BEFORE
THE SPOKANE COUNTY DIVISION OF PLANNING
IN THE MATTER OF SHORT ) FINDINGS OF FACT,
SUBDIVISION; SP-1255-00 ) CONCLUSIONS AND
DECISION
THIS MATTER, an application for short subdivision from WAM Enterprises, Inc, has been
received and was decided upon, pursuant to Spokane County Subdivision regulations, on the
22nd Day of December, 2000.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been properly delegated the responsibility for rendering
the decision by the Director of Spokane County Division of Planning.
2. The proposal inciudes a Preliminary Short Subdivision to divide a 35,790 square foot tract
into 2 lots, each intended for business use.
3. The proposal is located adjaoent to and east of Argonne Road in the Southwest 1/4 of ~
Section 17, Township 25 North, Range 44 E.W.M. The project sfte is adjacent to and west
of Mu11an Road. The subject project site is Assessoes tax parcel number 45173.0537.
4. The existing zoning of the property is Regional Business (B-3) which was established in
1991. The conditions of approvat specified below require that development of the lots be
consistent with the County Zoning Code. Pursuant to Section 58.17.195 of the Revised
Code of Washington (RC111), this proposal together with the conditions specified below
conforms to the nequirements of the existing B-3 Zone.
5. The Spokane County Comprehensive Plan designates this area as Major Commercial.
The development and uses proposed for this short subdivision and conditions attached
hereto are in accordance with the Major Commercial land use Category. The Major
Commercial category is intended to provide the opportunity for development of commercial
uses, specifically community and regional shopping centers and commercial uses, directly
related to major throughways. The Major Commercial category will be composed of three
different types of commercial development: shopping centers, highway and arterial
commercial strips, and freeway commercial. Highway and arterial commercial strip areas
will usually be made up of businesses on individual parcels clustered along a heavily
traveled street or highway. The project site fronts on two heavily traveled roads, Argonne
and Mullan Roads. Most commercial development will occur on generally flat land and
paricing areas, streets and buildings wi11 dominate the site. Landscaping, screening,
signage and architectural treatments will help to create sites that are aesthetically
pleasing.
6. The short subdivision is located within the Interim Urban Growth Area (IUGA) and is
consistent with the Spokane County Interim Urban Growth Area requirements as set forth
in Spokane County Resolution 97-0321.
7. The short subdivision site is located within the Public Transportation Benefit Area (PTBA).
The Spokane Transft Authority (STA) Route 95 (Argonne-Dishman-Mica Route) provides
transit servioes in the general vicinity of the short subdivision site. .

it is the responsibility of the individual lot owners to maintain existing surface paths of runoff
through their respective lots and to grade the lots in accordance with applica►ble rules and
regulations, so as to prevent property damage.
16. The County Arterial Road Plan designates Argonne and Mullan Roads as Principal
Arterials requiring 100 feet of right-of-way. Current right of way width for both roads is 50
feet. Since both roads are one-way roads, together they constitute a single principal
arterial. The County Division of Roads and Transportation right of way requirement is met.

Surrounding land use is a mix of service businesses and business offices.
DECISION
Based upon the above Findings of Fact and Conclusions, Short Subdivision Application SP-
1255-00 is hereby GRANTED PRELIMINARY APPROVAL for five (5) years, specifically to
December 22, 2005, and is subject to the conditions specified below. This decision is final
unless appeafed in writing, consistent with appeal procedures set forth in County Subdivision
Ordinance, Section 12.100.126.
CONDITIONS OF APPROVAL '
All the below conditions imposed shall be binding on the "Applicant,° which term shall include
the owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF PLANNING
1. The proposal shall comply with the Regional Commercial (13-3) Zone requirements and all
other applicable County Zoning Code requirements.
2. The proposal shall comply with the Spokane County Subdivision Ordinance, as amended.
3. The final short subdivision shall be designed substantially in conformance with the
approved preliminary short subdivision of record. No increase of density or number of lots
shall occur without a change of condition application submittal and approval.
4. The preliminary short subdivision is given condifional approval for five (5) years,
specifically to December 22, 2005. The applicant may submit an extension of time
application no less than thirty (30) days prior to the above expiration date, or November
22, 2005. Application(s) for extension of time shall be processed under the provisions of
Chapter 12.100.116 (Extension of Time) of the Spokane County Subdivision Ordinance. If
the applicant complies wdh the criteria of Chapter 12.100.118, the preliminary short
subdivision approval and conditions thereto will be changed to reflect the adopted poticy
and development regulations at the time of the extension application. Submission of a
time ex#ension request following said date will not be accepted and will render the
preliminary ptat null and void on December 22, 2005.
5. Prior to filing of the final short subdivision, the applicant shall submit to the County Division
of Planning DirectoNdesignee for review the proposed final short plat to ensure
compliance with these condftions of approval.

