The land affected by this Covcnant is described as follows: Tracts C& D of SPOKANE COLJNTY SHORT PLAT 1267-01 and being a portion of the Northwest Quarter of Tract 34 of Opportunity, Caunty of Spokane, State af Washington. (1) Maintenance Decisions: Following tlie initial completion of the consrrucaon of the easement road, the awners of Tracts C& D shall be obligated to share equally in the costs of niaintenance and repair of tlie roadway. All dccisions with respect to maintenancc, rcpair or improvement af the easement road shall be made by the owners of the lots responsible thercfore, ancl such dccisions shall rcquirc the affirntarive vote of the awners nf both lots. (2) En#orcement oF Maintenance: In the event that one of the parties believes that maintenance is needc:d to dic cascment road, but is unable to obtain the affirm.ative consent from the other owner, then the decision as to whether road maintenance is required shall be suhmitted to binding arbitration, pursuant to statutory law of the State of Washington. Each of the parties shall agrce to a single arbitrator. If thcy cannot agree to a single arbitrator, each slzall select an arbitrator, anci the twn selectrd arbierators shall seiect a third arbitrator, and the decision of the majority of the arbitrators shall bc final and binding upon th@se parties. (3) Maintenance Liens: The obligation of each owner to pay his or her pro-rata share of the maintenance cnsts of the easement roaa shall bc a charge and a continuing lien upon the parcel owned by such owner, and each such assessment shall also be the personal obligation of the person who was the owner of such parcel at the time the asscssment or charge fell due. All assessments or charges shall bear interest at the highest lcgal ratc thcn in effect following the date that such assessment or charges beeame payablc. Said interest, as wcll as costs and reasunablc attomey fees, if suit he necessary ta collect such an assessment, shall be an additional charge upon the parcel. The foregoing lien shaU be subordinate and inferior to the lien of any real estate contract, mortgage or deed of trust financing the purchase or the costs of construction of improvements on any parcel. No salr or transfer of any parcel shall c:ffcct any licn hcrcunder, wluch has alrcady attached, or which relates to an ' assessment which has already become due, nor shall any sale or transfer relieve such parcel from liability for any assessment thereafter beconung due or from the lien thereof. . . : ~ ~ V~ • ~ .N 1 y(4) Obstricctions: Neither of the owners of Tract C or D, nor any subsequent owner ~ shall place any gate or other obstruction on or across any portion of the road easement providcd fon ccrcin without the unanimous consent of ali owners. (5) Enforcement of Lien: In the event that any costs nf maintenance as provided herein shall remain unpaid for a period of six (6) months or longer, then the party advancing said costs of maintenance may bring action against the other party and his ' parcel and foreclose the lien in the same manner as a mortgage against real property. . ~ . BEFORE THE SPOKANE COUNTY DIVISION OF PLANNING IN THE MATTER OF SHORT ) FINOINGS OF FACT, SUBDIVISION; SP-1267-01 ) CONCLUSIONS AND DECISION THIS MATTER, an application for preliminary short subdivision approval from Elmer B. Niehenke has been received and was decided upon, pursuant to Spokane County Subdivision regulations, on the 8th day of March, 2001. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has been properly delegated the responsibility for rendering the decision by the Director of Spokane County Division of Planning. 2. The application proposes to subdivide 1.5 acres of property into four (4) lots, for those uses permitted in the existing Urban Residential-3.5 (UR-3.5) Zone. 3. The proposed short subdivision is located about 300 feet south of the intersection of Wilbur Road and Maxwell Road, fronting on the east side of Wilbur Road in the NE % of Section 16, Township 25 North, Range 44 EWM, Spokane County, WA., Assessors Tax Parcel no. 45161.0638. 4. The existing ioning of the property is Urban Residential-3.5 (UR-3.5) which was established in 1991 consistent with the Program to Implement the new Spokane County Zoning Code. The conditions of approval specified below require that development of the lots be limfted to one single family residence per lot due to the operation of the density requirements of the County Zoning Code. Pursuant to Section 58.17.195 of the Revised Code of Washington (RCV1/), this proposal, together with the conditions of preliminary approval specified herein, confiorms to the requirements of the existing zone except the minimum lot frontage requirement. Lot D does not conform to the minimum lot frontage requirement of 80 feet specified in Section 14.616.315 of the Spokane County Zoning Code. 5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses proposed for this short subdivision and conditions attached thereto are in accordance with the Urban land use category. The Urban category is intended to provide the opportunity for development of a"citylike" environment with intensive residential development including single family, two-family, and mutti-family dwellings. The Urban category also promotes "fill-inu development in areas with public services available such as water, sewer, storm sewer, transit and fire protection. This proposed short subdivision will essentially be a"fill-in" development since the surrounding area is trending to urban density single family dwellings. The short subdivision will be served by public water, public sewers, police, fire protection, solid waste collection and pubfic transit sen►ices. 6. The short subdivision is located in the Interim Urban Growth Area (IUGA) established by Spokane County Resolution 97-0321. The proposal is consistent with the requirements in said Resolution 97-0321. 