1. The individual signing Toelaw has furCher been graperly de[egated the responsibilEty for rendering
the decision hy the X3irector af Spokane County Divisinn af Building and Planning.
2. The proposal is to divide appraxirr3a#ely 4.6 acres inta 3 cammercial tracts.

3. The prnpasal is loeated ai the northwest ccrrner of Mullan Rflad and Sinto Avenue in the NW 'Id af
Section 17,'I`ownship 25 North, Range 42 E.W.IVi., Spakane Ccsunty, Washingtan.
4. The existing xc+ning of the praperty described in the applicatian is Neighborhood Business (B-t),
which vvas esta6lished in 1991. Pursuant to Section 58.17.195 of the Revised Code of Washingtoro
(RiCW), ihis prQp4sal cQnforms te the requirements of the existing B-1 2one.
5. The Spokane County Gomprehensive PEan designaies this area as Major Commercial and CJrban.
`Fhe development and uses, as proposed and condxiianed are in accard with the Major Corrtrnercial
and Urban Category. 7`his proposal is als4 campatible witih the surrounding uses, which are
primarily commerciaf ana single family residences.
d. The Sgokane County Arterial Road Plan identifies Sinto Avenue as a Locai Access F.aad with a
future right-of-way H+tdth af 60 feet. The existing right-af ruay width is 40 feet. In Qrder to
implement the Arteraal Road P1an, a strip vf praperty ] 0 feet in width along the Sintn Auenue
frontage is ta be set aside as a F'uture Acquis'stion Area. In addition, [he ipokane County Arterial
Road Plan identifies Mullan Raad as a Principal Arterial with a future right-of-way width of 100
feet. The existing righ#-af-way width is 60 feet. In arder to inraplement the Arterial Reaad Plan, a
strip of property 20 feet in rWidth alorag the Mullan Road Frontage is ta be set aside as a Future
Acquisitian Area. Therefore, as conditianed (such as impravements, sidawalks arad acquisi#ion
areas) this prvposal conforms to the lZaad Plan.
7. The prnposed site is located within t#ie PubIie Transportatian $enefit Area (P`FBA), The Spakane

established by the Sfiate and 5pokane County. The County Diu'ssion of Building and Flanning has

Based upon the aboue noted Findings of Fact and Canclusions, Short P1at Applicat:on SP-1 159-97 is
hereby APF'ROVED for five (5) years, specifically to CJctober 1, 2002 and subject to conditions raoteti
belaur. This decision as final unless appealed bn writing, consistent with adopted appeal procedures.

„Conditic►ns o£ Approval" are submitted to t.he Spokane County Planning I3epartment far inclusian in the
„Findings of Fact, CvncYusions and OrderfX]ecision" shnuld tfie request be appraved.
1. Conc3itional approval of the plat by the County Engineer is given
subject to approual Qf the road sy*stem as indicated in the preliminary
plat af record.
2. Plans, profiles and cross secticaras as designed to County standards
showing propased street centexline and curb grades be submitted to the
County Engineer for acceptance prior to construetion and/or the filing
❑f af inal plat; rrad plans to be prepared under the direction af a
licensed Professional Civil Engineer.
3, Drainage plans and design calculations shQwing the alignment of
drainage facilities kie submitted to the County Engineer for acceptance
prior to canstructivrr and]or the filing of trie final plat. Dxainage
plans to 3ae prepared under the dix'ection of alicensed Professional
Civil Engineer.
4. Constructian within all groposed puhlic/private roads shall be
performed under the direct supervisian af a licensed engineer/surveyor,
who shall furnish the County Engineer with "Recvrd Drawings" and
certification which states the follawing, "I have reviewed the
Gonstruction and to rny knawledge find it to be in suY.astantial
canformance with appraved certified plans and Standard Specifications

5. Na construction wark is to be performed within the existing or praposed
Public right-of-way until plans have been accepted by the County
Engineer and a permit has been issued by the Caunty Engineer. A11 work
is subject to inspectian and appxaual by the County Engineer.

5. All canstruction within the existing or propased Public right-nf-way is
to be compl.eted prior to filing the final glat or a bond in the amaunt
estimated by the County Engineer to cover the cast af ccnstruction caf
improvements. Construction certificatic}n, "Recard Llrawings" and
monumentation of the street centerlines shall be filed with the County
Engineer.
7. ApproaGh Permits are required for any access t❑ the Spokane County raad
system.
8. The applicant shall grant applicable border easements adjacent to
Spakane County Riaht af Way per Spakane County Standards.
9. The applicant shall comply with SpQkane County Zone Change #ZE-53-80.
10. The County Engineer has designated a Local Access Rcaadway Section for
the irrrgravement of Sinta Avenue which is adj acent to the prQposed
development. This will require the installation of asphalt equal t❑ 20
feet from centerline along the frontage of the development. The
constructiQn of curbing and sidewalk is alsa requi,red,
ii . The prflposed plat shall be improved to the standards set forth in
Spokane County Boaxd of Commissianers Resalution No. 95-0498, as
amended, which establishes regulations for raads, approaches, drainage
and fees in new constructian.
12. The County Engineer has examined this development prflposal and has
determined that the impact ❑f this praposal upan the existing County
Raad System warrants the raadway improvements herein specified.
13. The applicant should be advi.sed that there may exist uti.lities either
undergraund or overhead affecting the appl3cants property, including
property ta be dedicated or set aside future aCquisition. Spakane
County will assume no financial abligation for adjustments or
relocation regarding thess utilities. The applicant should check with
the appl icable util it ies and Spokane County Engineer tQ determine
whether the applicant or utility i.s responsible fDr adjustment ar
relacatian costs and ta make arrarrgements for any necessary work.
