashed line the required setbacks from all private or public roads. 9. The final short plat dedication shall contain the following statement: "Side yard and rear yard setbacks shall be determined at the time building grmits are requested unless these setbacks are specifcalty drafted on this short plat. The setbacindicated on this plat may be varied from if proper zoning or variance approvals are obtained. 10. Prior to recording the final short plat~ the applicant shall provide four (4) carrent Certificates of Title to the Division of Planning. SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS The Following conditions are appUcable to Tract "A" of SP-1251-00, now to be known as Tract "A" of SP-1251A-00; 1. Applicant shall comply with conditions of approval for ZE 0023-O1. 2. Conditional approval of the plat by the County Engineer is given subject to approval of the road system as indicated in the preliminary plat of record. 3. A Professional Engineer, licensed in the State of Washington, shall submit final road and drainage plans, a drainage report and calculations that conform to the 2001 Edition of the Spokane County Standards for Road and Sewer Construction, the current edition of the Spokane County Guidelines for Stormwater Management, and all other applicable standards. The plans and report shall receive the County Engineers acceptance prior to release of a construction or building permit or approval of the final plat. 4. Approach Permits are required for any access to the Spokane County road system. 5. Construction within all proposed public/private roads shall be performed uader che direct svpervision of a licensed engineer/surveyor, who shall furnish the County Engineer wiih "Record Drawings" and certification which states the foliowing, "1 have reviewed the construction and to my knowledge find it to be in substantial confonnance with approved certified plans and Standard Specifications except as noted." 6. No construction work is to be performed within the existing or proposed public right-of-way until plans bave been accepted by the County Engineer and a permit has been issued by the County Engineer. All work is subject to inspection and approvai by the County Engineer. 7. All construction within the existing or proposed public right-of-way is to be completed prior to filing the final plat or a bond in the amount estimated by the County Engineer to cover the cost of constructioa of unprovements, Construction certification, "Record Drawings" and monumentation of the street centerlines shall be filed with the County Engineer. 8. 7'be applicant shall grant applicable border easements adjaccnt to Spokane County Right of Way per Spokane County Standards. 9. The County Engineer has designated a Collector Arterial Roadway Section for the improvement of Valleyway Avenue which is adjacent to the proposed development. This will require the addition of approximately 8.5- I 0.5 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is aLso required. Findings and Decision SP-1251 A-00 3 ♦ . ~ 10. The proposed plat shall be improved to the standards set forth in Spokane County Board of ' Commissioners Resolution No. 1-0298, as amended, which establishes regulatioas for roads, approaches, drainage and fees in new construction. 11. The County Engineer has examined tbis devetopment proposal and has determined that the impact of this proposal upon the existing County Road System warrants the roadway improvements herein specified. 12. 'The applicant is advised that there may exist utilities either underground or overhead effecting the applicant's property, including properiy to be dedicated or set aside future acquisition. Spokane County will assume no financial obligation for adjustruents or relocation regardiag these utilities." "The applicant should contact the applicable utilities regarding responsibility for adjusunent or relocation costs and to make arraagements for any necessary work" 13. My part of the drainage systern that lies outside of the public right-of-way will neither be maintained nor operated by Spokane County forces. Prior to plan acceptaace by the County Engi.neer, the Sponsor shall provide a mechanism, acceptable to the County Engineer, for the perpetual maintenance of the stormwater draiaage system. This mechanism shall also provide for the funding of routine maintenance and the replacement of the various componeats of the drainage system at the end of the service life of the respective components, and any other improvements that may be legalty required in tbe future. An Operations and Maintenance Manual for the stormwater management system shall be prepared by the Sponsor's Engineer, and included in the project documents submitted to the County Engineer for acceptance, along with a discussion of the design life of the various components, a calculated annual cost for repair and maintenaace, and a calculated replacement cost. Homeowners Associations are accepted by the Spokane County Engineer for carrying out the required maintenance functions end responsibilities. 