7. The subdivision site is served by Sinto Avenue and Wilbur Road. Lot A will • have direct access to Wilbur Road and Lot B wili have direct access to Sinto Avenue. The proposed driveway road easement within the short subdivision will provide access to Lots B, C and D. The Spokane County Arterial Road Pian identifies Sinto Avenue and Wilbur Road as Local Access Roads. Improvement of Sinto Avenue to County Road Standards is necessary to safely accommodate the automobile traffic generated by this short subdivision and platted lots north of and acfjacent to Sinto Avenue. The private driveway providing access to Lots B, C and D needs to be improved to County private driveway standards necessary to safely accommodate the automobile traffic generated by said lots. 8. The subject property is located within the Public Transportation Benefit Area (PTBA). The Spokane Transit Authority (STA) Route numbers 73 and 95 provide transit service in the vicinity of the short subdivision. 9_ The subject property is served by a water system owned Modern Electric Water Company. The Company is willing and able to provide adequate water to meet the potable and fire flow needs of the short subdivision. 10. On-site sewage treatment systems will serve the wastewater disposal needs of the proposal as authorized by the Spokane Regional Health District and the Spokane County Division of Utilities. 11. The required public notice of the proposed short subdivision and comment period was provided consistent with the Spokane County Subdivision Ordinance. In addition, comment was requested from those agencies having a potential interest in the proposal. 12. In consideration of the application of perfonnance conditions specified below and the application of Spokane County development standards, the proposed short subdivision makes appropriate provisions for the public health, safety and generat welfare and that the public use and interest will be served by short subdividing the subject parcel. The proposal is generally consistent with Washington State Subdivision Statute RCW 58.17 and the Spokane County Subdivision Ordinance. The proposal is exempt from the environmental review requirements under the State Environmental Policy Act pursuant to WAC 197-11-800(6)(a). 14. This proposed short subdivision is located within a drainage basin which has been identified by the Spokane County Engineer's and Utilities offices as having stormwater runoff problems. Since this proposed subdivision is affected by or is a contributor to stormwater flows, property owners should participate in the planning and imp(ementation of a future basinwide stormwater management system. The following statements shall be placed in the dedicatory language of the final plat: "The owners or successors in interest agree to join in any County-approved stormwater management program and to pay such rates and charges as may be fixed through public hearings for senrice or benefit obtained by the planning, design, construciing, maintaining or operation of stormwater control facilities." The property owners within this plat shall be held responsible for keeping open and maintaining the surface path of natural or man-made drainage flow over and across their respective properties. If the property owner(s) fails to maintain the surface path of naturai or man-made drainage flow, or the drainage swale, a notice of such failure may be given to the property owner(s). If not coRected within the period indicated on said notice, Spokane County has the right to coRect the maintenance failure, or have it corrected, at the expense of the property owner. There may exist properties located uphill and adjacent to this subdivision which periodically discharge stonnwater runoff onto individual lots within this plat. Runoff from nearby uphill properties should be expected, and during snowmelt periods or wet seasons the lots may be subjected to higher amounts of stormwater n.inoff that what is normally observed or anticipated. Because stormwater runoff from adjacent properties have discharged onto this plat prior to devetopment, stormwater runoff will likely continue to do so after development. It is the responsibility of the individual lot owners to maintain existing surface paths of runoff through their respective lots and to grade the lots in accordance w(ith applicable nales and regulations, so as to prevent property damage. No concept drainage plan is required and i find no