To all of the above:
This letter is to inform you of my intention to start a law suit
against the following parties who were involved in the purchase of my
house at 7311 E. 4th, and whom I feel were not exercising proper care
to protect my interests and safety.
The closing papers were signed on March 30, 1990 and on the following
Tuesday morning, (April 3rd) I called Mr. Waldo regarding the findings
of my contractor, Dennis Pollack. Mr. Pollack also spoke with Mr.
Waldo concerning the electrical hazards that he found prevalent in the
area of the house in which he was working. He also told him of the
hazards he found in the basement.
Mr. Waldo then contacted both the realtors ; James W. Wilson and Larry
L. Whitesitt , who in return contacted a licensed electrician to look
the house over and report his findings and obviously did not take him
seriously as on Thursday I received a message on my home recorder from
Mr. Waldo requesting that I call him. I called him at approximately 4
P.M. and learned that he distributed the funds and filed the closing
papers that same day.
In the meantime I contacted two other electrical contractors to look
the house over and report their findings to me along with bids to do
whatever must be done to make the house in conformity with the county
code and safe for human habitation.
I intend to file a suit against the following persons :
A: Mr. Robert D. Waldo, closing attorney, for disbursing the
money without first consulting me.
B: James W. Wilson, Main Realty, for failure to disclose the
electrical condition of the property and allowing the funds to
be disbursed.
C: Larry L. Whitesitt , Star Brokers Centennial, for the same
failures as Mr. Wilson.
D: Sellers: Jon and Dara Sherman who obviously knew what condition
the wiring was in the house and falsely represented it or
concealed it. They also had to be aware of the county electrical
code and knew that the house would not meet the necessary
standards. I might also point out that no records can be found
that the electricity has never been inspected.
E: Lee Conners, Quality Resource and Services , Inc. , whom I paid to
inspect the house and who guaranteed his competency in this
matter.
I am enclosing a copy of the State Electrical Inspectors report so you
can see that I am not exaggerating the extent of illegal and hazardous
wiring inside and outside the entire house.
I am asking $5, 000 from each of you for your negligent and willful mis-
conduct and lack of concern over the safety of the inhabitants of this
house.
According to the electricians the wiring etc. was totally illegal. Pic-
tures have been taken and evidence collected for my case as well as
testimonials of all electricians who have been on the premises .
I do have a case against all of you, and will pursue it if the matter
is not solved to my satisfaction within 20 days from the date of this
letter.
With the booming housing market in our area it would be a shame if such
conduct as this gets to the media.
Please be aware that my attorney, Fred E. Woeppel has read and
approves this letter.