14. Erosioa Control: A Temporary Erosion and Sedimentation Control (TESC) plan shall be prepared by a WA State licensed Professional Engineer and implemented throughout the duration of construction. The TESC plan is to be prepared using best ma.nagement practices (BMP's) curreotly accepted within the Civil Engineering profession. The TESC plan is to include, at a minimum, a grading plan, Iocation and details of silt control structures, and street cleaning program. Runoff from exposed areas shall be filtered prior to discharging into a detention pond, swale, iafiltration facility, or aatural drainageway. The TESC plan is to be included in the road aad drainage plans. The applicant's Engineer is to submit the TESC plan and supporting catculations to Spokane County prior to site disturbance. The TESC major structures (such as silt ponds, silt traps) are to be installed prior to other site work and the TESC measures are to be implemented and maintained throughout the duration of construcrion, including house construction. 15. The Spokane County Engineer has reviewed this project for transportation concurrency and determined that it is exempt under the Phase I- Development Regulations - Section IV (B) (2c). The FoUowing Coadidons are applicable to t6e UR-3.5 parcel originally known as parcel "B" of SP-1251-00, now to be known as Tracts KC", "D", and lqg" of SP-1251A-00; 16. Conditioaal approval of the plat by the County Engineer is given subject to approval of tbe road system as indicated in the preliminary plat of record. 17. Approach Permits are required for any access to the Spokane County road system. 18. The applicant shall grant applicable border easements adjacent to Spokane County Right of Way per Spokane County Standards. Findings and Decision SP-12S 1 A-00 4 ~ • ' 19. To constcvct the road improvements stated herein, the applicant may, witli the approval of the County Engineer, join in and be a willing participant in any petition or cesolution which purposes is the formation of a Road Improvement District (RID) for said improvements pwsuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (cutb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, gcantees and assigns. This provision is applicable to Valleyway Avenue. 20. As an altemative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvement. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to exishng pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and assigns. This provision is applicable to Valleyway Avenue. 21. The following statements shall be placed in the dedicatory Ianguage of the final plat: • The property owners within this plat shall be held responsible for keeping open and maintaining the surface path of natwal or man-made drainage flow over and across their respective properties. If the property owner(s) fails to maintain the surface path of natural or man-made drainage flow, or t6e drainage swale, a notice of such failure may be given to the properiy ovmer(s). If not corrected within the period indicated on said notice, Spokaae County has the right to correct the maintenance failure, or have it corrected, at the expense of the property owmer. • There may exist properties, located uphill and adjacent to this subdivision, which periodically discharge stormwater runoff onto individual lots within this plat. Runoff from nearby uphill properties should be expected, atid during snowRtelt periods or wet seasons the lots may be subjected to higher amounts of stormwater runoff that what is normally observed or anticipated. Because stormwater runoff from adjacent properties have discharged onto this plat prior to development, stormwater runoff will likely continue to do so after development. It is the responsibility of the individual tot owners to maintain existing surface paths of runoff through their respective lots and to grade the Iots in accordance with applicable rules and regulations, so as to prevent property damage. • Any buildiag that is construc(ed Qn a lot in this plat shall be set at such an elevation so as to provide positive dra.inage away from any drainage entry point to the building (including but not limited to a window well, a window unprotected by a window well, or a doorway). Said positive drainage shall consist of a minimum slope of 3% away from the building for a distance of at least 10 feet from the building. The lots shall be graded so that either a) all runoff is routed away from the building, and conveyed over the lot to a natural drainage swale or approved drainage facility, or b) drainage intercepted on the lot is disposed of on the lot in an approved drainage facility. The approved drainage facility shall be constructed in accordance with any applicable accepted plans on file at the County Engineers Office. Any revisions to the accepted drainage plans must be accepted by the County Engineer's Office prior to construction of said revisions. • Spokane Courrty does not accept the responsibility of maintaining the drainage course on private lots or floodplain areas within private lots, nor the responsibility for any damage whatsoever, including, but not timited to, inverse caodemnation to any properties due to deficient construction and/or maintenannce of drainage courses in drainage easements on private property. • The owner(s) or successor(s) in interest agree to join in any County-approved stormwater management program and to pay such rates and charges as may be fixed through