critical soils on this site in reviewing the SCS Soils Survey. I recommend the following conditions of approval: A Professional Engineer, licensed in the State of Washington, shall submit final road and drainage plans, a drainage report and calculations that conform to the 1999 Spokane County Standards for Road and Sewer Construction and the curent edition of the Spokane County Guidelines for Stormwater Management and all other standards and laws that are applicable to this project if road improvements are required. Final drainage plans and a drainage report shall receive the County Engineers acceptance prior to release of a construction or building permit or approval of the final plat. Following plan acceptance by the Spokane County Engineer, drainage language will be drafted by Spokane County and provided to the Sponsor's Engineer or Surveyor for inclusion in the final plat document. Any applicable stormwater management systems and roads for this plat shall be constructed and certified to be constructed in accordance with the accepted road and drainage plans, or all the required improvements must be bonded for in accordance with Spokane County regulations, prior to the recording of the final plat. Record drawings and all construction documentation shall be submitted with the proper certification statement. • This proposed subdivision or development proposal is located within a drainage basin which has been identified by the Spokane County Engineer's and Utilities offices as having stormwater runoff problems. Since this proposed subdivision or development proposal is affected by or is a contributor to stormwater flows, property owners should participate in the planning and implementation of a future basinwide stormwater management system. If the property owner(s) fails to maintain the surface path of natural or man-made drainage flow, or the drainage swale, a notice of such failure may be given to the property owner(s). If not corrected within the period indicated on said notice, Spokane County has the right to correct the maintenance failure, or have it corrected, at the expense of the property owner. There may exist properties located uphitl and adjacent to this subdivision which periodically discharge stormwater runoff onto individual lots within this plat. Runoff from nearby uphill properties 1 shotld be expected, and durir.. owmelt periods or wet seasons tr. _._:s may be subjected to higher pmounts of stormwater runoff that what is normally observed or anticipated. Because stormwater runoff from adjacent properties have discharged onto this plat prior to development, stormwater runoff will likely continue to do so after development. It is the responsibility of the individual Iot owners to maintain existing surface paths of runoff through their respective lots and to grade the lots in accordance with applicable rules and regulations, so as to prevent property damage. Any building that is constructed on a lot in this plat shall be set at such an elevation so as to provide positive drainage away from any drainage entry point to the building (including but not limited to a window well, a window unprotected by a window well, or a doorway). Said positive drainage shall consist of a minimum slope of 3% away from the building for a distance of at least 10 feet from the building. The lots shall be graded so that either a) all runoff is routed away from the building, and conveyed over the lot to a natural drainage swale or approved drainage facility, or b) drainage intercepted on the lot is disposed of on the lot in an approved drainage facility. The approved drainage facility shall be constructed in accordance with any applicable accepted plans on file at the County Engineer's Office. Any revisions to the accepted drainage plans must be accepted by the County Engineer's Office prior to construction of said revisions. Spokane County does not accept the responsibility of maintaining the drainage course on private lots or floodplain areas within private lots, nor the responsibility for any damage whatsoever, including, but not limited to, inverse condemnation to any properties due to deficient construction and/or maintenance o# drainage courses in drainage easements on private property. The owner(s) or successor(s) in interest agree to join in any County-approved stormwater management program and to pay such rates and charges as may be fixed through public hearings for service or benefit obtained by the planning, design, constructing, maintaining or operation of stormwater control facilities. This short ptat is located within the Aquifer Sensitive Area (ASA). Treatment of storm runoff from driveways shall be provided. The preferred method of treatment is to have the runoff from driveways sheet flow over lawn turf or native-type grasses. If a ditch is to be used to collect runoff from driveways, then the ditch is to be grass-lined. If road and drainage improvements are required for this development, additional drainage language will be drafted by Spokane County and provided to the Sponsor's Engineer or Surveyor for inclusion in the final plat document following plan acceptance by the Spokane County Engineer.
