SP-1261-00 ) CONCLUSIONS AND APPLICANT: CHRIS SWANSON ) DECISION THIS MATTER, an application for short subdivision of land from Chris Swanson has been received and was decided upon, pursuant to Spokane County Subdivision regulations, on the 16Ih day of February, 2001. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Director of Spokane County Division of Planning. 2. The proposal is to divide approximately 5.98 acres into two (2) tracts for those uses permitted in the Urban Residential-3.5 (UR-3.5) zone. 3. The proposal is generally located at the terminus of Sundown Drive in the W'/z of the NW of the SW %d of Section 33, Township 25 North, Range 44 E.W.M., Spokane County, Washington. Parcel No. 45333.9170. 4. The existing zoning of the property is Urban Residential-3.5 (UR-3.5), which was established in 1991. Pursuant to the Revised Code of Washington (RCV1J) 58.17.195, this proposal conforms to the requirements of the existing Urban Residential-3.5 (UR-3.5) zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses, as proposed and conditioned, are in compliance with the Urban category. 6. Surrounding uses are primarily single family residential and currently zoned Urban Residential-3.5 (UR-3.5). Lot sizes range between 15,000 square feet to 9 acres. 7. The Spokane County Arterial Road Plan identifies Evergreen Road as a County Local Access with a future right-of-way width of 60 feet. The existing right-of-way width of 60 feet is not consistent with that specified in The Plan. In order to implement the Arterial Road Plan it is recommended that dedication of right-of-way necessary to complete the radius of a standard cul-de-sac at the end of Sundown Drive be provided by the applicant. Therefore, as conditioned the proposal conforms to the Artedal Road Plan. 8. The proposed site is located within the Public Transportation Benefit Area (PTBA). 9. The proposed short plat will be senred by Spokane County Water District No. 3. Wastewater disposaf witl be as authorized by the Director of Spokane County Division of Utilities and/or Spokane Regional Health District. 10. The required public notice was provided for this proposal and agencies having a potential interest in the project were notified and recommendations solicited. 11. No written comments were received from any adjoining property owners. 12. Recognizing the recommended conditions and Spokane County development standards, the proposed short plat makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by platting the subdivision. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations, promoting the public health, safety and general welfare in accordance with standards established by the State and Spokane County. The County Division of Planning has considered the provision of adequate public facilities as cited in RCW 58.17.110 (2). More specifically: a. open spaces f. sanitary waste disposal b. drainage ways g. parks and recreation facilities c. public and/or private right-of-ways h. playgrounds d. transit i. schools and school grounds e. potable water j. sidewalks 13. The subject site is located outside the 15 year sewer service area; although, Spokane County Utilities has indicated in a memo dated November 29, 2000 that the property is now included in the West Ponderosa Sewer Project. The Comprehensive Wastewater Management Plan is currently being updated to reflect the inclusion of this property. 14. The Spokane County Critical Areas Maps and Wetland Inventory Maps illustrate the location of a seasonal marsh on the subject property. The Washington State Department of Ecology was notified of the proposal on December 5, 2000. Chris Merker with Washington State Department of Ecology submitted verification of the wetland in a letter dated December 7, 2000, along with recommended Conditions of Approval. 15. A portion of the subject property lies within a flood zone, Zone A6, as identified on FIRM Community Panel No. 530174 0382 C, revised September 30. 1992. 16. Spokane County Critical Areas maps identify a wetland on site associated with Chester Creek. As required by Section 11.20.050 of the Spokane County Critical Areas Ordinance, a wetland report and delineation was submitted by the applicant, for review and acceptance by the Washington State Department of Ecology and the Spokane County Division of Planning. The wetland located on the site is identified in the wetland report as a Category 2 wetland. The individual wetland and required 150 foot wetland buffer area shall be illustrated on the final short plat map. 17. An Environmental Checklist was submitted by the applicant and was reviewed by the Spokane County Division of Planning. The review considered the specifics of the proposal, other available information, County ordinances, other regulations and laws, possible standard conditions of approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The County Division of Planning has determined that "no probable significant adverse impacts" would result from the proposal being developed and issued a Determination of Non-Significance (DNS) on January 10, 2001. The DNS was circulated for review and comments to various agencies of jurisdiction affected by the proposal. The DNS was advertised in the newspaper to the public 15 calendar days before the comment period ended on February 6, 2001. DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP-1261-00 is hereby APPROVED for five (5) years, specifcally to February 16, 2006 and subject to conditions noted below. This decision is final unless appealed in writing consistent with adopted appeal procedures. CONDITIONS OF APPROVAL All the below conditions imposed shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns and successors. SPOKANE COUNTY DIVISION OF PLANNING 1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone and other applicable Zoning Code chapters, as amended. 2. The final short plat shall be designed substantially in conformance with the preliminary plat of record. No increase of density or number of tracts shall occur without a change of condition or subdivision application submittal and approval. Findings and Decision SP-1261-00 2 . 3. The preliminary short plat is given conditional approval for five (5) years, specifically to February 16, 2006. The applicant may submit an extension of time application at least thirty (30) days prior to the above expiration date, but no later than January 16, 2006. Application(s) for extension of time shall be processed under the provisions of Chapter 12.100.118 (Extension of Time) of the Spokane County Subdivision Ordinance, as amended. 4. Prior to filing the final short plat, the applicant shall submit to the County Division of Planning Director/designee for review any proposed final short plats to ensure compliance with these Findings and Conditions of Approval. 5. A survey is required of the subject property prior to filing the final short plat. 6. Appropriate road names and street addresses shall be indicated on the final short plat map. 7. Appropriate utllity easements shall be indicated on the final short plat map. Approval of utility easements by utitity companies must be received prior to filing the final short plat. 8. The dedication shall contain the following statement: "Setbacks shall be determined at the time building permits are requested unless these setbacks are specifically drafted on this final short plat. The setbacks indicated on this subdivision may be varied from if proper zoning or variance approvals are obtained." 