DECISION
THIS MATTER, an application for short subdivision from Darryl Straughan has been received and was
decided upon, pursuant to Spokane County Subdivision regulations, on the 20th day of March, 1998.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for rendering
the decision by the Director of Spokane County Division of Building and Planning.
2. The proposal is to divide approximately 1.17 acres into four (4) lots for single family residences in
the Urban Residential-3.5 (IJR-3.5) zone. .
3. The proposal is generally located north of and adjacent to 8th Avenue and west of and adjacent to
Pierce Road in the NW 1/4 of Section 21, Township 25N, Range 44 EWM, Spokane County,
Washington.
4. The existin~ zoning of the property described in the application is Urban Residential-3.5 (LTR-3.5),
which was established in 1991. Pursuant to Section 58.17.195 of the Revised Code of Washington
(RCW), the proposal conforms to the requirements of the existing Urban Residential-3.5 (UR-3.5)
zone. •
5. The Spokane County Comprehensive Plan designates this area as Urban. The development and
uses, as proposed and conditioned, are in accord with the Urban category. This proposal is also
compatible with the surrounding uses which are primarily single family residential.
6. The site is located adjacent to 8th Avenue and Pierce Road. The Spokane County Arterial Road
Plan identifies 8th Avenue as a Minor Arterial with a planned right-of-way width of 80 feet and
Pierce Road as a Local Access Street. In order to implement the Arterial Road Plan, the Spokane
County Division of Engineering and Roads has required that a strip of property 13 feet in width be
set aside along the frontage of the proposal as Future Acquisition Area (FAA). Therefore, as
conditioned, the proposal is consistent with the Arterial Road Plan.
7. The proposed site is located within the Public Transportation Benefit Area (PTBA). The Spokane
Transit Authority (STA) Route 422 provides connecting services west of the site along University
Road. •
8. The proposed short plat will be served by a public water system. Waste water disposal will be as
authorized by the Director of Spokane County Division of Utilities.
9. The required public notice and comment period was provided for this proposal. In addition those
agencies having a potential interest in the proposal were notified and comments solicited. No
comments were received from any adjoining properiy owner(s) regarding this proposal.
10. Recognizing the recommended conditions and Spokane County development standards, the
proposed short plat makes appropriate provisions for the public health, safety and general welfare
and that the public use and interest will be served by platting the subdivision. The subdivision
proposal is generally consistent with RCW 58.17 and the County subdivision regulations,
promoting the public health, safety and general welfare in accordance with standards established

by the Stafe and Spokane Caunty. ! The Caunty Diuisian of Building and Planning has considered
the provision ofadequate public facilifiies as cited in RCW 58.17.110(2). More specifically:

~ 7. Appropriate utility easements shall be indicated on the final short plat map. Written approval of
utility easements by utility companies must be received prior to recording the final short plat.,
8. The final short plat map shall indicate by a dashed line the required setbacks from all private or
public roads.
9. T'he final short plat dedication shall contain the following statement: "Side yard and rear yard
setbacks shall be determined at the time building permits are requested unless these setbacks are
specifically drafted on this short plat. The setbacks indicated on this plat may be varied from if
proper zoning or variance approvals are obtained."
10. Prior to recording the final short plat, the applicant shall provide four (4) current Certificates of
Title to the Division of Building and Planning.
11. The applicant shall contact the County Division of Building and Planning at the earliest possible
stage in order to be informed of code requirements administered/enforced as authorized by the
State Building Code Act. Design/development concerns include: addressing, fire apparatus access
roads, fire hydrandflow, approved water systems, building accessibility, construction type,
occupancy classification, exiting, exterior wall protection, and energy code regulations.
12. The Spokane County Division of Building and Planning shall prepare and record with the County
Auditor a Title Notice specifying a future land acquisitton area for road right-of-way and utilities.
The Title Notice shall state the following:
a. A strip of property 13 feet in width from the existing right-of-way is reserved for future
acquisition area for additional road right-of-way width along 8th Avenue.
b. Future building and other setbacks required by the Spokane County Zoning Code shall be
measured from the reserved future acquisition area.
, c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located
within the future acquisition area for road right-of-way and utilities. If any of the above
improvements are made within this area, they shall be relocated at the applicant's expense
when roadway improvements are made.
d. The future acquisrtion area, until acquired, shall be private property and may be used as
allowed in the zone, except that any improvements (such as landscaping, parking, surface
drainage, drainfield, signs or others) shall be considered interim uses.
e. The property owner shall be responsible for relocating such "interim" improvements at the
time Spokane County makes roadway improvements after acquiring said future acquisition
area.
13. The shed illustrated on the preliminary short plat map that crosses the proposed property line
benween Tracts B and C shall be removed prior to the recording of the final short plat.
SPOKANE COUNTY DIVISION OF ENGINEER7NG AND ROADS
1. The conditional approval of the short plat by the County Engineer is given subject to approval of
' the road system as indicated in the Preliminary Plat of Record.

