No fence or portion thereof will be constructed within said easement without permis9ion of the Spokane County Engineer, nor will any objects be placed in said easement that would obstruct the sight distance necessary for safe and efficient vehicular movement. Any other easements granted or dedicated within this Border Easement area will be subordinate to the rights created by this easement and are subject to Spokane County Engineers permit process prior to usage. ` ti I BEFORE THE SPOKANE COUNTY DIVISION OF PLANNING IN THE MATTER OF SHORT ) FINDINGS OF FACT, SUBDIVISION; SP-1271-01 ) CONCLUSIONS AND DECISION THIS MATTER, an application for preliminary short subdivision approval from Robert S. Miller has been received and was decided upon, pursuant to Spokane County Subdivision regulations, on the 9th day of April, 2001. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has been properly delegated the responsibility for rendering the decision by the Director of Spokane County Division of Planning. 2. The application proposes to subdivide 1.44 acres of property into four (4) lots for those uses permitted in the existing Urban Residential-3.5 (UR-3.5) Zone. 3. The proposed short subdivision is located approximately 120 feet east of the intersection of Adams Road and 24th Avenue, fronting on the north side of 24"' Avenue in the Northeast % of Section 26, Township 25 North, Range 44 EWM, Spokane County, WA., Assessors Tax Parcel number 45261.1633. 4. The existing zoning of the property is Urban Residential-3.5 (UR-3.5) which was established in 1991 consistent with the Program to Impfement the Spokane County Zoning Code. Pursuant to Section 58.17.195 of the Revised Code of Washingion (RCV1), this proposal, together with the conditions of preliminary approval specified herein, conforms to the requirements of the existing zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses proposed for this short subdivision and conditions attached thereto are in accordance with the Urban land use category. The Urban category is intended to provide #he opportunity for development of a°citylike" environment with intensive residential development including single family, twafamily, and multi-family dwellings. The Urban category also promotes ufill-in" development in areas with public services available such as water, sewer, storm sewer, transit and fire protection. This proposed short subdivision will essentially be a"fill-inQ development since the surrounding area is comprised of urban density single family dwellings. The short subdivision will be served by public water, public sewers, police, fire protection, solid waste collection and public transit services. 6. The short subdivision is located in the Interim Urban Growth Area (IUGA) established by Spokane County Resolution 97-0321. The proposal is consistent with the requirements in said Resolution 97-0321. 7. Access to the site is provided by 24th Avenue. Lot B will have direct access to 24'" Avenue and a proposed private road easement will provide access to Lots A, C and D. The Spokane County Arterial Road Plan designates 24'hAvenue as a Collector Arterial requiring 70 feet of right-of-way width. The existing right of way width of 60 feet is not consistent with that specified in the plan. In order to implement the Arterial Road Plan the applicant must reserve a strip of property 5 feet in width along the 24'h Avenue frontage. This property may be acquired by Spokane County at the time when arterial improvements J6 ♦ are made to 24hAvenue. The private driveway easement providing access to Lots A, C and D must be improved to County private driveway standards necessary to safely accommodate the automobile traffic generated by said lots. 8. The subject property is located within the Public Transportation Benefit Area (PTBA). The Spokane Transit Authority (STA) Route number 97 provides transit service in the vicinity of the short subdivision. 9. The subject property is served by the Vera Irrigation District # 15 water system. The Company is willing and able to provide adequate water to meet the potable and fire flow needs of the short subdivision. 10. The Spokane County sewer system will serve the wastewater requirements of the short subdivision. 11. The required public notice of the proposed short subdivision and comment period was provided consistent with the Spokane County Subdivision Ordinance. In addition, comment was requested from those agencies having a potential interest in the proposal. One comment was received from a resident in the vicinity of the short subdivision site expressing concems regarding existing traffic and noise on 24t" Avenue. 12. In consideration of the application of performance conditions specified below and the application of Spokane County development standards, the proposed short subdivision makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by short subdividing the subject parcel. The proposal is generally consistent with Washington State Subdivision Statute RCW 58.17 and the Spokane County Subdivision Ordinance. The Division of Planning has considered the provision of adequate public facilities as cited in RCW 58.17.110(2). More specifically: a. open spaces f. sanitary waste disposal b. drainage ways g. parks and recreation facilities c. public and/or private right-of-ways h. playgrounds d. transit i. schools and school grounds e. potable water j. sidewalks 13. The proposal is exempt from the environmental review requirements under the State Environmental Policy Act pursuant to WAC 197-11-800(6)(a). 14. The County Engineer has examined this development proposal and has determined that - the impact of this proposal upon the existing County Road System warrants the dedication of additional right of way and the roadway improvements specified herein. 15. This proposed short subdivision is located within a drainage basin which has been identified by the Spokane County Engineers and Utilities offices as having stormwater runoff problems. Since this proposed subdivision or development proposal is affected by or is a contributor to stormwater flows, property owners should participate in the planning and implementation of a future basinwide stormwater management system. DECISION Findings and Decision SI'-1271-01 2 ..l► / Based upon the above noted Findings of Fact and Conclusions, preliminary short subdivision application SP-1271-01 is hereby APPROVED for five (5) years, specifically to Aprit 9, 2006 and subject to conditions specified below. This decision is final unless appealed in writing, consistent with appeal procedures set forth in Section 12.100.126 of the Spokane County Subdivision Ordinance. CONDITIONS OF APPROVAL All the below conditions imposed shall be binding on the "Applicant," which term shall include the developer, owner or owners of the property, heirs, assigns and successors. SPOKANE COUNTY DIVISION OF PLANNING 1. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) Zone and all other applicable Spokane County Zoning Code requirements and the Spokane County Subdivision Ordinance, as amended 2. The final short plat shall be designed substantially in conformance with the preliminary short subdivision of record. 3. The preliminary short subdivision is given conditional preliminary approval for five (5) years, specifically to April 5, 2006. The applicant may submit an extension of time application thirty (30) days prior to the above expiration date. Application(s) for extension of time shall be processed under the provisions of Chapter 12.100.118 (Extension of Time) of the Spokane County Subdivision Ordinance. If the applicant complies with the criteria of Chapter 12.100.118, the preliminary approval extension will be granted and conditions attached to preliminary subdivision approval will be changed to reflect the adopted policies and development regulations applicable the date the time extension application is submitted. Submission of a time extension request following March 11, 2006 will not be accepted and the preliminary short ptat will be null and void on April 9, 2006 if the final short plat is not recorded in the County Auditor's Office. 4. Prior to filing of the final short plat, the applicant shall submit to the Division of Planning for review the proposed final short plat to ensure comptiance with these Conditions of Approval. 5. Four (4) current certificates of title shall be furnished to the Division of Planning prior to filing of the final plat. 6. A survey is required of the subject property and the lots therein prior to filing of the final short plat. 7. Appropriate road names and street addresses shall be indicated on the final short plat map. 8. Appropriate utility easements shall be indicated on the final short plat map. Written approval of utility easements by utility purveyors must be received prior to filing of the final short plat by the Division of Planning. 9. The dedication shall contain the following statement: "Side yard and rear yard setbacks shall be determined at the time building permits are requested." Findings and Decision SP-1271-01 3 ~ ~ 10. The Spokane County Division of Planning shall prepare and record with the Spokane County Auditor a"Title Notice" noting that the property in question is subject to a variety of special conditions imposed as a result of the land use action herein. This "Title Notice" shall serve as official public notice regarding conditions of approval affecting the property in question. The "Title Notice" shall be recorded within fifteen (15) days of Final Plat approval and shall only be extinguished by the Spokane County Division of Planning. 11. The private driveway serving Lots A,C and D shall be constructed in conformance with the driveway standards established by the Division of Building and Code Enforcement, Spokane County. 12. The Spokane County Division of Planning shall prepare and record with the County Auditor a Title Notice including the wording in items "a" through "e" below. This notice may be extinguished in full or in part, only by the Division of Planning. The notice should be recorded within the same time frame as an appeal of the approval granted herein and shall provide the following: a. At least five (5) feet of future acquisition area is reserved on lots A and B adjacent to and parallel to 24'h Avenue for road right-of-way and utilities. b. Future building front yard setbacks required by the Spokane Zoning and Development Codes shall be measured from the reserved future acquisition area as depicted on the final short plat map. c. No required landscaping, parking, ground percolation drainage areas, drainfield or allowed signs should be located within the future acquisition area for road right-of-way and utilities. If any of the above improvements are made within this area, they shall be relocated at the applicant's or tract owner expense when roadway improvements are made. d. The future acquisition area, until acquired, shall be private property and may be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs and others) shall be considered interim uses. e. The property owner shall be responsible for relocating such °interim" improvements at the time Spokane County makes roadway improvements after acquiring said future acquisition area. SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS 1. Conditional approval of the short plat by the County Engineer is given subject to approval of the road system as indicated in the preliminary short plat of record. 2. If a RID is proposed for improvement of the road(s) described below, said owner(s) and successor(s)further agree: (1) that the improvements or construction contemplated within the proposed RID are feasible and (2) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceeds the cost and expense of formation of the RID, and (3) that the property within the proposed RID is sufficiently developed; provided, themselves, their heirs, grantees, assigns and successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of a RID by either the petition or resolution method under Chapter 36.88 RCW and to appeal to the Superior Court the decision of the Board of County Commissioners confirming the final assessment roll; provided further, it is recognized that actual assessments may vary from assessment estimate so long as they do not exceed a figure equal to the increased true and fair value improvement(s) add(s) to the property. The proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 99-0265, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. 11. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing County Road System warrants the roadway improvements herein specified. 12. The County Arterial Road plan identifies 24"' Avenue as a 70 foot Collector Arterial. The existing right of way width of 60 feet is not consistent with that specified in the plan. In order to implement the Arterial Road Plan it is recommended that a strip of property 5 feet in width along the 24`h Avenue frontage be set aside in reserve. This property may be acquired by Spokane County at the time when Arterial Improvements are made to 24`h Avenue. 13. The applicant should be advised that there may exist utilities either underground or overhead affecting the applicants property, including property to be dedicated or set aside future acquisition.