9. Four (4) current Certificates of Title shall be furnished to the County Division of Planning prior to filing the final short plat. 10. The final plat shall illustrate the 100-year flood plain on the face of the plat. 11. The final plat shall comply with the Spokane County Critical Areas Ordinance, as amended. 12. The final plat shall illustrate the location of the wetland identified within the wetland report, identify the assigned category, and delineate the required 150 foot wetland buffer. SPOKANE C4UNTY DIVISION OF BUILDING AND CODE ENFORCEMENT 1. The applicant should contact the Division of 6uilding and Code Enforcement at the earliest possible stage in order to be informed of code requirements administeredlenforced as authorized by the State 6uilding Code Act. Design/development concerns include addressing, fire apparatus access roads, fire hydrant flow, approved water systems, building accessibility, construction type, occupancy classification, existing exterior wall protection and energy code requirements. SPOKANE COUNTY DIVISION OF ENGINEERING ANO ROADS 1. Conditional approval of the p{at by the County Engineer is given subject to dedication of right- of-way and approval of the road system as indicated in the preliminary plat of record. 2. A Professional Engineer, licensed in the State of Washington, shall submit final road and drainage plans, a drainage report and calculations that conform to the 1999 Spokane County Standards for Road and Sewer constn.iction, the cument edition of the Guidelines for Stormwater Management and all standards and laws that are applicable to this project if road and/or drainage improvements are required. Any final road and drainage plans and a drainage report shall receive the County Engineer's acceptance prior to release of a constnuction or building permit or approval of the final plat. 3. Drainage language will be drafted by Spokane County and provided to the Sponsor's Engineer or Surveyor for inclusion in the final plat document following plan acceptance by the Spokane County Engineer. 4. Any applicable stormwater management systems and roads for this plat shall be constructed and certified to be constructed in accordance with the accepted road and drainage plans, or all the required improvements must be bonded for in accordance with Spokane County regulations, prior to the recording of the final plat. Record drawings and all construction documentation shall be submitted with the proper certification statement. F'indings and Decision SP-1261-00 3 . 5. Before the street and stormwater pians are submitted to Spokane County for•review and acceptance, a Design Deviation must be submitted to Spokane County for any non-standard elements of the project plans. The sponsor shall acquire approval of the Design Deviation from the County Engineer before constructian pians are submitted for review. The Design Deviation request must include adequate engineering justification and drainage calculations, and should include any other agency approvals that may be necessary for the proposed deviation to work as designed. The Design Deviation request shall include a description of maintenance responsibilities. The applicant shall make provision for the perpeiual maintenance of any drainage facilities located outside of the public right-of-way. The Spokane County Engineer may deny a Design Deviation or he may impose conditions of approval on the Design Deviation. 6. This proposed subdivision or development proposal is located within a drainage basin which has been identified by the Spokane County Engineer's and Utilfties offices as having stormwater runoff problems. Since this proposed subdivision or development proposal is affected by or is a contributor to stormwater flows, property owners should participate in the planning and implementation of a future basinwide stormwater management system. 7. That the regulations of the Nationa! Flood Insurance Program shall be observed since the proposed plat is affected by a Flood Hazard Zone. A development permit shall be obtained from the County Engineer before construction or development begins within any area of special flood haiard (reference Spokane County Ordinance 88-0521). This condition is applicable to driveway approaches, driveways and private roads constructed on the site for access. 8. Construction within all proposed public/private roads shall be performed under the direct supervision of a licensed engineer/surveyor, who shall furnish the County Engineer with . "Record Drawings" and certification which states the following, "I have reviewed the construction and to my knowledge find it to be in substantial conformance with approved certified plans and Standard Specifications except as noted." 9. No construction work is to be performed within the existing or proposed public right-of-way until plans have been accepted by the County Engineer and a pennit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 10. All construction within the existing or proposed public right-of-way is to be completed prior to filing the final plat or a bond in the amount estimated by the County Engineer to cover the cost of construction of improvements. Construction certification, "Record Drawings" and monumentation of the street centerlines shall be filed with the County Engineer. 11. Appropriate provision be made that the following described property be held in trust until the continuation of the streets be dedicated or deeded: A 1 foot strip at the ends or edges of all streets that terminate or border the plat boundary. Temporary cul-de-sacs are required when streets terminate at the plat boundaries. The applicant shall apply for access over the existing 1 foot strips which exist on Sundown Drive for a two lot driveway easement from Spokane County. 12. Approach Permits are required for any access to the Spokane County road system. 13. Dedication of the right-of-way necessary to complete the radius of a standard cul-de-sac at the end of Sundown Drive is required. 14. The applicant shall grant applicable border easements adjacent to Spokane County Right of Way per Spokane County Standards. Findings and Decision SP-1261-00 4 . . 15. The following statements shall be placed in the dedicatory language of the final plat: "The owners or successors in interest agree to join in any County-approved stormwater management program and to pay such rates and charges as may be fixed through public hearings for service or benefit obtained by the planning, design, constructing, maintaining or operation of stormwater control facilities. Development within this subdivision shall conform to the requirements of the National Flood Insurance Program and Chapter 3.20 of the Spokane County Code. Purchasers of the property within this subdivision are warned of possible flooding or ponding and the potential requirement to purchase flood insurance.
