DECISION
TffiS MATTER, an application for short subdivision from Joseph Christopher Terriff has been received
and was decided upon, pursuant to Spokane County Subdivision regulations, on the 19th day of
December, 2000.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the respoosibility for rendering
the decision by the Director of Spokane County Division of Planning.
2. The proposal is to divide approximately .83 acres into two (2) tracis for an existing residence and a
proposed residence, in ihe existing Urban Residential-3.5 (UR-3.5) zone.

3. The proposal is generally located south of and adjacent to 18th Avenue and west of and adjacent to
Adams Road, in the NW % of Section 26, Township 25 N., Range 44 EWM, Spokane County,
VVashington. The subject property is identified as Tax Assessors Parcel #45262.9059.
4. The existing zoniag of t6e property described in the application is Urban Residential-3.5 (UR 3.5),
which was established in 1991. Pursuant to Section 58.17.195 of the Revised Code of Washington
(RCW), this proposal conforms to the requirements of the existing Urban Residential-3.5 (UR-3.5)
zone.
5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses, as proposed and conditioned are consistent with the Urban category. This proposal is also
compatible with the surrounding uses which are primarily residential uses on similarly or larger
sized lots.
6. The subject property is located adjacent to both Adams Road and 18th Avenue. The Spokane
County Arterial Road Plan identifies Adams Road as a Minor Arterial aad 18tih Avenue as a Local
Access Road. In order to implement the plan, the Spokane County Engineer is requesting that a
strip of property 8 feet in width be set aside as a Future Acquisition Area (FAA) for future
roadway improvements. As conditioned, the proposal conforms to the road plan.
7. The subject property is loceted withia the Interim Urban Growth Area (IUGA) adopted by the
Board of County Commissioners (BOCC) Resolution #97-0321.
8. The proposed site is located inside the Public Transportation Benefit Area (PTBA). The nearest
public transit service is located along Adams Road.
9. The proposed short plat will be served by both a public water and public sewer system.
10. The required public notice and comment period was provided for this proposal. In addition, those
agencies having a potential iaterest in the proposal were notified and comments solicited.
Comments were received &om a neighboring property owaer expressing concern over the
proposed lot sizes in reletion to existing lots in the direct vicinity of the site. Although the smallest
proposed lot size of 13,200 square feet is smaller thaa some existing lots ia the area, it exceeds the
minunum lot size allowed in the existing Urban Residential-3.5 (UR-3.5) zone.
11. Recognizing the recommended conditions and Spokane County developmeat standards, the
proposed short plat makes appropriate provisions for the public health, safety and general welfare
and that the public use and interest will be served by platting ihe subdivision. The subdivision

proposal is gencrally consistent with RGW 58.17 and the Caunty subdivision reguiations,
pronYOting the public health, safety and general welfare in accardance with standards establtsheci

SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
1. Conditional approval of the Plat by the Counry Engineer is given subject to dedication of right-of-
way and approval of the road system as indicated in the preliminary plat of record.
2. This proposed subdivision or development proposal is located within a drainage basin which has
been identified by the Spokane County Engineer's and Utilities offices as having stormwater
runoff problems. Since this proposed subdivision or development proposai is a.ffected by or is a
contributor to stormwater Flows, property ovmers should participate in the planning aad
implementation of a future basinwide stormwater management system.
3. No construction work is be perf'ormed within the existing or proposed Public right-of-way until
such plans have been accepted and a pecmit has been issued by the County Engineer authorizing
such work. All work is subject to inspection and approval by the County Engineer.
4. Approach permits are required for any access to the Spokane County road system.

interest agcee to join in any County-approved stormwater management program and to pay such

The property owners within this plat shall be held responsible for keeping open and maintainiag
the surface path of natural or man-made drainage flow over and across their respective properties.
If the property owner(s) fails to maintain the surface path of natural or man-made drainage flow, or
the drainage swale, a notice of such failure may be given to the property ovmer(s). If not corrected
within the period indicated on said notice, Spokane County has the rigbt to correct the maintenance

There may exist properties located uphill and adjacent to this subdivisioo which periodically
discharge stormwater runoff onto individual lots within this plaL Runoff from nearby uphiU
properties should be expected, and duriag saowmelt periods or wet seasons the lots may be
subjected to higher amounts of stormwater runoffthan what is normally observed or anticipated.
Because stortnwater from adjacent properties have discharged onto this plat prior to development,
stormwater runoffwill tikely continae to do so after development. It is the responsibility of the
iadividual lot owners to maintain existing surface paths or rwioffthrough their respective lots and
to grade the lots in accordance with appticable rules and regulations, so as to prevent property
damage.
Any building that is constructed on a lot in t6is plat shall be set at such an elevation so as to
provide posrtive drainage away &om any drainage point to tlie building (including but not limited
to a window well, a window unprotected by a wi.adow well, or a doorway). Said positive drainage
shall consist of a minimum slope of 3% away from the buiidiog for a distence of at Ieast 10 feet
from the building. The lots shall be graded so that either a) all runoff is routed away from the
building, and conveyed over the lot to a natural drainage swale or approved dra.inage facility, or b)
drainege intercepted on the lot is disposed of on the lot in an approved drainage facility. The
approved drainage facility shall be constructed in accordance with any applicable accepted plans
on file at the County Engweer's Off'ice. Any revisions to the accepted drainage plans must be
accepted by the County Engioeer's Office prior to coastruction of said revisions.

