16-078.01 NB Stormwater Engineering: Stormwater Effectiveness Studies Ph 2/3 CONTRACT AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF SPOKANE VALLEY AND NB Stormwater Engineering,LLC Spokane Valley Contract#16-078{ x,14 For good and valuable consideration,the legal sufficiency of which is hereby acknowledged, City and the Consultant mutually agree as follows: 1. Purpose: This Amendment is for the Contract for engineering services for Stormwater Effectiveness Studies in Eastern Washington. by and between the Parties, executed by the Parties on June 6, 2016, and which terminates on June 30, 2017. Said contract shall be referred to as the "Original Contract" and its terms are hereby incorporated by reference. Total compensation under the Original Contract is not to exceed$67,870.00. 2. Original Contract Provisions: The Parties agree to continue to abide by those terms and conditions of the Original Contract and any amendments thereto which are not specifically modified by this Amendment. 3. Amendment Provisions: This Amendment is subject to the following amended provisions, which are either as follows, or attached hereto as Appendix "A". All such amended provisions are hereby incorporated by reference herein and shall control over any conflicting provisions of the Original Contract,including any previous amendments thereto. 4. Compensation Amendment History: This is Amendment # 1 of the Original Contract. Paragraph 3 (Compensation) of the Original Contract is hereby amended to change the total compensation paid from $67,870.00, to $99,900.00. Paragraph 3 of the Original Contract is amended to read as follows:City agrees to pay Consultant an agreed upon hourly rate up to a maximum of$99,900.00 as full compensation for everything done under this Agreement,as set forth in Exhibit B. Consultant shall not perform any extra, further, or additional services for which it will request additional compensation from City without a prior written agreement for such services and payment therefore.The City agrees to pay up to $ 99,900.00 as full compensation for everything furnished and done under this contract, in accordance with the provisions outlined in the scope of work,as previously and/or presently amended. 2. The Scope of Work, (Exhibit B) of the Original Contract, is hereby amended to include the following additional tasks and/or services: Consultant/Contractor shall Amend Task 4 to include the following subtasks: ➢ Case Study Development—NBSWE will further develop two studies to be used as cases to test the review and approval process of detailed study design proposals and QAPP's with Ecology. It is expected to include conducting an extensive literature search and assisting in preparing for Ecology meetings including the development of two draft power point presentations. ➢ Task 4 Meetings NBSWE will meet with Ecology,the City of Spokane Valley,and the lead entities for the purpose of planning the development of the QAPP templates,reviewing the developed templates with the group,and planning meetings with affected jurisdictions for Ecology meetings.This will include: • Two 4 hours meetings with Ecology plus travel expenses for 2 people round trip from Spokane or Pasco to Olympia(for 1 meeting)and Ellensburg(for 1 meeting) • Two 2 hour meetings with the lead entities plus travel expenses for one person round trip from Spokane to Wenatchee(for 1 meeting)and Ellensburg(for 1 meeting) • Six 1-hour planning meetings with the Ecology • Responding to Ecology comments on the QAPP Templates • Developing agendas for Ecology meetings > QAPP Guidance Document for Structural Treatment BMPs-NBSWE will develop guidance for structural treatment BMPS that defines the content of the detailed study design proposal compared to the content of the TAPE QAPP. > Task Deliverables: Case Study—(2)draft PowerPoint presentations and(2)literature search summaries(limited to 2-3 pages). Two agendas for Ecology meetings. Structural treatment guidance document for QAPP vs detailed study design content(limited to 3-4 pages) ➢ Schedule: Deadlines for other technical documentation will be negotiated between the City and NBSWE as needed 2