submitted to the County Engineer for acceptance prior to construction and/or the recording of the
plat. Drainage plans to be prepared under the direction of a licensed professional Civil

appresximately I2-14 feet of asphalt along the frantage of the devetQpment. The constructian of
curbing arad sidewalk is also required.
11. The proposed plat shall be impraved to the standards set forth in Spokane Gounty $oard of
Cornmissioners Resolutian No. 95-0498, as amended, whicfn esC,ablishes regulations far roacls,
approaches, drainage and fees in new cQnstruc#ion.

1. What is an Agreemenl to Pav Fees ?
Thc current "Agreement tn Pay Fees" was autharixed through Resolvtifln 1Vo. 80-3392 that ►vas
adopted hy #he 5pakane County Cammissinners an Decemher ZT, I9$0. 1'he Resolution authnrixes fhe
County Engineer to cn1leci a fee for time that is expended by 5pokane County personnel wh❑ are
charged with revietiv and inspectinn du#ies that are required to be performe[3 fox tbe applicahle
developmenfi propnsals. The fee agreemenf is based an ttae indir-iduals acfual time spent pius 10°/0.
Thesc cos4s are biiled out osn a monthly basis. Tbe amnvnt of time spen# on review of a prnject ►yill be
directly proportiuna] to the complesity ot' the gropnsal and the quali#y of the subinittals t'rom the
applicant and his agents. It is the goal af Spnkane County ta minimize as much as passible our rerie►v
and inspectivn time on a projcct If the applicant selects ageats tn represent him who arQ familiar
with the process and submiitallinspestion requirements and these requxrements are fAllo►ved, there
shouFd be a satiings in fees that are charged ta him by the iCounty.
2. When da I neerl to submit the Aareement to Pav fecs?
For ali plats and nnly those xqne ehanges that ivill reqwire a concept drainage plan, the $ee agreement
should he suhmitted with ihe prolect application as per 5pokane County Resolution No. 96-0293.
Failure to subrnit the required agaeement ivill eausc the I)ivisinn of Engineering to haE•e to issue an
immediate not9ee that the application is fechnicaifv incominlete. '1'he fee agreemeu; that is 5ubmitted
should he a properiy eYecufed originai. Fased eap"ses are nat acceptable. Unneeessary dclay to the
review process can bc avoided by submittiing the agreement with thc applecatinn. '4Vhen the
agreemeat is received, Spokauie County personnel can beoin the review nf the application mat+2ria1.
3. If I do not like fhe fee agrecment ►vhat else ean I do?
At the preseat time the fee agreerrient is the nnly mechanism fnr cost recovery that ive are authorized
to emplnv. A 9ump sum type of fee is presentlw being studicd br stafi' and is being implemented in the
revie►v of commercial buildiug permits. If tt~is method pro~~es to be more acceptable tn the County
and the puhllc, it is likeiy that an up fron# fee ►vill be ch:arged for each prnject for praject revieiv.