lots or floodplain areas within private lots, nor the responsibility for any damage whatsoever,

6. The applicant shall grant applicable border easements adjacent to Spokane Counry Right of Way
per Spokane County Standards.
7. To construct the road improvements stated herein, the applicant may, with the approval of the

The RID waiver contained in this agreement shall expire after ten (10) years from the date of
execution below. This provision is applicable to Adams Road.
10. The County Engineer has designaied a Minor Arterial Roadway Section for the improvement of
Adams Road which is adjacent to the proposed development. This will require the additian of
approximately 5-7 feet of asphalt along the frontage of the development. The construction of
curbing and sidewalk is also required.
11. The proposed plat shall be improved to the standards set forth in Spokane County Board of
Commissioners Resolution No. 99-0265, as amended, which establishes regulations for roads,
approaches, drainage and fees in new construction.
12. The County Engineer has examined this development proposal and has deterniined that the impact
of this proposal upon the existing County Road System warrants the dedication of additional Right
of Way and the roadway improvements herein specified.
13. The County Arterial Road Plan identifies Adams Road as an 80 foot Minor Arterial. The existing
right of way width of 32 feet, measured from centerline, is not consistent with that specified in the
plan. Ia order to unplement the Arterial Road Plan it is recommended that a strip of property 8 feet
in width along the Adams Road frontage be set aside in reserve. This properly may be acquired by
Spokane County at the time when Arterial Improvements are inade to Adams Road.
14. The applicant should be advised that there may exist utilities either undergound or overhead
affecting the applicants property, including property to be dedicated or set aside future acquisition. r
Spokane County will assume no financial obligation for adjustrnents or relocation regarding these
utilities. The applicant should check with the applicable utilities and Spokane County Engineer to
determine whether the applicant or utility is responsible for adjustment or relocation costs and to
make arrangements for any necessary work.
15. Slope easements as necessary for the construction or reconshvction af Adams Road are hereby
granted to Spokane County.
SPOKA.NE COUNTY DIVISION OF UTILITIES
1. The dedication shatl state: Public sewers shalt be constructed to provide for the connection of
each parcel to the County's system of sewerape. Uses on properties within the project shall be
required to connect to the sewer and pay applicable charges per the County Sewer Ordinance.
Sewer connection permits shall be required.
2. The dedicarion shail state: A public sewer system will be made availabte for t6e plat, and
individual services will be provided to each lot prior to sale. Use of icwdividual on-site disposal
systems shall not be authorized.
3. Applicant shall submit expressly to Spokane County Division of Utilities "under separate cover",
only those plan sheets showing sewer plans and specifications for the public sewer connections
and facilities for review and approval. Commercial developments shall submit tustorical and or
estimated water usage as part of the sewer plan submittal.
4. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the finalization of the
project.
5. Any water service for this project shall be provided in accordance with the Coordinated Waier
System Plan for Spokaae County, as amended.

1. Sewage disposal method shall be as authorized by the Director of the Spokane County Division af
Utilities.
2. Water service shall be coordinated through the Spokane County Division of Utilities.
3. Water service shall be by an existing public water supply when approved by the Regional Engineer
(Spokane), State Department of Health.
4. Prior to recording the final short plat, the applicant sliall demonstrate to the satisfaction of the
Spokane Regional Health District that an adequate and potable water supply is available to each
tract of the plat.
5. Prior to recording the final short plat, the applicant shall present evidence that the plat lies wiihin

property owner(s). If not corrected within the period indicated on said notice, Spokane County
has the right to correct the maintenance failure, or have it corrected, at the expense of the
property owner.
• There may exist properties located uphill and adjacent to this subdivision which periodically
discharge stormwater runoff onto individual lots within this plat. Runoff from nearby uphill
properties should be expected, and during snowmelt periods or wet seasons the lots may be
subjected to higher amounts of stormwater runoff that what is normally observed or anticipated.
Because stormwater runoff from adjacent properties have discharged onto this plat prior to
development, stormwater runoff will likely continue to do so after development. It is the
responsibility of the individual lot owners to maintain existing surface paths of runoff through their
respective lots and to grade the lots in accordance with applicable rules and regulations, so as to
prevent property damage.
• Any building that is constructed on a lot in this plat shall be set at such an elevation so as to
provide positive drainage away from any drainage entry point to the building (including but not
limited to a window well, a window unprotected by a window well, or a doorway). Said positive
drainage shall consist of a minimum slope of 3% away from the building for a distance of at
least 10 feet from the building. The lots shall be graded so that either a) all runoff is routed
away from the building, and conveyed over the lot to a natural drainage swale or approved
drainage facility, or b) drainage intercepted on the lot is disposed of on the lot in an approved
drainage facility. The approved drainage facility shall be constructed in accordance with any
applicable accepted plans on file at the County Engineer's Office. Any revisions to the