public hearings for service or benefit obtained by the planning, design, constructing, maintaining or operation of stormwater control facilities. Findings and Decision SP-1251A-00 5 • This short plat is located within the Aquifer Sensitive Area (ASA). Treabnent of storm runoff from driveways shall be provided. The preferred method of treatment is to have the runoff from driveways sheet flow over lawn turf or native-type grasses. If a ditch is to be used to collect ruooff from driveways, then the ditch is to be gress-lined. • That in consideretion of Mutual Benefits now or to be hereafter derived, do for themselves, their heirs, grantees, assigns and successor(s) in interest hereby request and authorize Spokane County to include the above described property in a Road Improvement District (RID) and to support the formation of a Road Improvement District for improvement of the road(s) described below by requesting and audiorizing Spokane County to place their name(s) on a petition for the formation of a Road Improvement Distnct pursuant to RCW 36.88.050, or by requesting and authoriziag Spokane County to cast their ballot in favor of a RID being formed under the resolution method pursuant to RCW 36.88.030, and/or by not filing a protest against the fonnation of a RID being formed under the alternative resolution metbod provided for in RCW 36.88.065 and Chapter 35.43 RCW. As per the Spokane County Zoning Code Phase One Development Regulatioas the dedicatioa shall state: Public sewers shall be constructed to provide for the connection of each parcel to the County's system of sewerage. Uses on properties within the project shall be required to connect to the sewer and pay applicable charges per the County Sewer Ordinance. Sewer connection permits shall be required. 2. As per the Spokane County Zoning Code Phase Ooe Development Regulations the dedication shall state: A public sewer system will be made available for the plat, and individual services will be provided to each lot prior to sale. Use of individual on-site disposel systems shall not be authorized. 3. Applicant shaU submit expressly to Spokane County Division of Utilities "under separate cover", only those plan sheets showing sewer plans and specifications for the public sewer connecdons and facilities for ceview and approval. Commercial developments shall submit historical and or estimated water usage as part of the sewer plan submittai. 4. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the fiQalization of the project. 5. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. SPOKANE REGIONAL HEALTH DISTRICT l. The final plat shall be designed as iadicated on the preliminary short plat of record and/or any attached sheets as noted. 2. Appropriate utility easements shal] be indicated on copies of the prelimioary plat of record for distribution by the Planning Division to the utility companies, Spokane Couaty Engineer, and the Spokane Regional Health District. Written approval of the easements by the utility compaaies shall be received prior to the submittal of the final plat. 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 4. Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional Eogineer (Spokane), State Department of Health. 6. Prior to filiag the final plat, the sponsoc shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. 7. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane Regional Health District that an adequsite and potable water supply is available to each tract of the plat. 8. A public sewer system will be made available for the plat and individual service will be provided to each tract prior to sale. Use of individual on-site sewage disposal systems shall not be authorized. 9. Spokane County does not accept the responsibility to inspect or maintain drainage facilifies located outside of public rights-of-way, except in cases where Spokane County specifically assumes that responsibility in writing, which may be defined herein through the adoptioa of a Special Stormwater Management Service Area, or in other documents. Prior to plan acceptance by the County Engineer, the Sponsor shall provide a mechanism, acceptable to the County Engineer, for the perpetual maintenance of the stormwater drainage system. This mechanism shall also provide for the funding of routine maintenance and the replacement of the various components of the drainage system at the end of the service life of the respective components, and any other improvements that may be legally required in the future. An Operations and Maintenance Manual for the stormwater management system shall be prepared by the Sponsor's Engineer, and included in the project documents submitted to the County Engineer for acceptance, along with a discussion of the design life of the various components, a calculated annual cost for repair and maintenance, and a calculated replacement cost. Homeowners Associations are accepted by the Spokane County Engineer for carrying out the required maintenance functions and responsibilities. 