surface paths of runoff through their respective lots and to grade the lots in accordance
wi#h applicable n,iles and regulations, so as to prevent property damage.
Any building that is constructed on a lot in this short piat shall be set at such an elevation
so as to provide positive drainage away from any drainage entry point to the building
(including but not limited to a window well, a window unprotected by a window well, or a
doorway). Said positive drainage shall consist of a minimum slope of 3% away from the
building for a distance of at least 10 feet from the building. The lots shall be graded so
that either a) all runoff is routed away from the building, and conveyed over the lot to a
natural drainage swale or approved drainage facility, or b) drainage intercepted on the
lot is disposed of on the lot in an approved drainage facility. The approved drainage
facility shall be constructed in accordance with any applicable accepted plans on file at
the County Engineers Office. Any revisions to the accepted drainage plans must be
accepted by the County Engineer's Office prior to construction of said revisions.
Spokane County does not accept the responsibility of maintaining the drainage course on
private lots or floodplain areas within private lots, nor the responsibility for any damage
whatsoever, including, but not limited to, inverse condemnation to any properdes due to
deficient construction and/or maintenance of drainage courses in drainage easements on
private properiy. '
The owner(s) or successor(s) in interest agree to join in any County-approved stormwater
management program and to pay such rates and charges as may be fixed through
public hearings for service or benefit obtained by the planning, design, constructing,
maintaining or operation of stormwater control facilities.°
5. The proposed short plat shall be improved to the standards set forth in Spokane County
Board of Commissioners Resolution No. 99-0265, as amended, which establishes
regulations for roads, approaches, drainage and fees in new constnaction.
6. The applicant should be advised that there may exist utitities either underground or overthead
affecting the applicant's property, inciuding property to be dedicated or set aside for future
acquisition. Spokane County will assume no financial obligation for adjustments or
relocation regarding these utilities. The applicant should check with the applicable utilities
and Spokane County Engineer to deterrnine whether the applicant or utility is responsible for
adjustment or relocation costs and to make arrangements for any necessary work.
SPOKANE COUNTY DIVISION OF UTILITIES
1. The Guidelines for Stormwater Management require that all impenrious area within the ASA
drain to bio-infiltration swales for water quality treatment provided the soi{s are acceptable
for infiltration.
2. All swales, drywells, and drainage easements shall be identified on the short plat prior to
final approval.
3. Post-development stormwater runoff may not be discharged to public roads, public right-of-
way, or surrounding properties.

applicant shall provide for individual domestic water service as well as fire protection to
each tract prior to sale of each tract and prior to issuance of a building permit for each

8. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane
Regional Health District that an adequate and potable water supply is available to each
tract of the plat.
DIVISION OF BUILDING AND CODE ENFORCEMENT
1. The applicant shall contact the Division of Building and Code Enforcement at the earliest
possible stage of design/development to be informed of code nequirements
administered/enforced by the department; e.g., State Building Code Act regulations
such as requirements for constn,iction type, occupancy classification, fire
hydrantfflow, fire apparatus access roads, accessibility, energy code regulations,
and general coordination with other aspects of project implementation.
2. Prior to the issuance of the initial building permit(s), the applicant shall submit to the Division
of Building and Code Enforcement documentation signed by the water purveyor and the
applicable fire district stating that the public water system has been installed, tested and '
accepted as operational pursuant to the approved water plan.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All development occurring on the short subdivision site shall be consistent with all air quality
requirements of the Spokane County Air Pollution Control Authority.

The Spokane County Engineering Department has reviewed the above referenced application. The
following "Conditions of Approval" are submitted to the Spokane County Planning Department for

1. Conditional approval of the plat by the County Engineer is given subject to approval of the road
system as indicated in the preliminary plat of record.
2. This proposed subdivision or development proposal is located within a drainage basin which has
been identified by the Spokane County Engineers and Utilities offices as having stormwater
runoff problems. Since this proposed subdivision or development proposal is affected by or is a
contributor to stormwater flows, property owners should participate in the planning and
implementation of a future basinwide stormwater management system.
3. Approach Permits are required for any access to the Spokane County road system.
4. The applicant shall grant applicable border easements adjacent to Spokane County Right of
Way per Spokane County Standards.
5. The following statements shall be placed in the dedicatory language of the final plat:
• The property owners within this plat shall be held responsible for keeping open and
maintaining the surface path of natural or man-made drainage flow over and across their

discharge stormwater runoff onto individual lots within this plat. Runoff from nearby uphill
properties should be expected, and during snowmelt periods or wet seasons the lots may be
subjected to higher amounts of stormwater runoff that what is normally obsenred or anticipated.
Because stormwater runoff from adjacent properties have discharged onto this plat prior to
development, stormwater runoff will likely continue to do so after development. It is the
