'i'he ResalutiQn authorizes the County Engineer tn caaleet a fee Fnr time that is expended by Spokane County persnnnel whn arc Charged with review and inspection duties that are required to be performet3 for the aPplieable de►-elapment proposals. The fee agreement is hased on the individuals actira1 t6me spent plus 10°/o. These costs are billed rsue on a mnnthly basis. The amount of time spenf on review of a pra}ect ►vill be directly preportional to the complexity of the praposal and fhe quality of the submittals from the applRCant and his agents. Hill has been received and was decided upon, pursuant to Spokane County Subdivision regulations, on the 26th day of January, 1998. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Director of Spokane County Division of Building and Planning. 2. The proposal is to divide approximately .73 acres (31,625 sq. ft.) acres into 2 tracts for 1 existing single family residence and 1 new additional residential tract. 3. The subject property identifed as Tract was created through the alteration of Tract "C" (le ~no. AE--1=1=92) to the original Final ShJ6 lat, SP-732-91, wlii'ch was recorded on March 2, 1992. 4. The proposal is located east of and adjacent to the terminus at Longfellow Avenue and approximately 450 feet south of Wellesley Avenue, in the I4E'/4 of Section 3, Township 25 North, Range 44 E.W.M., Spokane County, Washington. 5. The existing zoning of the property described in the application is Urban Residential-3.5 (UR-3.5), which was established in 1991. Pursuant to Section 58.17.195 of the Revised Code of Washington (RCVI), this proposal conforms to the requirements of the existing UR-3.5 zone. 6. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses, as proposed and conditioned are in accord wtth the Urban Category. This proposal is also compatible with the surrounding uses, which are primarily single family residences. 7. The Spokane County Arterial Road Plan identifies Longfellow Avenue as a Local Access Road with a future right of way width of 60 feet.. In order to implement the Arterial Road Plan, a 5 foot wide strip of the subject property along the frontage of Longfellow Avenue is to be set aside as a Future Acquisition Area. In addition, the County Engineer has requested the existing 25 feet width of right-of-way along the frontage of the proposed site be dedicated to the County for the extension of Longfellow Avenue. Therefore, as conditioned, (such as improvements, dedication and acquisition areas) the proposal conforms to the Road Plan. 8. The proposed site is located within the Public Transportation Benefit Area (PTBA). The Spokane Transit Authority (STA) Valley/Trentwood Route 20 provides connecting services to the site. 9. The proposed short plat will be served by a public water system. Waste water disposal will be as authorized by the Director of Spokane County Division of Utilities. 10. The required public notice and comment period was provided for this proposal. In addition, those agencies having a potential interest in the proposal were notified and comments solicited. No written comments were received from any adjoining property owners regarding this proposal. , ti 11. Recognizing the recommended conditions and Spokane County development standards, the ' proposed short plat makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by platting the subdivision. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations, promoting the public health, safety and general welfare in accordance with standards established by the State and Spokane County. The County Division of Building and Planning has considered the provision of adequate public facilities as cited in RCW 58.17.110(2). More specifically: a. open spaces f. sanitary waste disposal b. drainage ways g. parks and recreation facilities c. public and/or private right-of-ways h. playgrounds d. transit i. schools and school grounds e. potable water j. sidewalks 12. An Environmental Checklist was submitted by the applicant and was reviewed by the Spokane County Division of Building and Planning. The review considered the specifics of the proposal, other available information, County ordinances, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The County Division of Building and Planning has determined that "No probable significant adverse impacts" would result from the proposal being developed and issued a Determination of Nonsignificance (DNS) on December 8, 1997. The DNS.was circulated for review and comments to various agencies of jurisdiction affected by the proposal. The "DNS" was advertised in the newspaper to the public 15 calendar days before the comment period ended on December 23, 1997. No written comments were received regarding the environmental determination. DECISION Based upon the abo-v-e noted Findings of Fact and Conclusions, Short Plat Application SP-1167-97 is . hereby APPROVED for five (5) years, specifically to February_ 1 2 0 and subject to conditions noted below. This decision is final unless appealed in `vi+iiting, consis ent with adopted appeal procedures. CONDITIONS OF APPROVAL All the below conditions imposed shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns and successors. SPOKANE COUNTY DIVISION OF BUIELDING AND PLANNING 1. The proposal shall comply with the Urban Residential-3.5 (CJR-3.5) zone and other applicable Zoning Code chapters, as amended. 2.