14. Erosion Control: A Temporary Erosion and Sedimentation Control (TESC) plan shall be prepared by a WA State licensed Professional Engineer and implemented throughout the duration of construction. The TESC plan is to be prepared using best management practices (BMP's) currently accepted within the Civil Engineering profession. The TESC plan is to include, at a minimum, a grading plan, location and details of silt control structures, and street cleaning program. Runoff from exposed areas shall be filtered prior to discharging into a detention pond, swale, infiltration facility, or natural drainageway. The TESC plan is to be included in the road and drainage plans. The applicant's Engineer is to submit the TESC plan and supporting calculations to Spokane County prior to site disturbance. The TESC major stn,ictures (such as silt ponds, silt traps) are to be installed prior to other site work and the TESC measures are to be implemented and maintained throughout the duration of construction, including house construction. 15. The Spokane County Engineer has reviewed this project for transportation concurrency and determined that it is exempt under the Phase I- Devetopment Regulations - Section IV (6) (2c). The Following Conditions are applicable to the UR-3.5 parcel originally known as parcel "B" of SP-1251-00, now to be known as Tracts "C", "D", and "E" of SP-1251A-00; 16. At such time as an RID is created or any Road lmprovement Projec# is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and assigns. As an alternative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvement. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and assigns. This provision is applicable to Valleyway Avenue. 21. The following statements shall be placed in the dedicatory language of the final plat: • The property owners within this plat shall be held responsible for keeping open and maintaining the surface path of natural or man-made drainage flow over and across their respective properties. If the property owner(s) fails to maintain the surface path of natural or man-made drainage flow, or the drainage swale, a notice of such failure may be given to the property owner(s). If not coRected within the period indicated on said notice, Spokane County has the right to correct the maintenance failure, or have it corrected, at the expense of the property owner. • There may exist properties, located uphill and adjacent to this subdivision, which periodically discharge stormwater runoff onto individual lots within this plat. Runoff from nearby uphill properties should be expected, and du(ng snowmelt periods or wet seasons the lots may be subjected to higher amounts of stormwater runoff that what is normally observed or anticipated. Because stormwater runoff from adjacent properties have discharged onto this plat prior to development, stormwater runoff will likely continue to do so after development. It is the responsibility of the individual lot owners to maintain existing surface paths of runoff through their respective lots and to grade the lots in accordance with applicable rules and regulations, so as to prevent property damage. • Any building that is constructed on a lot in this plat shall be set at such an elevation so as to provide positive drainage away from any drainage entry point to the building (including but not limited to a window well, a window unprotected by a window well, or a doorway). Said positive drainage shall consist of a minimum slope of 3% away from the building for a distance of at least 10 feet from the building. The lots shall be graded so that either a) all runoff is routed away from the building, and conveyed over the lot to a natural drainage swale or approved drainage facility, or b) drainage intercepted on the lot is disposed of on the lot in an approved drainage facility. The approved drainage facility shall be constructed in accordance with any applicable accepted plans on file at the County Engineer's Office. Any revisions to the accepted drainage plans must be accepted by the County Engineers Office prior to construction of said revisions. Page 5 Engineezs Q5l31/2002 12tIA • Spokane County does not accept the responsibility of maintaining the drainage course on private lots or floodplain areas within private lots, nor the responsibility for any damage whatsoever, including, but not limited to, inverse condemnation to any properties due to deficient construction and/or maintenance of drainage courses in drainage easements on private property. • The owner(s) or successor(s) in interest agree to join in any County-approved stormwater management program and to pay such rates and charges as may be fixed through public hearings for service or benefit obtained by the planning, design, constructing, maintaining or operation of stormwater control facilities. • This short plat is located within the Aquifer Sensitive Area (ASA). Treatment of storm runoff from driveways shall be provided. The preferred method of treatment is to have the runoff from driveways sheet flow over lawn turf or native-type grasses. If any outstanding balance on the account for this project is not paid within 30 days of the invoice date, no further reviews of the project documents will be conducted until the entire account balaace is paid. Any balance on the account for this project not paid within 65 days of the invoice date may result in legal acdon or the initiation of other collecdon procedures, including refenal to a collection agency.
