approximately 8.5-10.5 feet of asphalt aloRg the frontage of the development. The construction of
curbing and sidewalk is also required.
14. The private road shall be improved to adopted Spokane County Road and Sewer Standards for
private roads. The private road will provide access to this proposal as well as the adjacent
proposed short plat, SP-1012-95.
15. All vested owners shall sign and record private road documents as prescribed by the Spokane
County Engineer. These documents shall be reviewed and approved by the Spokane County
Engineer prior to recording with the Spokane County Auditor. Recording numbers shall be
referenced in the dedicatory language of the short plat.
16. The proposed plat shall be improved to the standards set forth in Spokane County Board of
Commissioners Resolution No. 95-0498, as amended, which establishes regulations for roads,
approaches, draina?e and fees in new construction.
17. The County Engineer has examined this development proposal and has determined that the impact
of this proposal upon tlle existing County Road System warrants the dedication of additional right-
of-way and the roadway improvements herein specified.

11. As an alternative methad of canstxucting the road irnprovement stated
herein, the applicant may, with the approval of the County Engineer,
accamplish the road improvements stated herein by joining and
participatinq in a County Road Praject (CRP) to the extent a£ the
required road improvement. At such time as an Rza is created or any
Raad Improvement Praject is sanctioned by Spokane County, the
irnprovements required (curb, sidewalk, drainage contral and paving t❑
existing pavement) will be at the sale expense of the undersigned
awner, their heirs, grantees and assigns. This provision is applicable
ta Fourth Avenue.
12. That the following statement shall appear within the dedicatory
language of the final p1at:
That in consideratipn of Mutual Benefits now or to be hereafter

successor(s) in interest hereby request and authorize Spakane County to
include the above described property in a Road rmprovement District
(RTD) and to support the formation ❑f aRoad Improvement District for
improvement af the raad(s) described below by requesting and
authorizing Spokane County to place their name(s) on a petition for ths
formatian of a Road Imprflvement District pursuant to RCW 36.88.050, or
by requesting and authorizing Spokane Caunty ta cast their ballot in
favor of a RID being farmed under the resfllution method pursuant to RCW
36.88.030, andlor by not fiiing a prntest against tYre forrnation of a
RID being formed under the alternative resolution method provicied for
in RCW 36. $8. Q65 and Chapter 35.43 RCW.
If aRID is praposed far improvement of the road(s) described belaw,
said awner(s) and successar(s) further agree: {1} that the improvements
or canstructian contemplated within the proposed RID are feasible and
(2) that the benefits ta be derived from the formation of the RID by
the property included therein, together with the amount af any County
partfcaipation, exceeds the cast and expense of farmation of the FtID,
and. (3) that the praperty within the proposed RID is sufficiently
developed; prQVided, themseives, theiar heirs, granteas, assigns and
successar(s) shall retain the right, as autharized under RCW 35.$8.090,
ta abject ta any assessment(s) on the property as a result af the
improvements called for in canjunction with the formation of a RID by
either the petition Qx resolutian method under Chapter 36.88 RCW and to
appeal to the Superior Court the decision of the Board of Caunty

it is zecognizecl that aGtual assessments may vary from assessment

It is further acknawledged and agreed that at such time as a RID is
created or any Couraty Road Imprcavement project is authoxized by Spokane
County, the improvements required shall ae at the sole expense of the
owner(s) of property within the RTD or served by the imgrovements
without any manetary participation 3ay Spokane Corznty.
The RID waiver contained in this agreement shall expire afte.r ten (10)
years from the date of execution below. This provision is applicable
to Fourth Avenue.
13. The County Engineer has designated aCollector Arterial Roadway Sectian
for the improvement of Fourth Avenue which is ad3acent to the propaseei
deuelopment. This will require the addition of approximately 8.5-10.5
feet of asphalt along the frontage of the development. The
constructian of curbing and sidewalk is also required.
14. The private rraad sha11 be improved to adopted Spokane County Raad and
5ewex 5tandards for private raads. The private road will provide
access to this praposal as well as the adjacent p~opDS~d platr SP-1012-
95.
15. All vested owners sha11 sign anr.i record pra.vate raad documents as
prescribed by the Spokane County Engineer. These documents shal.l be
reviewed and approved Jay the Spakane Caunty Engineer prior to recarding
with the Spokane County Auditar. Recording ni.zmbers shall be referen,ced
in the dedicatory language of the piat.
16. The proposed plat shall be improved to the standards set faxth in
Spokane County Board of Commmissioners Resolution No. 95-099$, as
amended, which establishes regulations for roads, approaches, drainage
and fees in new construction.
17.'The Caunty Engineer has exama.ned this develrpment proposal and has
determzned that the impact of this propasal upon the existing County
Road System warrants the dedication of additianal Right of Way and the
roadway impravements herein specified.
18, That the follawing statement must be placed in the plat dedication:
"The pxivate road as shawn herean is an easement which provides a means
of ingress and egress for those 1ots within the plat having frontage
therefln.

19. xhe County Arterial Road plan identifies Faurth Avenue as a 70 foot
Callectar Arterzal. T"he existzng right of way width af 40 feet is not
consistent with that specified in the Plan. In order to implement the
Arterial Road Plan it is rec4mmended that in additian tfl the required
right af way dedication, a strip of property 12.5 feet in width alang
the Fourth Avenue frontage be set aside in reserve. This property may
be acquired hy Spakane County at the tircte when Arterial Improvements
are made ta E'DUrth Avenue. .
20. The County Arteri.al Road plan identifies the Va1.1.ey Cauplet as a 160
fcaot Principal Arterial. The existing right of way width of 100 £eet
is not cansistent with that specified in the Plan. In arder to
implement the Arterial Road Plan it is recommended that astrip Df
property 50 feet in width along the Valley CDUp1et frontage be set
aside in reserve. This property may be acqui.red by Spokane County at
the time when Arterial Imgrovements are made to Valley Couplet.
21. The applicant shpuld be advised that there may exist utilities either
underground ar overhead affecting the applicants propearty, including
praperty to kae dedicated ❑r set aside future acquisitian, Spakane
Caunty will assume no financial obligation for adjustments or
relacation regarding these utilities. The applicant should check with
the applicable utilitaes and Spokane County Engineer to determine
whether the applicant or utility is responsible for adjustment or
relcacation costs anci to make arrangements for any necessary work.
