It is easy to see vegetation has developed to prevent erosion. c. The sprinkler head at erosion site has contributed greatly to the problem. Once the area has been filled and grass replanted and matured the sprinkler will no longer cause erosion. 2. The Bernhardts bought the property with the current slope. Before purchasing the property they clearly saw the slope and found it to be acceptable. If before the purchase they had asked to have the same work done I would have charged them for it. In addition,the house and property passed all required inspections and the city issued a certificate of occupancy. On top of that a VA appraiser inspected the property and apparently found it to be in compliance with VA standards. 3. I have tried to help and the buyer has impeded my efforts by trying to require additional work. The buyer has complained to the city and this has created unnecessary requirements by the city. 4. To do the work discussed with the engineer,the one I brought out to the house, would cost about $3000. If the buyer wants I would be happy to do the work as discussed with the engineer, if the buyer will split the cost. That would be around $1500 for each of us. Attachments: bernhardt.doc Hi Tim, I've reviewed your response to the Veterans Administration and reject your explanations of the problem, our involvement in your delays in resolving said erosion problems, and resolution of the situation. Our claim as outlined in the document you received via certified mail July 30, 2007 and copied to the Veterans Administration, is that you did not engineer the slope according to code and the driveway in accordance with the water run-off plans for this property. It seems that you've failed to understand that resolution of the slope erosion and probable failure of the septic drainfield, as confirmed by your septic subcontractor you used in building this property, will continue to deteriorate if the slope is not engineered according to code. The City's involvement has been unbiased to either party. They have simply communicated what is required by the City to ensure the slope is engineered in a manner to protect you, the builder, and the buyer, Donna and I. Additionally, you failed to complete the construction of the drainage ditch according to the original stormwater plans, project plan 07002061, and the review instruction provided to Simpson Engineering by the City's Building Department Center dated June 4, 2007. The letter I presented to you outlines what is expected of you as the builder of this property. The purchase of this property by Donna and myself in no way releases you of your obligation to correct the failure of the slope and your obligation to honor the warranty agreement you signed as part of the VA home loan agreement. I will extend to you until the end of the month August 31, 2007 to submit for permit and have an approved engineering solution to resolve the claim as outlined in the aforementioned claim document. If you fail to make good on the warranty and fix the problem, I will take it upon myself to fix said problem and recover all funds for construction and legal fees as allowed by the Revised Code of Washington; you may want to research RCW 64.50.020. You told me you would fix the problem back in February. You've asked me to be patient- I've run out of patience. Dave, I understand not wanting the expense of the engineered design. However, for a condition such as the one at your property, the code requires that we have an engineer provide the details for construction and final approval. This is probably in both yours and Mr. Jones best interest given the situation thus far. Code requirements related to such construction are fairly prescriptive and no one at the City actually has any authority to waive them-that's why we gave you and Mr. Jones the information that we have to this point. Mary Kate, I just met with Tim, our builder, and we had an engineer on site yesterday. In meeting with Tim and I, the engineer feels that a slope with a 2:1 grade and geo-cloth and rock on the side of the property next to the septic tank would resolve the problem. Tim's reservation at this point is having to expend the cost of an engineering plan when the engineer has already explained what is needed. I told Tim that I would be willing to go with him and sit with the City to see if the engineer's discussion with Tim and me would suffice in loo of having to pay the cost of an engineered plan. If this is a suitable option, Tim and I have set aside Tuesday to meet with the City to discuss. Please let us know if this is an option and if there is availability on Tuesday to meet with the City. Mr. Bernhardt, Our conversation with Mr. Jones was to convey and reinforce the same the same information we have given you. 8/23/2007 Page 5 of 10 The City's position is that we are not directing anyone with respect to what must be done to repair the failed slope area nor who is responsible for the repair. What we are saying is that regardless of what the solution is, a permit is required for the repair since we are not able to foresee a repair that would be exempt from the permit requirement. In addition, because the repair is for a slope that holds a surcharge due to the location of the drain field, we will require that any permit application is accompanied by an engineered solution. We do have concerns regarding the proximity of the slope failure to your drainfield and how that may impact its function. We plan on asking the health department to asses the situation at some point if repair is not undertaken before the rainy season-if we can call it that If you need further clarification, it may be worth meeting to discuss the situation as it now stands and what steps may need to be taken in the event you and Mr. Jones cannot come to an agreement on the repair. The purchase of this property by Donna and myself in no way releases you of your obligation to correct the failure of the slope and your obligation to honor the warranty agreement you signed as part of the VA home loan agreement. I will extend to you until the end of the month August 31, 2007 to submit for permit and have an approved engineering solution to resolve the claim as outlined in the aforementioned claim document. If you fail to make good on the warranty and fix the problem, I will take it upon myself to fix said problem and recover all funds for construction and legal fees as allowed by the Revised Code of Washington; you may want to research RCW 64.50.020. You told me you would fix the problem back in February. You've asked me to be patient- I've run out of patience. What we are saying is that regardless of what the solution is, a permit is required for the repair since we are not able to foresee a repair that would be exempt from the permit requirement. In addition, because the repair is for a slope that holds a surcharge due to the location of the drain field, we will require that any permit application is accompanied by an engineered solution. We do have concerns regarding the proximity of the slope failure to your drainfield and how that may impact its function. We plan on asking the health department to asses the situation at some point if repair is not undertaken before the rainy season-if we can call it that If you need further clarification, it may be worth meeting to discuss the situation as it now stands and what steps may need to be taken in the event you and Mr. Jones cannot come to an agreement on the repair. I've met with the City's Stormwater engineer and have reviewed our original stormwater plans as well as the stormwater plans for project 07002061. A number of discrepancies and questions have been noted. I expect the stormwater engineers to get back to me in the coming days on what their final finding are and what will be required to rectify. I will also be meeting with the building inspector regarding some construction omissions and a building engineer to review the grading permit related to the cut slope and its erosion. Once I've had the opportunity to review plans with the building/construction inspector and engineer, and we have a complete punch list of items to resolve, I'll discuss with the city on next steps and follow up with you accordingly. Lastly, when we met last you told me that the City had declined a proposal to include our property in project 8/23/2007 rage 9 Or 1U 07002061. I was disappointed to find no record in any of the plans or communications on record. If you have any such documentation or if you know who that person was that declined the proposal, please let me know as I would like to follow up with them on the reasons why. Schafer Road Tim, Thanks for coming by this morning to inform me of plans to begin to begin filling in the property to the west and adjacent to our property the week of July 9th. However, after being informed that the county would not permit you to do the same to our property and fix the excessive erosion problems that we've been dealing with since purchasing our property from you in December of 2006, I need to know what specifically you plan to do to fix this problem that is under warranty and you asked Donna and Ito patiently work with you to resolve. After you left, I did not get the feeling that you were going to provide a suitable solution to fix the erosion problem simply by lessening the contour of the existing landscape. I know the two pieces of property adjacent to us have not sold are a primary priority, but we've waited long enough to have the property fixed and now that all water run off will be diverted to our property, I'm concerned that we will be left to deal with any increase in water run off and erosion problems. This said, I will be contacting the county to determine what if any thing needs to be done to deal with the additional run-off and ensure that you provide us with a solution that is satisfactory for both parties. I don't wish to be difficult, but I've been left with an uneasy feeling about this and will ask the county to hold off on any development until I know we have an appropriate solution. I will be more than happy to discuss further, but it is time to provide us with an appropriate solution to our erosion problems and that any additional run off will not exacerbate the erosion problem.
