installing, operating and rtaaintaining drainage swales and drainage facilities, as conditivns
of plat approval, are hereby granted to the public.
2. Spokane Counry and its auti~~rized agents are hereby granted the right of ingress and
egress to, aver, and from said easements for the purpase o#' inspection and emergency
mainrenance af water quatity treatment srvales ("208 swales") and other drainage
faciIities, if not pragerly anaintained by the prvperry owner. 5pvkane Cvunry does not
accept the respansibility ta irspect or maintain the drainage easements or drain,age
swales, nor does the County accept any IiabiIity for any failure by the lvt owner(s) to
praperly maintain such arem.

Mission Aveaue and Maxwell Avenue.
E21 As an alternative method ❑f constructing the road improvement stated
hexein, the applicant may, with the apprflval af the Caunty Engineer,
accomplish the road improvements stated herein by joining and
participating in a Gounty Road Pr❑ject (CRP) to the extent af the
required raad imprvvement. At such time as an RID is created or any
Road Impravement Project is sanctioned by 5pokane County, the
imprvvements required (curb, sidewalk, drainage cantrvl and paVing to
existing pavement) will he at the sale expense af the undersigned awnere
their heirs, grantees and assigns. This provision is appli.cahle to
Mission Avenue aad Maxwell Avenue.
E22 That trie frallawing statement shall appear within the dedicatory language
of the final plat:
The owner(s) or successor(s) in interest agree to authvrize Spvkane
County to place their name(s) vn a petition fvr the formation af a
Road Impravement Distriet (RIp) by the petition methad pursuant to
Chapter 36.88 RGW, which petitian 311CZUdeS the awner ( s ) property, LLand
further not to obj ect, by the signing of a ballot, the formatian af
a RID by the resolutivn method pursuant to chapter 36.88 RCW, which

of any Caunty partiaipatican, exceeds the cost and expense of formatian
of the RID, and (3) that the progerty within the progosed RID is
sufficbently develvped. FY`ovidedr further, the owner(s) or
successvr(s) sha1l retain the riqht, as authorized under RCW
36.88.090, ta abject ta any assessment(s) an the praperty as a result
of the improvements called far in c❑njunction with the fQrmation of
a RID by either petitian or resolution method under Chapter 36.88 RCW,
and to appeal to the Superivr Court the deci,sinn ❑f the Bvard of
County Cvmmissianers affirminq the final assessment rall. It is
further agreed that at such time as an RTa is created ar any Road
Ymprovement project is sanctioned by Spokane County, the impravements
required (GUrb, sidewalk, drainage control and paving) will be at the
svle exgense of the undersigned awner, their heirs, grantees and
assigns withvut participation by Spakane County.
The RID waiver contained in this agreement shall exgire after ten
(10) years from the date of executivn belflw. Hawever, the owner(s)
or successor(s) agree that if said RID waiver expires without
a❑nstructian of the required improvements, the owner(s) ar
successor(s) agree to construct the required impravements at their own
expense; pay to Spokane Caunty the then estimated cast of the required
impravements t❑ enable the County tv Gvmplete the same; or furnish a
band or ather secure method suitahle ta the County (which may include
the executian of anather RID waiVer agreement) , providing far or
securing to the Caunty the actual construction of the imgrovements.
All of the requirements of this agreement shall run with the land and
stnall be binding upvn the owner(s), their successor{s} or assign(s).
This pravision is applicahle t❑ Missian Avenue and Maxwai3 Avenue.
E24 The Caunty Engineer has designated Typieal Rvadway 5ectian Nuznber Two.
Xinor Arterial Standard far the imprflvement of Mission Avenue which is
adjacent to the prvpvsed development. This wili require the additian of
approximately 4-6 feet ❑f asphalt along the frontage of the development.
Th~ construction of curbing aad sidewalk is also required.
E24 The County Engineer has designated Typical Roadway Section Number Twa.
Loaai Acaess Standard for the improvement of Maxwell Avenue which is
adj acent to the prQposed development. This wi 11 require the additifln of
approximately 8-10 feet of asphalt along the frontage of the
develvpment. The canstructican of cuxhinq is alsa required.
E32 The propDSed plat sYrall be impraved to the standards set forth in
Spvkane Cvunty Baard of Commissianers Resaluti.can No. 80-1592, as
amended, which establishes regulations for raads, approaches, drainage
and fees in new canstruction.
E33 The County Engineer has Examined this development proposal and has
determined that the impact of this pxoposal upan the existing County
RQad System warrants the dedicatiQn ❑f additional Right of Way and the
rvarlway impravements herein specified.
E51 The County Arteriai Road plan identifies Missfan Avenue as a Minor
Arterial. The existing right of way width of 60 feet is not cvnsastent
with that speaified in The Plan. In order ta implement the Arterial
Rvad Plan it is recommended that in addition to the required right of
way dedicatifln, a strip ❑f property 8 feet in width along the Mission
Avesue frontage be set aside in reserve. This praperty may be acquired
by Spvlkane Caunty at the time when Arterial Imprauernents are made to
Mission Avenue.
E90 The applicant should be advised that there may exist utilities either
underground ❑r averhead affecting the applicants prpperty, including

raad and intends ta run a fenca along the property line separating the
twv parcels. The final plat shall indicate where the paVement }areak is
located sa that the cantinuous driveway is nvt construed to be a private
road. Ey lacating the pavement break vn the final plat, the cantinuous
driveway shall become tw❑ separate and distinct driVeways and is not
required to conform with Spakane County Private Rvad Standards.
